HomeMy Public PortalAboutCanyon Springs DEIR Public Comment #24 (Lahontan)O opn� Water Boards Lahontan Regional Water Quality Control Board March 1, 2013 Denyelle Nishimori, Senior Planner Town of Truckee Community Development Department 10183 Truckee Airport Road Truckee, CA 96161 COMMENTS ON THE 2012 DRAFT ENVIRONMENTAL IMPACT REPORT FOR THE PROPOSED CANYON SPRINGS SUBDIVISION PROJECT (PROJECT) (SCH# 2004052060), TOWN OF TRUCKEE, NEVADA COUNTY The Lahontan Regional Water Quality Control Board (Water Board) staff received a copy of the Draft Environmental Impact Report (DEIR) for the above - referenced project on December 21, 2012. The proposed Project presented in the current DEIR reflects revisions to previously proposed developments involving the Project. The Project will be located at the far eastern end of the Town of Truckee on currently undeveloped land. We have reviewed the DEIR and our comments follow. 1. Section 4.6 Geology, Soils and Seismicity: E. Impacts and Mitigation Measures, Impact and Mitigation Measure GEO -3, Page 4.6 -22 - During grading and earthwork on the project site soil erosion and the loss of topsoil may occur. This Section of the DEIR does not identify or discuss the Water Board permitting requirements in regard to soil stabilization for construction projects with over an acre of soil disturbance (although the same permitting requirements are discussed in Section 4.9 (page 4.9 -5) in regard to hydrology and water quality). The Water Board will require the project proponent to procure a Statewide General Stormwater Construction Permit, and provide a Stormwater Pollution Prevention Plan for the proposed Project that adequately addresses Best Management Practices and soil stabilization implementation. 2. Section 4.9 Hydrology and Water Quality: B.2.b. State Laws and Regulations, Water Quality Control Plan for the Lahontan Region (Basin Plan), Paragraph 2, last sentence, states "However, exemptions may be granted by the Lahontan RWQCB that fall within the following categories of new projects." Page 4.9 -4 —This statement regarding discharges due to disturbance to 100 - year floodplains fails to address that the Project categories allowed must also meet certain requirements; in addition, findings must be made pursuant to the Basin Plan prior to exemptions being granted. Section 4.9 Hydrology and Water Quality: B.a.i. Total Maximum Daily Load (TMDL) — Page 4.9 -3. The DEIR notes that primary sources of sediment to the Clean Water Act Section 303(d) listed Middle Truckee River include dirt roads, urban stormwater runoff, legacy erosion sites, and graded ski runs. The Project site as described has a legacy of disturbance. The Town of Truckee is required to meet waste load allocations of sediment from urbanized sources as specified by the TMDL. We request additional information regarding how the Project will implement stabilization of sediment within the categories noted above, which will provide the Town of Truckee with the ability to meet a portion of the waste load allocations of the TMDL and comply with the monitoring and reporting associated with the Small Municipal Storm Sewer System (MS4) permit.
