WHEREAS, the Florida Legislature in 1970 adopted legislation which allowed municipalities of the State to join the Florida Retirement System; and WHEREAS, at the time when many municipalities entered the Florida Retirement System, the cities' contributions were 4% of the employee's salary and the employee was required to contribute 4 %; and WHEREAS, the Florida Legislature made said Florida Retirement System non - contributory for city employees without the consent of member cities; and WHEREAS, effective January 1, 1989 Tequesta is required to contribute 14.38% of gross salary for regular employees and 17.98% for special risk employees; and WHEREAS, the city governing bodies have no control over additional increases and benefits and additional contributions; and WHEREAS, said increases and benefits and contributions may result in additional tax burden on the citizens of the municipality including the Village of Tequesta; and WHEREAS, cities individually may provide benefits that are actuarially equivalent to the Florida Retirement System at less cost; and WHEREAS, many city employees are forced to forfeit the entire' city's contributions to the Florida Retirement System without vesting in such system; and WHEREAS, much of the city contributions are now being allocated to pay for actuarial deficits and unfunded liability created prior to the city's enrollment into the State program; and WHEREAS, the State's own independent actuarial valuations indicate that allowing cities to withdraw from the system for all future employees would result in an insignificant effect on the remaining members of the Florida Retirement System. Dear Members of the Planning Board: Our Client wishes to apply for Four Variances, on the above :escribed property. (1) Minimum Area of 15,414 sq.ft. instead of the required 20,000 sq.ft., a variance of 4,586'sq.ft. is requested. (2) Front yard setback of 30.0 ft. to wall or 27.0 ft. to eves instead of the required 41.75 to wall or 38.75 ft to eves, a variance of 11.75 ft. is requested. (3) Side Yard set back of 12.67 to the walls or 9.67 to the eves instead of the required 18.0 to the walls or 15.0 to the eves, a variance of 5.33 ft. to both sides is requested. (4) That the owner be allowed to place the entrance to the garage facing the street, instead of a side entrance to the garage. All these variances are being requested due to the fact that this parcel of land was platted prior to the new setbacks, and g.:rage entrance code being adopted. It will cause a great hardship to our client should a variance n.)t be granted due to the small size of the lot. :1.- 11''!''!tNS '.'l ;Yi!(JhilaSi=;Nll..
