HomeMy Public PortalAboutFinal MMRP-FEIR Edits Memo Date: June 16, 2014 To: Planning Commission From: Jenna Endres, Associate Planner Subject: Minor Modifications to Coldstream Specific Plan Final Environmental Impact Report and Mitigation Monitoring and Reporting Program Following publication of the Coldstream Specific Plan Final Environmental Impact Report (FEIR) and Mitigation Monitoring and Reporting Program (MMRP), staff located a number of discrepancies within the text and timing of certain mitigation measures. In order to correct these discrepancies, staff is recommending the following changes to both the FEIR and the MMRP. The proposed changes are minor in nature, do not change any of the impact statements and required mitigation measures nor do they alter any of the conclusions made within each document. In most cases, they are made to ensure the text is internally consistent with the timing and enforcement of each mitigation measure. Summary of proposed changes: • MM 4.1.3. “Timing” column states “Prior to approval of tentative maps for the Village Green Residential Small Lot area and Recreation parcel.” Three minor changes are proposed to the timing in this mitigation measure: 1) modification of the project design (to be done prior to approval of tentative maps), 2) the fence (design to be approved prior to installation), and 3) access point and easement to be deeded after there is a legal parcel. • MM 4.2.2a. 1. The “Timing” column text (“Prior to recordation of final map”) conflicts with text of mitigation, which states that intersection improvements are to be approved prior to temporary or final certificate of occupancy of any buildings. The text within the mitigation measure language is proposed to be changed to match that of the timing section. 2. A clarification note will be added within the “Timing” column to recognize the condition of approval written by the Town’s Engineering Division. The Engineering Division condition of approval recognizes that this work has already been completed and thus this mitigation measure will require reimbursement rather than construction of improvements. The Engineering condition reads: “Intersection improvements have been constructed by a Town Capital Improvement Project at the SR 89 South/Donner Pass Road/Frates Lane intersection, which fulfill the short-range improvements required by Mitigation Measure 4.2.2a. The recently approved Tahoe Forest Hospital Expansion Project had a similar Mitigation Measure, including the ability to request reimbursement of a fair-share portion of the short-rang e improvements from future discretionary Category 3 and 4 projects (as defined by General Plan Table CIR-6). The Town and Tahoe Forest Hospital District paid their fair shares toward the intersection improvements in 2011. Prior to any building permit issuance or subdivision map approval, the applicant shall pay this project’s fair share contribution of $36,908 ($20,259 to the Town and $16,649 to Tahoe Forest Hospital District) toward the intersection improvements.” • MM 4.2.2b. “Timing” column text should be revised to reflect the fact that this impact is only significant for Option A under 2030 cumulative conditions. Given the fact that the improvements are included within the Town’s Traffic Impact Fee program, payment of traffic fees at time of building permit approval should be the timing for Option A. • MM 4.2.2c. “Timing” column text (“Prior to recordation of final map”) conflicts with text of mitigation, which states that intersection improvements are to be approved prior to temporary or final certificate of occupancy of any buildings. The text within the mitigation measure will be changed to be consistent with the timing statement. • MM 4.2.3a. This measure should be implemented at the same time as other 2010 traffic mitigation measures, i.e., prior to temporary or final certificate of occupancy of any buildings. • MM 4.2.3b. This measure should be implemented at the same time as other 2010 traffic mitigation measures, i.e., prior to temporary or final certificate of occupancy of any buildings. • MM 4.2.10a. This measure should be implemented at the same time as other 2010 traffic mitigation measures, i.e., prior to temporary or final certificate of occupancy of any buildings. • MM 4.3.3. “Timing” column text should be revised to clarify that the stated timing only relates to when the final design of the landscaped berm is approved. The measure does not specify when the berm is to be constructed, presumably prior to issuance of certificates of occupancy for residences within the applicable noise contour of I-80 or those that correspond with the area formerly known as Forest Residential. The timing will be revised to reflect a requirement to construct the berm prior to issuance of certificates of occupancy and clarify when final design of the landscaped berm is required. • MM 4.3-5. The phase reference in the “Timing” column text is outdated. It should be tied to opening up Deerfield Drive, so construction of Phases 5A or 5B would be appropriate here. The timing will be revised to reflect construction of either Phase 5A or 5B. • MM 4.3.8a. The phase reference in the “Timing” column text is outdated. It should be Phase 3 based on the current phasing diagram. • MM 4.3.8b. The phase reference in the “Timing” column text is outdated. It should be Phase 3 based on the current phasing diagram. • MM 4.3.8c. The phase reference in the “Timing” column text is outdated. It should be Phase 3 based on the current phasing diagram. " MM 4.4.3b.  Timing column text requires the applicant to provide evidence of disclosure to future project residents of potential exposure to wood smoke from prescribed burns at Donner Memorial State Park. The text should be modified to require approval of the form or text of the disclosure prior to issuance of building permits. " MM 4.7.5a.  Timing column text will be revised to clarify that the requirement applies to the approval of any final map. " MM 4.7-5b.  Timing column text will be revised to clarify that the bridge design must be completed prior to approval of site improvement plans for Phases 5A and 5B, because those phases require construction of the bridge. " MM 4.8.1d.  Timing column text ( Prior to approval of the proposed Coldstream Specific Plan ) conflicts with the mitigation measure, which states that willow flycatcher surveys, if needed, are to be done prior to each phase of construction. The text in this mitigation measure will be revised to state that the surveys shall be done prior to each construction phase. " MM 4.8-2c.  Timing column text ( Fourteen days prior to ground disturbance ) will be revised to  during construction to be consistent with the mitigation measure, which requires implementation of construction BMPs. " MM 4.8-7. The  timing and  monitoring responsibility columns are reversed for this measure.
