SUMMARY STATEMENT:
The State Revolving Fund Loan
Application must include an agreement with a project engineer. Toothman—Orton was the project engineer on the first phase and we can extend that agreement. We have included a new sentence
in the termination section that allows either party to terminate the agreement without cause prior to start of construction. By including this sentence we can publish an RFP and terminate
the agreement. I have discussed this with Rick Orton and Kim Trout and both concur that we should extend the agreement for the purposes of the SRF loan submission and that the City
should keep open the option of executing the RFP—which the change in the termination section allows.
RECOMMENDED ACTION:
Approve the extension of the agreement with Toothman—Orton
and authorize the Mayor to sign.
