SUMMARY STATEMENT:
The
City terminated the contractor on the J-Ditch project and is currently awaiting a decision from the Surety on completion options. Given the time sensitive nature of the project, it
is vital that the City be prepared to respond to proposals from the Surety when received. It is the recommendation of staff that the City not permit the terminated contractor (St. Clair)
from completing the project or to permit completion by any contractors with significant ties to St. Clair (other than sub-contractors already used). Further, it would facilitate the
completion to empower the City Manager to negotiate an agreement for completion with the Surety. The City Manager would communicate his actions to Council, and if deemed necessary request
a special Council meeting prior to acting.
RECOMMENDED ACTION:
Direct the City Manager, in consultation with legal staff and JUB, to negotiate and sign a satisfactory, binding agreement
for the completion of the J-Ditch project that does not include the use of St. Clair Contractors or any entity with significant ties to St. Clair Contractors other than selective use
of sub-contractors that have already been used on the project.
