CALL TO ORDER — Vice Mayor Tirman (presiding on behalf of Mayor Wallace Dee) called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Flora, Goodwin; Vice Mayor Tirman, and Mayor Wallace Dee. Absent: Council Member Abrams. Staff Present: Scott Mathot, Associate Engineer; Becky Bucar, Engineering Manager, Dan Wilkins, Director of Public Works/Town Engineer; Jeff Loux, Town Manager; Andy Morris, Town Attorney; Judy Price, Director of Communications/Town Clerk, Jessica Thompson, Senior Engineer; Erica Mertens, Administrative Analyst II; Denyelle Nishimori, Community Development Director, Jennifer Masters, Administrative Technician; and Rob Leftwich, Chief of Police. 3. PLEDGE OF ALLEGIANCE — led by Bill Seline. 4. PUBLIC COMMENT Jack Kashtan, Truckee resident: • Spoke regarding Agenda Item 6.4 Hazard Mitigation Plan. Vice Mayor Tirman informed Mr. Kashtan that he could comment on the item during the consent calendar, and requested that he be seated. Mr. Kashtan agreed that he would comment during that time. Vice Mayor Tirman announced that Thursday, June 281", there will be a public forum for any interested members of the public to come and discuss items of concern with a few members of Council and the Town Manager. The forum will be from 4-5:30 p.m. at Philosophy. 5. PRESENTATIONS 5.1 Becky Bucar, Engineering Manager, announced the promotion of Scott Mathot from Engineering Assistant to Associate Engineer. 5.2 Joanne Robique, United States Department of Agriculture Forest Service, Tahoe National Forest, Truckee Ranger District presented on the Local Fuels Reduction Projects. Town of Truckee June 25, 2018, Town Council Regular Page 1 In response to Council questions: • There are overarching discussions about the large-scale management plan in the ' future but it is a complicated situation with many moving parts. She is hopeful for the possibility of more comprehensive fuels management in the future. • The Sawtooth fuels reduction has not begun. They pulled back on the work in order to give the public an opportunity to comment. She estimated that a decision should be reached in the fall, then work can commence next summer. • A variety of companies are likely to bid on these types of projects. 5.3 Bill Seline, Truckee Fire Chief, Truckee Fire Protection District, presentation and Update on Wildfire Prevention and Preparedness (on -file with the Town Clerk). In response to Council questions: • Robert Womack, Emergency Operations Coordinator -Truckee Police Department: o Roughly 5,000 have signed up for notification. o Information is also pushed out to other social media outlets as well, to reach an even larger group of individuals. • Fire preparedness is enforceable through ordinances that are in effect, and in the most drastic cases, the district completes the work and a tax lien is applied to the property for the work. • There are informational flyers available to renters and out of town visitors. • Emergency Operations Coordinator Womack has been working on updating that information. Robert Womack, Emergency Operations Coordinator, provided Council with a I PowerPoint presentation (on -file with the Town Clerk). Vice Mayor Tirman opened the presentation items to public comment. Jack Kashtan, Truckee resident: Questioned whether vacant lots are cited due to citizen complaint, or if they are cited on a proactive basis. o Response: Craig Harvey, Truckee Fire Protection District Fire Marshall, Stated when the Truckee Fire Protection District conducts defensible space inspections, and come across a vacant lot that is affecting a residence within that 100 foot zone or the 30 foot zone, they can inforce defensible space requirements in a number of ways ranging from a fee schedule, citation, or abatement of the property. Vice Mayor Tirman closed public comment. 6. CONSENT CALENDAR Jack Kashtan, Truckee Resident, pulled Item 6.4 for further discussion. It was moved by Mayor Wallace Dee, and seconded by Council Member Goodwin, to approve the Consent Calendar Items 6.1, 6.2, 6.3, 6.5 and 6.6 as follows: 6.1 Waive the second reading and adopt Ordinance 2018-10, adopting regulations for . commercial cannabis delivery services, including approval of Development Code Town of Truckee June 25, 2018, Town Council Regular Page 2 amendments to Chapters 18.12 (Commercial and Manufacturing Zoning Districts) ' and 18.58 (Standards for Specific Plan Uses) to effectuate the new regulations. Amended Ordinance provided to Council as Additional Information adopted. 6.2 Adopt Resolution 2018-39 adopting the Town of Truckee Conflict of Interest Code, which identifies the Town positions designated to file FPPC Conflict of Interest Statements. 6.3 Adopt Resolution 2018-47 authorizing the Town Manager to execute, jointly with the Truckee Fire Protection District, the Wildland Fire Agreement with Cal Fire for Fiscal Year 2018-2019 to provide wildland fire fighting resources within the Town of Truckee in the amount of $222,559.39. 6.5 Authorize the Public Works Director/Town Engineer to file a Notice of Completion with the Nevada County Clerk Recorder for CNW Construction, Inc. for the Town Hall Remodel (C0502), and the Town Hall Lease Space Improvement Projects (C1714). 6.6 Authorize expenditures not to exceed $65,000 with Liebert Cassidy, Whitmore for legal and other services for the fiscal 2017/18 year. The Consent Calendar carried with the following vote: Ayes: Council Members Goodwin, Flora, Vice Mayor Tirman, and Mayor Wallace Dee. Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. ' 6.4 Adoption of the Nevada County 2017 Local Hazard Mitigation Plan — Town of Truckee Annex. Recommended Action: Adopt the Nevada County 2017 Local Hazard Mitigation Plan, including the Town of Truckee Annex. Jack Kashtan, Truckee resident: • Stated that this plan lacks flood and debris flow mitigation. • Provided anecdotal information regarding flows and flood events in his neighborhood. • Noted that the plan does not appear to have much action associated with mitigation of flooding and debris flow. • The budget for such activities does not seem sufficient to mitigate the flows, and it doesn't appear that there is a timeline as it is funding dependent. Rob Leftwich, Town of Truckee Chief of Police, noted: • Of the entire hazard mitigation plan, the portion that was presented to the Town was only the Town of Truckee Annex which is 100 pages of the full 900 page document. • Those natural events are addressed in the plan to some degree, but it is not intended to be the answer for all plans and contingencies. • There are some jurisdictional boundaries that may come into play in regard to the specific area that Mr. Kashtan referenced since the plan is meant to cover the entirety of Nevada County. Town of Truckee June 25, 2018, Town Council Regular Page 3 Robert Womack, Emergency Operations Coordinator. • Provided further explanation that the Federal Emergency Management Agency (FEMA) requires the plan to be updated every five years. Because the plan covers a five year span, and will likely have an impact on the General Plan Update. • The process is to look at what they accomplished, and then take note of what still needs to be accomplished, and them rank them. The staff recommendation was moved by Council Member Flora, seconded by Mayor Wallace Dee, and adopted with the following vote: Ayes: Council Members Goodwin, Flora, Vice Mayor Tirman, and Mayor Wallace Dee. Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. DISCUSSION ITEMS 7.1 STAFF REPORT: Adoption of Commercial Solid Waste Service Rate. Recommended Action: Approve commercial solid waste rate schedules, modifying programmatic commercial services and increasing service rates. Erica Mertens, Administrative Analyst II, presented from the staff report (presentation on - file with the Town Clerk). Vice Mayor Tirman opened the item for public comment. Seeing none, Vice Mayor Tirman closed public comment. The staff recommendation was moved by Council Member Goodwin, seconded by Council Member Flora, and adopted with the following vote: Ayes: Council Members Goodwin, Flora, Vice Mayor Tirman, and Mayor Wallace Dee. Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. 7.2 STAFF REPORT: Envision Donner Pass Road (DPR) Western Segment Utility Undergrounding Project, C1815 Contract Award and Utility Provider Agreements. Recommended Action: 1) Award the Envision DPR Western Segment Utility Undergrounding Project (C1815) to C&D Contractors, Inc. in the amount of $2,693,576, authorize a project contingency amount of 10%, and authorize the Town Engineer to approve contract change orders or changes to unit quantities within the approved contingency amount for a total authorized contract expenditure amount of $2,962,934; and 2) Authorize the Town Manager to execute agreements with AT&T, Suddenlink, and Truckee Donner Public Utility District (Amendment) as outlined in this staff report. Council Discussion: • Suddenlink was the entity with which the Town had the most doubts about signing the Public Utility Agreement (PUA), but at this time we are confident that they will sign. • The intention is to hold off on signing the construction contract award until the Public Utility Agreements with the utility providers have been signed. • In the bid process, staff looks at engineering estimates to compare the costs, and in looking at the engineers estimates; the low bid for this project came in 10% under the estimates. Vice Mayor Tirman opened the item for public comment. Seeing none, Vice Mayor Tirman closed public comment. The staff recommendation was moved by Mayor Wallace Dee, seconded by Council Member Goodwin, and adopted with the following vote: Ayes: Council Members Goodwin, Flora, Vice Mayor Tirman, and Mayor Wallace Dee. The motion passed 4-0. 7.3 PUBLIC HEARING — STAFF REPORT: Contract Award for Bridge Street at Donner Pass Road and West River Street/East River Street Intersection Feasibility and Improvement Project, C1805. Recommended Action: Authorize the Town Manager to 1) execute a design services contract with Eastern Sierra Engineering in the amount of $553,305 for the Bridge Street at Donner Pass Road and West River Street/East River Street Intersection Feasibility and Improvement Project; 2) authorize a 10% contingency ($55,330) for a total authorized contract amount of $608,635; 3) authorize staff to solicit participation in the Project Advisory Committee; and 4) authorize a budget amendment to C1805, as outlined in this staff report. Jessica Thompson, Senior Engineer, presented from the staff report (presentation on - file with the Town Clerk). Council Discussion: • Requested staff discuss the discrepancy between the initial $300,000 figure as compared to the $600,000 figure. • There is a wide array of different options being considered, and the $600,000 figure is a worst case scenario. • Staff did not want the contract amount to be limiting to the design phase. Part of the budget is explicitly for traffic impact fees. • There is a possibility of reducing the contractor in order to reduce expenses. number of alternatives requested of the Town of Truckee June 25, 2018, Town Council Regular Page 5 " A provision could be written into the contract specifying contractual reimbursement will be based on time and materials reporting. ' " The timing for the project would be roughly through the end of next summer if it is approved tonight. " Staff had discussions with contractors to find out why some showed interest, but did not actually bid. It was because the project is very challenging, the contractors are busy, and therefore are being very selective in the projects they are choosing. " Concern about keeping this project moving forward in an effective manner, and not getting sidetracked by other side conversations. " We need to be focused with our outreach, especially in the downtown area. " Outreach needs to be very specific that this is not the General Plan discussion. " It is a good idea to make sure that during the Downtown Specific Plan, and General Plan Update conversations, to inform the public that a separate conversation will be occurring about this one specific area. Vice Mayor Tirman opened the item for public comment. Jeanie McCarthy, Truckee resident: " Provided anecdotal information surrounding the project area. " Stated she is against this project., We have already spent a lot of money creating a bypass, then creating an underpass for the train in order to relieve traffic downtown. " There is no more land downtown to accommodate this plan. " This is public money being spent on the unnecessary studying and re -studying of issues that cannot be solved. Vice Mayor Tirman closed public comment. , Council Discussion: Dan Wilkins, Public Works Director/Town Engineer: o Noted that the focus at this location is more about improving pedestrian safety than it is about the improvement of traffic flow. o . Stated that if this project increases pedestrian safety beyond the current requirements, it may allow train engineers to have the discretion to blow their horn or not as part of the quiet noise envelope. Regarding Ms. McCarthy's concerns, the funds are coming from traffic impact fees imposed on development projects throughout the Town, including the Railyard project - not from the General Fund. Council Member Goodwin volunteered to serve as a Council liaison on this project. The staff recommendation was moved by Council Member Goodwin, seconded by Council Member Flora, and adopted with the following vote: Ayes: Council Members Goodwin, Flora, Vice Mayor Tirman, and Mayor Wallace Dee. COUNCIL REPORTS ' Vice Mayor Tirman • Attended the first Truckee Thursdays of the season. • Attended the Truckee Arts Master Plan kickoff meeting. • Attended Truckee Chamber business speaks. • Attended Tahoe Truckee Humane Society fundraiser this past Saturday. Council Member Goodwin • Attended the Truckee High School graduation as their commencement speaker. Town Manager Loux, gave an update and noted that the same affordable housing partner has proposed a project at Schaffer's Mill (a required project of Placer County), and the Town could be on the receiving end of $1.5 million dollars for regional transit and transportation, and an additional $500,000 for the West River Streetscape Project. 9.
