HomeMy Public PortalAbout19 Railyard Artist Loft Downtown Specific Plan AmendmentTOWN OF TRUCKEE California RESOLUTION 2016-19 AA RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE APPROVING AMENDMENTS TO THE DOWNTOWN SPECIFIC PLAN WHEREAS, the Town of Truckee has adapted minor amendments to the Truckee Railyard Master Plan with Town Council Resolution 2016-18; and WHEREAS, the adoption of minor Truckee Railyard Master Pian amendments calls for amendments to the Downtown Specific Plan to maintain consistency between the Downtown Specific Plan and the Master Flan; and WHEREAS, amendments to the downtown Specific Plan require legislative action by the Town Council, and the Planning Commission is charged with the responsibility of reviewing the amendments and forwarding to the Town Council a recommendation for the approval or denial of the amendments to the Downtown Specific Plan; and WHEREAS, the Town of Truckee Planning Commission, at a duly noticed public hearing on April 19, 2016, adopted Resolution 2016-03 recommending approval of minor Truckee Railyard Master Plan amendments, Downtown Specific Plan amendments and a Development Permit for the construction of the Truckee Artist Lofts, a 4 -story, 121.000 sf. 77 unit multi -family housing project with 66 income --restricted rental apartments and 11 market -rate rental units, 45 on-site parking spaces, and 3,855 sf. of ground floor commercial on APN: 19-420-71 within the Downtown Extension (DE) District of the Truckee Railyard Master Plan and adopting findings in support of such actions; and WHEREAS, on or about April 8, 2016 and April 29, 2016, a public notice was published in the Sierra ,Suri and mailed to property owners within 500 feet of the project site and all other interested persons informing the public of the date, time, and location of the public hearing for the Council's consideration of minor Master Plan amendments, amendments to the Downtown Specific Plan, Development Permit and EIR Addendum; and WHEREAS, the Council held a public hearing on the matter at meetings on May 10, 2016. and WHEREAS, the Town Council has completed and certified a Final Environmental Impact Report in compliance with the California Environmental Quality Act Statutes and Guidelines and reviewed and considered the information contained in the Final EIR. The Council made the findings required by Section 15091 of the California Environmental Quality Act Guidelines; these findings are set forth in Exhibit C of Council Resolution 2009-32, adopted by the Council on June 10, 2009, The Council has eliminated or substantially lessened all significant effects on the environment where feasible as shown in the findings of Resolution 2009-32 and determined that any remaining significant effects on the environment found to be unavoidable are acceptable due to overriding concerns and considerations as described in the findings of Resolution 2009-32; and Resolution 2016-19 Page 1 WHEREAS, the Council adopted Resolution 2009-32 thereby certifying the Final Environmental Impact Report and finding that the approval of the amendments to the Downtown Specific Flan will not have a significant effect on the environment upon incorporation of mitigation measures into the project; and WHEREAS, the Council duly considered the Final Environmental Impact Report, any and all information and public comments, and the recommendation of the Planning Commission as set forth in their Resolution 2009-03; and WHEREAS, An Environmental Impact Report (EIR) Addendum was prepared in conjunction with the Truckee Artist Lofts application in support of the associated minor Master Plan Amendments and the Addendum concludes that that there are no new environmental impacts: and NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee hereby amendments the Downtown Specific Plan as set forth in Exhibit "A" attached hereto and incorporated herein, BE IT FURTHER RESOLVED, the Council hereby adopts the findings set forth in Exhibit "B", attached hereto and incorporated herein, in support of amending the Downtown Specific Plan. BE IT FURTHER RESOLVED, the applicant shall defend, indemnify, and hold harmless the Town and its agents, officers, and employees from any claim, action, or proceeding against the Town to attack, set aside, void, or annul the certification of the Final EIR and/or actions of the Town Council utilizing the findings set forth in this ordinance, which claim, action, or proceeding is brought within the time period provided for by State law. The foregoing Resolution was introduced by Council Member Barr, seconded by Council Member Wallace Dee, at a Regular Meeting of the Truckee Town Council, held on the 90�h day of May, 2096 and adopted by the following vote: AYES: Council Member Barr, Council Member Wallace Dee, Council Member Flora, Vice Mayor Goodwin, and Mayor deRyk Jones. Area_ RescrILItion 2016-19 Page 4 Town Council Resolution 2016-19 EXHIBIT B Findings Downtown Specific Plan A. The proposed amendments to the Downtown Specific Plan ensure and maintain internal consistency with all of the goals, policies, and actions of all elements of the General Plan and the Downtown Specific Plan. This finding is supported by the discussion contained in the "General Plan Consistency, " 'Downtown Specific Plan Consistency, " of the May 27, 2009 Planning Commission staff report. The amendments are miner and will ensure consistency with the proposed Master Plan amendments. This finding is further supported in the findings contained within the April 19, 2016 Planning Commission meeting minutes, Town Council resolution 2016-18 and Resolution 2016-20 and May 10, 2016 Town Council meeting minutes. B. The proposed amendments to the Downtown Specific Plan will not be detrimental to the public interest, health, safety, convenience, or welfare of the Town. This finding is supported by Final Environmental Impact Report Volumes 1, and 11, dated November 2008 and Volume Ill dated May 2009 and the Addendum dated April 2016 and also in the -Discussion/Analysis" section of the April 19, 2016 Planning Commission staff report. This finding is further supported in the findings contained within the April 19, 2016 Planning Commission meeting minutes, Town Council Resolution 2016-18 and Resolution 2016-20. A. The approval of the amendments to the Downtown Specific Plan complies with the California Environmental Quality Act (CEQA) (Pub. Resources Code, § 21000, etseq.) and the CEQA Guidelines (Gal. Code Regs., tit. 14, § 15000 et seq.). The project will not have significant effects on the environment (as defined in Pub. Resources Code, § 29068) after implementation of the Mitigation, Monitoring and Reporting Plan (MMRP), other than those Significant and Unavoidable effects addressed by the Statement of Overriding Considerations. The proposed amendments as detailed in Exhibit A will not result in any substantial modifications that will allow significantly different or new development than what is currently allowed under the Specific Plan. A Final EIR and Addendumn have been completed in accordance with the requirements of the CEQA Statutes and Guidelines.
