FIRST READING OF ORDINANCE NO. 89 -1 AN ORDINANCE OF THE TOWN COMMISSION AMENDING THE TOWN COMPREHENSIVE ZONING ORDINANCE AT SECTION VII— "R.S ". RESIDENTIAL SINGLE — FAMILY DISTRICT. PARAGRAPH (N) TO ADD A NEW SUBPARAGRAPH (4) LIMITING THE NUMBER OF KITCHENS IN SINGLE — FAMILY PRIMARY DWELLINGS TO ONE (1). 7, FIRST READING OF ORDINANCE NO. 89 -2 AN ORDINANCE AMENDING ORDINANCE NO. 83 -1. Clark Approval of Minutes Mayor Vice -Mayor Commissioner CommLissioner Commissioner Town Manager Town Clerk Town Attorney Cha =tan, Planning & Zoning Board Chief of Police Captain, Police Department Code Enforcement Officer Director of Planning, Resource Engineering & Planning,Inc On motion duly made and seconded the Minutes of the December 9, 1989 meeting were approved. Financial Report Mr. Gwynn reported 87% of the tax roll has been collected and invested in Money Market accounts. Mr. Gwynn also gave the tax projection, revenue and expenditure and year -to -date reports noting the extraordinary legal expenses. On motion duly made and seconded the Finance Report was accepted as presented by the Conmission. Mr. Gwynn spoke on Labor Attorney fees the Town is obligated to pay for police department legal expenses. Discussion ensued on these and possible anticipated legal expenses for collective bargaining. Mr. Gwynn noted a request by Chief Greer to attend a leadership training school in Sarasota. Mr. Gwynn denied this request. Discussion ensued on Officer Certification. Chief Greer stated this requirement has been in Town Commission Meeting January 13, 1989 Minutes Page Two C 3. (continued) effect two years and four officers have not completed re- training. Chief Greer stated Officer Peterson has his. 4. Police Report Chief Greer gave the Police Department report for the month of December. Request by Mr. Perry O'Neal to place an entry wall over a Section of the road right -of -way at 588 Banyan Road. Mr. Mayer stated the Planning & Zoning Board approved this request with a Stipulation. Mr. Randolph reported he received the Agreement from the Petitioner's attorney, as required in the Stipulation, in recorable form. On motion duly made and seconded the Town Commission accepted the recommendation of the Planning & Zoning Board to approve this request with said Stipulation Agreement as approved by the Town Attorney. 6. Mr. Randolph read the Title of the Town of Gulf Stream Ordinance No. 89 -1 as follows: AN ORDINANCE OF THE TOWN OCIMMISSION OF THE TOM OF GULF STREAM, PALM BEACH OOUNTY, FLORIDA, C_ AMENDING ORDINANCE 83 -1, THE OFFICIAL ZONING ORIDNANCE OF THE TOWN, SO AS T'0 PROVIDE FOR AN AMENDMENT TO SECTION X C (5), WHICH AMENDMENT SHALL PROVIDE THAT ALL REAL ESTATE SIGNS SHALL BE OF WHITE BACKGROUND WITH BLACK LETTERING; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR OODIFICATION; AND PROVIDING AN EFFECTIVE DATE. Discussion ensued on the definition of "kitchen ". On request of Commissioner Armour, Mr. Randolph will provide the definition of "kitchen ". Discussion ensued on procedure for adopting Ordinances i.e. Public Hearings, advertising, costs, etc. i Town Commission Meeting January 13, 1989 Minutes Page Three 7. (continued) 0 on motion duly made and seconded the Commission approved a motion stating Zoning is in progress and no Permits are to be issued in contravention of ordinances 89 -1 and 89 -2. of Gulf Stream Can Mr. Clark spoke on the purpose of this meeting; to provide additional input on the draft of the Comprehensive Plan. Commissioner Stahl spoke on the Sea Road extension right -of -way as not having been legally resolved. Based on what is known, it can be considered public access to the beach. Mr. Clark responded it can be counted as beach access. Mayor Koch noted the Town will not de -annex anything but our Master Plan gives us the ability to annex adjacent property to comply with the Conclave Act. Mr. Clark outlined State procedure noting the Town Plan will be filed by February 1, 1989 and, after ninety days, will be returned to the Town for review and response. on motion duly made and seconded the Commission approved transmittal of the Town of Gulf Stream Master Plan to the State of Florida. 9. Commission Comments Mr. Gwynn read a letter addressed to himself from Mayor Koch. A copy of said letter is attached hereto and made a permanent part of this record. Mr. Gwynn quoted portions of a letter from Rusten Associates giving the scope of study anticipated in their proposal. After discussion, on motion duly made and seconded, the Commission voted to hire Rusten Associates to do a city government analysis and total evaluation of both the Administrative and Police areas of the Town and authorize the money to be expended. Discussion ensued on the second request contained in Mayor Koch's letter to the Town Manager regarding the abolishment of all titled positions held by the Commiissioners except those dictated by the Charter. Commissioner Stahl mentioned that he had no problem addressing this request but that he thought it was premature to take action on it. No action was taken. 10. A Workshop Meeting of the Town Commdssion will be held on February 21, 1989 at 9:00 a.m. to review the resumes of applicants for the position of Town Manager. on the "Kitchen Removal" Agreement (Walsh - Place Au Soleil) Mr. Randolph has not received it from Mr. Nowlin but no Permit can be issued until said Agreement in recordable firm, has been received. on motion duly made and seconded the Commission approved the renewal of George Frost as Town of Gulf Stream representative to the County Planning Commission. Long, Division of Criminal Justice Standards and Training SUBJECT: Mandatory Retraining In 1984, the Florida Legislature enacted legislation which required that officers complete forty (40) hours of mandatory retraining every four (4) years. The bill stipulated that such training must be Commission- approved, job related and consistent with the needs of the employing agency. The legislature further mandated that every officer certified before July 1, 1985 complete forty (40) hours of mandatory retraining by July 1, 1989. Our records indicate that as of 10/22/88, you have either 1) not completed the required forty (40) hours of mandatory retraining, or 2) your employing agency has not submitted the necessary information to us indicating that you may have satisfied this requirement. If this office has not received such documentation by July 1, 1989, your certification will lapse, making you ineligible to remain employed. If you believe that you have in fact met the 40 -hour mandatory retraining requirement, it is imperative that you immediately contact your agency training or personnel officer to rectify this situation. A 'Mandatory Retraining Notification Form' must be completed by your agency, certifying your completion of such training. That form must be mailed to this office as soon as possible in order that you receive proper credit toward this requirement. You are encouraged to provide all required documentation to us as soon as possible, preferably before May 16, 1989, in order to reduce confusion and delay caused by last- minute submissions. As you know, the Gwynns have served this town loyally and well for over 15 years . Their reason for leaving is well known. But we have to move on and I am making two requests and I hope the Commission will act on them without delay. First, I propose that we authorize the expenditure of $5,950 for an update of the Rusten Associates Report of 1986. It is vital that the Town Commission have this information. It will be extremely helpful in choosing our manager. However, it will be far more important for the new Manager to have a report on conditions of the Police Department when he takes over his duties. Second, and just as important the new Town Manager should not only have the above information but also, know that he has the sole authority in operating the Town and all departments are under his direction and his only responsibility is to carry out the policies as dictated by the commission as a whole. Therefore, I move that we abolish all titled positions held by the commissioners except those that are dictated by our charter and I quote Section 3 -05, " The commission shall elect from among its members a Mayor and Vice Mayor ". These are the only positions authorized. From this day on that the Department Heads and employees of the Town will follow the chain of command and deal directly with their department heads and then the department heads deal directly with the town manager. The town manager makes all decisions other than policy and any major ones he wishes to present to the commission and that the department heads refrain from discussing their operations with anyone other than the chain of command. Further, that all town commissioners refrain from dealing with any departmental operation. I want to thank all the titled commissioners present and past for their conscientious efforts in what they believed was their duty and in the best interest of the town. However, times have changed and to operate like we have in the past with a new town manager would be counter productive. We have to get back and operate within the charter and any town manager that would be worth his salt would not take the job under any other circumstances. All components of that proposal are hereby renewed and restated, with the following exceptions: (1) The scope of services section, entitled "Specific Tasks We Would Perform ", would be expanded to include our review of two additional areas: (a) Communications between and among the Town Manager, the Town Clerk, the Chief of Police, and the Police Commissioner; and (b) The duties, functions, and workloads of the Secretary assigned to the Police Department. (2) The section of the proposal entitled "Timing of This Study" must be amended because of the passage of time. It should now read, 'Based on our current schedule of client commitments, we could initiate this reassessment of the Police Department in Gulf Stream on Wednesday, February 15, 1989. We will require a maximum of four weeks to complete our work and submit our written report. Therefore, assuming a pro- ject start date of February 15, we would send our report to Town officials by no later than March 15, 1989." INTERVIEW ARRANGEMENTS Assuming the Town Commission's acceptance of our proposal, I will plan to initiate the study in Gulf Stream on Wednesday, February 15, 1989. On that day, I would like to conduct interviews with Mayor Koch, with you, and with Barbara Gwynn. I would appreciate your scheduling those interviews and advising me of that schedule. Also, I would request that you have available for me upon my arrival the documents cited under Task 1 of our proposal, including reports the Chief of Police was supposed to submit to the Town Commission by April 1, May 1, and June 1 of 1986 concerning the implementation of recommendations contained in our original report. There may be other pertinent and more current documents, reports, etc. that you will want to have available for our review. On Thursday and Friday, February 16 and 17, Jim Nolan and I will want to spend our time in the Police Department, interviewing Chief Greer, Captain Buchan, the de- partment secretary, and possibly other members of the Police Department, as we deem necessary. These interviews will deal essentially with the status of recommendations contained in the 1986 report, existing impediments to full implementation, and pos- sible modifications to achieve the objectives of the Mayor and Town Commission. We will also want to examine available dispatch cards and other data which reflect exist- ing service demand levels and the department's ability to respond to those demands for service. We will rely on you to make the necessary arrangements for the availabil- ity of Police Department personnel for interviews and the availability of dispatch cards and other workload data. CONCLUSION We shall look forward to hearing from you relative to the Commission's action on Friday and to the receipt of the executed contract. Data to be Furnished to RUSTEN. All information, data, re- ports, records and maps as are existing, available, and necessary for carrying out the services shall be furnished to RUSTEN without charge by CLIENT, and CLIENT shall cooperate with RUSTEN to the extent pos- sible. 9. Audit and Inspection Records. At any time during normal business hours, and as often as CLIENT may deem necessary, RUSTEN shall make available to CLIENT for examination all of its records with respect to all matters covered by this Agreement and RUSTEN will permit CLIENT to audit, examine and make excerpts or transcripts from such records. 10. Termination of Agreement for Cause. If, through any cause, RUSTEN shall fail to fulfill in timely and proper manner its obliga- tions under this Agreement, or if RUSTEN shall violate any of the covenants, agreements, or stipulations of this Agreement, CLIENT shall thereupon have the right to terminate this Agreement by giving written notice to RUSTEN of such termination and specifying the effective date thereof, said notice being given at least ten (10) days before the effective date of such termination. In that event, all finished or unfinished documents, data, studies, surveys, and reports prepared by RUSTEN shall, at the option of CLIENT, become the property of CLIENT - 2 - and RUSTEN shall be entitled to receive only the pro rata share of the total compensation which is equal to any satisfactory work com- pleted on such documents and other materials. Notwithstanding the above, RUSTEN shall not be relieved of liability to CLIENT for damages sustained by CLIENT by virtue of any breach of the Agreement by RUSTEN, and CLIENT may withhold any payments to RUSTEN for the purpose of setoff until such time as the exact amount of damages due CLIENT from RUSTEN is determined. RUSTEN hereby expressly waives any and all claims for damages for compensation arising under this Agreement except as set forth in this section in the event of such termination. 11. Termination for Convenience of CLIENT. CLIENT may terminate the Agreement at any time by giving notice to RUSTEN and specifying the effective date thereof, at least thirty (30) days before the effective date of such termination. In that event, all finished or unfinished documents and other materials as described in Paragraph 10 above shall, at the option of CLIENT, become the property of CLIENT. If the Agreement is terminated by CLIENT as provided here- in, RUSTEN shall be entitled to receive payment for all professional services rendered and expenses incurred to date of termination. RUSTEN shall also be entitled to an additional payment of 10% of the contract price, except that total compensation shall not ex- ceed the amount set forth in Paragraph 6 above. 12. Equal Opportunity. RUSTEN will not discriminate against any employee, or against any applicant for such employment, be- cause of race, color, religion, sex, age, or national origin. This provision shall include, but not be limited to, the following: em- ployment, upgrading, demotion, or transfer; recruitment or recruit- ment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including ap- prenticeship. 13. Nonassignability. RUSTEN shall not assign any interest in this Agreement, and shall not transfer any interest in the same (whether by assignment or novation) without the prior written con- sent of CLIENT thereto. 14. Interest of RUSTEN. RUSTEN covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services hereunder. RUSTEN further covenants that in the performance of this Agreement no person having such interest shall be employed. 15. Publication, Reproduction and Use of Material. No ma- terial produced, in whole or in part, under this Agreement shall be subjected to copyright in the United States or in any other country. CLIENT shall have unrestricted authority to publish, disclose, distribute, and otherwise use, in whole or in part, any reports, data, or other materials prepared under this Agreement. - 3 - All reports, data, and other materials prepared under this Agreement and submitted to CLIENT shall become the exclusive property of CLIENT upon completion of this Agreement. 16. Indemnification a. CLIENT, its agents, officers, and employees, shall not be held liable for any claims, liabilities, penalties, fines or for damages to any goods, properties or effects of any person whatso- ever, nor for personal injuries to or death of them, or any of them, caused by or resulting from any negligent acts or omissions of RUSTEN, or its agents, employees, or representatives, not including liability by reason of acts or omissions caused by CLIENT, its agents, or employees; and RUSTEN, its agents, officers, and employees, shall not be held liable for any claims, liabilities, penalties, fines or for damage to any goods, properties or effects of any person whatsoever, nor for personal injuries to or death of them, or any of them, caused by or resulting from any negligent acts or omissions of CLIENT, or its agents, employees or represent- atives, not including liability by reason of acts or omission caused by RUSTEN, its agents or employees. b. RUSTEN further agrees to indemnify, and save free and harm- less CLIENT and its authorized agents, officers and employees against acts or omissions caused by RUSTEN, its agents or employees, Cj and any cost or expenses incurred by the respective parties on account of any claim therefor, and CLIENT agrees to indemnify and save free and harmless RUSTEN and its authorized representatives and employees against acts or omissions caused by CLIENT, its agents or employees, and any cost and expenses incurred by the respective parties on account of any claim therefor. c. It is contemplated by the parties that this indemnity agree- ment is not limited in any way by the extent of any policy of insurance currently in force and held by either party. 17• Notice. In no event shall any payment by CLIENT hereunder constitute or be construed to be a waiver by CLIENT of any breach of conditions or any default which may then exist or while any such breach or default shall exist in no way impair or prejudice any right or remedy available to CLIENT with respect to such breach or default. 21. Integrated Document. This Agreement embodies the agreement between CLIENT and RUSTEN for the scope of services and the terms and conditions. No verbal agreements or conversations with any officer, agent or employee of CLIENT prior to the execution of this Agreement shall affect or modify any of the terms or obligations contained in any documents comprising this Agreement. Any such verbal agreement shall be considered as unofficial and in no way binding upon CLIENT. 22. Severability of Provisions. If any provisions of this Agree- ment are held invalid, the remainder of this Agreement shall not be affected thereby if such remainder would then continue to conform to the terms and requirements of applicable law. 23. Amendments. This Agreement may be amended at any time by mutual written agreement of the parties thereto. Mr. Boucher requested that a regular Certificate of occupancy be issued, which was agreed by all Commissioners. 6. Presentation of Town Planning Board Report. A. Pugliese - Addition to the guest house. It conforms to all the setbacks. Planning Board has recommended approval. Motion was made and seconded to approve request. Motion passed. B. Rigby - Banyan Road - Hedge extension on the road, which would close the entrance to 12 feet. The Fire Department rcguires 24 " entrance. The Planning Board has referred the matter to the Town Commission for decision. There was considerable discussion regarding liability. Commissioner Dixson stated it was his thought there should be a lease agreement to be revocable at will and an indemnity agreement in the event something should occur by reason of the lack of adequate access or some other reason. Town Attorry Randolph suggested that the site plan be approved, subject to a legal document regarding liability, and if abandon- ment is required the Town should proceed with that. All of this is to be done at the property owners' expense, including attorney's fees, etc. Motion was made and seconded that the site plan be approved with certain stipulations: 1. That there will be a legal document, to be recorded, relieving the Town of Gulf Stream of any liability for what is placed on the property. 2. There will be a legal document regarding liability, and if abandonment is required, they will proceed with that. 3. The owner will agree to remove anything that the Town requires, at the owner's expense. 4. All expenses, including attorney's fees will be paid by the owner. r 5. The Town's rights will be protected involving the property to be used as proposed on the site plan. 6. This is not a precedence to be applied in future cases, but each subsequent case is to be determined on its own merits. Notion passed. We purchased the property in December of 1982, and during the pass. 10 months have spent considerable sums to transform the property - house and garden - into what we feel it should be, considering its beautiful location. I The enclosed colored plan shows the extent of our land- scape development with the addition of 25 new trees, shrubbery and grass. A new circular brick and concrete driveway creates an orderly transition from street to home. In order to complete the design, and finish off the property, we ask permission to continue our ficus hedge across the north end of the existing easement. The two huge banyan trees which flank it now form a visual demarcation which we seek to reinforce. We fully understand that this is'a public easement. However, in view of the fact that we are at the end of Banyan Road, and there exists now adequate turning in front of our proposed hedge for most vehicles, emergency vehicles - fire, police and ambulance - would have full -use of the circular drive for turning without backing up. Please understand that we are not asking for a permanent structure, but a hedge, which we will maintain at our own expense. If the .City desires it, we will place a letter on file pledging to remove the -hedge within 30,days, at our own expense, after notice from the 'City to. do so. We feel that our request is not unreasonable considering the extent of the transformation of our property, and we look forward to a favorable reply. Introduction of new owners and discussion of development concept. The representative for the owner appeared and submitted conceptual plans and photographs of similar designs used elsewhere. He indicated that a single family design structure comprising six to seven dwelling units would be built on the site. The Board stated they would favor the single family design and would work with the developer when plans are submitted for review. No Board action was required at this time. Pugliese - 1511 North Ocean Boulevard. Site plan review - Guest house addition. Plans and elevations, showing uniformity with existing roof line, °building line, and structural design were submitted for review and action. After a brief dis- cussion the Board unanimously voted to recommend that the Town Commission approve the request as submitted. O'Boyle - 19 North Hidden Harbour Drive. Preliminary Site Plan Review. Prelim- inary plans were submitted to the Board for their review and comment. After considerable discussion it was determined that the plans as submitted did not meet required front and side yard setback requirements. No action was necessary at this time, however, the Board indicated that they would not look favorably upon the request and suggested that the applicant redesign the proposal prior to submittal-of the plans for formal site plan review. moo ."paiRigby - 588 Banyan Road: Request for hedge extension. Mr. Rigby was present to discuss his request to extend an existing hedge along his north property line. After considerable discussion it was determined that the proposed extension would further encroach upon public right -of -way and would reduce his driveway entrance width to twelve (12') feet. The Board voted to recommend approval of the request contingent upon a favorable response from the fire department with regard to the access width, and upon the Town Commission's favorable action regarding the sale to Mr. Rigby of that portion of the existing right -of -way which has been incorporated into his overall site and lot design and is currently being utilized by him as parking and driveway. If they feel the zone is justified, the Traffic Operations Department will issue a work order to the Maintenance Department for installation of the sign's. Mr. McKeehan also mentioned that once the engineering report is completed and a No Parking Zone is determined to be advantageous, the zone is "written into law" and sent to Tallahassee for recording. Anyone subsequently issued a ticket for parking in a No Parking Zone cannot then avoid the ticket, based upon this recordation with the State. Any real estate sign offering property for sale or rent may be double -sided in design, however, shall not exceed two (2) square feet in total dimension. All said siqns shall be of white backqround with black block lettering Any other sign permitted herein shall not exceed a dimension of six (6) square feet, and shall be single sided in design. Any sign erected, displayed or maintained in violation of this section shall constitute a violation of this Ordinance. Except for the placement of real estate signs, all signs shall first be reviewed and approved by the Town Planning Board prior to the placement of said signs." Section 2 Severability In the event that any court of competent jurisdiction shall hold that any provision of this Ordinance is invalid or unenforceable, the same shall not affect the validity of the Ordinance as a whole, or any part thereof, other than the part so declared to be invalid. Section 3 Repeal of Conflicting Ordinances All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4 Codification This Ordinance shall be codified and made a part of the official Comprehensive Zoning Ordinance of the Town of Gulf Stream, Palm Beach County, Florida. Section 5 Effective Date This Ordinance shall take effect immediately upon its passage and approval as provided by law. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, as follows: Section 1. Section VII - "RS" Residential Single - Family District at paragraph (N) of the Town of Gulf Stream Comprehensive Zoning Ordinance shall be amended to add an additional subparagraph (4) at the end of the existing provisions to read as follows: 0(4) Limitation on number of kitchens. In a single - family primary dwelling the number of kitchen areas shall not exceed one (1)." Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Comprehensive Zoning Ordinance of the Town of Gulf Stream, Florida. Section 4. A Public Hedring on these proposals will be held by the Town Commission on January 13, 1989 at 9:00 A.M. in the Commission Chambers of the Town Hall located at 100 Sea Road, Gulf Stream, Florida. A copy of the Comprehensive Plan to be considered at said hearing is on file in the office of Town Clerk located in said Town Hall and may be reviewed by members of the public during normal business hours, 9:00 A.M.-4:00 P.M., Mondays- Fridays, except observed holidays.
