SUMMARY STATEMENT:
The City does not have any provision for assisting employees
with legal fees associated with job related events.
We currently have a police officer charged with a misdemeanor stemming from a response to a domestic violence call. (see attached
summary) Unlike larger cities where officers would have access to legal defense funds, McCall officers do not have access to funds to pay for attorney fees at this time.
The City should
have a policy which addresses this issue, to include a fund which could be accessed by employees (police and other employees), the policy must define the parameters of use and an approval
process.
RECOMMENDED ACTION: Authorize the funding for legal fees for Officer John Koch, direct staff to prepare an agreement that would require Officer Koch to repay the City should
he be found guilty. Direct the staff to develop a policy for funding legal expenses for employees for job related situations.
