Case No. P21008 - A Replat of Lot 11 and Lot 1-A of Capital Mall Subdivision. Application filed
by Capital Mall J.C. 1 LLC to replat Lot 11 and Lot 1-A for the purpose of dividing Lot 11 into three
separate lots (Lot A, Lot B, and Lot C) and placing a portion of Lot 1-A into newly made Lot 11-A
(Starbucks location) and Lot 11-C (future development). Both Lot 11 and Lot I -A are east of the West
Truman Boulevard and Country Club Drive intersection. The property is described as Lot I 1 and Lot I-
A of Capital Mall Subdivision Jefferson City, Cole County, Missouri. Central Missouri Professional
Services, Inc.(consultant).

A. Private Street Name Proposal: An application has been submitted by the Jefferson City School
District for the creation of 2 private street names for driveway additions off of Thomas Jefferson
Middle School / Lawson Elementary Driveway located at Fairgrounds Road/West Edgewood
Drive. The main new drive is proposed as Patriot Drive and the other road would be named Lion
Way.

1. Call to Order and Introduction of Members, Ex -officio Members and Staff
Vice Chair Penny Quigg called the meeting to order. Five regular members and two alternates were
present. A quorum was present.
Designation of Voting Alternates
The Vice Chair announced that all regular members present and alternate Ms. Gampher are eligible to
vote. Alternate Ms. Hawk joined virtually, but video was unavailable, so she was not able to vote.
2. Procedural Matters and Procedures Explained
Mr. Barron explained the procedures for the meeting. The following documents were entered as
exhibits. Mr. Barron advised that copies of the exhibits are available through the City Clerk or the
Department of Planning and Protective Services:

3. Adoption of Agenda
Ms. Cotten moved and Mr. Record seconded to reorder the agenda to move case P21007 ahead of
Case P21006. The motion passed 5-0 with the following votes:

4. Approval of the Regular Meeting Minutes of May 13, 2021.
Ms. Cotten moved and Mr. Butler seconded to approve the regular meeting minutes of May 13, 2021

5. Communications Received
Communications packets, pertaining to Case P21006 Comprehensive Plan Update, were sent to
Commission members prior to the meeting.
6. Other New Business
Case No. P21007 — Schotthill Woods Subdivision Section Five, Final Subdivision Plat. Request
filed by Schotthill Woods Corporation, property owner, for a Final Subdivision Plat of 7.01 acres
consisting of 1 lot. The property is zoned PUD Planned Unit Development and is located on the north
side of Schotthill Woods Drive 1400 feet east of Eastland Drive and is described as part of the
Northwest Quarter and the Southwest Quarter of Section 21, Township 44 North, Range 11 West, and
part of Lot 62 of Schotthill Woods Subdivision, Jefferson City, Cole County, Missouri.
Mr. Barron stated the proposal is for the approval of a Final Subdivision Plat within the Schotthill
Woods development along Schotthill Woods Drive. The final plat would create one lot with existing
frontage on Schotthill Woods Drive.
Mr. Wade gave his staff report and stated that most infrastructure was already in place and would
recommend approval, subject to minor technical corrections being addressed on documents prior to
the final plat being considered by the City Council.
Mr. Keith Brickey, 2500 East McCarty, with Central Missouri Professional Services presented his case.
He stated the reason for the subdivision and final plat is the clean up an association and dissolve a
partnership.
Mr. Barron stated the final subdivision plat meets the requirement for subdivision plats as outlined
within the subdivision code. He noted that the correction of minor technical details, as identified by City
Staff will need to be addressed as well as submittal of a signed plat document prior to placement on
the City Council Agenda.
Mr. Deeken moved and Ms. Cotton seconded to approve the Final Subdivision Plat of Schotthill Woods
Subdivision, Section Five, subject to comments and technical corrections of the Planning and
Engineering Divisions. The motion passed 5-0 with the following votes:

7. New Business/Public Hearings
Case No. P21006 — Adoption Activate Jefferson City 2040, Comprehensive Plan Update.
Request filed by City Staff for the consideration of Activate Jefferson City 2040, an update of the 1996
Jefferson City Comprehensive Plan. Activate Jefferson City 2040 outlines goals and
recommendations to strengthen quality of life within Jefferson City and update the Future Land Use
Map.
Ms. Nanoski and Ms. Lewis gave a presentation of the 2040 Comprehensive Plan.
Mr. Glover Brown, 1700 Valley Hi Rd, spoke to Commission members about his views on the
Comprehensive Plan. He requested that City staff and Commission member add something about the
history of Black Americans on Jefferson City.
Mr. Record moved and Mr. Butler seconded to approve the resolution to adopt Activate Jefferson City
2040 as the updated comprehensive plan for the City of Jefferson. The motion passed 5-0 with the
following votes:
Aye: Deeken, Cotton, Record, Butler, and Gampher
Nay: None
8. Other Business
Appointment of P&Z Liaison to the Historic Preservation Code Revision Committee
Ms. Senzee greeted the committee and expressed the need for a member of the Planning and Zoning
Commission to serve as a liaison on the Historic Preservation Code Revision Committee.
Mr. Deeken moved and Mr. Record seconded to have Ms. Cotton serve as the liaison to the Historic
Preservation Code Revision Committee and Mr. Butler to serve as the alternate. The motion passed 5-
0 with the following votes:
Aye: Deeken, Cotton, Record, Butler, and Gampher
Nay: None
Virtual Meetings
Mr. Barron announced that this meeting would be the last meeting with the virtual option available.

Case No. P21008 — A Replat of Lot 11 and Lot 1-A of Capital Mall Subdivision
Request filed by Capital Mall J.C. 1 LLC, owner, for the a replat of Lot 11 into three separate lots
(thus proposing formation of a Lot 11-A, Lot 11-B, and Lot I 1-C). There would also be
modification of Lot I -A where a portion of Lot I -A would be added into suggested Lot 11-A and
Lot 11-C of the Capital Mall Subdivision. Then the remainder of Lot 1-A would become Lot 1 -A-
l. Both Lot 11 and Lot I -A are east of the West Truman Boulevard and Country Club Drive
intersection. The property is described as Lot 11 and Lot 1-A of the Capital Mall Subdivision,
Jefferson City, Cole County, Missouri. Central Missouri Professional Services, Inc. (consultant).
Property Description
Acreage: The Capital Mall Subdivision consists of several lots (totaling 55.2 acres)
including Lot 11 which is 0.65 in acreage and Lot 1-A which is 21.32 in acreage.
History: The Capital Mall was developed in the late 1970's, but was never formally
divided into lots and outlots. A development agreement approved by the City Council in 2013
permitted the property owner to divide the property into several lots based on existing tax parcel
boundaries and outlined a plan that would require the owner to submit a formal subdivision plat at
a future date. A Special Exception Permit and rezoning plan approved by the Planning and Zoning
Commission in 2015 outlined the creation of several additional outlots and a final subdivision plat
was approved in 2017.
Previous Cases
Cases involving the Capital Mall Subdivision include:
BOA:
B20006 The Board approved a variance for the proposed Lot 1-B and the proposed Lot I I -
C with the requirement that lots have to have frontage on a public street. A variance permitting the
proposed Lot 1-B to be platted around the existing building at a zero lot line setback was also
approved.
P&Z:
P15001 The Commission approved for the rezoning of the 3600 Block of Country Club
Drive and the 3700 Block of West Truman Boulevard from C-1 Neighborhood Commercial to C-
2 General Commercial (excluding lot 6). A Special Exception Use Permit for these two same
blocks was also approved. Additionally, these blocks were granted approval for a preliminary
subdivision plat with a condition that gave a street frontage variance for Lot 3 and Lot 4.
P17002 A Final Subdivision Plat of the Capital Mall Subdivision was approved for the
3600 Block of Country Club Drive.
P20006 This case involved the approval of a Replat of Lot 1 of the Capital Mall
Subdivision as well as the approval for the requested variance from the Subdivision Code
requirement that all lots have street frontage to permit Lot 1-B to have no street frontage.
Board of Adjustment Action
The division of Lot 11 would result in a lot without street frontage (11-C) which is a requirement
of both the Subdivision Code as well as the Zoning Code. A variance to the zoning code
requirement was scheduled to be heard and was approved by the Board of Adjustment on Tuesday,
October 13, 2020.

Private Street Name Proposal — Lion Way and Patriot Drive
The Jefferson City School District has applied for new names to be given to two private streets
east of the Fairgrounds Road and West Edgewood Drive intersection. Thomas Jefferson Middle
School would be connected to West Edgewood through the newly proposed street to be named
Patriot Drive and Lawson Elementary School would be connected to Patriot Drive by means of a
new street to be called Lion Way.
Zoning and Land Use:
Current Zoning: RA -1 Residential High Density
Current Subject Lot Use: Within the property where the new street names have been
proposed are two schools and a day care center that would be directly impacted by the creation of
the two new streets.

Chapter 25, Planning and Development
Sec. 25.33
A. Street names shall be easy to read and pronounce so that the public, and children In
particular, can manage the name in emergency situations.
B. All street names in exact or approximate alignment with existing named streets shall bear
the names of such existing named street. All other street names shall be assigned
names which do no not conflict with names of existing streets within the 911 dispatch
area.
C. Names of private and public streets and rights-of-way shall be established by the Council
after review by the Planning and Zoning Commission.
D. It shall be unlawful for any owner or occupant of any structure or parcel to which an
official public or private street name has been assigned to use any other name or
temporary name,
E. The City Administrator shall cause signs to be erected to mark the locations of public and
private streets. Private street name signs shall be different in color from those used on
public streets.
F. The City Administrator may retire street names or disallow certain spellings, due to over-
use or if proposed use of a particular name or spelling would be confusing. The list of
retired street names shall be published in the guidelines.
Sec. 25-34. Street Name Change
A. The process to change the name of a street, public right-of-way or private street shall be as
outlined in this Section.
(1) City staff may initiate a request to change a street name by filing an application with
the Planning and Zoning Commission
(2) A majority of property owners along a street may propose that the name of the street
be changed by filing a Petition signed by a majority of the property owners along the
street to the Planning and Zoning Commission. A filing fee shall be required for a
Petition to change the name of a street. This fee shall be paid at the time the petition
Is submitted to the city. The purpose of the fee is to cover the cost to process notices
and shall be non-refundable. The fee shall be set out In Appendix Y.
B. All property owners abutting the street proposed to be renamed shall be notified of the
application or petition to change the street name, and the date of public hearing before the
Planning and Zoning Commission at least 10 days prior to the hearing date. A notice of public
hearing shall be published in a newspaper of general circulation in the city at least fifteen (15)
days prior to the public hearing.
C. The Council, after receiving a recommendation from the Planning and Zoning Commission,
shall hold a public hearing to consider the name change. Notice of public hearing shall be
published once in a local newspaper of general circulation at least fifteen (15) days prior to the
hearing. Following the Council's public hearing, the Council may, by ordinance, change the
name of the street.
D. Upon the passage of an ordinance changing the name of a street.
(1) a notice that the name of the street has been changed shall be mailed to each
property owner and delivered to each building unit; and
(2) a notice shall be published In a newspaper of general circulation In the city at least
once per week for four (4) consecutive weeks; and
(3) the city clerk shall file with the recorder of deeds of the appropriate County a certified
copy of the ordinance; and
(4) new street name signs shall be erected as soon as practical following the passage of
the ordinance, or upon the effective date of the change, whichever is applicable. Both
new and previous street name signs may be displayed for one year if it serves the
public interest.
