Koch, Mayor, presiding. Present: William F. Koch, Jr., Mayor James E. Cross, Commissioner James T. Skelly, Jr., Commissioner Lawrence E. Stahl, Commissioner Also present: William Gwynn, Town Manager Barbara Gwynn, Town Clerk James Greer, Chief of Police Absent: Alan I. Armour, Vice -Mayor Mayor Koch announced that this meeting is required under the law of the State of Florida to set the millage for the Budget for the coming year. Mr. Gwynn provided Proof of Publication as required under the law. The Mayor announced that the Town Manager has three Resolutions to present to the assembly and asked for comments from the floor. Mr. Gwynn read the Title of Town of Gulf Stream Resolution 87 -7 entitled: A RESOLUTION OF THE TOWN CONNISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, PROVIDING FOR ADOPTION OF A BUDGET FOR THE TOWN'S FISCAL YEAR COI!41ENCING OCTOBER 1, 1987, AND ENDING ON SEPT04BM 30, 1988, AND APPROPRIATING THE NET REVENUE OF THE WATER FUND TO THE GENERAL FUND FOR THE FISCAL YEAR COMMiCING OCTOBER 1, 1987, AND ENDING ON SEPTEMBER 30, 1988. On Motion duly made and seconded the Conmission approved the above Resolution. Mr. Gwynn read the Title of Town of Gulf Stream Resolution 87 -6 entitled: Town Commission Meeting on the Budget Minutes September 15, 1987 Page Two A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ESTABLISHING A 4.4363 MILL TAX LEVY AGAINST THE ASSESSED VALUATIONS OF ALL TAXABLE REAL AND PERSONAL PROPERTIES WITHIN THE CORPORATE LIMITS OF SAID TOWN OF GULF STREAM, FOR THE YEAR 1987. On Motion duly made and seconded the Commission approved the above Resolution. Mr. Gwynn read the Title of Town of Gulf Stream Resolution 87 -9 entitled: A RESOLUTION OF THE 'TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, ESTABLISHING A 1.4769 MILL VOTED DEBT SERVICE TAX LEVY AGAINST THE ASSESSED VALUATIONS OF ALL TAXABLE REAL AND PERSONAL PROPERTIES WITHIN THE CORPORATE LIMITS OF SAID TOWN OF GULF STREAM, FOR THE YEAR 1987. On Motion duly made and seconded the Commission approve the above Resolution. The Mayor stated that the staff of the Town of Gulf Stream has proposed a Budget and the Town Commission has adopted said Budget which meets the rollback and is, to the best of the Mayor's knowledge, the only govermental taxing agency that has reduced the millage. It is less this year than the previous year despite a raise in costs. There being no further business the meeting was adjourned at 5:10 p.m. on Motion duly made and seconded. Natapow Town Attorney On Motion duly made and seconded the Minutes of the August 14, 1987 meeting were approved. 3. Financial Report Mr. Gwynn reported that funds are sufficient to carry the Town through the middle of December, that no problems are expected and that for the eleven months of the fiscal year revenues exceeded expenditures. It is expected there will again be a $30,000 carryover to the new budget. On Motion duly made and seconded the ConTnission accepted the Financial Report. Police Report: - Gate House, Place Au Soleil (a) Chief Greer reported on his department's activities during the past month, noting two burglaries in the area. Discussion was held on shift coverage. (b) Appearing for Place Au Soleil, Mr. Dittman presented a number of signed petitions to the Commission. Said petitions were in response to a letter sent to the residents of Place Au Soleil setting forth the facts on the proposed Gate House. Mr. Dittman estimated that 98 or 99 per cent of the residents who were in PiacefAu= 5oleil during the week signed the petition but it was acknowledged that many residents were away. on request, Mr. Dittman read the letter aloud. Mr. Randolph pointed out that the Place Au Soleil Hone Owner's Association will be fully responsible for the construction of the proposed Gate House as well as all liability and responsibility included therein and thereafter and for the maintenance of said Gate House in a non - negligent manner. After further discussion the Commission approved a Motion duly made and seconded for the construction of said Gate House subject to approval by the Planning & Zoning Board of the Tbwn of Gulf Stream and subject also to the understanding that the Gate House will not be manned by the Police Department of the Town of Gulf Stream. 5. Planning & Zoning Board Report i, Variance request by Mr. and Mrs. Charles Carden, Lot 23, 805 Canary Walk, Place Au Soleil, to construct a single family resident. On Motu duly made and seconded the Commission approved all three variance requests. 2. Variance request by Mr. and Mrs. Natapow, lot. 1, Pope Sub - division, to construct a single family residence. Discussion ensued on the paving of a public road by the homeowner to match the driveway. Mr. Randolph said the Town would have to have an Agreement with the homeowner that, if a problem arose in the paving, it would be the responsibility of the homeowner. On Motion duly made and seconded the Commission accepted the reccmTendation of the Planning and Zoning Board with the proviso that the owner maintain the cul -de -sac which is made up of the same material as the driveway. Mr. Nichols, appearing for Mr. and Mrs. Natapow, presented drawings of the proposed landcape plan. Said plans are incomplete and moist come before the Planning & Zoning Board on October 7, 1987 and the Town Commission on October 9, 1987. 3. Request by Mr. and Mrs. Donald Keddy to remodel and add a new kitchen at 2943 Polo Drive, Gulf Stream Properties. on Notion duly made and seconded this request was approved by the Comission. Request by Mr. and Mrs. Corbett, 920 Emerald Row, Lot 55, Place Au Soleil, to add a portico to existing residence. On Motion duly made and seconded this request was granted by the Ccmmmission. 5. Request by Mr. and Mrs. Ralph C. Leslie, 531 Palm Way, to construct a dock. On Motion duly made and seconded this request was granted by the Co=ssion. 6. Request by the Gulf Stream Bath and Tennis Club to construct a spectator's cove at the tennis courts. Mr. Spton appearing for the Bath and Tennis Club described the construction as a "shelter" or an "alcove ". On Motion duly made and seconded this request was granted by the Commission. 6. Ordinance 87 -5 Regarding the Protection of Sea Turtles Mr. Randolph explained that the Town requires a Ordinance on Sea Turtles in order not to be a part of the Palm Beach County Sea Turtle Ordinance. Ordinance 87 -5 provides that, whenever possible, street lighting be directed away from the ocean as well as other protections for encouraging the propagation of sea turtles. A suggestion was made that a copy of this Ordinance be sent to owners of ocean-front properties. Mr. Randolph gave the first reading of the Title of Ordinance 87 -5 of the Town of Gulf Stream as follows: AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PLAM BEACH COUNTY, FLORIDA, PROVIDING FOR RESTRICTIONS RELATING TO THE PROTECTION OF "SEA TURTLES "; PROVIDING FOR ENFORCEMENT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. 7. Update to Comprehensive Plan - Town Planner Terry A. Clark AICP Mayor Koch introduced Mr. Clark, Director of Planning, Resource Engineering and Planning, Inc. noting the need to up -date the Town of Gulf Stream Comprehensive Plan. Florida Law, as amended in 1986, requires specific information to be included in said Plan which will be filed with the State for review, at the end of this month. Final submission of the Town Plan will be toward the end of 1989. Mr. Clark distributed an outline of the projected plan. Further information will be forthcoming. Mayor Koch called the Commissioner's attention to references in the data supplied,to the Marina Cay proposal and the developer of same and to the de- annexing of certain properties and land use proposal. The Mayor emphasized the objection of the Town of Gulf Stream to these proposals and the need for effective preventive action. The Mayor, Mr. and Mrs. Gwynn and Mr. Clark will attend a meeting of the Town Commission Meeting September 11, 1987 Minutes Page Four 7. Update to Comprehensive Plan (continued) Treasure Coast Regional Planning Council on Friday, September 18, 1987 in Stuart. Mr. Clark will change the Master Plan to reflect the actual facilities available in the Town of Gulf Stream. Said changes will be available for the Treasure Coast meeting. The Town Attorney was directed by the Commission to write today to the City of Delray Beach and to the Treasure Coast Regional Planning Council stating its objections to the Seacrest Commercial Properties, Ltd. - Marina Cay use of the F.I.N.D. land area. Copies of said letter will be available at the September 18, 1987 meeting for distribution to the members of the Council. 8. Inter -Local Agreement for Fire - Fighting Services Mr. Gwynn spoke on the renewal of this contract noting it has been extended from three to five years. in other respects the Agreement remains the same. Transfer of Funds Mr. Gwynn spoke on the need to transfer $36,150 from the Dredging Fund to the General Fund and also to authorize the closing of the Construction Fund to the General Fund of what is approximately $4000. on Notion duly made and seconded the Commission approved said transfers. 11. Request for an alternate to attend the League of Municipalities meetings. Commissioner Skelly accepted said attendance. 12. Financial Report On Motion duly made and seconded the Commission accepted the Financial Report for August 1987. 4. Police Report - Gate House, Place Au Soleil (a) Chief Greer reported on his deaprtment's activities during the past month, noting two burglaries in the area. Discussion was held on shift coverage. (b) Appearing for Place Au Soleil, Mr. Dittman presented a number of signed petitions to the Commission. Said petitions were in response to a letter sent to the residents of Place Au Soleil setting forth the facts on the proposed Gate House. Mr. Dittman estimated that 98 or 99 per cent of the residents who were in residence during that period signed the petition but Town Commission Meeting September 11, 1987 Minutes Page Two 4. Police Report (continued) it was acknowledged that many residents were away at the time. on request, Mr. Dittman read the letter aloud. Mr. Randolph pointed out that the Place Au Soleil Home owner's Association will be fully responsible for the construction of the proposed Gate House as well as for all liability and responsibility included therein and thereafter and for the maintenance of said Gate House in a non - negligent manner. After further discussion the Commission approved a Motion duly made and seconded for the construction of said Gate House subject to the understanding that the Gate House will not be manned by the Police Department of the Town of Gulf Stream. 5. Planning & Zoning Board Report 1. Variance request by Mr. and Mrs. Charles Carden, Lot 23, 805 Canary Walk, Place Au Soleil, to construct a single family residence. On Motion duly made and seconded the Commission approved all three variance requests. 2. Variance request by Mr. and Mrs. R. Natapow, Lot 1, Pope sub - division, to construct a single family residence. Discussion ensued on the paving of a public road by the homeowner (to match the driveway). Mr. Randolph said the Town would have to have an Agreement with the homeowner that, if a problem arose in the paving it would have to be the responsibility of the homeowner. On Motion duly made and seconded the Commission accepted the recommendation of the Planning & Zoning Board with the proviso that the owner maintain the cul -de -sac which is made of the same material as the driveway. Mr. Nichols, appearing for Mr. and Mrs. Natapow, presented drawings of the proposed landscape plan. Said plans are incomplete and must come before the Planning & Zoning Board on October 7, 1987 and the Town Commission on October 9,19E 3. Town of Gulf Stream Ordinance U7 5 Regarding tivr• Protection of-,Sea Turtles Mr. Randolph explained that the Town requires a Sea Turtle Ordinance in order not to be a part of the Palm Beach County Sea Turtle Ordinance. Ordinance 87 -5 provides that, whenever possible, street lighting be directed away from the ocean as well as for other protections encouraging the propagation of sea turtles. A suggestion was made that a copy of this Ordinance be sent to owners of ocean -front properties. Mr. Randolph gave the first reading of the title of Ordinance 87 -5 of the Town of Gulf Stream as follows: AN ORDINANCE OF THE TOM CO`AILSSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, PROVIDING FOR RESTRICTIONS RELATING TO THE PROTECTION OF "SEA TURTLES"; PROVIDING FOR ENFORCEMENT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. 7. Update to Comprehensive Plan - Town Planner Terry A. Clark AICP Mayor Koch introduced Mr. Clark, Director of Planning, Resource Engineering and Planning, Inc., noting the need to up -date the Town of Gulf Stream Comprehensive Plan. Florida Law, as amended in 1986, requires specific information to be included in said Plan which will be filed with the State for review at the end of this month. Final submission of the Town Plan will be toward the end of 1989. Mr. Clark distributed an outline of the projected plan. Further information will be forthcoming. Mayor Koch called the Conrdssicner's attention to references in the data supplied, to the Marina Cay proposal and to the developer of same as well as to the de- annexing of certain properties and the land use proposal. The Mayor emphasized the objection of the Town of Gulf Stream to these proposals and the need for effective preventive action. Mayor Koch, Mr. and Mrs. Gwynn and Mr. Clark will attend a meeting of the Treasure Coast Regional Planning Council on Friday, September 18, 1987 in Stuart. Mr. Clark will change the Master Plan to reflect the actual facilities available in the Town of Gulf Stream. Said changes will be available for the Treasure Coast meeting. The Town Attorney was directed by the Commission to write today to the City of Delray Beach and to the Treasure Coast Regional Planning Council stating the Town of Gulf Stream objections to the Seacrest Commercial Properties, Ltd. - Marina Cay use of the F.I.N.D. land area. Copies of said letter will be available at the September 18, 1987 meeting for distribution to the members of the Council. 8. Inter -Local Agreement for Fire - Fighting Services Mr. Gwynn spoke on the renewal of this contract noting it has been extended from three to five years. In other respects the Agreement remains the same. The Town Attorney will confer with the Town of Ocean Ridge on Paragraph No.9 of the Agreement (Indemnification by the Town of Gulf Stream). 9. BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA that: (1) The BUDGET for the Town of Gulf Stream,for the Fiscal Year commencing October 1, 1987, and ending on September 30, 1988, a detailed copy which is attached hereto and reflects, in part, total estimated General Fund and Water Fund expenses for said Fiscal Year in the amount of $935,249 and $199,800 respectively, be hereby approved and adopted, disbursements for which to be made only under the categories of anticipated expenses in the identified classification of expenditures as set forth in said Budget and for no other purpose than those for which they are appropriated unless so authorized by Act of the Commission of the Town of Gulf Stream.
