GWYNN APRIL 8, 1988 Assistant Town Manager Town Clark BARBARA GWYNN Chief of Police JAMES GREER The meeting was called to order at 9:00 a.m. by the Hon. William F., Koch, Jr., Mayor. 1. Roll Call Present: William F. Koch, Jr., Mayor James T. Skelly, Jr. Commissioner Absent: Alan I. Armour Vice -Mayor Lawrence E. Stahl Commissioner James E. Cross Commissioner Mayor Koch announced that no quorum was present and therefore no meeting could be held and no official action could be taken. However. Mayor Koch stated that reports could be given and the Engineering Report would be heard. The Mayor said a special meeting would be set up to hear the items that must be voted on. Financial Report The Town Manager, Mr. Gwynn, gave his report for March 1988 on receipts and disbursements noting the State allocation of funds for the second phase of the State Comprehensive Plan and the Florida Revenue Sharing program disbursements. Police Report Ghief Greer reported the department's activities during the previous month noting water usage violations and burglaries in the comamuzity. Chief Greer spoke in detail on the modus operandi of the persons cornmilding these crimes . and of the efforts of the police to capture them. Mayor Koch urged all residents to keep their hones locked and to.call the Police if they see anything suspicious. Mayor Koch announced that Mr. Butkus would give his report, the Commissioners would ask their questions and then those present would make their comments and /or questions. Town Commission Meeting April 8, 1988 Minutes Page Zwo Mr. Butkus opened his remarks by stating he had recently completed the septic tank survey for the Tbwn of Gulf Stream in answer to some misgivings that an unhealthy condition existed in certain areas in reference to septic tank systems,such as seepage and foul smelling water. Mr. Butkus explained the procedure by which he randomly surveyed 60 properties throughout the Town of Gulf Stream first by questionnaire and finally by personal inspection of responding residents properties. Noting the evidence of system malfunctioning as spongy drainfields and seepage, Mr. Butkas said he found no evidence of that but did not rule out entirely that there might well be such malfunctioning. Citing the hares built in the 1940's and 50's and the concurrent small drainfields than by today's standards, Mr. Butkus noted that many residents had overcome this problem by erecting special areas on their property to enlarge the drainfield capacity and noting the special care some residents must give for septic tank maintenance. Mr. Butkus addressed the solutions and costs of collection systems, special taxing districts, pump stations and the available alternatives. In conclusion Mr. Butkus stated that there did not appear to be a health hazard in the community in reference to the septic systems; that residents outside the target area do not appear to be in favor of any change. Residents within the target area do seen to be in favor of an alternate solution. Mr. Butkus then answered questions from the assembly on costs, assessments, property values, tax districts and Tvan Ordinance procedures. Mayor Koch spoke on providing the target area with a summary of the Butkus report and establishing future action on the response of residents of said target area. 7. F.I.N.D. Report Mayor Koch reported on the results of a meeting held in Ft. Lauderdale recently at which F.I.N.D was requested to trade the F.I.N.D. property for property in the north of Florida. Emphasizing the determination of the group requesting the property trade, Mayor Koch reported that F.I.N.D has given the Town of Gulf Stream one year to design and cane back to them with a proposal to turn the F.I.N.D. area into a public park. Noting that state funds might be available but that the Town must have access to the area. The Mayor stated that a Committee should be appointed to work on this proposed park and he asked Messrs. Dixson, Dittman and Lynch to serve on it noting that it would have to get to work immediately and to report to the Commission monthly. Town C omnission Meeting April 8, 1988 Minutes Page Three Cannission Comments Traffic conditions in the area of north Federal Highway were discussed. Mr. Dittman said an effort is being made to organize various groups to clean up said area. Some sixteen organizations have thus far joined the effort. Effort is also being made to have the County enforce the law in that area. Mr. Dittman suggest the Town of Gulf Stream write to Mr. Henderson of the Department of Transportation citing the potentially dangerous traffic situation existing on the Highway. He also suggested the Town write a strongly worded letter to Sheriff Wille describing the situation and requesting the assistance of two patrolmen on weekends to keep traffic moving. Letters to the City of Delray Beach and to the County CcnTission citing doctor and ambulance tie -up in heavy weekend traffic caused by the Swap Shop should also be sent urging emergency measures be taken in this public safety situation. A copy of the Town of Gulf Stream Resolution pertaining to this problem should be enclosed with these letters. Mr. Mayer suggested the Sheriff's office be called each time there is a problem and request help. This goes on the record. Mayor Koch requested Mr. Butkus to summarize his report and Mrs. Gwynn will work up a one -page account of the summary. Mayor Koch adjourned the hearing at 10:07 a.m. (�o- O ) W Y � -. Butkus Mayor Vice -Mayor Commissioner Commissioner Commissioner Town Manager Town Clerk Chairman, Planning & Zoning Board Vice-Chairman, Planning & Zoning I Town Attorney Consulting Engineer Mayor Koch announced this meeting as a continuation of the prior Regular Meeting of April 8, 1988 at which a quorum was not present. Recognizing that most of those present were interested in the Sewer Project, Mayor Koch announced that it would be first on the agenda and then he introduced Mr. Butkus, the Consulting Engineer of the Sewer Project. Speaking of the forty properties in the target area, Mr. Butkus noted that the recommendation of the septic tank survey and of the instant report is that a sewage collection system should be constructed. Approximate cost for each property for the system would be $201 monthly for a ten -year payback and $252 monthly for a seven - year payback. Discussion ensued on financing and the extent of community participation. Noting that a mailing had gone only to the target area properties, Mayor Koch ordered the mailing of a questionnaire which included information of probablE costs be sent Town -wide. Also, that a telephone call be made to non - responding residents in the target area. The Civic Association may be consulted on the mailing. Tabulation will be made upon receipt of all information and a special meeting will be called. Mr. Randolph outlined the steps necessary to inaugurate a sewer project for the Town. Everyone having been heard, discussion on the sewer project ended at 9:40 a.m. Site Plan Review and Variance Request Owner: Mr. Robert Place, Lot 40 2564 Ave. Au Soleil. Mr. Mayer reported the circumstances of the Planning & Zoning Board approval of this request. On Motion duly made and seconded the Commission approved a variance request. Site Plan Review and Variance Request Owner: Mr. William O'Hey, 2525 No. Ocean Boulevard. Mr. Mayer described the area and the particular property noting this request is limited to the building of a garage. On Motion duly made and seconded the Commission approved the requested variance. Site Plan Review Mr. Tan Walsh. That part of the No. 100' of the So. 668' of Gov. Lt. I, Sec. 10, Township 46, S. Range 43 E. of Ocean Blvd. Request to construct a single family. residence. Noting the proposed wall would be reduced from 6' to 4' in height and all other requirements being met, the Commission approved the recommendation of the Planning & Zoning Board on Motion duly made and seconded. Plan Review Dr. and Mrs. Allen Jared. lot 62, Place Au Soleil. Request to construct a single family residence. After confering with Mr. Mayer the Coudssion approved this request on Motion duly made and seconded. Site Plan Review Owner: Mr. Sam Hubbard, 3425 Polo Drive, Lot 6, Block 1, Plat #1, Polo Fields. Request to add a bedroom to an existing residence. All Town Code requirements having been not the Commission approved this request, subject to approval by the County Health Department on the relocation of the septic tank,on Motion duly made and seconded. Mayor Koch stated for the record that he was abstaining from discussion and voting in this matter, in accordance with the laws of Florida, Statute 112.3143, pertaining to conflict of interest, and would submit Form 8B to be filed with the Minutes. Mr. Gwynn read the Title of Resolution No. 88 -3 as follows: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, PROVIDING FOR THE DECLARATION OF A "WATER EMERGENCY ',',PROVIDING RESTRICTIONS ON THE USE OF WATER BY TOWN RESIDENTS; PROVIDING A PENALTY; PROVIDING AN EFFECTIVE DATE. Touri Commission Meeting April 18, 1988 Minutes Page Three After discussion of this subject the Commission decided to strike all of Section Three and to amend Section Two (b) to read "and /or landscaping ". The Commission moved to pass this Resolution with the changes as noted above. Commissioner Armour addressed the assembly on the recent and sudden death of Thomas Brandt noting Mr. Brandt's contributions to the community. All present bowed their heads in silent tribute to Mr. Brandt. The Town will write to Mr. Brandt's family citing his achievements on the Planning & Zoning Board. WHEREAS, Chapter 10, Article II of the Town Code of Ordinances sets forth provisions for the restrictions on the use of water during "Water Emergencies;" and WHEREAS, The Town of Gulf Stream receives its water supply from the City of Delray Beach; and WHEREAS, the City of Delray Beach has notified the Town that the water supply has been severely limited due to industrial pollution, making it necessary to close down four of Delray's most productive wells; and WHEREAS, the above - referenced condition qualifies as an emergency situation as set forth in Section 10 -16 of Chapter 10, Article II of the Town Code of Ordinances; and WHEREAS, it is necessary to impose certain restrictions on the use of water; now therefore BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1: The Town Commission hereby ratifies the declaration of an emergency situation, pursuant to the terms of Chapter 10, Article II, of the Town Code of Ordinances. Section 2: The Town Commission hereby imposes the following conditions on the use of water by residents of the Town of Gulf Stream: A. Residents may water lawns only twice a week, said watering to occur on the same days as their scheduled garbage pickup. (Place au Soleil -- Monday and Thursday) (East of the Intracoastal Waterway - Tuesday and Saturday) B. There shall be no watering of lawns and or /iaadscaping between 7 a.m, and 6 p.m. on any day. C. Washing of automobiles, trucks, trailers, campers, boats, or any other type of mobile equipment is hereby prohibited. page 1 - 5/13/88 Section 3: All of the penalties applicable pursuant to Chapter 10, Article II of the Town Code of Ordinances are applicable in the event of violation of the restrictions set forth in this Resolution. Section 4: This Resolution is effective immediately and shall be effective until declared removed by the Town Clerk of the Town of Gulf Stream. 18 PASSED AND ADOPTED in a regular adjourned session this day of April 1988. Watering of lawns is banned between 7 a.m. and 6 p.m. every day. Restriction includes all private wells. 3. Washing of cars and other mobile equipment is prohibited. 4. Outside aesthetic uses of water such as cleaning sidewalks, driveways, walkways and awnings is prohibited, as is draining existing pools for the purpose of repairs which necessitate refilling. Pressure cleaning of structures and roofs is also prohibited. Salt water boaters are restricted to flushing their engines and equipment to 5 minutes per outing. This existing indebtedness is being paid off with property taxes at the rate of 1.5 mills over fifteen years, the cost of $4,400,000 bond issue to be paid off over fifteen years would cost the taxpayers an additional 3.5 mills per year, individual homeowners cost of connecting up are not now available. The Town Commission cannot incur the indebtedness for a Town —Wide Sewer System without the approval of the registered voters of the Town.
