Article 9 of the May 13, 1988 Minutes was changed to read "light bulb" instead
of "light "; with the addition of the word "bulb" the Minutes were approved on
motion duly made and seconded.
3. Financial Report
Mr. Gwynn reported on transfer of funds, debt retirement and comparison of
revenues (budgeted and actual, as right on target) and money market funds.
On motion duly made and seconded the Commission approved the Financial report.
In order to begin the Budget process the date of July 18, 1988 was set down
for a workshop meeting at 4:30 p.m.

4. Police Report
Chief Greer reported on the department's activities during the month
of May. Mr. Cullen asked to speak on a Police Department matter but
that he would wait until "Public Camments ". Mayor Koch agreed.
5. Planning and Zoning Board Report
a. Final Site Plan Review. Mr. and Mrs. Pulte. 3111 Oleander Way, Repl.
of Gulf Stream Properties #2 N. 50' of Lot 44, S. 33' of Lot 48 and
Lot 47. Request to build a single - family residence.
On motion duly made and seconded the Commission accepted the recommendation
of the Planning and Zoning Board to approve this request.
b. Addition Plans and Site Plan Review. Mr. and Mrs. Warner Jones, 555
Pelican Lane.
On motion duly made and seconded the Commission accepted the recommendation
of the Planning and Zoning Board to approve this request.
c. Site Plan Review for Swimming Pool. Mr. and Mrs. Rocco Auri, Lot 32
Place Au Soleil.
On Motion duly made and seconded the Commission accepted the recommendation
of the Planning and Zoning Board to approve this request.
d. Report on Charlton Boat Hoist, etc.
After presentation by attorneys for Messrs. Sheehan and Charlton,
discussion of the history of the area, examination of maps and surveys,
a review of the background of this action and direction by the Town
Attorney, the Camdssion, on motion duly made and seconded, unanimously
voted to enforce the Town of Gulf Stream Codes and ordered removal of
the noted boat hoist. Also on motion duly made and seconded the Commission
unanimously voted to have the Town Manager send a written Notice to
Mr. Charlton that the Town Commission has ordered the hoist to be removed
within thirty (30) days.
Discussion ensued on non -compliance of the above. Mayor Koch noted that
the Town has the power to enforce its ordinances.
6. Ms. L. Kim Jones, Department of Natural Resources
Ms. Jones spoke on Federal, State and Local efforts to protect
threatened species, especially Loggerhead Turtles, and the efforts to
protect them. A Turtle Walk is offered to the residents of the Town of
Gulf Stream on June 29, 1988 at 9 p.m., said walk to be on the beach of
the Calf Stream Golf Club. Mayor Koch noted that the Club is private
property but that the Town would ask the Club if they would permit the
walk and parking at the Club. Ms. Jones noted that a Federal authority
would accompany the walk. The rain date for the walk is July 6th.

7. Delinquent water bills for the following residents: Mr. and Mrs. Fritz
Woellner $634.14; Mr. William Sirak $438.32; B. Urda $519.84 and Martin
O'Boyle $307.32.
Noting that the Town has a covering Ordinance, Mayor Koch stated that
the usual and normal procedures should be followed.
8. Report on F.I.N.D. - Public Park
Mr. Dixson said he was speaking for the Chairman of the Park Committee
and that the Committee is pursuing all alternatives and opportunities.
Commissioner Armour spoke on a possible authoritative zoological survey
presentation by the Town to F.I.N.D.
Mayor Koch spoke to the establishment of this Camii.ttee as a Regular
Committee of the Town of Gulf Stream. Meetings must be advertised and
disclosures must be filed in compliance with State Law, meetings must be
held in accordance with the Sunshine Law. A meeting of this Committee
will be held on June 22, 1988.
Mr. Armour made a motion that the Mayor appoint a Committee as an advisory
arm of the Town Commission to investigate the uses of the F.IN.D. area
south of Place Au Soleil. On motion duly made and seconded this motion
was approved by the Commission.
9. Mark Cullen, attorney for Officer Paul Peterson, spoke to the Commission
on possible liability of the Town in the Peterson matter. Mr. Cullen read
a letter received by Officer Peterson and commented on the letter and a
job action taken by the Police Department. Mr. Cullen asked that the Town
Commission make inquiry into the natter.
Mayor Koch said the matter will be referred to the Town Attorney.
10. Mr. Gwynn has received a request for the Annual Audit by Ernst and Whinny
on September 30, 1988. On motion duly made and seconded the Cam-dssicn
accepted this request.
There being no further business the meeting was adjourned at 10:15 a.m.

RE: Report of F.I.N.D. Park Committee
Gentlemen:
The Advisory Committee met on June 1, 1988, following a meeting
of the Town Planning Board.
We had not received on that date a copy of the Memorandum that
the Commission directed the Town Attorney to prepare relative to
scenarios under which the F.I.N.D. property might be de- annexed
and the advisability of the Town's acquiring vacant Lot 43 (in
Place au Soleil) , or other property outside the Town contiguous
to the F.I.N.D. property in order to defend against de- annexation.
Accordingly, the Committee has deferred making a formal
recommendation as to whether the Town should acquire such
contiguous property pending receipt of Mr. Randolph's memorandum,
although our preliminary assessment is that such action would be
in the best interest of the Town.
Mrs. Gwynn reported that the local Audobon Society Chapter had
made a preliminary investigation of the F.I.N.D. property and,
they having found many species of native flora and fauna present
on the property, opined in writing that it would be in the best
interests of the Town to keep the property in its natural state.
Mrs. Gwynn having also reported that the newly created County
Department of Environmental Resources had shown an interest in
aiding any effort of the Town to keep the F.I.N.D. in its natural
state, we requested her to attempt to arrange for an officer of
that Department, as well as the President of the Local
Audobon Society, the Executive Director of F.I.N.D. and (if
possible) a representative from the Florida Department of Natural
Resources to meet with the Committee at our next scheduled
meeting on June 22 at 10:00 a.m., for the purpose of getting any
necessary assistance and support required to cut through "red
tape" and get the Florida Department of Natural Resources to
perform an environmental study of the property at the earliest

date and for the purpose of obtaining allies to convince the
F.I.N.D. Commissioners not to reject outright any proposal from
the Town to acquire the property for "simply" a wildlife refuge.
The need for allies would seem to be important in that the
feeling of the F.I.N.D. Commissioners, as expressed to Mayor
Koch, Mr. and Mrs. Gwynn and the undersigned (at the meeting we
attended in April) , was that they would want to see a plan for
more than just a wildlife sanctuary (i.e. they desired that the
land be made accessible to the public). In view of anticipated
and presently received objections from residents to a full scale
park, if not to any "park" at all, the Town's only possible
alternative to the ultimate development of the property may well
be limited to its first choice, a wildlife sanctuary. In the
context of Florida's ever changing political climate, including a
rumored possibility of the F.I.N.D. merging with the Department
of Natural Resources, it may be entirely possible for the Town,
with the help of the Audobon Society, and the County and State
Environmental Resource Department, to change the F.I.N.D.
Commissioner's thinking on the public value of a wildlife
sanctuary. Accordingly, we're moving ahead.
We also hope to establish liaison and a good working relationship
with the new Executive Director of F.I.N.D., hopefully,

and /or County to do an environmental study of the property and
support the Town's "first choice" plan, it would probably be in
the Town's best interest to go back to the F.IN.D. at an early
date with a request for their consideration or reconsideration of
the idea of a wildlife sanctuary. Their direction, together with
Mr. Randolph's Memorandum, would then provide sufficient
informaton to allow for a public hearing to be held for the
purpose of formally advising Town residents of the options then
known available and their feelings on them.

This letter is to confirm the nature and extend of our services to the
Town of Gulf Stream, Florida.
We will examine the general purpose financial statements of the Town of
Gulf Stream, Florida, for the fiscal year ending September 30, 1988, in
connection with the expression of our opinion on the fairness with which
the statements present financial position and results of operations in
conformity with generally accepted accounting principles consistently
applied. Our examination will be made in accordance with generally
accepted auditing standards and will include such tests of the accounting
records and such other auditing procedures as we consider necessary in the
circumstances.
We do not contemplate a detailed examination of all transactions or expect
that we will necessarily discover fraud, should any exist. We will, how-
ever, inform you of any findings that appear unusual or abnormal.
Our fee for the aforementioned services will be based on our normal hourly
rates and will be billed monthly as the work progresses. We estimate the
total charges will not exceed the amounts for various funds as outlined
in the following schedule:

In addition to the previously mentioned audited financial statements, we
will perform an examination of the City's compliance with the laws and
regulations contained in the Florida Statutes and the City Code of Ordi-

specifying the areas of noncompliance for the year ending September 30,
1988, or if no areas of noncompliance are noted, we will so state in our
report. We will also prepare a report on our study and evaluation of the
City's system of internal control. Our examination will include the study
and evaluation of internal accounting controls and administrative controls
as required by the Rules of the Auditor General. We estimate that our
fees for the procedures required by the Auditor General will not exceed
$1,000. If you have any questions concerning the Rules of the Auditor
General or our procedures to meet these requirements, please call us.
Any other accounting and consulting services as may be requested from time
to time will be provided at our normal hourly rates. We will provide you
with an estimate of our fees for a particular service at the time it is
requested.

Building department had a meeting with Mr. Saberson to discuss
Mr. Sheehans problem with Mr. Charlton.
April 13, 1988
Building department has a meeting with Mr. Randolph ( town
attorney) to discuss the problem between Mr. Charlton and
Mr. Sheehan.
April 25, 1988
Had a meeting with Mr. Charlton - Explained he needed at least
15 foot from Mr. Sheehans lot line to build the boat dock and
hoist that he had submitted plans to build.
Gave Mr. Charlton variance forms and plan review forms.
Informed Mr. Charlton about the encroachments on Mr. Sheehan's
property and that it was a violation of town codes and ordinances.
His response was that the town could take whatever action it
wanted to, 'and that the water and electric lines were there
before the boat hoist was installed.
Mr. Charlton could not attend the May 4, Planning and Zoning Board
meeting.

Dear Ms. Gwynn:
I represent Mr. and Mrs. Sherwood H. Sheehan, Jr. and it appears
that there is a dispute between Mr. and Mrs. Sheehan and their neigh-
bor Mr. Charlton about, among other things, the construction of a
boatlift encroaching upon Mr. and Mrs. Sheehan's property. In addi-
tion it appears that certain utility connections have been made
across the Sheehans' property to the boatlift. I realize that some
of the matters that may be involved in this dispute will not be
within the jurisdiction of the town. However, I would like to know
for certain whether applications were made for construction of the
boatlift and the utility connections required and if so were permits
issued for the construction. If you have applications and permits,
singular or plural, I would be grateful if you would furnish me
copies at my expense to determine whether the as built facilities
conform to the application. If there were no such applications
or permits I would like for you to state that affirmatively.
I would also like to know whether there have been applications
and permits issued for docks and a lift on the seawall on the west
boundary of Lot 1 of McLouth Subdivision. If so may I please have
copies of those applications and permits, if any.

Dear Mrs. Gwynn,
Please be advised that this letter will confirm my intentions to formally
register a complaint with the town of Gulf Stream, regarding the following
matters, which I have outlined.
1) A boatlift recently constructed on the seawall to the south of my
property contrary to deed restriction, which prohibit construction
on the said seawall. The boatlift is built on the seawall adjacent
to lot 12, McClouth Subdivision, which I own. You will note in the
included survey, that the northern half of the seawall is clearly
marked in Detail "A" as being within my property line. This boat -
lift was not on the seawall when I purchased the property on
January 10, 1987. It was built after I did so, and prior to my
moving into our house. I wish to make it clear that I have never
approved any construction to my property and specifically this boatlift.
2) This seawall is the foundation support wall of the southern border
of Lot 12 and it has been permanently altered. The wall has been cut
and concrete has been removed. In addition to this, the combined
weight of the lift frame work and the boat hung from it may have al-
ready seriously weakened the intergrity and strength of the seawall.
3a) The above described damage to the seawall was made to allow permanent
placement of white P.V.C. tubing (containig water), through the sea-
wall, within my property line. This tubing is placed underground
through my property on Lot 12.
3b) In addition to item 3a, gray P.V.C. tubing, containing electrical
wiring to the boatlift, has been permanently fastended onto the sea-
wall, within my property line. This tubing is also placed under-
ground through my property on Lot 12.
4a) Framework and hardware for the boatlift is erected on the seawall of
my property, Lot 12. The steel anchor braces which support the
framework are permanently bolted into the seawall, within my property
line.

b) In addition to item 4a a steel ladder has been erected on the sea-
wall and it also has been permanently bolted into the seawall,
within my property line.
5a) Two docks have also been constructed independently of each other,
on the seawall of Lot 1 adjacent and opposite to the southeast corner
of my property, Lot 12. Said docks have been constructed on the
seawall contrary to deed restictions in the McClouth Subdivision.
b) In the above docks construction, a concrete slab has been poured
directly onto the original seawall immediately adjacent to the
southeast corner of Lot 12.
6) In addition to the above dock construction there is also a second
boatlift built on the seawall of Lot 1. The concrete support pillars
(2) are place directly onto the seawall, supporting the steel frame-
work and hardware of the boat. A major factor in the location of
this boatlift is the total weight placed on the seawall by the lift
together with the boat and the stress of damage which may occur as
a result.
7) It is my understanding that the sea floor of the Yacht Basin, in the
McClouth Subdivision is the jurisdiction of the Department of Natural
Resources. With reference to the above mentioned docks, there are
numerous concrete pilings which have been driven into the sea floor,
supporting these docks.
8) In the matters of items 5,6,7, I believe that this dock construction
has been undertaken without the knowledge and approval of the Department
of Natural Resources, the Environmental Protection Agency or the
Town of Gulf Stream. Further it is my understanding that construction
of this type would not be permitted without the appropriate environ-
mental impact surveys, relating to the sea floor and its ecology.
I believe that it is reasonable to conclude that no permits for construction have
been granted, by any ldcal, state or federal agency, including the Town of Gulf
Stream. I ask that the construction be removed and the seawall be restored to
its original state as intended in deed restrictions of the McClouth Subdivision.

I would appreciate if these matters are dealt with in a timely manner. I have
made numerous attempts to settle the items which I have outlined in this letter
with Mr. John Charlton. I have received no cooperation from him as of the
writing of this letter. I am always hesitant to go beyond direct contact and
cooperation with a neighbor, but in these matters I am unfortunately left with
no choice but to request the direct involvement of the Town of Gulf Stream in
enforcing the described violations, which have been outlined in this letter.
I would be most anxious �o have these matters completely resolved so that our
family may continue to enjoy our beaufitul little town which we have come to
love so much, and wish to preserve in its own unique fashion.

permits from the Town. Further I like to add that the boat lift
supports are partly on my clients property and at no time did he
give permission for such a structure to be placed. To add to
this encroachment, all the electrical and water supply are
mounted over Mr. Sheehans property.
Lastly, I understand that you have no jurisdiction over this
Point, however in accordance with the deeds no boats are to be
stored along this said seawall as shown in the survey, nor can
docks be built on the seawall perpendicular to this indicated
seawall. Furthermore all these extra docks were built, we believe
without the necessary permits from all bodies having jurisdiction
over these docks.

Dear Ms. Gwynn:
I represent Mr. and Mrs. Sherwood H. Sheehan, Jr. and it appears
that there is a dispute between Mr. and Mrs. Sheehan and their neigh-
bor Mr. Charlton about, among other things, the construction of a
boatlift encroaching upon Mr. and Mrs. Sheehan's property. In addi-
tion it appears that certain utility connections have been made
across the Sheehans' property to the boatlift. I realize that some
of the matters that may be involved in this dispute will not be
within the jurisdiction of the town. However, I would like to know
for certain whether applications were made for construction of the
boatlift and the utility connections required and if so were permits
issued for the construction. If you have applications and permits,
singular or plural, I would be grateful if you would furnish me
copies at my expense to determine whether the as built facilities
conform to the application. If there were no such applications
or permits I would like for you to state that affirmatively.
I would also like to know whether there have been applications
and permits issued for docks and a lift on the seawall on the west
boundary of Lot 1 of McLouth Subdivision. If so may I please have
copies of those applications and permits, if any.

Dear Mr. Randolph:
This letter is to advise you that I represent John C. Charlton and
am concerned about a letter directed to him from Richard Brandt of
the Town of Gulf Stream. A copy of said letter is enclosed for your
review. ,
First, nothing was done regarding the construction of the boat hoist
without the knowledge of Lou Sessa, who reviewed the situation on
several occasions. As Mr. Sessa was continually aware of the instal-
lation, Mr. Charlton assumed that he complied with the requirements
of the Town, and if not is willing to do so:
Secondly, if utility connections encroach upon Mr. Sheehan's property
and it is his desire to have these relocated, Mr. Charlton will do
so promptly.
Thirdly, Mr. Brandt states that "we are advised that you have construct-
ed a boat hoist which encroaches on said property." He states
further "since it is apparent that these installations encroach upon
the private property of Mr. Sheehan, you will be required by the
Town to rectify this matter immediately." I suspect that he was
"advised" by Mr. Sheehan. I take exception to Mr. Brandt's conclusion
that the encroachment is "apparent ". As one of two title attorneys
that have thoroughly reviewed the positioning of the hoist and the
evolution of the seawall, it is definitely not apparent to either of
US. What is apparent is that it would probably take a court of law
and considerable research to determine this point, which Mr. Sheehan
has been advised that he is welcome to pursue. Meanwhile, Mr. Charlton
is concerned that the Town of Gulf Stream, at Mr. Sheehan's behest,
has apparently reached a legal conclusion and is willing to execute
same without adequate knowledge and without Mr. Charlton's point of
view being heard.

Thank you for your letter of February 22, 1988,
which was in response to my letter of February 16.
The purpose of my forwarding, under my cover
letter of February 16th, the January 12th letter of Mr.
Griffith was to receive your advice as to the statements
made therein. You will note that Mr. Griffith indicates
that Mr. Charlton is willing to comply with all the
requirements of the Town regarding the construction of
the boat hoist. If he has not complied with those
requirements, I would recommend that you pursue having
Mr. Charlton comply with whatever requirements you have
in regard to such construction.
Mr. Griffith advises that if utility connections
encroach upon Mr. Sheehan's property, that Mr. Charlton
will have these relocated. Again, it seems that this is
a matter that can be taken care of under your supervision.
Finally, Mr. Griffith indicates that it is not obvious
that there is an encroachment of Mr. Charlton's boat hoist
onto Mr. Sheehan's property. If that is the case, and
if the Town cannot prove that there is an encroachment,
I suggest that this remain a matter for the property owners y�
to rectify.

This will confirm our phone conversation of April 29, 1988 pertaining
to the above matter. As I explained, I represent Mr. Sherwood Sheehan, Jr.
the owner of Lots 11 and 12 of McLouth Subdivison of which Lot 12 adjoins
the above - referenced Lot 1.
My client has by letter dated December 4, 1987 (a coy of which I
enclosed) addressed to Mrs. Barbara Gwynn previously adyinfed the Town of
various activities and construction by Mr. Charlton on Lot 12, Lot lA
(submerged lot) and adjoining Lot 1.
In regard to those matters, I would advise you of the following:
1. We were advised by the Town that there were no building permits
which were applied for or issued in regard to the construction of
the dock and boat hoist which were constructed on and adjacent to
Lot 12 owned by Mr. Sheehan, Jr.
2. The boat hoist that was constructed encroaches upon my client's
property i.e. Lot 12 of McLouth Subdivision. We have previously
furnished to the Town and to your office a survey done by
O'Brien, Suiter and O'Brien together with pictures that clearly
show that the boat hoist and associated construction (including
steel ladder, PVC pipe (for water), and PVC pipe (containing
electrical wiring) encroach upon my client's property.
3. There are two other docks adjoining Lot 1 upon which there has
been recent construction including the construction of a boat
hoist and concrete slab. It is our understanding that also no
permits were applied for or issued for this construction.
4. In the McLouth Subdivision, the platted lots include not only the
lots on which single family homes will be constructed but also
submerged lots within the private yacht basin. Lot LA which
adjoins Lot 1 (and Lot 12) is a submerged platted Lot. This Lot
is located in the RS Residential Single Family district. In this
district the minimum set back is 15 feet or 158 of the average
footage of the Lot width or depth. Therefore, the dock
construction violates the City setback requirements and should be
dismantled. It is my understanding that Mr. Dick Brandt has
informed Mr. Charlton of this violation, however, he indicated an
intention not to do anything to either apply for permits or to
remove the construction unless and until forced by the Town to do
SO.
Although the above referenced matters were scheduled for a Planning
and Zoning Board meeting of May 4, 1988 and thereafter a City Council
meeting of May 6, 1988, I understand from a phone conversation I had with
Barbara Gwynn on April 29, 1988 that Mr. Charlton cancelled these meetings
further evidencing his intention not to seek the Town's review or approval
of any of the construction.
My client has been very patient about this situation which has existed
now for many months, however, we would at this time respectfully request
the Town to take legal action against Mr. Charlton to force him to comply
with the Town ordinances and to remove all encroachments from Mr. Sheehan's
property.
It is my understanding that you will put this matter on a City Council
Agenda. I would appreciate it if you would please advise me as to the date
and time of the City Council meeting at which it will be discussed.
