HomeMy Public PortalAboutOrd 1171ORDINANCE NO. 1171 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE, CALIFORNIA, ADDING CHAPTER 15.86 (EXPEDITED ELECTRIC VEHICLE CHARGING STATION PERMITTING) TO TITLE 15 (BUILDINGS AND CONSTRUCTION) OF THE RANCHO MIRAGE MUNICIPAL CODE TO ESTABLISH PROCEDURES FOR EXPEDITED PERMIT PROCESSING FOR ELECTRIC VEHICLE CHARGING SYSTEMS WHEREAS, the City of Rancho Mirage ("City") is a charter city and recognized for purposes as a political subdivision of the State of California; and WHEREAS, the State of California adopted Assembly Bill 1236 ("AB 1236"), which added Section 65850.7 to the California Government Code, which requires local agencies to adopt an ordinance that creates an expedited and streamlined permitting process for electric vehicle charging systems; and WHEREAS, AB 1236 requires the City Building Official to approve a complete application for installation of electric vehicle charging stations which meet specified standards in the City's checklist, through issuance of permit unless the City makes specified written findings based upon substantial evidence that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact; and WHEREAS, AB 1236 further allows applicants to appeal the Building Official's determination to the City's Planning Commission; and WHEREAS, the creation of an expedited, streamlined permitting process for electric vehicle charging stations would facilitate convenient charging of electric vehicles and help reduce the City's reliance on environmentally damaging fossil fuels. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE, CALIFORNA, DOES ORDAIN AS FOLLOWS: Section 1. RECITALS That the above Recitals are true and correct and are incorporated as though fully set forth herein. Section 2. TITLE, WORDS AND PHRASES That this Ordinance shall be known as the City of Rancho Mirage Electric Vehicle Charging Station Permit Expediting Ordinance. The terms, phrases, and words used in this Ordinance shall be construed in compliance with the definitions set forth by California Government Code Section 65850.7. Section 3. ADDING CHAPTER 15.86 (EXPEDITED ELECTRIC VEHICLE CHARGING STATIONS PERMITTING) TO TITLE 15 (BUILDINGS AND CONSTRUCTION) OF THE RANCHO MIRAGE MUNICIPAL CODE That Chapter 15.86 (Expedited Electric Vehicle Charging Stations Permitting) is hereby added to Title 15 (Buildings and Construction) of the Rancho Mirage Municipal Code as follows: 15.86 Expedited Electric Vehicle Charging Station Permitting 15.86.10 Purpose The purpose of this Chapter is to establish an expedited, streamlined Electric Vehicle Charging Station permitting process that complies with California Government Code Section 65850. 7, to achieve timely and cost-effective installation of such stations. 15.86.20 Definitions All terms, phrases, and words used or referenced in this Chapter shall, for purposes of this Chapter, have the same meanings ascribed to them in California Government Code Section 65850. 7. 15.86.30 Expedited Review Process Established Consistent with Government Code Section 65850. 7, and in accordance with this Chapter, the City shall implement an expedited administrative permit review process for Electric Vehicle Charging Stations and adopt a checklist of all requirements with which Electric Vehicle Charging Stations shall comply in order to be eligible for expedited review. 15.86.40 Permit Application Processing A permit application that satisfies the information requirements in the City's adopted checklist, shall be promptly processed. Upon confirmation by the Building Official that the permit application and supporting documents meet the requirements of the City adopted checklist, and is consistent with all applicable local, state and federal laws, rules and regulations, the Building Official shall, consistent with Government Code Section 65850. 7, approve the application and issue all necessary permit(sJ. Such approval does not authorize an applicant to energize or utilize the Electric Vehicle Charging Station until approval is granted by the City. If the Building Official determines that the permit application is incomplete, he or she shall issue a written correction notice to the applicant, detailing all deficiencies in the application and any additional information required to be eligible for expedited permit issuance. 15.86.50 Ground for Denial; Use Permit 2 The Building Official may deny a permit upon findings that the Electric Vehicle Charging Station could have a specific, adverse impact upon the public health or safety, as defined in Government Code 65850. 7. If the Building Official finds, based upon substantial evidence, that the Electric Vehicle Charging Station could have a specific, adverse impact upon the public health or safety, the City may require the applicant to apply for a use permit, which shall not be denied unless it makes written findings based upon substantial evidence that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact, in accordance with Government Code Section 65850. 7(b) and (c). 15.86.60 Appeal The Building Official's decision may be appealed to the City's Planning Commission. Section 4. ELECTRONIC SUBMITTAL$ That consistent with Government Code Section 65850.7, the Building Official shall allow for electronic submittal of permit applications covered by this Ordinance and associated supporting documentations. In accepting such permit applications, the Building Official shall also accept electronic signatures on all forms, applications, and other documentation in lieu of a wet signature by any applicant. Section 5. EXPEDITED REVIEW ELIGIBILITY CHECKLIST That the City hereby adopts the checklist set forth in Attachment A, incorporated herein by this reference, with which Electric Vehicle Charging stations shall comply to be eligible for expedited review. Section 6. ASSOCIATION APPROVAL That consistent with Government Code Section 65850.7, the Building Official shall not condition the approval for any Electric Vehicle Charging station permit on the approval of such a system by an association, as that term is defined by Civil Code Section 4080. Section 7. CITY ATTORNEY REVIEW That the City Attorney prepared and framed this Ordinance pursuant to Section 1.04.010 of the Municipal Code and finds that the City Council has the authority to adopt this Ordinance, that the Ordinance is constitutionally valid and that the Ordinance is consistent with the general power and purposes of the City as set forth in Section 1.04.031 of the Municipal Code. 3 Section 8. SEVERABILITY That the City Council declares that, should any provision, section, paragraph, sentence or word of this Ordinance be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this Ordinance as hereby adopted shall remain in full force and effect. Section 9. REPEAL OF CONFLICTING PROVISIONS That all the provisions of the Rancho Mirage Municipal Code as heretofore adopted by the City of Rancho Mirage that are in conflict with the provisions of this Ordinance are hereby repealed. Section 10. EFFECTIVE DATE That this Ordinance shall take effect on the 30th day following its second reading by the City Council. Section 11. CERTIFICATION That the City Clerk shall certify to the passage hereof, and cause it to be posted as required by law.
