RESOLUTION NO.2010-09
A RESOLUTION OF THE TOWN OF TRUCKEE PLANNING COMMISSION
RECOMMENDING THE REDEVELOPMENT AGENCY AND TOWN COUNCIL ADOPT THE
PROPOSED AMENDMENT TO THE REDEVELOPMENT PLAN FOR'IRE TRUCKEE
REDEVELOPMENT PROJECT AND APPROVE THE NEGATIVE DECLARATION
WHEREAS; Sections 33346, 33356 and 33453 of the Community Redevelopment Law (Health and
Safety Code Section 33000 et seq.) provide that, prior to a joint public hearing of the legislative body and
redevelopment agency on a proposed amendment to a redevelopment plan, the redevelopment agency shall
submit the proposed changes to the planning commission for report and recommendation;
WHEREAS, the Redevelopment Agency of the Town of Truckee (the "Agency") has prepared,
completed, and submitted to the Commission a proposed Amendment to the Redevelopment Plan for the
Truckee Redevelopment Project (the "Project"), to add a provision regarding limitation on the amount of
allowed bonded indebtedness.
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
TOWN OF TRUCKEE as follows:
1. The Commission recommends the Town Council and Redevelopment Agency Board approve
the amendment as submitted, since it is a legally required technical change with no land use
implications.
2. The Commission recommends approval of the negative declaration of environmental impact as
prepared for the same reason as cited above.

The foregoing Resolution was introduced at a Regular Meeting of the Planning Commission of the
Town of Truckee, held on the 8th day of December 2010 by Commissioner who moved its
adoption,which motion being duly seconded by Commissioner was upon roll call carried and
the Resolution adopted by the following vote:

RECOMMENDATION:
Adopt'Resolution 2010-09 recommending the Redevelopment Agency and Town-Council adopt-:
proposed amendment to the Redevelopment Plan and approve the Negative. Declaration as
proposed.
DISCUSSION:`
When the Truckee'Redevelopment Plan was adopted in 1998 a provision was legally required to
be placed in the plan which capped the amount ,of bonded indebtedness which ,the
'•Redevelopiiient'Agency was allowed to issue as $45 million dollars,over the life of=the plan. For
reasons not nowapparent, that-provision was deleted from the final version of the-adopted plan.
The Town,has'subsequently issued bonds to.fund Redevelopment Agency activities.and havinga
cap in place is a requirement of that issuance so this amendment must be adopted as soon as
possible.
Typically, revisions to redevelopment plans' involve changes. in allowed-land use., The law
therefore'contains a.provision requiring referral to the Planning.Commission for comment prior to
action by the Town Council and Redevelopment Agency Board of Directors on,the,amentlment.'
In_this situation;-this requirement has,little relevance since the-amendment is',purely,:technical and
corrective Be that as it may, the state still mandates Commission review and,commentif,any, on
the amendment.,
The commission:packet also contains a,negative declaration of environmental impact in,support
of the proposed action. Given the technical nature of,the Amendment it's ,approval is also'a
routine exercise to demonstrate compliance with CEQA.;
It`should.be noted that,all-affected local agencies have received written notice-of the Amendment
and no objections have been received. As the item,,goes forward,to the'Town:Council, and the
Redevelopment Agency there will'be further notices given to'_those agencies, as well as property
ownersin the redevelopment area.
