AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER
18, SECTION 72 OF THE CITY CODE TO ADD THE OFFENSE OF TRESPASS IN THE
SECOND DEGREE.
NOW BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. Chapter 18 (MISCELLANEOUS PROVISIONS AND OFFENSES)
Article V (OFFENSES INVOLVING PROPERTY DAMAGE OR TRESPASS) Section 72
(TRESPASS) is amended by adding Section B to read as follows:
Sec. 18-72. Trespass.
A. Trespass in the First Degree
1. A person commits the offense of trespass if he or she knowingly enters unlawfully or
knowingly remains unlawfully in a building or inhabitable structure or upon real
property.
2. A person does not commit the offense of trespass in the first degree by entering or
remaining upon real property unless the real property is fenced or otherwise enclosed in
a manner designed to exclude intruders or as to which notice against trespass is given by:
i. Actual communication to the actor; or
ii. Posting in a manner reasonably likely to come to the attention of intruders.
B. Trespass in the Second Degree
1. Aep rson commits the offense of trespass in the second dep_ree if he or she enters
unlawfully upon real property of another. This is an offense of absolute liability.
2. Trespass in the second de ree shall be punished by a fine not exceeding Live hundred
dollars$50( 0.00).
Section 2. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
