AN ORDINANCE AMENDING DEVELOPMENT CODE CHAPTERS 18.16 (SPECIAL
PURPOSE ZONING DISTRICTS) AND 18.220 (DEFINITIONS, GLOSSARY) TO ALLOW FOR
SEASONAL CARETAKER UNITS IN THE PUBLIC FACILITY ZONE DISTRICT
WHEREAS, the Truckee-Donner Recreation and Park District has identified a need to
employ seasonal park caretakers within the West End Beach, Truckee River Regional Park
and Riverview Sports Park; and
WHEREAS, the Development Code does not currently permit seasonal park
caretakers as an allowed use in the PF (Public Facility Zone District); and
WHEREAS, the Truckee-Donner Recreation and Park District has requested a
Development Code Amendment to allow seasonal park caretakers within the PF zone
district at the West End Beach, Truckee River Regional Park and Riverview Sports Park;
and
WHEREAS, the Planning Commission is an advisory body to the Town Council who is
the review authority to approve amendments to the Development Code; and
WHEREAS, the Commission shall make a written recommendation to the Council
whether to approve the proposed amendments to the Development Code; and
WHEREAS, at its October 18, 2016 hearing, the Planning Commission recommended
approval of the requested Development Code Amendment to the Town Council; and
WHEREAS, the project is categorically exempt from CEQA pursuant to Section
15061(b)(3); and
WHEREAS, a public notice was published in the Sierra Sun and mailed to property
owners within 500 feet of the project sites informing the public of the date, time, and
location of the public hearing for the consideration of the approval or denial of the
Development Code Amendment; and
WHEREAS, all legal prerequisites for the adoption of this ordinance have been met.
The Town Council of the Town of Truckee Does Ordain as Follows:
Section 1. The Town Council hereby amends Chapter 18.16 (Special Purpose Zoning
Districts), Table 2-9 of the Truckee Municipal Code to read as follows:

Section 2. The Town Council hereby amends Chapter 18.220 (Definitions, Glossary), Table
2-9 of the Truckee Municipal Code to include a definition for seasonal park caretaker as follows:
Seasonal Park Caretaker. A seasonal Truckee-Donner Recreation and Park District
employee who is responsible for providing on-site maintenance, management and
security at Truckee-Donner Recreation and Park District-managed parks. Seasonal park
caretakers are allowed at the West End Beach, Truckee River Regional Park and the
Riverview Sports Park. The seasonal park caretakers live on-site within each park in
their personal recreation vehicles and are generally on-site starting in April and ending in
October, weather permitting. Duties generally include opening and closing the parks,
enforcing park rules, reservations management, grounds maintenance and event
oversight. All caretaker units are required to be legally connected to public water,
sanitation and power.
Section 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any
reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision
shall not affect the validity of the remaining portions of the ordinance. The Town Council of the
Town of Truckee hereby declares that it would have passed this ordinance and each section,
subsection. sentence, clause and phrase thereof irrespective of the fact that one or more
sections. subsections, sentences. clauses or phrases may be held invalid or unconstitutional.
Section 4. The Town Clerk is hereby directed to publish this ordinance in accordance with
the law.
The foregoing Ordinance was introduced at a regular meeting of the Truckee
Town Council held on the 13th day of December, 2016, and adopted at a regular meeting
of the Truckee Town Council, on the 12th day of January, 2017, Vice Mayor Wallace Dee,
moved for the adoption, the motion was seconded by Council Member Tirman, and was
carried by the following vote:
AYES: Vice Mayor Wallace Dee, Council Member Tirman, Council Member
Flora, and Mayor Goodwin.
NOES: none.
ABSENT: Council Member Abrams.
