HomeMy Public PortalAbout05 22 14 MeetingMINUTES OF THE REGULAR MEETING AND PUBLIC HEARING HELD BY THE ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM, FLORIDA, ON THURSDAY, MAY 22, 2014, AT 8:30 A.M., IN THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order: Vice - Chairman Smith called the meeting to order at 8:35 A.M. II. Roll all: CPresent and Thomas Smith Participating Malcom Murphy Hewlett Kent Absent with Paul A. Lyons, Jr. Notice Amanda Jones Robert Dockerty S. Curtiss Roach John Randolph Also Present and William H. Thrasher Participating Rita L. Minutes: A. Regular Meeting and Public Hearing held on April 24, 2014. Board Member Murphy moved and Alternate Member Kent seconded the approval of the Minutes of April 24, 2014 and at Roll Call, all voted AYE. IV. Additions, Withdrawals, Deferrals, Arrangement of Agenda Items: There were none. V. Announcements: A. Meeting Dates 1. Regular Meeting & Public Hearing Dates Vice - Chairman Smith announced the following approved upcoming ARPB meeting dates and asked for any conflicts. a. June 26, 2014 @ 8:30 A.M. b. July 24, 2014 @ 8:30 A.M. C c. There is no meeting in August d. Septgmber 25, 2014 @ 8:30 A.M. e. October 23, 2014 @ 8:30 A.M. Alternate Board Member Kent advised he was uncertain about the June 26, 2014 meeting at this time. VI. PUBLIC HEARING: A. Applications for Development Approval ARP13 Regular Meeting & Public Hearing May —M 2014 1. An application submitted by Mark Marsh, Bridges, Marsh & Associates, as agent for Robert M. Gardiner owner of property located at 530 Old School Road, Gulf Stream, Florida, legally described as Lot 8, Block 3, Plat No. 1 Polo Fields Subdivision for the following: a. SPECIAL EXCEPTION 1 to permit the addition of a 253 sq. ft. bedroom to an existing home that encroaches approximately 3.5 ft. into the east side setback. b. SPECIAL EXCEPTION 2 to permit the addition of a 253 sq. ft. bedroom to an existing home that extends approximately 5 ft. into the rear waterfront setback in the Core Design District. C. LEVEL 3 ARCHITECTURAL /SITE PLAN REVIEW to permit the construction of a 253 sq. ft. bedroom addition to an existing non - conforming Bermuda style, one - story, single family dwelling at the location described herein. Vice Chairman Smith advised he has a conflict regarding this matter in that the applicant, Mr. Gardiner, is one of his clients. He stated he will be unable to vote on this application, leaving less than a quorum to take action on this application. The Vice Chairman asked for a motion to defer action on this application to a time certain, that being Friday, May 30, 2014 at 8:30 A.M. Board Member Murphy so moved, Alternate Board Member Kent seconded the Motion and all voted AYE at roll call. VII. REORGANIZATION: A. Election of a Chairman B. Election of a Vice - Chairman Vice - Chairman Smith suggested the deferment of the reorganization until the next meeting, June 26, 2014 at 8:30 A.M., at which time it is expected there will be a full Board present. Alternate Board Member Kent moved to defer the Reorganization to the Regular Meeting to be held on Thursday, June 26, 2014 at 8:30 A.M. Board Member Murphy seconded the motion with all voting AYE. VIII. ITEMS BY STAFF: There were no items from the staff. C\ IX. ITEMS BY BOARD MEMBERS: There were no items 'by the board members. X. It applies equally to members of advisory and non - advisory bodies who are presented with a voting conflict of Interest under Section 112 3143, Florida Statutes. Your responsibllilies under the law when faced with voting on a measure In which you have a conflict of interest will vary greatly depending on whether you hold an elective or appointive position For this reason, please pay close attention to the Instructions on this form before completing the reverse side and filing the form. INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES A person holding elective or appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which Inures to his or her special private gain or loss. Each elected or appointed local officer also Is prohibited from knowingly voting on a mea- sure which inures to the special gain or loss of a principal (other than a government agency) by whom he or she is retained (Including the parent organization or subsidiary of a corporate principal by which he or she is retained); to the special private gain or loss of a relative; or to the special private gain or loss of a business associate. Commissioners of community redevelopment agencies under Sec. 163 356 or 163 357, F , and officers of Independent special tax districts elected on a one -acre, one -vote basis are not prohibited from voting in that capacity For purposes of this law, a "relative" includes only the officer's father, mother, son, daughter, husband, wife, brother, sister, father -in -law, mother -in -law, son -in -law, and daughter -in -law. A "business associate" means any person or entity engaged in or carrying on a business enterprise with the officer as a partner, Joint venturer, coowner of property, or corporate shareholder (where the shares of the corporation are not listed on any national or regional stock exchange). ELECTED OFFICERS: In addition to abstaining from voting In the situations described above, you must disclose the conflict: PRIOR TO THE VOTE BEING TAKEN by publicly staling to the assembly the nature of:yoorfnterest In the measure on which you are abstaining from voting; and WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person responsible for recording the min- utes of the meeting, who should incorporate the forth in the minutes. APPOINTED OFFICERS: Although you must abstain from voting In the situations described above, you otherwise may participate in these matters. However, you must disclose the nature of the conflict before making any attempt to influence the decision, whether orally or in writing and whether made by you or at your direction.
