2. On motion duly made and seconded the Minutes of the February 1, 1989
meeting were approved.
3. Variance Requests
Dr. and Mrs. Jarad and Mr. and Mrs. Sherman - Lots 62 - 63
Request to extend a wood dock from the required 5' to 8' and to extend the
location of davits from the required 15' to 5' w/s of lot 62, 935 Emerald
Row.
After discussion of the foundation problem and noting agreement between
the parties the Board on motion duly made and seconded approved this request.
Mr. and Mrs. William F. Koch III, Lot 12 Gulfstream Cove
Variance request as follows:
1. Minimum area of 15,414 sq. ft. instead of the required 20,000 sq. ft. -
a variance of 4,586 sq. ft. is requested pursuant to Section VII R.S.
single family district A -1, Page 22.
2. Front yard setback of 30.0 ft. to wall or 27.0 ft. to eaves instead
of the required 41.75 ft. to wall or 38.75 ft. to eaves - a variance
of 11.75 ft. is requested. Pursuant to Section VII - R.S. Single
family District J -1, Page 24.

instead of the required 18.0 ft. to the walls or 15.0 ft. to the eaves,
a variance of 5.33 ft. to both sides is requested. Pursuant to Section
VII R.S. Single Family District K -1, Page 24.
4. That the owner be allowed to place the entrance to the garage facing the
street instead of a side entrance to the garage. Pursuant to Section X-
R.S. Single Family District F -2, Page 35.
GULF STREAM BUILDING CODES - ORDINANCE No. 83 -1.
LEGAL: LOT 12, GULF STREAM COVE, ACCORDING TO PLAT THEREOF RECORDED IN
PLAT BOOK 24, PAGE 185 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA.
Noting this lot was platted prior to the new Codes; that notification to residents
has been made and no response received; that County law determines location of drain
fields thus limiting usage of the lot; the predominance of street - facing garages on
Middle Drive, and the willingness of the Petitioner to reduce eave size by 3 ", the
Board on motion duly nude and seconded, Mrs. Orthwein and Mr. Mayer abstaining,
approved this request.
3. Replat Request. Michael, Mark and William Walsh
This item was adjourned until after the following matter.
4. Gulf Stream School - Gift of House
Francis N. Carpenter, President of the Gulf Stream School appearing with
Mr. Woodward, Headmaster, informed the Board of an offer received by the
School from Mr. Pulte of a house to be moved from its present location
in the Town of Gulf Stream on to the grounds of the Gulf Stream School.
Mr. Carpenter said there is sufficient room for the house on the grounds and they
would use it as a residence for the Head Mistress.
Discussion ensued on the history of the house, the logistics of the proposed
move and the necessary components of the house. Inasmuch as this is an
exceptional situation and the house an historical building, a legal opinion
will be required. On motion duly made and seconded the Board moved to
accept this proposal.
3. Replat Request. Michael, Mark and William Walsh. Request to replat a parcel
of Lots 6 and 7, Gulf Stream Ocean Tract.
After examination of plans and noting no response to resident notification
and discussion of the history of this request, the Board on motion duly made
and Seconded approved this request.
There being no further business the meeting was adjourned on motion at 9:35 a.m.

The following variance has been requested pursuant to Section VII
11R.S.11 Residential Single Family District of the Gulf Stream Code
of Ordinances.
A request to reduce the side yard set back requirement from
thirty -four and one -half feet to thirty -two and one -half feet
(from 34 }1 to 32P) as required in Section VII K.I. Lots
forty -nine A (49 -A), fifty (50) and fifty -one (51) of Replat of
part of Gulf Stream Properties No. 2. Address: 3432 North Ocean
Boulevard, Gulf Stream, Florida.
The Planning and Zoning Board will conduct a Public Hearing on
May 3, 1989 at 9 :00 a.m. and the Town Commission sitting as the
Board of Adjustment will conduct a Public Hearing on May 5, 1989
at 9:00 a.m, in the Gulf Stream Town Hall, 100 Sea Road, Gulf
Stream, Florida.
All interested parties will be given an opportunity to be heard.

In response to Commissioner Armour's inquiry on the Emergency Medical Contract
(February 10, 1989 Minutes) Mayor Koch said he will discuss the contract with
the Delray Beach City Manager next week.
To a question on the F.I.N.D. Agreement (February 10, 1989 Minutes) the Mayor
responded it has been signed by all parties and is in process through the bank.
On motion duly made and seconded the Minutes of the meetings of February 10, 1989,
February 21,1989 and March 2, 1989 were approved.
3. Financial Report
hir. Gwynn reported 92% of the tax roll has been received. All budget items are
on schedule with the exception of the deficit incurred earlier this year for
legal expense. The Financial Report was approved.
4. Police Report
Chief Greer reported for the previous month noting two burglaries. Five
investigations pending. The mandatory re- training of officers is complete.

Due to the rock formation that extends East and West along

Pursuant to our conversation pertaining to my dock width variance,
I sight the following.
Upon attempting to drive the pilings, B.K. Marine ran into rock
formations that were formidable. I was notified by B.K. of this
and suggested they do the best they could to follow the agreed to
plans and permit. I was notified shortly thereafter by the job
foreman that the rock formation was directly under the seawall,
dock and where my boat would be. I suggested to them to extend the
northwestern end of the dock three feet as a small landing to the
stern of the boat.
I respectfully apply for a variance from original plans on this
hardship.

Dear Mr. Brandt,
On November 28, 1988 a building permit was issued ( #524) for
us to construct a 33'x5' wide wood dock for the Sherman
residence.
The barge started construction and found extensive rock.
Because of this, we could not get adequate penetration of
dock pilings. Due to this hardship, we moved the piling out
on west end approximately 3' thus making the dock wider than
the permitted 5'.
We would appreciate any consideration you could allow on this
matter, so the homeowner can have use of the dock.

TO WHOM IT MAY CONCERN:
In attempting to install the davits at 935 Emerald Row, I discovered that
at low tide there were rocks immediately beneath the davits just below
the mater surface. This mould have rendered the davits virtually
unusable therefore I shifted the position of the davits toward the west
property line. I did not realize that a davit was considered a
"structure" and was not aware that there was a limitation on davit
position in relation to the property setback lines. Dr. Jared has dis-
cussed the location of this davit with his immediate neighbor to the
west, Mr. Sherman, and they apparently have no difficulty with this
location.
Again I apologize for not proceeding with the usual variance application,
but was ignorant of the interpretation of a davit as a "structure ".

TO WHOM IT MAY CONCERN:
I can respectfully applying for a variance for a boat davit which is
located within the setback space of my west property line. The
original location which was chosen was unfortunately directly over an
area of rocky bottom which extends East and West along the bulkhead
bordering the south side of the canal behind my house. This same chain
of rocks likewise affects Mr. James Sherman's dock (my neighbor
immediately to the west). In preparation for this application for
variance, Mr. Sherman and I have discussed this matter and have mutually
agreed the location of his dock and the location of ray davit are in no
racy a concern to either of us.

The following variance requests will come before the Gulf Stream
Planning and Zoning Board and the Town Commission.
1. Minimun Area of 15,414 sq. ft. instead of the required
20,000 sq. ft., a variance of 4,586 sq. ft, is requested.
Pursuant to Section VII R.S. Single Family District A -1 Pg. 22.
2. Front yard setback of 30.0 ft. to wall or 27.0 ft to eaves
instead of the required 41.75 to wall or 38.75 ft to eaves
a variance of 11.75 ft. is requested. Pursuant to Section
VII - R.S. Single Family District J -1 Pg. 24.
3. Side Yard setback of 12.67 ft. to the walls or 9.67 ft. to the
eaves instead of the required 18.0 ft. to the walls or 15.0 ft.
to the eaves, a variance of 5.33 ft. to both sides is requested.
Pursuant to section VII R.S. Single Family District K -1. Pg. 24.
4. That the owner be allowed to place the entrance to the garage
facing the street, instead of a side entrance to the garage.
Pursuant to Section X- R.S. Single Family District F -2. Pg. 35.

LEGAL: LOT 12, GULF STREAM COVE, ACCODING TO PLAT THEREOF RECORDED
IN PLAT BOOK 24, PAGE 185 OF THE PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
The Town of Gulf Stream Planning and Zoning Board will review the
request at their regular meeting on Wednesday, April 5, 1989 at 9 A.M.
Gulf Stream Town Hall.
The Town Commission sitting as the Board of Adjustment will conduct
a public hearing at 9 A.M., Friday, April 14, 1989 at the Gulf
Stream Town Hall, 100 Sea Road, Gulf Stream, Fl.
All interested parties will be given an opportunity to be heard.
Plans are on file in the office of the Town Clerk, Gulf Stream
Town Hall.

Dear Members of the Planning Board:
Our Client wishes to apply for Four Variances, on the above
described property.
(1) Minimum Area of 15,414 sq.ft. instead of the required
20,000 sq.ft., a variance of 4,586'sq.ft. is requested.
(2) Front yard setback of 30.0 ft. to wall or 27.0 ft. to eves
instead of the required 41.75 to wall or 38.75 ft to eves,
a variance of 11.75 ft. is requested.
(3) Side Yard set back of 12.67 to the walls or 9.67 to the
eves instead of the required 18.0 to the walls or 15.0
to the eves, a variance of 5.33 ft. to both sides is
requested.
(4) That the owner be allowed to place the entrance to the
garage facing the street, instead of a side entrance to
the garage.
All these variances are being requested due to the fact that
this parcel of land was platted prior to the new setbacks, and
g, -rage entrance code being adopted.
It will cause a great hardship to our client should a variance
not be granted due to the small size of the lot.

All the above variances are in harmony with the surrounding
properties, and granting these variances will not center on
the applicant any special privileges that anyone else on this
street hasn't received.
