HomeMy Public PortalAbout38 Temporary Suspension of Workforce Housing o TOWN OF TRUCKEE California RESOLUTION NO. 2073-38 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE APPROVING A ONE-YEAR EXTENSION TO THE TEMPORARY SUSPENSION OF WORKFORCE HOUSING REQUIREMENTS WHEREAS, the Town Council on February 5, 2009 adopted Ordinance No. 2008-09 estabtishing requirements for affordable housing on non-residential projeds; and WHEREAS, the adopted ordinance was incorporated into the Town of Truckee Municipal Code, Title 18 as DevelopmenYCode Chapter 18.216 (Workforce Housing); and WHEREAS, Section 18.216.010.D (Purpose and Intent) of the Development Code states that "it is intended for the Town Council to conduct an annual review of this Chapter and its implementation to consider whether amendments are necessary"; and WHEREAS, the Town Council on October 20, 2009 adopted Resolution No. 2009-64 to adopt the 2007-2014 Housing Element; and o WHEREAS, Program H-1.2.4 of the Housing Element requires the continued implementation of the Workforce Housing Ordinance and states, "Review annually the effediveness of the Workforce Housing Ordinance and bonuses, concessions, and incentives and implement revisions as found appropriate"; and WHEREAS, the Town Council on January 7, 2010 approved implementation of the 2010 Economic Development Work Program to implement the Town's economic development activities; and WHEREAS, Action Item B.1 of the 2010 Economic Development Work Program is to "continue ongoing regulatory-based and opportunity-driven economic development and redevelopment efforts," noting that "the overall objective is to continue implementing activities that will support the Town's goals and priorities while reducing regulatory barriers when feasible"; and ' WHEREAS, research completed by Bay Area Economics on March 2, 2011 found that there are currently more market-rate rental and for-purchase housing opportunities in the Truckee region at prices that are considered to be affordable to median- and moderate-income households; and WHEREAS, based on a review of Town policies related to the changing housing conditions in comparison to the desire for economic development, it was determined that a temporary suspension of the Workforce Housing requirements may be an appropriate measure ato encourage new commercial and industrial construction; and Council Resolution No.2013-38 Page 2 WHEREAS, the Housing Advisory Work Group on August 8, 2011 reviewed and approved a draft resolution to implement a suspension and forwarded this draft resolution to the � Town Council as the recommendation of the Work Group; and WHEREAS, the Town Council finds the actions to establish a temporary suspension to the Workforce Housing requirements to be exempt from further review under the Califomia Environmental Quality Act pursuant to Section 15061(b)(3) of the CEQA Guidelines; and WHEREAS, the Town Council on September 1, 2011 adopted Resolution No. 2011-43 to approve a temporary extension of the workforce housing requirements which expires on January 31, 2013; and WHEREAS, the Town Council on September 11, 2012 adopted Resolution No. 2012-39 to approve a temporary extension of the workforce housing requirements which expires on January 31, 2014; and WHEREAS, the Council finds that workforce housing availability has not changed _ substantially in the past year and that a one-year extension to the workforce housing suspension continues to be an appropriate measure to encourage new commercial and industrial construction. ........ NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee hereby adopts a one-year extension to the temporary suspension of the Workforce Housing � requirements of Development Code Chapter 18.216 (Workforce Housing) as set foRh in Exhibit "A", attached hereto and incorporated herein. The foregoing Resolution was introduced by Vice Mayor Flora, seconded by Council Member deRyk Jones, at a Regular Meeting of the Truckee Town Council, held on the 22nd day of October, 2013 and adopted by the following vote: AYES: Council Member Brown, Mayor Wallace Dee, Council Member deRyk Jones, Council Member Barr and Vice Mayor Flora. ABSENT: None. / / arolyn allace Dee, Mayor ATTEST: � ` Ju Price, wn Clerk , Council Resolution No.2013-38 Page 3 TOWN COUNCIL RESOLUTION NO. 2013-38 � EXHIBIT A Temporary Suspension of Workforce Housing Requirements (A) Term: The temporary suspension of Workforce Housing requirements of Development Code Chapter 18.216 (Workforce Housing) shall become effective on the date of adoption of this resolution and shall expire on January 31, 2015. Prior to the expiration of the resolution, the Town Council shall have the option to extend the suspension at one-year increments by adoption of a subsequent resolution. (B) Eligibility: The purpose of the suspension is to encourage projects to commence construction. Therefore, the temporary suspension shall only apply to non-residential projects where a building permit for the project is issued during the suspension and which have diligently pursued construction within six months of the permit issuance date. In the event that land use entitlements for a project have been approved by the review authority with a condition requiring workforce housing construction or in-lieu fees, the condition shall be waived only if a building permit for the project is issued during the suspension and if the project is diligently pursuing construction within six months of the permit issuance date. The review authority shall not vest projects with a waiver at the time of land use entitlement approval. Diligent pursuit of ' construction shall require, at a minimum, the completion of the installation of the foundation(s) for all structure(s) on the property. If the project does not comply with the timelines set forth above or other timelines established by the Development Code or the project conditions of o approval, the conditioned Workforce Housing requirements shall be met prior to temporary certificate of occupancy for any structure on the property. � ►�
