HomeMy Public PortalAboutr 05:227 ~ez111util1U 11£ tire Ißl1tl1U£Ir 11£ C1.lètrtet£Ì) ~ ~ 3} ~ No. 105-227 Date of Adoption July 21, 2005 APPROVING THE DESIGNATION OF REDEVELOPMENT AREA BOUNDARIES - WEST CARTERET MINUE STREET RETAIL REDEVELOPMENT AREA WHEREAS, by Resolutions #04-337, adopted on October 28,2004, and Resolution #05- 47, adopted on January 27, 2005, the Mayor and Council of the Borough of Carteret ("Borough Council") authorized and directed the Planning Board of the Borough of Carteret (the "Planning Board") to undertake a preliminary investigation to determine whether those properties listed on Exhibit A hereto ("Delineated Area") meet the criteria set forth in the New Jersey Redevelopment and Housing Law, NJ.S.A. 40A: 12A-I et seq. ("Redevelopment Law"), a for being determined to be an "area in need of redevelopment" as therein defined; and WHEREAS, after providing requisite notice, the Planning Board held a hearing on April 27, 2005 to review the results of the preliminary investigation and to solicit public comment on whether the Planning Board should recommend to the Borough Council that the Delineated Area be determined to be an "area in need of redevelopment"; and WHEREAS, at the public hearing, the Planning Board considered the testimony of and exhibits furnished by a' license professional planner from Beacon Planning and Consulting Services, LLC, the author of the Redevelopment Area Assessment Report for the DeJineated Area, dated April 2005, and afforded all interested members of the pubJic an opportunity to make inquire into and give testimony concerning the boundaries of the proposed Delineated Area and whether said area should be determined to be a redevelopment area; and WHEREAS, the Planning Board, by a Resolution of Findings and Conclusions, memorialized on May 25, 2005, has recommended to the Borough Council, pursuant to Section 6 of the Redevelopment Law, that the Delineated Area, excluding Block 50.01, Lots 27-29 and Lot 32.04, be determined to be an "area in need of redevelopment", finding that said properties meet at least three (3) of the statutory criteria to be an area considered in need of redevelopment all as set forth in the Assessment Report prepared by Victor Furmanec, P.P., of Beacon Planning; and WHEREAS, the Borough Council has given due consideration to the recommendation of the Planning Board and further finds that said recommendation is supported by substantial evidence; and WHEREAS, the Borough Council further concludes that there exits within the delineated area sufficient criteria for the designation of a redevelopment area as set forth in NJ.S.A. 40A:12A-5, as more fully described and delineated in the Redevelopment Area Assessment Report, as found by the Carteret Planning Board. NO. 4ÞO,)-22L- PAGE 2 of 2 NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey that the West Carteret Minue Street Retail Redevelopment Area as depicted on Figure 15, Proposed Redevelopment Area, containing those properties listed on Table I, Study Area Properties, excluding Block 50.01, Lots 27-29 and Lot 32.04, as set forth in the above-referenced Beacon Planning Assessment report, dated April 2005, a copy of which is attached hereto and made a part hereof, is a redevelopment area as so defined by N.J.S.A. 40A: 12A-3. BE IT FURTHER RESOLVED, that a duly executed copy of this Resolution shall be transmitted to the Commissioner of the New Jersey Department of Community Affairs. BE IT FURTHER RESOLVED, that a copy of the Redevelopment Area Assessment Report shall be kept on file in the Office of the Borough Clerk for public inspection. BE IT FURTHER RESOLVED, that duly executed copies of this Resolution shall be transmitted to the Planning Board and filed in the office of the Borough Clerk.
