William F. Koch, Jr., Mayor. 1. Roll Call Present: William F. Koch, Jr. Mayor Alan I. Armour Vice -Mayor James E. Cross Commissioner James T. Skelly, Jr. Commissioner Lawrence E. Gwynn Town Manager Barbara Gwynn Town Clerk James Greer Chief of Police William Mayer Chairman, Planning & Zoning Board Richard Brandt Code Enforcement Officer Robert Dittman, Esq. Place Au Soleil Home Owners Assoc. 2. Minutes The Minutes of the November 13, 1987 meeting were approved on motion duly made and seconded with an addition to item 9, first paragraph, as follows ... sum of $6995.00 ... "monies received were in settlement of the County Road and Bridge Fund Rebate to Municipalities ". Also on the Minutes of November 13, 1987, item 6, the F.I.N.D. Agreement; Mr. Randolph spoke with the F.I.N.D, attorney about the Town's concerns. Mr. Randolph does not anticipate any problem and believes F.I.N.D. will go along with the Town's request. He expects an Agreement will be ready for signature before the next Town Commission meeting. On Motion duly made and seconded the Commission agreed to accept the Lease Agreement 3. Financial Report On Motion duly made and seconded the Commission approved Mr. Gwynn's report. Town Commission Meeting December 11, 1987 Minutes Page Two 4. Audit Report Mr. Gwynn introduced Ernst and Whinny Auditors Paul Brenner and his associate. Mr. Brenner gave the Audit Report for 1987 noting the State of Florida now requires two additional reports. Mr. Brenner stated that the Town's system of internal control is working well and that he had only one, and minor, recommendation i.e. the sequence of occupational Licensing. Mayor Koch spoke to this matter explaining the background of the sequence of Permits problem and noted that it has been corrected. The Auditor answered questions put to him by the Cocmissioners. Mayor Koch expressed the Conmissions thanks to Mr. Gwynn for the good job he has done through the year. on Motion duly made and seconded the Conraission accepted the Audit Report. Mr. Gwynn read aloud his letter of rebuttal to the Auditor General of the State of Florida in which he explained the steps taken to correct the sequence of occupational Licensing. This letter is required under the law. 5. Police Report Chief Greer reported on his department's activities during the previous month noting receipt of a letter from Mr. Henn, owner of the Delray Drive-,In. Said letter advised the Town of Gulf Stream Police would no longer be permitted on the property of the Drive -In. Chief Greer gave this letter to the Town Attorney. Mayor Koch noted that the police have other means of access to the area in question. Conmi.ssioner Cross spoke on a possible change of weapons for the Police Department. Discussion ensued on weapon types and costs. Chief Greer will report to the Commission with exact figures in January. Mayor Koch reminded Chief Greer of the officers responsibility to wear flak jackets. Inquiry from the audience into the incidence of crime in nearby cocmunities was responed to by Chief Greer who stated that the situation is volatile but that they are aware of the problem and "have a handle on it ". Comaissioner Cross spoke to the subject and general discussion ensued with audience participation. 6. Ccnudssion Co[ments Mr. Dittman spoke on the status of the Gate House noting they are in a fund- raising situation and are also receiving bids. It is expected building will start within a few months. Cmmissioner Armour spoke on the Delray Beach Chamber of Conmsce efforts to bring together all parties interested in improving the appearance of northern Federal Highway and noting that the City of Delray Beach has received over Three Million Dollars to irnprove its approaches. Commission Comments (continued) attended by governmental representatives, citizen groups and area residents and covered the Flea Market, the parking situation, water supply and improvements to the median strip. Groups have been formed to unify efforts to clean up the area and their representatives will report to the County Commission. Mr. Dittman spoke on the difficulty of enforcing governmental Codes due to the multiplicity of jurisdictions and he questioned whether there is real motivation on the part of the County to clean up the area. However, there is real support from the City of Delray Beach, the merchants and area residents but it will be a tough battle. Mr. Dittman also spoke on the Seacrest Property Group and its intent to use F.I.N.D. property. Mr. Randolph spoke on a Seacrest Property letter to Place Au Soleil Home Owners Association noting obscure offers to the residents. Mayor Koch said the whole area would be affected by the Seacrest Property proposals. Commissioner Armour said the Town has to adopt a policy that it is all for cleaning up the area of Federal Highway but that we go on record, if we have not already done so, that we are for a low- density in that area. Mayor Koch noted that the Town of Gulf Stream would have input into any change of zoning, etc. in the discussed area but noted that there is a possibility the Legislature might allow the sale of F.I.N.D. property. Swapping of property is also a possibility. Mr. Dittman said we must keep our ear to the ground in order not to lose control of the area under discussion. In response to a request to sell water to Tradewinds Estates the Mayor said our present contract precludes this practice. However, a new procedure is possible. Mayor Koch thanked the Civic Association for the reception and Art Show recently presented. Mr. Randolph spoke on the Volvo agency lease stating no further action is required. Discussion ensued on previously taken action by the Commission. On motion duly made and seconded the Commission voted to accept the lease with Volvo as advised by the Town Attorney. Discussion ensued on frequently rented residences in the Town of Gulf Stream. Mr. Randolph reported an existing Ordinance sufficiently covers this area. .Mrs. Gwynn will supply copies of this Ordinance for the Commission. Mr.Mayer said he was offered a position on the Board of the Bath and Tennis Club and he inquired as to the effect on his Chairmanship of Planning & Zoning. Mayor Koch assured Mr. A9 yer there would be no problem.
