HomeMy Public PortalAbout04 Easement Abandonments Tahoe Forest Hospital Town of Truckee • California RESOLUTION 2013-04 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR THE ABANDONMMENT OF DRAINAGE, SEWER AND PUBLIC UTILITY EASEMENTS WITHIN THE TAHOE FOREST HOSPITAL DISTRICT CAMPUS ASSESSOR'S PARCEL NUMBER 18-630-08 WHEREAS, the Town of Truckee has received an application requesting approval to abandon four easements as follows: • Easement Abandonment 1: 10'drainage easement across the project area now occupied by the new Cancer Center building. This easement is located across a portion of Parcel 1 as shown on Final Map #93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; • Easement Abandonment 2: 10' sewer easement in the area now occupied within the hospital Western Addition. This easement is located across a portion of Parcel 1 as shown on Final Map #93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; ' • Easement Abandonment 3: Drainage and public utility easement in the area now occupied by the hospital western addition. This easement is located across a portion of Parcel 1 as shown on Final Map#93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; • Easement Abandonment 4: Public utility easement in the area now occupied by the hospital western addition. This easement is located across a portion of Parcel 1, as shown on Final Map#93-01 for Tahoe Forest Hospital District, recorded in Book 8 of Subdivisions, Page 26, Official Records of Nevada County. Said easement is further identified in County of Nevada Board of Supervisors Resolution No. 91726, recorded in document No. 91- 39898, Official Records of Nevada County; and WHEREAS, environmental review has been conducted in accordance with the California Environmental Quality Act(CEQA)and the CEQA Guidelines and the Town Council has determined the project will not have a significant impact on the environment and is exempt from environmental review in accordance with Section 15061(b)(3) of the CEQA Guidelines; and WHEREAS, the Community Development Director, Town Engineer and Public Works Director have reviewed the drainage, sewer and public utility easement abandonments and find the easements in question have been superseded by relocation, there are no other public facilities located within the easements, and the easements are not necessary for present or prospective use and; WHEREAS,two new easements have been recorded to address existing Truckee Donner Public Utility District water system facilities and the Town has not received any objections to the proposed abandonments from any other public utility or special district. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, the Town Council hereby abandons any and all interest to the easements for the following: • Easement Abandonment 1: 10'drainage easement across the project area now occupied I by the new Cancer Center building. This easement is located across a portion of Parcel 1 as shown on Final Map #93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; • Easement Abandonment 2: 10' sewer easement in the area now occupied within the hospital Western Addition. This easement is located across a portion of Parcel 1 as shown on Final Map #93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; • Easement Abandonment 3: Drainage and public utility easement in the area now occupied by the hospital western addition. This easement is located across a portion of Parcel 1 as shown on Final Map#93-01 Reversion to Acreage Map for Tahoe Forest Hospital District, in the office of the Nevada County Recorder, in Book 8 of Subdivisions, Page 26; • Easement Abandonment 4: Public utility easement in the area now occupied by the hospital western addition. This easement is located across a portion of Parcel 1, as shown on Final Map#93-01 for Tahoe Forest Hospital District, recorded in Book 8 of Subdivisions, Page 26, Official Records of Nevada County. Said easement is further identified in County of Nevada Board of Supervisors Resolution No. 91726, recorded in document No. 91- 39898, Official Records of Nevada County. BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to coordinate the recordation of this easement abandonment. I . . . . . This routing indicates the desire of the Hospital District to abandon four existing easements. The District's Water Department has no objection to the abandonment of Easement 1 (a 10'.wide drainage easement) and Easement 2 (a 10' wide sanitary sewer easement). In regards to Easements 3 and 4, the Water Department owns and maintains water system facilities in the area indicated by these easements. These facilities provide service to an existing fire hydrant to the northeast of the day care facility and to a fire sprinkler lateral to the south of the skilled nursing facility. Therefore, the District requires that these easements remain in place or that a new easement is recorded to cover these existing facilities. Further discussions with Martin Wood of SCO Planning Engineering and Surveying determined that the legal description for a new easement covering these water system facilities has been prepared, but is not yet recorded. Therefore, the Water Department has no objection to abandonment of the four easements with the following conditions: 1) Abandonment of the existing public utility easements requires formal action by the District's Board of Directors 2) The District's Board will not take action upon this issue until the new easement is recorded and documentation thereof is submitted to the District. The District's Electric Department may have additional comments on this proposed abandonment and will respond in a separate letter.
