Mr. Fereday sought permission to enlarge a nonconforming structure and encroach on the lake shore setback by constructing a fire escape within 37' of the high water line, in variance from the requirements of MCC 3-15-040(B)3(c) and 3-28-010(A) The P&Z found that the proposal satisfied the requirements of MCC 3-30-010 and recommends that the City Council approve the application. The P&Z recommends that no second hearing be held. No appeal of the P&Z’s recommendation has been filed. The P&Z’s Findings & Conclusions and the complete record of the case are attached. Also attached are draft Findings & Conclusions for the City Council, incorporating the P&Z’s Findings & Conclusions and approving the application. RECOMMENDED ACTION: Adopt the draft Findings & Conclusions and approve variance application VAR–01–1.
