NOTICE OF ADOPTION OF AN AMENDMENT TO THE REDEVELOPMENT
PLAN FOR THE REDEVELOPMENT PROJECT
NOTICE IS HEREBY GIVEN, in compliance with Sections 33373(b) and 33456 of the
California Health and Safety Code, that the City Council of the City of (the
"City Council") adopted Ordinance No. on , 20 , approving and
adopting the Amendment (the "Amendment") to the Redevelopment Plan (the "Redevelopment
Plan") for the Redevelopment Project (the "Project"). The Redevelopment
Agency of the City of (the "Agency") is vested with the responsibility to carry
out the Redevelopment Plan, as amended by the Amendment. A copy of the Redevelopment
Plan and the Amendment may be obtained from the Agency.
The City Council adopted Ordinance No. , on , 19_,
approving and adopting the Redevelopment Plan for the Redevelopment Project
with respect to that certain area ("Original Project Area") described in Exhibit A, attached
hereto and incorporated herein by reference. A legal description of the boundaries of the
[Original] Project Area was also recorded in the Official Records of the County of

The purpose of the Amendment is to add certain property to the Project Area (the
"Added Area". A legal description of the boundaries of the Added Area is attached hereto as
Exhibit B and incorporated herein by reference. All of the property located within the
Project Area, [including both the Original Project Area (described in Exhibit A) and the
Added Area (described in Exhibit B)J, is subject to the provisions of the Redevelopment
Plan.
Proceedings for the redevelopment of the Project Area, including the Added Area, as
contemplated by the Amendment, have been instituted under the California Community
Redevelopment Law(Health and Safety Code Section 33000 et seq.).

AGENCY'S EMINENT DOMAIN AUTHORITY: Sections of the
Redevelopment Plan provide as follows: [CHECSREDEVELOPMENT PLAN LANGUAGE]
Except as specifically exempted herein, the Agency may acquire, but is not
required to acquire any real property located in the Project by any means
authorized by law.
It is in the public interest and is necessary in order to eliminate the,conditions
requiring redevelopment and in order to execute this Plan for the power of
eminent domain to be employed by the Agency to acquire real property in the
Project Area which cannot be acquired by gift, devise, exchange, purchase, or any
other lawful method. Eminent domain proceedings, if used, must be commenced
within twelve (12) years from the date of adoption of this Plan by the City
Council (by ,20 ).
The Agency shall not acquire real property to be retained by an owner pursuant to
a participation agreement if the owner fully performs under the agreement. The
Agency is authorized to acquire structures without acquiring the land upon which
those structures are located. The Agency is authorized to acquire either the entire
fee or any other interest in real property less than a fee.
The Agency shall not acquire real property on which an existing building is to be
continued on its present site and in its present form and use without the consent of
the owner unless: (a) such building requires structural alteration, improvement,
modernization or rehabilitation; or (b)the site or lot on which the building is
situated requires modification in size, shape or use; or(c)it is necessary to impose
upon such property any of the controls, limitations, restrictions, and/or
requirements of this Plan, and the owner fails or refuses to execute a participation
agreement in accordance with the provisions of this Plan.
The Agency is not authorized to acquire real property owned by public bodies
which do not consent to such acquisition. The Agency is authorized, however, to
acquire public property transferred to private ownership before redevelopment of
the Project Area is completed, unless the Agency and the private owner enter into
a participation agreement and the owner completes his responsibilities under the
participation agreement.
Generally, personal property shall not be acquired. However, where necessary in
the execution of this Plan, the Agency is authorized to acquire personal property
in the Project Area by any lawful means,including eminent domain.
In addition to the above limitations, the Agency has adopted "Amended and Restated
Rules Governing Participation by Property Owners and the Extension of Reasonable Preferences
to Business Occupants in the Redevelopment Project" ("Owner
Participation Rules"), which provide reasonable opportunities for owners of property and tenants
in the Project Area to participate in the Redevelopment Plan, and extend reasonable preferences
to businesses in the Project Area. Accordingly, the power of eminent domain shall not be

exercised except in compliance with the rules and procedures set forth therein, as said Owner
Participation Rules may be amended from time to time. A copy of the Owner Participation
Rules are available at the office of the Agency.

Implementation Plan. Section 33490(c) of the California Community Redevelopment

adopt an Implementation Plan for each of its Redevelopment Plans containing the specific goals
and objectives of the Agency, the specific programs, including potential projects, proposed to be
carried out by the Agency, and the estimated expenditures associated with the programs and
projects identified for each Project. In conjunction with the proposed Amendment, the Agency
has also prepared an amendment to the Implementation Plan.
At any time not later than the hour set forth above for the hearing of objections to the
proposed Amendment, any person may file in writing with the City Clerk of the City of
or the Secretary of the Redevelopment Agency of the City of a
statement of objections to the proposed Amendment. At the day, hour and place of the hearing,
any and all persons having any objections to the proposed Amendment, or the regularity of any
of the prior proceedings, may appear before the City Council and the Agency and show cause
why the proposed Amendment should not be adopted.

The legal description of the boundaries of the Project Area was recorded with the County
Recorder of County at the time of adoption of the Redevelopment Plan.
Copies of the legal description of the Project Area are available to the public for inspection
during the Agency's normal business hours. Copies of the legal description are also available
upon request, free of charge at the offices of the City Clerk of the City of and
the office of the Agency, located at , , California.
Based upon an Environmental Checklist and Initial Study, a Negative Declaration has
been prepared relating to the proposed Amendment. The Negative Declaration is available for

WHEREAS, the Redevelopment Agency of the City of (the

WHEREAS, pursuant to Sections 33451.5(c) and 33452 of the California Community
Redevelopment Law(Health and Safety Code Section 33000 et seq.), the Agency shall submit to

with a Report to the City Council on the proposed Amendment; and
WHEREAS, Section 33458 of the Health and Safety Code authorizes a joint public
hearing on the proposed Amendment with the consent of the Agency and the City Council;

WHEREAS, the Redevelopment Agency of the City of (the "Agency")
submitted to the Planning Commission of the City of (the "Planning
Commission") a proposed Amendment (the "Amendment") to the Redevelopment Plan (the
"Redevelopment Plan") for the Redevelopment Project (the "Project")
which would add certain additional area (the "Added Area") to the existing boundaries of the
Project ("Existing Area") and to make certain other clarifying and technical changes related
thereto; and[or whatever the case may be for the Amendment]
WHEREAS, by Resolution No. , adopted on , 20 , the
Planning Commission formulated and adopted a Preliminary Plan for the proposed Amendment;
and
WHEREAS, pursuant to Sections 33346 and 33453 of the California Community
Redevelopment Law (Health and Safety Code Section 33000 et seq.), the Planning Commission
is to review the proposed Amendment and make its report and recommendation thereon to the
City Council of the City of ("City Council"); and
WHEREAS, the Amendment authorizes the acquisition of land for, and the construction

acquired by dedication or otherwise for street, square, park or other public purposes, and
no real property shall be disposed of, no street shall be vacated or abandoned, and no
public building or structure shall be constructed or authorized, if the adopted general plan
or part thereof applies thereto, until the location, purpose and extent of such acquisition
or disposition, such street vacation or abandonment, or such public building or structure
have been submitted to and reported upon by the planning agency as to conformity with
said adopted general plan or part thereof. . .
"(c) A local agency shall not acquire real property for any of the purposes
specified in paragraph (a)nor dispose of any real property, nor construct or authorize a
public building or structure, in any county or city, if such county or city has adopted a
general plan or part thereof and such general plan or part thereof is applicable thereto,
until the location, purpose and extent of such acquisition, disposition, or such public
building or structure have been submitted to and reported upon by the planning agency
having jurisdiction, as to conformity with said adopted general plan or part thereof. . ..";

WHEREAS, the General Plan of the City of has been prepared and
adopted in compliance with the Planning and Zoning Law (Government Code Section 65300
et seq.); and
WHEREAS, the Planning Commission has considered the proposed Amendment, the
[Supplemental Environmental Impact Report/Negative Declaration] on the proposed
Amendment,the General Plan of the City[as amended], and other pertinent reports;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Findings: The Planning Commission hereby finds and determines that:
(a) Pursuant to Sections 33346 and 33453 of the California Community
Redevelopment Law, the proposed Amendment to the Redevelopment Plan for the
Redevelopment Project conforms to the General Plan of the City of
[as amended]; and
(b) Pursuant to Section 65402 of the Government Code, with respect to
activities which may be undertaken within the Added Area pursuant to the proposed Amendment
and that are referred to in said section, such activities and undertakings conform to the General
Plan of the City of
Section 2. Report and Recommendations: The Planning Commission hereby reports
to the Agency and the City Council the findings referred to in Section 1 hereof and recommends
the approval and adoption of the proposed Amendment in substantially the form presented to the
Planning Commission for its review.
Section 3. Transmittal: The Secretary of the Planning Commission is hereby
authorized and directed to transmit a certified copy of this Resolution to the Agency and the City
Council for consideration as part of the Agency's Report to the City Council regarding the
proposed Amendment pursuant to Section 33352 of the Community Redevelopment Law, and
this Resolution shall be deemed the report and recommendation of the Planning Commission
concerning the proposed Amendment and contemplated public projects and activities thereunder
as required by applicable provisions of law.
