A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE ACKNOWLEDGING RECEIPT OF THE REPORT TO TOWN COUNCIL ON THE PROPOSED AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE TRUCKEE REDEVELOPMENT PROJECT, AND CONSENTING TO AND CALLING A JOINT PUBLIC HEARING ON THE PROPOSED AMENDMENT WHEREAS, the Redevelopment Agency of the Town of Truckee (the "Agency"), by Resolution No. 2011-01 on January 6, 2011, submitted to the Town Council of the Town of Truckee (the 'Town Council") a proposed Amendment to the Redevelopment Plan (the "Amendment") for the Truckee Redevelopment Project (the "Project") and consented to and requested that the Town Council call a joint public hearing of the Agency and the Town Council to consider and act upon the proposed Amendment; and WHEREAS, the Town Council acknowledges receipt of the proposed Amendment, along with the Report to the Town Council and the proposed Negative Declaration relating to the Amendment; and WHEREAS, Section 33458 of the California Community Redevelopment Law 1 (Health and Safety Code Section 33000 et seq.) authorizes a joint public hearing on the proposed Amendment with the consent of the Agency and the Town Council; NOW THEREFORE BE IT RESOLVED by the Town Council of the Town of Truckee: Section 1. The Town Council hereby consents to and, at the request of the Agency, calls a joint public hearing of the Agency and the Town Council on the proposed Amendment on March 3, 2011, at 6:00 p.m. in the Town Council Chambers to consider and act upon the proposed Amendment and all documents and evidence_pertaining thereto. Section 2. The Town Clerk of the Town of Truckee shall, in cooperation with the Secretary of the Agency, prepare, publish and mail such notices and documents and do all other acts as may be necessary to carry out the purposes of this Resolution. i 74-1 The foregoing Resolution was introduced by Council Member Wallace Dee, seconded by Council Member Brown, at a Regular Meeting of the Truckee Town Council, held on the 20th day of January 2011 and adopted by the following vote: AYES: Council Member Wallace Dee, Council Member Brown, Council Member Green, and Vice Mayor deRyk Jones. Call and set joint public hearing with Redevelopment Agency for March 3, 2011. DISCUSSION: The statutory process regarding the amendment of redevelopment plans requires a series of procedural steps culminating in a joint public hearing on the proposed amendment and its environmental documentation. The joint hearing seems strange,given that the same people are,in effect, meeting with themselves. Be that as it may, the next required steps, asoutlined in the attached resolution are for the council to receive the various documents and call a joint public hearing. The intervening month is necessary to publish hearing notices in the newspaper, send a hearing notice to all property owners in the area, mail hearing notices to all affected taxing agencies, and to prepare other required documentation. As noted in an earlier report, there has been no substantive comment from the affected taxing agencies following an earlier notice, nor any public comment. FISCAL IMPACT: None.
