Dear Mr. Usovicz:
At the request of the Town Council of the City known as the Town of Watertown, I invite you to attend a
meeting of the Town Council on November 9, 2010 at 7:15 PM to discuss the Town's ongoing concern with the
progress of removal of double poles by various companies operating in the Town. Representatives from each of
the invited companies have previously attended meetings of the Town Council while requesting pole permits
and have pledged to resolve this longstanding issue. In addition, meetings have been held with Town staff to
seek resolution of this matter. To date,the problem remains outstanding.
As you are aware, the provisions of G.L. c.164, § 34B clearly obligate any company installing new service
poles to transfer wires from the existing pole and remove that existing pole within ninety days from the date of
installation of the new pole. The obligation to ensure the transfer of wires from the existing pole to the new
pole rests with the owner of the pole.
It is clear, based upon the number of double poles found throughout the Town,that the statutory process is not
being followed in Watertown. The failure of your company and others to comply with the statutory
requirements described above is disappointing. Of greater concern is the failure of your company to honor the
commitments made when your representative appeared before the Town Council seeking approval of a permit.
The Town Council wishes for you to address those commitments and your understanding of the statutory
obligations regarding the removal of double poles.
