Public Works Director/Town Engineer Subject: Measure V Expenditures for 2012/2013 Fiscal Year Measure V was enacted by Truckee voters in 2008. Attached to this report as Exhibit A is the ballot language and supporting resolution for Measure V as well as Resolution 2010-38 which established the Measure V Oversight Committee. Since this Measure is dedicated to "paving, repairing and improving our Town's roads to enhance safety for drivers, bicyclists and pedestrians including regular upgrades to drainage to protect water quality", a citizen's oversight committee was created "that shall have the responsibility of auditing the road projects funded by this Measure to ensure that the use of the funds is in accordance with the approved ballot measure. This review shall occur in conjunction with the annual audit of the Town's finances." The purpose of the following is to provide the Measure V Oversight Committee with information regarding expenditures of Measure V funds for the 2012/2013 fiscal year. During the 2012/2013 fiscal year, the Town of Truckee expended $2,290,624 of Measure V funds. These funds were charged to nine (9) separate capital improvement program budgets. An additional $88,535 in Prop 50 Grant funds was allocated to this project to fund restoration activities. The attached Exhibit B presents a map of the road improvement area. The 2012 Recessed Striping and Marking Project (CIP 60-11-03) expended $35,610 in Measure V funds for the purpose of installing striping and markings on various Town roads. An additional $79,262 of Measure A funding was allocated to this project to fund the portion of the work that was completed on roads that are eligible to receive Measure A funding. The 2012 Slurry Seal Project (CIP 60-12-01) expended $304,734 in Measure V funds for the purpose of implementing a portion of the Summer 2012 Slurry Seal project. An additional $144,000, $134,414, and $33,009 was allocated to this project from a combination of SLPP Grant, Truckee Special Service Area 1, and Truckee Special Service Area 5 funding sources, respectively, for a project total of $616,157 in Fiscal Year 2012/13. The attached Exhibit C presents four maps showing the streets in Truckee which were slurry sealed during this project. 2 The 2012 Paving and Drainage Project (CIP 60-12-02) was started in Fiscal Year 2011/2012 but the majority of the expenditures for this project occurred in Fiscal Year 2012/2013. The project expended $1,677,098 in Measure V in Fiscal Year 12/13 with an additional $114,556 in Truckee Special Service Area 5 funding for work that occurred in Glenshire. The project included paving and drainage improvements to Donner Pass Road by Donner Lake, Schussing Way, Alder Drive, Deerfield Drive, River Park Place, Pioneer Trail, Martis Valley Road, Palisades Drive, and the Downtown Alley. The project also included drainage improvements in the Glenshire Subdivision. The majority of the Coldstream Road Bridge Repair Project (CIP 60-12-05) was completed in the Fiscal Year 11/12. However, $2,279 in Measure V funds were expended in Fiscal Year 12/13 to close out the project. The project included an emergency repair of the Coldstream Road bridge over Donner Creek. Additional improvements are expected to be necessary in future years. The Comstock Bridge Joint Repair Project (CIP 60-12-04) expended $28,855 in Fiscal Year 2012/2013 and there were no other expenditures on the project during that fiscal year. The project replaced damaged and deteriorated bridge joints on the Comstock Drive bridge. The 2013 Slurry Seal Project (CIP 60-13-01) expended $209,775 in Measure V funds for the purpose of implementing a portion of the Summer 2013 Slurry Seal project. An additional $32,932, $71,000, and $149,455 was allocated to this project from a combination of Measure A, SLLP Grant, and Truckee Special Service Area 1 funding sources, respectively, for a project total of $467,779 in Fiscal Year 2012/13. In addition, Placer County reimbursed the Town $4,617 for work completed in Placer County. Additional expenditures have occurred in Fiscal Year 13/14. The attached Exhibit D presents four maps showing the streets in Truckee which were slurry sealed during this project. The Glenshire Drive/Highland Avenue Safety Improvement Project (CIP 60-13-03) is currently in the design phase and expended $1,305 in Fiscal Year 2012/2013. Construction is planned to occur in 2014 and will be summarized in the Fiscal Year 13/14 and 14/15 reports. The Bridge Street At-Grade Railroad Pedestrian Crossing (CIP 60-14-03) is currently in the design phase and expended $3,180 in Fiscal Year 2012/2013. Construction is planned to occur in the early part of 2014 and will be summarized in the Fiscal Year report. Recommendation Based upon the provisions of Measure V, and the scope of the above projects, Town staff recommends that the Measure V Oversight Committee make a determination that the expenditure of Measure V funds in the 2012/2013 fiscal year was consistent with the provisions of Measure V as established by the voters in the November 4, 2008 general election. DISCUSSION:- Measure V was enacted by Truckee voters in 2008 which resulted in the continuation of a 1/2 cent sales tax dedicated to`paving, repairing and improving our Town's roads to enhance roadway safety for drivers, bicyclists and pedestrians including related upgrades to drainage to protect water quality." This measure requires the establishment of a citizen's oversight committee"that shall have the responsibility of auditing the road projects funded by this Measure to ensure that the use of the funds is in accordance with the approved ballot measure. This review shall occur in conjunction with the annual audit of the Town's finances." Fiscal Year 2009/10 is the first year that Measure V funds have been utilized and it is estimated that roughly$600,000 has been expended,primarily on slurry seals. To satisfy the Measure V requirements this committee needs to be in place when audited financials are available(late fall). Staff recommends that this committee be appointed by the Town Council and have 5 members that are qualified voters within the Town of Truckee. Staff would also recommend that owners or employees of construction firms and consulting firms that have or could potentially enter into road maintenance or road construction contracts or road design/permitting contracts with the Town be precluded from membership on the oversight committee. Due to the nature of the Committee it will be subject to the Brown Act and all meetings will be public.The findings of the Committee will be advisory to the Town Council and reviewed in conjunction with the Town's annual audit. Based upon Council adoption of the resolution,the Town Clerk will advertise for interested participants and applications will be brought back to the Council for formal appointments to the Committee, likely at the first meeting in November. . Staff will provide the necessary financial information, project analysis and administrative support to the Committee. FISCAL IMPACT: Minimal-stiff support to the Committee. Town Council Staff Report Page 1 of 1 TOWN OF TRUCKEE California RESOLUTION 2010.38 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE WHEREAS; Measure V was enacted by Truckee voters in 2008 establishing a '/2 cent sales tax for the purpose of paving, repairing and improving our Town's roads to enhance roadway safety for drivers, bicyclists and pedestrians including related upgrades to drainage to protect water quality, and WHEREAS; Measure V requires the establishment of a citizen's oversight committee that shall have the responsibility of auditing the road projects funded by this Measure to ensure that the use of the funds is in accordance with the approved ballot measure. The name of the Committee shall be the Measure V Oversight Committee. 2. The purpose of the Committee shall be to meet annually to audit the road projects funded by Measure V to ensure that the use of the funds is in accordance with the approved ballot measure. This review shall occur in conjunction with the annual audit of the Town's finances. 3. The Committee shall be made up of 5 members appointed by the Town Council who are qualified voters within the Town of Truckee. Owners or employees of construction, engineering, design, environmental consulting or similar firms that have entered into contracts or could potentially enter into road maintenance or road construction or consulting contracts related to road projects with the Town shall be precluded from membership on the Committee. 4. The Committee shall be subject to the Brown Act and all meetings will be public. 5. The findings of the Committee will be advisory to the Town Council and reviewed in conjunction with the Town's annual audit. 6. The Town Clerk will advertise for interested participants and applications will be brought back to the Town Council for formal appointment. The term of appointment-shall -be for 4 years except that the first Committee shall draw lots to determine two members that will serve a 2 year term. For the purpose of their review, the Measure V Oversight Committee shall utilize audited financial information on actual expenditures and refer first to the Measure V ballot language and then for additional guidance to Town Council Resolution 2008-45 placing Measure V on the ballot and the Official Argument in Favor of Measure V which are attached hereto as an exhibit B. Appropriate Town staff, as directed by the Town Manager, shall provide the necessary support to the Measure V Oversight Committee to facilitate their efficient completion of their responsibilities. Noes: None Absent- None Barbara Green, Mayor ATTEST: Judy Price, CMC,Town Cleric Town of Truckee Council Resolution 2008-45 Exhibit A Truckee Town Council and Citizens Committee Recommendation to extend the term of the 1/2 cent sales tax The Truckee Town Council has approved a Citizens Committee recommendation to place a'/z cent sales tax measure before the voters for the repair,maintenance,reconstruction and improvement of Town roads and for no other purposes. Exclusive Purpose of Funding The funds generated from this revenue source shall be used exclusively for the maintenance, repair, reconstruction, and improvement of Town roads and for no other purpose. The funds shall be used for maintaining roads,which includes slurry seal,pavement overlays, grind and overlays, drainage maintenance and improvement designed to protect the integrity of the roadway and total road reconstruction and such other similar treatments as determined by the Town Council. As funding permits, the funds may also be used to improve existing roadways including widening of shoulders for safety and the inclusion of Class 11 bicycle facilities, contiguous pedestrian facilities,safety improvements and associated drainage improvements. In general, traffic impact fees charged to new development(and not the proceeds from this measure)shall be the funding source for road improvements necessary to provide adequate vehicular traffic capacity to serve new growth and development. Allocation of FundinIZ The Town will actively solicit the involvement of the public in its annual process to allocate the funds generated from this revenue source to specific road maintenance and improvement projects. Independent Oversight Committee The Town Council shall establish a Citizen's Oversight Committee that shall have the responsibility of auditing the road projects funded by this Measure to ensure that the use of the funds is in accordance with the approved ballot measure. This review shall occur in conjunction with the annual audit of the Town's finances. Term This ballot measure shall become effective immediately upon approval by the voters and shall have a term of 20 years. This measure shall replace the current %z cent sales tax (Measure A) previously approved by the voters. �1u1vr�R cEI1fEQ4�EE Official Argument in Favor of Measure V Town oFTruckee Sales Tax for Road Maintenance and Icnprov' DlAUG 15 Pty 3= Election Date:November 4.2008 Word Count: 294 Measure V will not increase taxes. It simply extends the current sales tax rate to continue funding for paving, repairing and maintaining Truckee roads that is set to expire. In 1998 over 72%of Truckee voters approved a %cent sales tax to improve and maintain the most heavily used"backbone"roads in Truckee. These funds have been used to improve the worst of the potholes,cracks,ruts and road safety problems trte Town inherited when it incorporated in 1993. By law,this funding will expire in 2010. If it does expire,the Town of'l'rttckee will lose approximately$2.1 million in annual road funding and Truckee roads will deteriorate. Measure V is on the ballot to extend the existing''/_cent sales tax to maintain roads that have been improved and complete needed road repairs that still need to be addressed. Specifically, Measure V funds will be used to: • Fix potholes, pave, repair and maintain local roads • Improve roadway safety for drivers,bicyclists and pedestrians • Make it safer for students walking or bikini;to and from school • Upgrade roadway drainage to protect local water quality A large part of the motley from Measure V comes from tourists and second homeowners. This ensures they continue to pay their fair share for roads they use in Truckee_ Every penny from this measure must be used for maintenance and improvement of our Town's roads. No funds can be taken away or used for other projects. There is a clear system of accountability to ensure funds are spent properly. An independent Citizens'Oversight Committee and annual audits are mandatory. Having safe and well-maintained roads helps protect our property values,which is more important now than ever. Maintain and improve roads without increasing taxes. Please vote Yes on V.
