HomeMy Public PortalAbout05 30 14 Continuation MeetingMINUTES OF THE CONTINUATION OF THE REGULAR MEETING AND PUBLIC HEARING THAT WAS HELD BY THE ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM, FLORIDA, ON THURSDAY, MAY 22, 2014, AT 8:30 A.M., WAS HELD ON FRIDAY, MAY 30, 2014 AT 8:30 A.M. IN THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. Attorney Randolph advised that inasmuch as neither of the Chairman or the Vice Chairman is present, it is necessary that an Acting Chairman be appointed for this meeting. C` Mr. Dockerty moved that Hewlett Kent be appointed Acting Chairman and Mr. Murphy seconded the motion with all voting AYE at roll call. I. Call to Order: Acting Chairman Kent called the meeting to order at 8:35 A.M. II. Roll Call: Present and Hewlett Kent Acting Chairman Participating Malcom Murphy Board Member Robert Dockerty Alternate Board Member Absent with Paul A. Lyons, Jr. Board Member Notice Amanda Jones Board Member Thomas Smith Vice Chairman S. Curtiss Roach Alternate Board Member Also Present and John Randolph Town Attorney Participating William H. Thrasher Town Manager Rita L. Taylor Town Clerk Mark Marsh, Bridges & Marsh Agent for Mr. Gardiner III. Additions, Withdrawals, Deferrals. Arrangement of Agenda Items: There were none. IV. Public Hearing; The Town Clerk administered the Oath to Mr. Mark Marsh, agent for Mr. and Mrs. Gardiner, and asked the Board Members if there had been any ex parte communication. There was none declared. A. Applications for Development Approval 1. An application submitted by Mark Marsh, Bridges, Marsh & Associates, as agent for Robert M. Gardiner owner of property located at 530 Old School Road, Gulf Stream, Florida, legally described as Lot 8, Block 3, Plat No 1 Polo Fields Subdivision for the following: a. SPECIAL EXCEPTION 1 to permit the addition of a 253 sq. ft. bedroom to an existing home that encroaches approximately 3.5 ft. into the east side setback. b. SPECIAL EXCEPTION 2 to permit the addition of a 253 sq. ft. bedroom to an existing home that extends ARPB Regular Meeting & Public Hearing May 30, 2014 approximately 5 ft. into the rear waterfront setback in the Core Design District. C. LEVEL 3 ARCHITECTURAL /SITE PLAN REVIEW to permit the construction of a 253 sq. ft. bedroom addition to an existing non - conforming Bermuda style, one - story, single family dwelling at the location described herein. c; Mr. Marsh was recognized and first presented a photograph of the existing dwelling. He pointed out that it is a Gulf Stream Bermuda style structure with stucco walls and white, flat file roof. He then displayed the site plan showing the area of the proposed project, the southwest comer of the home. He explained that the request is to add a bedroom consisting of 253 square feet which is an extension of the west nonconforming wall of the home. This nonconforming wall encroaches 3.5 feet into the west side setback and will also encroach 5 feet into the rear waterfront setback, matching the existing wing on the southeast corner of the building, he said. He closed his presentation by advising that it will only be necessary to remove one small, nearly dead, tree in the area of the proposed addition and they will be installing foundation plantings around the new addition. Acting Chairman Kent asked if there have been any comments from neighbors and was advised there have been no comments. Mr. Murphy commented that he lilted the balance achieved by adding this matching wing on the rear elevation. There being no further comment, Mr. Murphy moved to recommend approval of a special exception to permit the addition of a 253 square foot bedroom to an existing home that encroaches approximately 3.5' into the west side setback, and further moved to recommend approval of a special exception to permit the addition of 253 sq. ft. bedroom to an existing home that extends approximately 5' into the rear waterfront setback in the Core Design District, and finally moved to recommend approval of Level III Architectural /Site Plan based on a finding that the proposed construction of a 253 sq. ft. bedroom addition to an existing nonconforming Bermuda style, one - story, single family dwelling at the location described herein meet the mimmutn intent of the Design Manual and applicable review standards. Mr. Dockerty seconded all three of Mr. Murphy's recommendations. The Town Clerk explained that she will take a roll call vote on each of the three motions. OMotions to recommend approval of the following: �. SPECIAL EXCEPTION to permit an encroachment of approximately 3.5' into the west side setback All voted AYE at roll call. b. SPECIAL EXCEPTION to permit the 253 sq. ft. addition to extend approximately 5' into the rear waterfront setback in the Core Design District. All voted AYE at roll call. c. LEVEL III ARCHITECTURAL /SITE PLAN based on a finding that the proposed construction of a 253 sq. ft. bedroom addition to an existing non - conforming Bermuda style, one - story, single 3 ARPB Regular Meeting & Public Hearing May 30, 2014 family dwelling at the location described herein meet the minimum intent of the Design Manual and applicable review standards. All voted AYE at roll call. V. ADJOURNMENT. Acting Chairman Kent asked for a motion to adjourn and Mr. Dockerty- so moved, followed with a second by Mr. Murphy with all voting AYE at roll call.
