5.1 Adam McGill, Chief of Police presented the Helmets are Cool Initiative.
5.2 The Fire Safe Council Annual Activities Presentation, by Joanne Drummond,
Executive Director Fire Safe Council of Nevada County, was continued to a future
meeting.
5.3 Dan Wilkins, Public Works Director/Town Engineer; introduced Anthony(Tony)Parisi,
new Senior Facilities Maintenance Worker. ,
6. CONSENT CALENDAR .
- It was moved by Vice Mayor Barr, seconded by Council i�ember Wallace Dee, to
approve the Consent Calendar as follows:
6.1 Approve the Minutes of December 10, 2013 and January 7,�2014.
6.2 Adopt Resolution 2014-03 ratifying the 2013 California Fire Code as adopted by the
Truckee Fire Protection District. J

6.3 Adopt Resolution 2014-01 approving the submittal of the grant application for the
Land and Water Conservation funds for Phase 1 of the Trout Creek Trail. .
6.4 Adopt Resolution 2014-02 authorizing the Town Manager to submit an application to
the California Department of Resources Recycling and Recovery(CalRecycle)for the
�purpose of applying for grant funds to expand the used oil and filter recycling
program and to execute all necessary forms to implement and carry out this grant on
behalf of the Town. ,
6.5 Approve Resolution 2014-06 Adopting certain modifications to the Town of Truckee's
Personnel Rules including the Employer-Employee Relations pursuantto the Meyers-
Milias Brown Act, previously adopted via Resolution 2007-55 and amended via
Resolution 2008-35, Resolution 2009-06, and Resolution 2010-08.
� 6.6 Consider appointment of all eight applicants to serve as the originally-designated
three Public-At-,Large representatives on the Stakeholder Committee for the Trails and
Bikeways Master Plan Update. �

7. DISCUSSION ITEMS
7.1 PUBLIC HEARING — Brickelltown Community Facilities District No. 2013-1 Public
Hearing, Resolution of Formation 2014-04,and Resolution calling for Election 2014-05
Capital Improvement Project 60-03-22.
Recommended Action: Conduct a public hearing to accept comments on the formation of
Community Facilities District 2013-1 (Brickelltown Maintenance District); adopt Resolution
2014-04 Forming Community Facilities District 2013-1, and adopt Resolution 2014-05
Calling for a Special Election of Community Facilities District 2013-1.
� Council Member Brown recused himself based on the proximity of his business to the
^ project site.
Dan Wilkins, Public Works Director/Town Engineer, presented from the staff report
(presentation on file with the Town Clerk).
Council Discussion:
• The Town is a paying member o�the district but not a voting member. `
, o Participation by the Town is voluntary. �
Mayor Flora opened the public hearing asking for anyone wishing to speak in support
or opposition to the formation of Community Facilities District 2013-1 (Brickelltown
Maintenance District); Forming Community Facilities District 2013-1, calling for a
Special Election of Community Facilities District 2013-1. �

Chaun Mortier, President, Truckee Historical Society, stated they are on the fence on this
item as they see the benefits to the project but have the following concerns:
1) They are a non—profit organization. All money is received through memberships,
donation and sales. The cost of this assessment will be 15% to 20% of the budget for
the jail.
. 2) There is a small section of land that will be lost - including the landscaping and the
bench - and with no signs it is a challenge to get people to the jail. -
3) The Truckee Donner Historical Society cannot condone the destruction of historic
resources. There is an old exercise yard—for the jail that will potentially be destroyed.
Response: 1)Their board will have to decide how to vote based on the expense. 2)and 3)
Staff will work with the Historical Society through the design process to address these
concerns. �
Dan Wilkins asked the Mayor request commenters identify if they are property owners, and if
they are; if they are protesting the district going to a vote. If there is a majority of property
owners protesting the district going to a vote, the item will be tabled for a year.

Jodi Sweet, Truckee resident:
• Does the district require a 2/3 vote of the property owners?
• Does this mean paid parking will extend through Brickelltown?
• Regarding inclusion of the depot in Brickelltown. Is there still an agreement with the °
County for snow removal? �
Response:
• Yes the vote requires 2/3 affirmative vote to pass. The votes are based on assessed
value ($1 = 1 vote).
• Paid parking would be extended to Brickelltown and the cost of the parking would not
be included in the maintenance district.
• Regarding snow removal, the Town, out of the general fund, hires a contractor to
move the snow off the pavement. If the district is formed, the General Fund will .
make a contribution to the district. The district will hire a contractorfor snow removal.
Including the Depot. This will spread the districts fixed costs among more
participants, lowering individual district participant's assessments. The Railroad
clears from tracks and loading dock area behind the building.
Jamie Brimer, Truckee resident:
• Will AT&T be involved in the voting on the district?
Response: Yes they are part of the district and will have votes based on assess value.

7.2 STAFF REPORT - Aquatic Invasive Species Prevention Ordinance Amendment and �
� Watercraft Inspection Program.
� Recommended Action: Waive the first reading and introduce Ordinance 2014-01 amending
the Town of Truckee Municipal Code to help prevent the introduction and spread of Aquatic
Invasive Species (AIS), reinstate mandatory watercraft inspection within the Town of
Truckee; and set a public hearing for January 28, 2014 to consider an amendment to the
Town of Truckee Fee Schedule with Resolution 2014-07 establishing fees and fines
associated with the Aquatic Invasive Species Watercraft Inspection Program.
Dan Olsen, Animal Services Manager, presented from the staff report (presentation on file
with the Town Clerk).
Council Discussion:
' • Per the draft ordinance only motorized water craft will be subject to mandatory
inspection:
o The ordinance could be modified to include any boats with a water ballast
system.
• The draft ordinance establishes progressive fines but no option to ban offenders
, from launching, the fine would continue for three or more offenses at $500.00.
• There is currently discussion of reciprocity with regional programs; however, Lake
Tahoe already has AIS that are not desired in Donner Lake.
• There is a pledge signed by the individuals that agrees to a re-inspection if they have
launched in another water body since their last inspection.

Lisa Wallace, Truckee River Watershed Council, stated full support the program and the
ordinance as presented. Has been working with the Town on this issue from 2009 adding
there is a real risk. Ms. Wallace requested Council support for the ordinance and the
- mandatory boat inspection program.
Jodi Sweet, Truckee resident, questioned if Fish and Game permit cover all the area lakes?
There is some overlapping here that will cause a compounding of fees for users of multiple
lakes in the region. Is Fish and Game assumed as the major regulating body on this?
Chris Crochanks, Fishery Biologist, Nevada Department of Wildlife, offered support for the
Ordinance from the Nevada Department of Wildlife and provided antidotal information from
Nevada's recent experience with finding mud snails in the Truckee River. "
� Charlie White, Donner Lake resident, questioned if there will be a gate at the Truckee
Donner Recreation and Park District boat launch to prevent non-inspected boats from
launching unattended.

Krista Anderson, Trout Unlimited in Truckee, providing Trout Unlimited background
information. Stated there are real and serious environmental and economic threats from
AIS. Trout Unlimited supports prevention as the most effective and logical approach and
supports the ordinance.
Dan Shaw, Environmental Scientist, California State Parks, stated California State Parks is
in favor of the inspection program. Providing ancidotal information regarding the spread of
Asian Clams in Donner Lake and Eurasian Milfoil in Lake Tahoe. Mr. Shaw stated
prevention is the best option as it is difficult and sometimes nearly impossible to contain the ,
problem. (Photos, provided my Mr. Shaw, are on-file with the Town Clerk.)
, Kathy Welch worked with the Truckee River Watershed Council, on terrestrial weeds. A
weed is a looser term for a winner. Donner Lake should not be a looser.
John Eaton spoke in favor of the effort. Addressed opposing opinion that these critters
cannot live with this lake. It is not worth risking the lake on an opinion. Mutation can occur
rapidly and can lead to an evolution and thrive where they previously couldn't. Spoke in
support of a limited number of times an individual could be find before they are banned.
Kim Boyd, Tahoe Resource Conservation District (RCD), in charge of the Lake Tahoe
watercraft program stated, there are a number of species that controlling is the only option
because they cannot be eradicated. The Tahoe RCD support prevention through this
� program. Stated the RDC has been working with stakeholders since 2009 to protect local
water bodies. With Truckee and Nevada the RCD is working on a regional prevention
program.
Ron Penrose, Truckee Meadows Water Authority (TMWA), stated TMWA has been
supporting the watercraft inspection programs in previous years via the Truckee River Fund.
The AIS issues is important water quality issue for Reno and Sp,arks. Intake facilities can be
severely impacted by.AIS. The TMWA supports this ordinance primarily from a municipal
water supply perspective, but also from an economic perspective.

Alexis 011ar, Executive Director Mountain Area Preservation Foundation (MAP), express
support for the ordinance and the mandatory inspection program. Aquatic Invasive Species
already exists in our local waterways and is a series threat. Ms. 011ar outlined MAP
participation in the stakeholder's committee process, and the conclusion of that process.
Ms. 011ar urged Council to adopt the ordinance and the mandatory boat inspection program.
Kathleen Eagan, Truckee resident, unequivocally supports this action rolling on a mandatory
basis.
Dan O'Gorman, Truckee Donner Recreation or Park District (TDRPD), stated he was not
present to express an opinion on the inspection program; that is a TDRPD Board decision.
" Stated the TDRPD does have staff in place to support the decision of the Council and
TDRPD Board. There may be additional costs that the TDRPD would like to have covered `
(to put a gate on the ramp). TDRPD is ready to back Council on their decision.

Steve Urie, stated opposition to the ordinance. Mr. Urie stating he sees no science to
support the ordinance. IVIr. Urie, requested information that supports what they are saying `
and has received nothing. We hear there is potential but the science doesn't support it. Mr.
Urie stated he provided a lot of information that cannot be evaluated. Stated there are a
number of State and Federal agencies that can do an evaluation, but this opportunity was
ignored by the stakeholders group. There was no public meeting of the steering committee.
There is no new information, and nothing has changed. We are working from emotional
standpoint not a scientific one. Encouraged Council to postpone the decision until Council
can review the science.
Sudeep Chandra, Professor of Limnology, University of Nevada Reno, provided his
background. Stated, Mr. Urie has a point that there are no site specific tests that can be run
to determine if an AIS will persist in Donner Lake, rather the observation in the region has
seen the expansion of warm water species and impacts on area lakes. Mr. Chandra is
watching different communities adopt a largely proactive approach to preventing AIS. Mr.
� Chandra did not speak for or against the program, only to suggest that there is some
evidence that Donner Lake could experience impacts.
Lisa Holan, Truckee resident, Aquatic Ecologist, strongly urged Council to adopt the
ordinance amendment recognizing all the potential invasive species and move to mandatory
boat inspections for this spring. Stated,AIS has a devastating environmental and economic
impact on industry, recreation and tourism. The argument that the sciences is not there is
not true, there have been invasions at a dramatic costs of suppression and potentially
unsuccessful eradication efforts. To dismiss the experiences of other areas in North
American just because our lake is unique is dangerous.
Mayor Flora closed public comment.
Council Discussion:
• If used locally just Donner Lake, are Boca and Stampede or any other county
stickers honored?
, o Reciprocity does not exist at this time. Tahoe is the only one with an
inspection program Boca and Stampede do not have one.
• Council will know if the TDRPD will staff the program prior to the second reading of
the ordinance.

o The stakeholders committee would consider alternatives if TDRPD is unable
to staff the program. . �
• The cost of the decontamination machine is expensive. Staffwill seek grant funds to
add a decontamination station in the future.
� • Average time of an inspection,with a completed application; is 2 to 5 minutes. If the
watercraft is not clean, drained and dry they it can be longer.
• The voluntary program allowed boats to launching without decontamination, the
mandatory program will not. �
• There is no universal permit that allows you to go from one body to another.
• Nevada and Sierra Counties are looking at the programs for Boca and Stampede.
We would have our own, and they would have theirs,they could potentially honor our
, stickers.
Council Discussion: �
• Add language about sailboats with water ballasts.
• Three violations and no access to the lake.
, o Keep our lakes fun and ensure boats can launch.
o An offensive ordinance may be counter-productive..
o Wait until it can be determined if it is an issue.
Council Direction:
� • Approve as amended by staff.
o Minor change to Section 14.01.030 related to AIS definition. Change
"They" to "and" to read as follows:
. Aquatic Invasive Species are aquatic animals and plants that have
been introduced into waterways in which they do not live naturally and
have harmful effects on the natural resources in these ecosystems and
the human uses of these resources.Aquatic Invasive Species include
but are not limited to invertebrates (New Zealand Mudsnails, Quagga
Mussels, and Asian Clam), plants(Eurasian Watermilfoil, Hydrilla, and
Curly Leaf Pondweed), and warm water fishes."
• Modify Ordinance to include watercraft with water ballast:
o Paragraph 1 of section 14.01.050:
■ The first sentence would start with: "All motorized and/or
trailered watercraft, and other watercraft having water ballast
tanks, shall be inspected..."
■ The second sentence would startwith:"All otherwatercraft may
be subject to an inspection..."

7.3 STAFF REPORT — TBWB Strategies Contract Amendment and Consideration of
Potential�Sales Tax Ballot Measure Dedicated to Trails.
Recommended Action: 1) Authorize the Town Manager to increase TBWB Strategies'
contract amount by $28,840 for new contract maximum of $61,840; 2) Amend Capital
Improvement Project 60-14-04(Public Opinion Survey for Dedicated Trails Funding Source)
to increase the General Fund budget for this effort from $33,000 to $65,000; and 3)
Consider the results of outreach effort conducted by staff; and provide direction to staff to
finalize ballot language and the implementing resolution for the January 28, 2014 Town
Council meeting.

Residents Association
Janet Phillips, Tahoe-Pyramid Bikeways, spoke in support of the Trails tax measure. Ms.
Phillips stated Truckee is an important hub of trail connection. She is grateful for your
enthusiasm for trails. A $450,000 bridge built in California was funded by Nevada using
Federal money and utility contracts. (Presentation on file with the Town Clerk).

Lisa Wallace, Board President, Our Truckee River Legacy Foundation, state since 1997 the
foundation has been actively involved in implementation of the Legacy Trail. The foundation
could potentially be an advocate for the trail tax measure if the Legacy Trail remains the
priority in the Town. The foundation understands Town's use of the conditions of approval
for PC 1 to have the section of the trail completed through the project area, however, the
foundation requested Council commit to completion of the trail with the trails tax measure
funding regardless of developer participation in this section. Resolution and discussion that
Phase 5 is within the ten year budget. If for some reason the Legacy trail drops in priority
the foundation would be silent on the issue. The foundation will take an active role if the
Legacy Trail remains included.
Alexis 011ar, Mountain Area Preservation Foundation (MAP), spoke in support of the trails
tax measure. In addition MAP supports the inclusion the acquisition of open space adjacent
to the trails. Ms. 011ar stated better trails lesson greenhouse gases and improve the local
y economy.
Allison Pedley, Truckee Trails Foundation, provided some statics on the economic impact of
trails in the Tahoe Basin and the potential impacts in Truckee. Anyone afraid the money will
� come back. Ms. Pedley thanked Council for hiring Charles to conduct the polling. The
foundation has pledged $10,000 to the trails tax measure advocacy campaign. This is one
third the anticipated campaign budget and a huge commitment for the foundation.
Paco Lindsey, Truckee resident, thanked Council and Town staff for pursuing this tax
measure. Mr. Lindsey provided information regarding his participation since 1988 in the
Truckee trails planning. He is an avid cyclist and business owner. As an advocate he has
already spoke to people that will commit to the campaign efforts. Mr. Lindsey volunteered to �
be the president of the advocacy committee. 8:51:03 PM � �
Mike Staudenmayer, Northstar Community Facilities District (CFD), stated the work on the
Legacy Trail is a model for the region. Thanks for the through presentation. Encourage
folks to support the measure: 1) it could accelerate the active already on Segment 1 from
Town line to Martis Valley; 2) provide the ability to make grant applications more attractive;
(Northstar CFD provided seed money and is now the largest funding source); 3) providing
the necessary maintenance. Thanked Council forthe resolution language, which does not
have this money going to overhead.
Jodi Sweet spoke in opposition, stating it is unfair to those that do not get anything out of it.
Mr. Sweet recommended Council provide berm removal in the bond measure to provide
benefit to others. He urged Council to re-due this measure. Mr. Sweet recommended
bicyclists foot the bill by instituting a bicycle permit fees and/or trail use fees.
Doug Gonda, Truckee resident, spoke in support of the trails tax measure. Thanked Council
for considering this tax incr,ease. Referenced other communities trail networks and �
expressed amazement regarding a 67% positive polling for the measure.
Leeds Davis stated he wanted to go on record as a proponent of this measure. Supporting
the sales tax measure as a fair way to assess taxes on users that are both locals and
� visitors. Mr. Davis recommended the funding from the measure be allowed for use on bike
lanes as well as trails to improve safety.

Helen Pelster spoke in support of moving the tax measure forward. Trails not just cyclists
but are sidewalks. Trails help with the lack of sidewalks here in Truckee. Questioned the
definition of winter use as snow removal or grooming for Nordic skiing. Spoke in support of
removal for those who use the trails as primary transportation. _
Brian Schusterman, Truckee resident and Truckee Trails Foundation Board member, Spoke
in support of the earthen trails as well as the paved trails. Looking forward to working with
the advocacy group to ensure the measure passes.
Sean Connelly, Truckee resident and Truckee Trails Foundation Board member, supports
the measure. Supports both earthen and paved trails. ,,
Nancy Richards stated support for moving the trails measure forward. Supports for the
pride the Town has for the work already completed on Trails in Truckee. There is a safety
issue with hap hazard maintenance. We need to insure the longevity of the trails.
Michael Collins has ridden a bicycle every day. He spoke in support of the measure from an
alternative transportation perspective. Mr. Collins stated Town could see a return on
investment if Amtrac allowed bikes on trains(unboxed). Allowing bikes on trains could be a
real benefit to downtown. Urged Council to lobby Amtrac.
John Eaton stated he strongly support the measure. He stated before we go too far we
need to know what people expect of the trails. He hopes for support of handicapped trails.
Mark Featherstone, Truckee resident,selfishly supports the measure as it links to the bicycle
pump track to every neighborhood in Truckee and allows him to get to every park and
without crossing street traffic. -
Dennis Dickinson, Truckee resident, stated he hopes everyone will support the building of
the library, as it is his passion. Mr. Dickinson stated he is on the fence regarding the tax
measure. Pointed out the survey suggested the measure would do better in November and
questioned why it is being considered for June. Mr. Dickinson stated the measure does not
have the votes to pass in June. Stated Council need not be concerned about the school
bond measure based on the Measure V and Measure U elections going at the same time.
Maggie Hargrave spoke in support of the measure, stating on behalf of the lower income
community in Truckee that she works with at the Family Resource Center. Support for those
that don't have a vehicle and use the trails for transportation. Ms. Hargrave expressed a
desire to help in the advocacy campaign.
Keenan Hawkins spoke in strong support of this measure. Personally very interested and will
work with the Truckee Trails foundation to pass the measure. Mr. Hawkins encouraged
Council to pass this item.
Mike Salmon, President, Truckee Trails Foundation and Truckee resident, stated it is
exciting to have this as a topic tonight. Mr. Salmon suggested Council consider going to a'h
cent sales tax or 15 years instead of ten. Mr. Salmon stated it is a great thing makes a lot of .
sense.

� , • Survey results were stronger in November, but not with a competing measure on the
ballot. We don't want to overshadow the School District. Don't want to compete. �
June is a preferable time. If a get out the vote campaign is utilized it could pass.
• Council did not go to '/ cent — in order to encourage staff to continue to go after
other funding sources. .
• We may be able to complete the trails network in 10 years and not need a full%4 cent
to maintain them into the future. It will be a good time to look back and not be a
burden to our community.
• The Trails and Bikeways Master Plan process will continue. We are seeking funding
for Class 1 but not precluding other on street trails. �
• We have funding sources for Class 2 trails. Glenshire Drive Bike Lane project relied
on '/2 cent road tax measure to fund the project.
• There is an ongoing planning process over the next 10 year, a public process. The
input does not stop with the passage of the tax measure.
• The'/4 cent puts Truckee at the state average tax rate. Most of our visitors are used
to a higher tax rate.
• The winter use language is open and vague to allow flexibility based on the season.
• There are concerns regarding being on the edge of the polling. This is a challenging
measure.
• The commitment of$10,000 from the Truckee Trails Foundation is amazing.
• This is`an idea whose time has come. Move forward and work with the community.
Commit to the challenge of getting this accomplished. We have a fragile economy
and will have to fight for this measure.
• Those that ride have stepped up to pay for trails in Truckee. Tahoe Donner
contributed $4 million towards trails.
• Funded the Mousehole was approved by Nevada County Transportation
Commission.
• You can take your bike unboxed on the Amtrac.

Recommended Action: Approve additional funds in the amount of $9,200 to secure the
payment of$16,000 to the North Lake Tahoe Resort Association for costs associated with
fhe Lake Tahoe Ironman 2013. .

Council Discussion: -
' • There were challenges with residents being able to get to home if they made it to
Safeway. They couldn't get home to their neighborhood.
• Little support in the literature to balance the venues. Ironman saw the Town's
participation traffic plan request and Ironman will include Truckee in future literature.
• Direct contribution form Resort Association exceeds this by at least 10 times;
$100,000 up front each year for this event. We don't have that level of participation.

Aaron Casey, Truckee River Watershed Council, explained a program that the Truckee
River Watershed Council (TRWC) is proposing,that the TRWC would like to expand to this
event. TRWC is working with lodging to charge a$1.00 to be used for land acquisition,trails,
education and schools. TRWC feels it is a great way to mitigate the environmental impacts
of this event and a great opportunity for partnership. Utilized in the community to support the
environment.
Response: Staff will provide Ironman contact information to Aaron Casey.

Additional signage or personal would be valuable at local intersections.

7.5 - STAFF REPORT—Letter of support for the Truckee Donner Land Trust's request for
funding for the River Parkways Program for acquisition of river frontage property on
West River Street which is a portion of APN 19-300-41.
Recommended Action: Authorize the Mayor to sign the support letter for funding from the
State of California River Parkway's Program to assist the Truckee Donner Land Trust in
L acquiring the river frontage portion of the "Arnold Property" on West River Street.
Vice Mayor Barr recused herself based on a conflict arising from her status as project
applicant.

• The intent is that the Land Trust would maintain this as publicly accessible land.
• Using State funding would mandate the land remain public.

Written comment was received by Stefanie Olivieri (one file with the Town Clerk).
Lisa Wallace, Truckee River Watershed Council, stated they are in partnership with the
Truckee Donner Land Trust with a longer term picture and plan for the acquisition of this
parcel at the appraised value. Some business exist on this property will need to be
accommodated. Land restoration and trail access are planned. The letter of support will be
critical to secure the funding. The funding� is leftover from a project that did not use the
funding. .
Ms. Wallace, spoke on behalf of Perry Norris, Land Trust, encouraging support. �
Dennis Dickinson recommended Council consider connecting this propertywith the Fish and
Game owned property across the river with a bridge. �
Alexis 011ar, Mountain Area Preservation Foundation(MAP)spoke in support of the letter of
support for this item.
