The meeting was called to order at 9:00 a.m. by the Bon. William F. Koch, Jr., Mayor.

In response to a query by Commissioner Skelly Mayor Koch said the meetings with
the City of Delray Beach on the Emergency Medical Contract had so far been
unproductive as they have not yet justified their cost figures. Another meeting is
planned.
On motion duly made and seconded the Minutes of the March 10, 1989 meeting were
approved.
3. Financial Report
Mr. Gwynn reported transfer of monies from the Money Market account to the
Operating Account as the tax money is used. Reporting further on the comparison
of actual expense to budget -net revenue year -to -date is $145,000 and the budget
projection was for $215,000. for an approximate $70,000 shortfall. A fairly sizeable
FPL adjustment is expected in July. The Financial Report was accepted on motion
duly made and seconded.

4. Police Report
CCaptain Buchan gave the Police report for the month of March.
5. Planning and Zoning Board Report
Mayor Koch stated for the record that he was disqualifying himself from all
Planning and Zoning matters; that he would abstain from discussion and voting
on these matters and will submit Form 8B to be filed with these Minutes and made
a permanent part thereof.
Commissioner Armour assumed the Chair.
a. Variance Request. Dr. and Mrs. Jared and Mr. and Mrs. Sherman, 935 Emerald Row.
Lots 62 - 63. Request to extend a wood dock from the required 5' to 8'
and to extend the location of davits from the required 15' to 5', w/s
of Lot 62. Advertised, no objections. Approved by Place Au Soleil Homeowners.
Mr. Mayer explained the foundation problems. Community agreement was noted. On
motion duly made and seconded the Commission accepted the recommendation of the
Planning and Zoning Board and approved this request.
b. Variance Request. Mr. and Mrs. William Koch III, Lot 12 Gulfstream Cove.
(See attached for description of request).
After extensive discussion between all parties, examination of plans and
informing the audience that plans for the proposed house would again follow
usual procedure of Planning and Zoning Board and Town Commission consideration
and action,and counsel by the Town Attorney, Commissioner Stahl made a motion
that the Commission approve the Variances as requested subject to the following
conditions:
1. That the owner of the property join in the request.
2. That the house be no larger than 4300 sq. ft, of air conditioned space.
3. Reduce the save size by 3 ".
Motion was seconded and passed by the Town Commission.
c. Replat request. Michael, Mark and William Walsh. Lots 6 and 7, Gulf Stream
Ocean Tract. No variance required. Notice mailed to surrounding residents.
Neighbors Mr. and Mrs. Sipp, expressed their concern about a buffer zone. Mr.
Mayer suggested proper landscaping would screen the area. Landscape plans will
be filed with the Town. Discussion ensued on similar problems in the Town and
coastal line limitations. On motion duly made and seconded the Commission
granted the replat request.
d. Letter from Mr. and Mrs. Pulte to Mr. Carpenter, Chairman, Board of Trustees
of Gulf Stream School, proposing donation of cottage and contents to the school.
Mr. Mayer spoke on moving this building from its present site on to the grounds
of the school. Discussion ensued on the limitations placed on school building
and the unusual circumstance of this offer of an historical building of interest
to the community. Mr. Cross delineated the conditions under which the building
could become part of the school complex. This agenda item is for information
only and no Commission action is required. A Public Hearing will be held.

Mayor Koch resumed the Chair.
6. Mr. Randolph read the title of Resolution 89 -2 as follows:
A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA,
REQUESTING THAT THE 1989 LEGISLATURE ENACT
LEGISLATION WHICH WOULD ALLOW MUNICIPALITIES
TO WITHDRAW FROM THE FLORIDA RETIREMENT SYSTEM.
The Town of Gulf Stream is not a party to this action. The purpose of our
joining is to support other municipalities.
7. Update on Place An Soleil Gate House Project.
Mr. Dittman spoke on the need for certain safety changes in the entranceway of
the Gate House. The Commission approved this request subject to review of the
Town Manager on motion duly made and seconded.
8. Request to change the next regular Commission Meeting date from May 12th to
May 5, 1989 at 9 a.m.
The Commission approved subject date change and set down the following dates
of future meetings:
May 5, 1989, June 16, 1989, July 7, 1989, August 11, 1989 and September 8, 1989.
Meeting dates for Budget Hearings and Workshops will be set down.
S. Commission Comments
On a question concerning the status of Bridge litigation Mr. Randolph said it
is uncertain if the County is continuing its Appeal.
8. Mr. Flannery read Resolution No. 89 -3 as follows:
A RESOLUTION OF APPRECIATION
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA
WHEREAS, WILLIAM E. GWYNN has served as Town Manager of
the Town of Gulf Stream, Palm Beach County, Florida, from
February 1974 until March 1989.
WHEREAS, in recognition of the dedicated and devoted time,
service and energies given in the interest of the Town as
the Town Manager and his conscientious endeavor to serve
the Town faithfully in a myriad of duties plus never
missing a regular or special Commission meeting in his
fifteen years of service to the Town, the entire Commission
on behalf of itself and the Town wishes to extend its
appreciation.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF
THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, as
follows:

On motion duly made and seconded the Commission approved Resolution 89 -3.
Mr. Gwynn was congratulated by Mayor Koch and the Conn111SHi.ou and the audience.
H. Mr. Flannery repurted the Police Department if now fully unionized. Mr. Flannery
noted that this limits the control of the Town Manager in police affairs. lie
spoke of the extensive attorney fees noting in particular the high cost of teluphunu
calls to Tallahassee attorneys and suggested a Telephone Retainer Agreement available
for attorney telephone calls at a cost not to exceed $15U per month and easily
cancellable be entered into. The Town Commission gave Mr. Flannery the authority
to enter into such an Agreement.
9. Mayor Koch refered to Town Ordinance 89 -3 received from the Town Attorney on request
of the Commission spelling out the powers and duties of the Town Manager.
Mr. Randolph read the Title of Ordinance No. 89 -3 on First Reading as follows:
AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN
OF GULF STREAM, PALM BEIACH COUNTY, FLORIDA,
PROVIDING FOR THE "POWIiRS AND DUTIES OF THE TOWN
NANACER "; PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE.
On motion duly made and seconded Town of Gulf Stream Ordinance 89 -3 was placed
un First Reading.
On Driftwood Landing debris and tree problem Mr. Flannery suggested the Town
Attorney cheep the Ordinances controlling removal of dehri.s and tree overhang
hang problems i.e. billing owner of the lot for debris removal but no
provision is made for collection of the bill and the responsibility of the Town
rel-arding overhanging trees. Mr. Randolph will look into this matter.
Mayor Koch is invited to the Boca Raton Historical Society Breakfast on the
Preservation of RailRoad Trust April 28, 1989.
Commissioner Armour spoke on police department matters. Mr. Flannery responded
it is up to the police to approach the Town on any negotiation. A recent meeting
with a representative from the Dept. of Insurance, Tallahassee,,speaking on
Police and Fire pensions was very informative. Determination of the Town's
contribution will have to be made. Mayor Koch said this will be addressed at
Budget time.

Mr. Dittman reported on the status of F.I.N.D. It was noted the easement has not
yet been recorded nor has it been delivered to the Town Attorney as of this date.
Mayor Koch requests this be resolved prior to the next meeting.
Mrs. Gwynn reported on the Comprehensive Plan and its emphasis on water conservation,
re- cycling, beach access and recreational areas. Mrs. Gwynn will meet with the
Regional Director of the Treasure Coast to discuss these matters. Also reported
by Mrs. Gwynn is a current study of the coastal setback line and its effect on
the Town after 1990 -91.
Mr. Armour thanked Mrs. Gwynn for her informative report.
Mayor Koch noted the beach cleanup by Gulf Stream School and requested the Town
congratulate the School in writing to the Headmaster, Mr. Woodward.
There being no further business the meeting was adjourned at 10:10 a.m.

RESOLUTION NO. 89 -2
A RESOLUTION OF THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA,
REQUESTING THAT THE 1989 SESSION OF THE FLORIDA
LEGISLATURE ENACT LEGISLATION WHICH WOULD ALLOW
MUNICIPALITIES TO WITHDRAW FROM THE FLORIDA
RETIREMENT SYSTEM.
WHEREAS, the Florida Legislature in 1970 adopted legislation
which allowed municipalities of the State to join the Florida Retirement
System; and
WHEREAS, at the time when many municipalities entered the Florida
Retirement System, the cities' contributions were 4% of the employee's
salary and the employee was required to contribute 4 %; and
WHEREAS, the Florida Legislature made said Florida Retirement System
non - contributory for city employees without the consent of member cities;
and
WHEREAS, effective January 1, 1989 Tequesta is required to contribute
14.38% of gross salary for regular employees and 17.98% for special risk
employees; and
WHEREAS, the city governing bodies have no control over additional
increases and benefits and additional contributions; and
WHEREAS, said increases and benefits and contributions may result
in additional tax burden on the citizens of the municipality including
the Village of Tequesta; and
WHEREAS, cities individually may provide benefits that are actuarially
equivalent to the Florida Retirement System at less cost; and
WHEREAS, many city employees are forced to forfeit the entire'
city's contributions to the Florida Retirement System without vesting
in such system; and
WHEREAS, much of the city contributions are now being allocated to
pay for actuarial deficits and unfunded liability created prior to the
city's enrollment into the State program; and
WHEREAS, the State's own independent actuarial valuations indicate
that allowing cities to withdraw from the system for all future employees
would result in an insignificant effect on the remaining members of the
Florida Retirement System.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM:
Section 1. The legislature of the State of Florida should immediately
pass legislation which would allow municipalities in the State to have
one (1) year to withdraw from the Florida Retirement System for all future
employees.
Section 2. Specifically, the Palm Beach County Legislative Delegation
is requested to support any such legislation which would allow municipalities
in the State to have one (1) year to withdraw from the Florida Retirement
System for all future employees.
Section 3. Senatorial Members of the Palm Beach County Legislative
Delegation are requested to give due consideration to being the Senate's
sponsor for the bill filed by House Representative Harry C. Goode, Jr. of
Melbourne which will permit municipalities to opt out of the Florida
Retirement System.

Section 4. The Town Clerk is hereby directed to provide copies
of this Resolution to the Palm Beach County Legislative Delegation,
Secretary of the Florida Senate, Clerk of the Florida House of
Representatives, Palm Beach County Board of County Commissioners, all
Palm Beach County Municipalities, and the Executive Director of the
Florida League of Cities for purposes of information dissemination and
consideration of the matters contained herein.

Mr. Gwynn read the title of Resolution 89 -1 as follows:
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA, ENDORSING THE SOLID WASTE
AUTHORITY'S SELECTION OF THE WEST BOCA SITE #1 AS
A LANDFILL, TRANSFER STATION SITE AND, IF REQUIRED,
A FUTURE BURNING UNIT SITE; REQUESTING SUPPORT FROM
THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS
WEST BOCA SITE SINCE THE SOLID WASTE AUTHORITY HAS
OBTAINED ALL REQUIRED AND NECESSARY EXPERT OPINIONS
AND HAS EXPENDED IN EXCESS OF SIX HUNDRED THOUSAND
DOLLARS ($600,000) IN THE SELECTION PROCESS.
REQUESTING OTHER MUNICIPALITIES WITHIN PALM BEACH
COUNTY TO JOIN IN THIS EFFORT IN ORDER TO AVOID
FURTHER EXCESSIVE EXPENDITURES AT TAXPAYER'S EXPENSE.
DIRECTING THE TOWN CLERK TO FURNISH COPIES OF THIS
RESOLUTION TO ALL OTHER MUNICIPALITIES LOCATED WITHIN
PALM BEACH COUNTY, AND TO THE MEMBERS OF THE SOLID
WASTE AUTHORITY OF PALM BEACH COUNTY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
After discussion of the Resolution the Commission, on motion duly made and seconded,
approved Resolution 89 -1.
7. Commission Comments.
Mr. Randolph spoke on the Police and Fire Communications Agreement noting the Delray
Beach City Attorney has agreed to make changes as requested by Mr. Randolph
relating to the Hold Harmless paragraph of the Agreement. On motion duly made
and seconded the Commission approved said Agreement subject to the inclusion
of the paragraph approved by Mr. Randolph.
On a Commission question on the "Bridge" matter Mr. Randolph replied the decision
may be appealed but, if not, then the municipalities involved will receive a check.
On the F.I.N.D. matter, Mr. Randolph responded all papers are in final form and
will be recorded. The Town wanted a "free and unencumbered way to get back in
the property and the Town, through the Easement it has, will be able to do that."
Mayor Koch stated the Town has the right; we have the Easement.
There being no further business to come before the Commission a motion for adjourment
was made and approved at 9:35 a.m.

AN ORDINANCE OF THE TOWN COMMISSION OF
THE TOWN OF GULF STREAM, PALM BEACH
COUNTY, FLORIDA, PROVIDING FOR THE
"POWERS AND DUTIES OF THE TOWN MANAGER ";
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, as follows:
Section 1. The Code of Ordinances of the Town are
hereby amended so as to provide for the specification of the
powers and duties of the Town Manager, as follows:
Powers and Duties of the Town Manager.
The Town Manager shall be the Chief Admini-
strative Officer of the Town. He shall be
responsible to the Commission for the admini-
stration of all Town affairs placed in his
charge by or under the Town Charter or by way
of the ordinances of the Town or the direction
of the Town Commission.
The Town Manager shall:
(a) Recommend to the Town Commission the
appointment of, and when he deems it
necessary for the good of the Town, the
suspension or removal of all appointive
administrative officials provided for by
or under the Charter or by Town
Commission ordinance; the Town Commission
may accept or reject such recommendations
and may make appointments in, the absence
of such recommendations.
(b) Appoint, and when he deems it necessary
for the good of the Town, suspend or
remove, all other Town employees. He may
authorize any administrative officer who
is subject to his direction and super-
vision to exercise these powers with
respect to subordinates in that officer's
department, office or agency;
(c) Direct and supervise the administration
of all departments, offices and agencies
of the Town except as otherwise provided
by Charter or by law;
(d) Attend all Town Commission meetings and
he shall have the right to take part in
discussion but may not vote;
(e) Administer all laws, provisions of the
Charter and acts of the Town Commission
subject to enforcement by him or by
officers subject to his supervision;
(f) Prepare and submit the annual budget and
capital programs to the Town Commission;
(g) Submit to the Town Commission and make
available to the public a complete report
on the finances and administrative
activities of the Town as of the end of
each fiscal year;
(h) Make such other reports as the Town
Commission may require concerning the
operations of Town departments, offices
and agencies subject to his direction and
supervision;
(i) Keep the Town Commission fully advised as
to the financial condition and future
needs of the Town and make such
recommendations to the Town Commission
concerning the affairs of the Town as he
deems desirable;
(j) Sign contracts on behalf of the Town as
directed by the Town Commission;
(k) Perform such other duties as are
specified in the Charter or ordinances of
the Town or as may be required by the
Town Commission;
(1) The Town Manager shall represent the Town
before appointive officers of other
governmental bodies except when the Town
Commission shall have designated some
other person to act."
Section 2. If any provision of this Ordinance or
the application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this Ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions of this Ordinance are
hereby declared severable.
Section 3. This Ordinance shall be codified and
made a part of the official Charter of the Town of Gulf Stream,
Florida.
Section 4. This Ordinance shall take effect
immediately upon its passage and approval, as provided by law.
