RESOLUTION 2011 -37
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
TO APPROVE A LETTER OF NO PREJUDICE REQUEST FROM THE CALIFORNIA
TRANSPORTATION COMMISSION FOR THE 2012 SLURRY SEAL PROJECT
WHEREAS, $144,000 in Prop 1B State and Local Partnership Program (SLPP) funds
have been programmed by the California Transportation Commission (CTC) for the 2012 Slurry
Seal project (Project); and
WHEREAS, the Town has been advised that due to the state's economic condition
and the resulting status of bond sales, SLPP project funding could be delayed pending
additional bond sales; and
WHEREAS, Assembly Bill 672 authorizes approval of a Letter of No Prejudice (LONP)
for projects programmed or otherwise approved for funding from Proposition 1B programs; and
WHEREAS, the Project meets LONP eligibility requirements; and
WHEREAS, the LONP will allow the Town to move forward with the Project using
Town funds and retain eligibility for reimbursement from Prop 1B funds; and
WHEREAS, the Town commits sufficient Measure V funds to pay for reimbursable
Project costs ($144,000 in addition to the Measure V funds contained in the 11/12 Fiscal Year
budget, for a total of 463,000 in Measure V funds).
NOW, THEREFORE, BE IT RESOLVED BY THE TRUCKEE TOWN COUNCIL to
authorize the use of up to $144,000.00 of additional Measure V funds for the 2012 Slurry Seal
project and submit the LONP request for CTC consideration.
BE IT FURTHER RESOLVED that the Town Manager is hereby authorized to execute
the LONP request and any related documents required by resultant agreements with the
California Transportation Commission and administering agencies.

The foregoing Resolution was introduced by Council Member Green, seconded by
Council Member Wallace Dee at a Regular Meeting of the Truckee Town Council, held on
the 18th day of August, 2011 and adopted by the following vote:
AYES: Council Member Green, Council Member Wallace Dee, Council Member
Brown, Vice Mayor deRyk Jones and Mayor Anderson.
NOES: None.
