Dale ot Adoption~[IJly__l~2001 APPROVING A MEMORANDUM OF AGREEMENT- LIGHT DUTY GRIEVANCE WHEREAS, the Carteret PBA Local #47 and Carteret/SOA filed grievance 00-03 and 00-06 on behalf of patrolman James Hart and Lieutenant David LaPoint ("Grievants"), respectively, with regard to the application of a "light duty" policy within the police department; and WHEREAS, the Mayor and Council and the PBA LocaI #47 and the Carteret/SOA have agreed upon an amicable of said grievances to avoid the cost and effort associated with further proceedings with regards to the same. NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the Borough of Carteret as follows: 1. The Memorandum of Agreement between the parties is hereby approved. 2. The Mayor and appropriate Borough officials are authorized to execute the same in a form acceptable to the Borough Attorney. Adopted this 19th day of July, 2001 and certified as a true copy of the original on July 20, 2001. KATHLEEN M. BARNEY, RMC/CMC Municipal Clerk RECORD OF COUNCIL VOTE X - Indicate Vote AB - Absent NV - Not Voting XOR - Inclicalcs Vote to Overrule Veto Adopted at a meeting of the Municipal Council MEMORANDUM OF AGREEMENT ~VHEREAS, the Carteret PBA Local #47, and Carteret/SOA filed grievancc 00- 03 and 00-06 on behalf of Patrolman James Hart and Lieutenant David LaPoint (the "Grievants") respectively, with regard to the application of a "light duty" policy within the police department; and WHEREAS, said grievances have initially been denied; and WHEREAS, the Mayor and Council and Carteret PBA Local # 47 and Carteret/SOA have agreed upon an amicable settlement of said grievance. NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS: 1. Patrolman James Hart shall be reimbursed eight (8) sick days; Lieutenant David LaPoint shall be reimbursed one (1) sick day. 2. This Memorandum of Agreement resolves all issues outstanding between the parties with regard to the above referenced grievances. 3. The settlement of these grievances shall not constitute, nor be claimed to represent, evidence of a "past practice" or form the basis of any further grievance by any member of the Carteret PBA Local # 47 or the Carteret/SOA. 4. The settlement of this grievance shall not constitute an admission on the part of the Borough of Carteret with regard to the validity of any claims being asserted pursuant to the above referenced grievances.
