AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE,
CALIFORNIA, ADDING CHAPTER 15.86 (EXPEDITED ELECTRIC VEHICLE
CHARGING STATION PERMITTING) TO TITLE 15 (BUILDINGS AND
CONSTRUCTION) OF THE RANCHO MIRAGE MUNICIPAL CODE TO ESTABLISH
PROCEDURES FOR EXPEDITED PERMIT PROCESSING FOR ELECTRIC VEHICLE
CHARGING SYSTEMS
WHEREAS, the City of Rancho Mirage ("City") is a charter city and recognized for
purposes as a political subdivision of the State of California; and
WHEREAS, the State of California adopted Assembly Bill 1236 ("AB 1236"), which
added Section 65850.7 to the California Government Code, which requires local agencies
to adopt an ordinance that creates an expedited and streamlined permitting process for
electric vehicle charging systems; and
WHEREAS, AB 1236 requires the City Building Official to approve a complete
application for installation of electric vehicle charging stations which meet specified
standards in the City's checklist, through issuance of permit unless the City makes
specified written findings based upon substantial evidence that the proposed installation
would have a specific, adverse impact upon the public health or safety, and there is no
feasible method to satisfactorily mitigate or avoid the specific, adverse impact; and
WHEREAS, AB 1236 further allows applicants to appeal the Building Official's
determination to the City's Planning Commission; and
WHEREAS, the creation of an expedited, streamlined permitting process for
electric vehicle charging stations would facilitate convenient charging of electric vehicles
and help reduce the City's reliance on environmentally damaging fossil fuels.
