CALL TO ORDER— Mayor Flora called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Brown, deRyk Jones, Wallace Dee,Vice Mayor Barr, and Mayor Flora. Staff Present: Administrative Services Director Sczcurek, Public Works Director/Town Engineer Wilkins,Town Manager Lashbrook,Town Attorney Morris, Chief Building Official Goetz, Parking Services Manager Beede, Associate Engineer Thompson, Community Development Director McLaughlin,Associate Engineer Bucar, Town Clerk Price,Assistant Town Manager Terrazas, and Records Technician Kuhlemier. � 3. PLEDGE OF ALLEGIANCE— Led by Paco Lindsey. Mayor Flora recognized the passing of former Mayor and Council Member Ron Florian. Announced a memorial at Town Hall on June 21, 2014, stated more information will follow. 4. PUBLIC COMMENT—none. , 5. PRESENTATIONS —none. 6. CONSENT CALENDAR It was moved by Council Member Wallace Dee, and seconded by Council Member Brown, to approve the Consent Calendar as follows: 6.1 Approve the Minutes of April 3, and April 8, 2014 closed session and regular. Vice Mayor Barr abstained from the minutes of April 8, 2014. 6.2 Waive the second reading and adopt Ordinance 2014-05,which amends Chapter 9.13 (discharging a firearm) of the Town of Truckee Municipal Code. 6.3 Adopt Resolution 2014-17 requesting the Nevada County Transportation Commission revise the allocation of Transportation Development Act Funds for Fiscal Year 2013/2014 for the fixed route and paratransit system operations. 6.4 Adopt Resolution 2014-18 authorizing the Town Manager to submit an application for operational assistance through the Federal Transit Administration 5311 program to provide funding for Truckee Transit operations. 6.5 Award the Bridge StreetAt-Grade Railroad Pedestrian Crossing Projectto Four Point Engineering in the amount of$49,459.00 and authorize a 10%contingency amount of $5,000 for a total authorized contract expenditure amount of$54,459. DISCUSSION ITEMS 7.1 STAFF REPORT — Consider taking a "Council" position related to the June Ballot Measure R establishing a '/4 cent sales tax for maintenance and improvement of Truckee's Trails. Recommended Action: Take public comment and,adopt Resolution 2014-11 supporting ballot Measure R that will establish a%4 cent sales tax forthe maintenance and improvement of Truckee Trails. Town Manager Lashbrook presented from the staff report (on file with the Town Clerk). Mayor Flora opened the item for public coraiment. Paco Lindsey, Truckee Trails Foundation and Truckee citizen: • Stated his support of the item. • Stated appreciation in the way the Town and citizens work together for the benefit of the community. • Urged adoption of the resolution. Greg Pasquali, Truckee visitor, stated when he visits Truckee he utilizes the Legacy Trail and supports the measure. Mayor Flora closed public comment. The Staff recommendation was moved by Vice Mayor Barr, seconded by Council Member Brown, and carried with the following vote: 6:25:32 PM Ayes: Council Member Brown, Council Member Wallace Dee, Council Member deRyk Jones, Vice Mayor Barr and Mayor Flora. Noes: None. Absent: None. Abstain: None. The motion passed unanimously. 7.2 STAFF REPORT — Truckee Railyard Downtown Corridor Improvement Project — Transportation Investment Generating Economic Recovery Discretionary Grant. Recommended Action: Adopt Resolution 2014-20 requesting Transportation Investment � .� Generating Economic Recovery Discretionary Grant funding from the Department of Transportation for the Truckee Railyard Downtown Corridor Improvement Project. Vice Mayor Barr recused herself based on business interest in the project site. ,. Town of Truckee ' April 22, 2014 Town Council Regular Page 2 1 Public Works DirectorITown Engineer Wilkins presented information from the staff report. • Requested the staff recommendation be modified to change Resolution 2014-20 to show $2.5 million dollars instead of$3 million, and move$500 thousand to the Tig'er request. Council Discussion: • The Town can have the project ready for construction in two years, five hundred thousand can make the grant more competitive. Mayor Flora opened the item for public comment. Greg Pasqualli, Truckee Development Associates, said this was the fourth year the team has pursued funding for this grant. Stated the development has components of the criteria for the grant application. Council Direction: , • fVlodify Resolution 2014-20 to show 2.5 million dollars instead of$3 million, and move $500 thousand to the'Tiger request. Mayor Flora closed public comment. The Staff recommendation with modifications was moved by Council Member Wallace Dee,seconded by Council Member deRyk Jones,and carried with the following vote: 6:34:56 PM Ayes: Council Member Brown, Council Member Wallace Dee, Council Member deRyk Jones, and Mayor Flora. Noes: None. Absent: None. Abstain: Vice Mayor Barr. The motion passed 4-0. 7.3 STAFF REPORT—Adoption of the Mitigated Negative Declaration for the Trout Creek Trail Project Capital Improvement Project 60-10-06. Recommended Action: Receive and consider public comments on the Mitigated Negative Declaration; and adopt Resolution 2014-19 adopting the Mitigated Negative Declaration for the Trout Creek Trail Project. Associate Engineer Thompson and Associate Planner Endres presented information from the Staff report(presentation on file with the Town Clerk). Council Discussion: • Soils testing will occur next week. o Cultural Resource report in"surface scatter"revealed non extensive dumping at the Trout Creek Dump Area which occurred in the 1930s and 1940s. • Truckee Sanitation District did not find anything in the area when the sewer line was constructed. • Phase one is scheduled for this summer and phase two is planned for next year. • In the next couple months the alignment in phase two will be worked out. • Property owner concerns will be addressed in the design phase. Dennis Dickinson, Truckee resident, reiterated 'concerns on a possible burn dump (public comment on file with the Town Clerk). ' Allison Pedley, Truckee Trails Foundation, stated support of the item. Mayor Flora closed public comment. Council Discussion: • The soils report will determine a burn dump on site and Nevada County Environmental � Health Department will provide direction. Council Direction: , • Modification to section 4-C. The Town will complete an updated survey for rare plants. If a rare plant is identified, the Town will transplant or realign the trail per Fish and Game regulations. • Modification to section 4-D.A preconstruction survey in Phase II will be completed for identification of the Fly Catcher(species of bird). If the Fly Catcher is identified and willows need to be removed they will be replaced in the project area to maintain the habitat. • Modification to section 8; modify text changes as outlined in staff report. • Modification to section 8-A to address public comments. The Town will add a testing component for possible air quality issues per the comments. If there is an issue the soil will be removed or covered with clean soil.The Town will work with Nevada County Environmental Health Department. • Modification to section. Add an air quality and dust management plan permit. - The Staff recommendation with amendments was moved by Council Member Wallace Dee, seconded by Vice Mayor Barr, and carried with the following vote: 7:24:33 PM � Ayes: Council Member Brown, Council Member Wallace Dee, Council Member deRyk Jones, Vice Mayor Barr and Mayor Flora. Noes: None. Absent: None. � Abstain: None. The motion passed unanimously. 7.4 STAFF REPORT — Bond Expenditure Agreement with the Truckee Redevelopment Successor Agency. Recommended Action: Approve Resolution 2014-22 authorizing the Town Manager to . execute a Bond Expenditure Agreement between the Town of Truckee and the Town of Truckee Redevelopment Successor Agency. Council Member Brown recused himself based on the proximity of his business to the project site. � Assistant Town Manager Terrazas presented information from the staff report (on file with the Town Clerk). Town of Truckee � April 22, 2014 Town Council Regular Page 4 � � Council Discussion: • The Oversight Board discussed their role in the process, and came to the conclusion that moving forward they would be approving the ROPS and not projects. The ROPS would be based on bond expenditures, which are governed by the bond covenants. • In �order to do the transfer of authority, the Town has to be approved through the Department of Finance which could take from 30 days to a few months. Mayor Flora ` � • Attended the Forest Service and Burea� Reclamation meeting. • Attended a regional meeting with the Town Manager, Placer County Fifth District Supervisor and Placer County Chief Executive Officer. • Attended,with Council Member deRyk Jones,the workshop for the Trails and Bikeways Master Plan Update on April 16, 2014. , ' 9.
