HomeMy Public PortalAbout15 Temporary Exemption to Woodstove Compliance Requirements ' TOWN OF TRUCKEE California RESOLUTION 2017-15 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE ESTABLISHING A TEMPORARY EXEMPTION TO WOODSTOVE COMPLIANCE REQUIREMENTS WHEREAS, the Town Council on December 18, 2003 adopted Ordinance 2003-06, thereby requiring the removal of all non-Town approved solid fuel burning appliances within the Town of Truckee by July 15, 2006; and WHEREAS, the Council on April 20, 2006 adopted Ordinance 2006-02, thereby extending the deadline to July 15, 2007; and WHEREAS, the Council on May 5, 2007 adopted Resolution 2007-18 which established procedures and guidelines to implement the provisions of Ordinances 2003-06 and 2006-02; and WHEREAS, the Council, on July 12, 2016 adopted Resolution 2016-38, restating certain procedures previously established by Resolution 2007-18; and U WHEREAS, among the provisions of Resolutions 2007-18 and 2016-38 are requirements that if a building permit with a valuation of $5,000 or more is issued, the property owner must remove all non-Town approved woodstoves and other solid fuel burning appliances from the property, and that the Town's building inspector must inspect the property to ensure compliance prior to approving a final building inspection or issuing a certificate of occupancy; and WHEREAS, the storms of the 2016-2017 winter have caused significant damage to the exteriors of a number of residences in Truckee, including deck failures and roof damage caused by falling trees; and WHEREAS, swift repair of these damaged residences is necessary in order to avoid further damage and to ensure that the residences are fit for occupancy; and WHEREAS, requiring the removal of non-certified woodstoves and other solid fuel burning appliances from heavily damaged residences in order to obtain a final building inspection and/or certificate of occupancy is likely to delay the completion of repairs and/or encourage property owners to undertake repair work without building permits; and WHEREAS, the Town Council finds that temporarily exempting residences with significant weather-caused exterior damage from the requirement to remove non-certified woodstoves and other solid fuel burning appliances in connection with obtaining a final building inspection and/or certificate of occupancy will encourage the swift repair of damaged residences and avoid a hardship to the owners of such properties; ****** NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee hereby finds and declares as follows: 1. The requirements of Sections 3.a and 3.b of Exhibit A of Resolution 2016-38 (and the analogous provisions of Resolution 2007-18) are hereby suspended with respect to building permits and certificates of occupancy for the repair of exterior damage caused by climatic conditions between October 15, 2016 and May 1, 2017 and costing in excess of $5,000 to repair. 2. For purposes of this resolution, the Community Development Director or his designee shall determine whether any particular residence for which the benefit of the suspension is claimed meets the foregoing criteria. 3. The suspension enacted herein shall expire and be of no further force or effect on October 16, 2017, and shall be inapplicable to building permits for which complete applications are received on or after that date.
