A request to place a "Polo Cottage" for historical preservation and faculty housing. 2. Request to reduce the Front -yard setback requirement from the required (78') to (58') from the center of SR AlA. 3. Minimum square footage of the "Polo Cottage" is less than the required (3,000) square feet. Pursuant to Section VII R.S. Residential Single - Family District J -1, N -1 and H -1. Gulf Stream Code of Ordinances. This request will come before the Planning and Zoning Board June 7, 1989 at 9 a.m. and the Gulf Stream Town Commission June 16, 1989 at 9 a.m. Gulf Stream Town Hall, 100 Sea Road, Gulf Stream, Florida. JR HEADMASTER To: Town of Gulf Stream From: Gulf Stream School Foundation, Inc. Subject: Application for Variance Project Name: "Moving of house - departure from Code re: Agreement" Date: May 12, 1989 Gulf Stream School requests a variance from the existing Code concerning the matter of "no more buildings to be constructed on the School grounds." The School proposes to move a small wood -frame "polo cottage" from its existing location at the corner of Banyan Road and SR AIA to a location beside its sports field and fronting AIA. The house is being donated to the School and would be used as a teacher residence only. Background: About four years ago when the School proposed to construct a new auditorium /chapel building, it secured the permission of the Town of Gulf Stream to do so provided (1) that an existing wooden building (used as a classroom building) be razed and (2) that no other new school buildings be constructed. The School is happy with this arrangement and has no desire or plans to "enlarge the student body." (In fact, present facilities are at capacity to service the needs of existing students.) This agreement was formulated into the Town Code for future reference. The School bases its request for a Variance on the following reasons: 1. This does not involve new construction. 2. It is not a school building. It is a small residence. Students will not be using it. 3. The building is an historical "polo cottage," an original, as judged by Mr. Clemmer Mayhew of the Delray Historical Society. Not many such buildings now exist. This is a step in preservation. 4. Placement of the house in this location is both reasonable and appropriate. There are no other practical places to put faculty housing of this type on the campus. It is also suitable in terms of concept. Gulf Stream became the center for polo in the Southeastern United States in the 193O's and GULF STREAM SCHOOL • 3600 GULF STREAM ROAD • GULF STREAM, FLORIDA 33483 • 276 - -l-F page 2 194O's. The School was built on land leased to it originally by the Phipps family and on which land national polo matches were played. For years, the School operated its classes in converted stables on this site. The preserving of a polo cottage would be historically and reasonably consistent with the area's history. 5. This small, wood -frame cottage, which has only two bedrooms and amounts to less than 1,500 square feet, is low -lying and attractive. It will blend -in well with the surroundings; and after its placement, the building will be thoroughly landscaped. It will utilize the same, existing driveway which services the small, and similar (and non - conforming -use) house to the north. 6. Probably for the next ten years at least, the house will be lived in by a single person, a long- tenured teacher at the School. There would be no increase in traffic as this person would park outside the cottage and walk to work rather than using existing School parking space. Said person would act as a security check and fire warden, both at the School and indirectly for this part of the Town for much or all of the summer as well as winter months. Matter relating to building and sanitary codes are referred to in the second Variance Application which accompanies this document. Sincerely, Thomas M. Ocean Blvd. to Gulf Stream School property, to a location approximating 3650 N. Ocean Blvd., on SR AlA. Date: May 12, 1989 Gulf Stream School Foundation, Inc., petitions the Town of Gulf Stream for a variance from the existing Code regarding setback requirements for the moving and placing off an existing house from its present location at 3452 N. Ocean Boulevard to School property, approximating 3650 N. Ocean Boulevard. The house to be moved is a one - story, wood- frame, "polo cottage" faced in front with brick. It contains two bedrooms and would be lived in by a single person who teaches at the School. The cottage is small, and under 1,500 square feet of floor space. It is low and unobtrusive. As indicated on the attached partial site plan, the only practical place on which the dwelling may be moved is a site adjacent to the sports field and located close to an presently- existing dwelling known as the Silvia house at 3700 N. Ocean Boulevard. The petitioner would like to point out that the Silvia house at 3700 N. Ocean Boulevard, an original and historical dwelling some fifty feet to the north, and once a stable- keeper's cottage, is already non- conforming, with only 15 -plus feet from the front property line. The proposed dwelling is consistent conceptually and historically with the location and the founding of the School, once a part of polo fields and stables in the 1930's and 1940's. Not many such buildings exist which tie us to the past. We are able to locate the house slightly beyond the 25 -foot setback requirement from the front property line. It will be placed at a 7 -foot height above mean sea level (this is not a problem as the house would sit on relatively high ground, on level with AIA). It would be slightly higher than the Silvia house, in fact. Facilities will be approved in the normal manner through the County Health Department. House will be upgraded as to electrical and plumbing, etc., requirements to meet existing codes. All proper permits will be secured and State and local police authorities would be contacted. The driveway- access will meet the approval of Ocean Ridge Fire Department. Bond will be posted for road damage. Insurance certificates will be provided so as to hold the Town of Gulf Stream harmless from liability. The proposed move would be accomplished by LaPlant -Adair Company, professional movers, and would occur at night - well into the early morning. The house would be divided in two parts for moving. OTHER: The house would provide not only living space for a valued faculty member, but said person would provide additional security for the School at off- hours, and indirectly, security watch for the town. The proposal implies no additional parking in the area since said teacher normally parks at the School during the day now and would be parking on the other side of the campus. (Technically, there would be less traffic since said person would walk to work.) Except for the setback problem, we see this proposal in a positive light: it does not increase population in the usual sense; it is a reasonable use of the land; and the use is consistent historically with the Town and the School. It is our understanding that the required setbacks have changed since the original house was constructed, and they will therefore need a variance to construct the roof system. The hardship which Mr. & Mrs. Norem face is that the foundation system which holds up the existing rear porch and the proposed new roof presently exists at the old setback lines. This existing foundation system is a piling and grade beam system which would be next to impossible to change or add to given the existing site configuration along the waterway. The granting of this variance requested will not confer on the applicant any special privileges that have not already been granted to other residents in the area, and it is the minimal variance that will make the reasonable use of the rear porch possible. The porch in question exists on the northwest rear portion of the lot and is not visible from any public roadway. The addition as proposed will be visible from the waterway and neighbors to the north of the site, but will be in the same architectural style as the remainder of the existing home and, in our opinion, will enhance the pool, patio, and rear area of the lot. I have collected, additionally, a number of ordinances and documents governing architectural and zoning,commissions for some of our neighboring communities: Manalapan has an architectural committee that must approve as simple a procedure as changing the color of a house. This committee acts to approve all new construction plans, residential changes and additions within the town. In Palm,Beach, where Tim Frank is Town Planner, they are conducting massive down zoning -- that is, zoning parcels to maintain present usage utilizing a comprehensive plan. No building permit is issued without the approval of either the Palm Beach Architectural Commission or Landmark Preservation Commission. It is of particular interest to note that our town attorney, John Randolph, is attorney for Palm Beach as well and has worked diligently to protect Palm Beach from this teardown and subdivision mania. Available also, are guidelines for Lost Tree Village and excerpts from Vanity Fair, April 1989, an article titled " Teardown" by Domenick Dunne. Please contact Clarence at Town Hall, 407 - 276 -5116, to see a copy. Another current issue precipitating a need for concern is the Coastal Construction Line Setback, which could very likely go into effect in January of 1990. Developers and residents, alike, are very aware of the restrictions this new law will pose and, therefore, are making plans to move quickly to circumvent the impact on oceanfront properties. The Town Appearance and Beautification Committee feels someone should reevaluate town ordinances in light of the CCL ruling and this national teardown trend. In addition, we feel that thoughtful consideration should be made in regard to lot coverage, setbacks, appropriate landscaping, and a concern many have about developers coming into our community to build "spec" houses that do not fit into the character of Gulf Stream as a town of charm and quality. l page 2 With this in mind, we ask the Directors of the Town of Gulf Stream Civic Association, Inc. to strongly urge the Gulf Stream Town Commission, at its June 9th meeting, to declare a one hundred day moratorium on approving new construction so that a committee can be made up of representatives as follows: one from the Town Commission two from the Planning and Zoning Board one from the Town of Gulf Stream Civic Association one from the Place au Soleil Homeowners' Association one from the Town Appearance and Beautification Committee. These representatives can meet with the Town Attorney to make recommendations regarding the possible establishment of: (1) an architectural committee (2) a landmark preservation board (3) changes in our current zoning ordinances (4) guidelines to discourage the construction of "spec" houses. At this time the plans for the construction of this residence have been approved. These permits include the Demolition of the existing residence. The Permit for selective tree removal we understand is ready for approval with the exception of the issue of the Australian Pines. In pursuit of this point, we were not able to find any regulation, code or ordinance of file with the Town that provided for protection of Australian Pines. In fact the only regulation record is a State law that prohibits the propogation and sale of Meleleuka, Australian Pine and Brazilian Pepper trees anywhere within the State of Florida. Further more, the Counties of Dade, Broward and Palm Beach, require no permits for the removal of these species of tree on private or commercial properties other than the proper license to operate to a tree trimming service. Furthermore, it is in direct conflict with our lisence as Registered Landscape Architect in providing for the Health, Saftey and Welfare Act to ignore the Australian Pines which occur on the parcel for which we are responsible when these same trees line the primary hurricane evacuation route. We hope you understand our dilema. We have checked with Palm Beach County Building Department, Landscape Division, as well as the PBC Agricultural Extension Agents offices and found no justification to allow the trees to remain. Can this Board refer us to some regulation of record to allow us to resolve this issue in order to proceed with construction in a timely manner. Built during the era when Gulf Stream was the "Polo Capital of the United States ", the cottage exemplifies the values and traditions of the time. Today, it serves as a reminder of a time when this community was one of the premiere resorts in America. has The house features three bedrooms and two baths with an open Living— Dining area. The Living Room a .fireplace, and hardwood floors accent the house.., The matching bay windows in the two principal bedrooms, and the detailed glass wall in the Living area denote an architectural sense of detail (Both %Henry Pope and Henry Harding, two distinguished architects, have been credited with the cottage designs).Though modest in scale and dimension, the structure's significance becomes integral when considered as part of an ensemble of almost fifteen remaining cottages. "(April 22,1964, A.D. Beveridge) GULF STREAM POLO TIMELINE 1926 Phipps Family introduces Polo to Palm Beach County 1934 Gulf Stream Polo begins. J.S. Phipps introduces Polo to Gulf Stream on the fields along the Intracoastal Waterway. Over 2000 spectators were often attracted to the site where games were played four times weekly. Proclaimed the "Winter Polo Capital of the United States ", the playing fields were complimented with two practice fields, stables, a clubhouse, a blacksmith shop, and numerous cottages for the players, their families, and polo personnel( "the Polo Cottages") These modest frame buildings were situated near the fields and were built between the late 1920s to the early 1940s. Considered the "Birthplace of Florida Polo ", the nation's finest enthusiasts were featured: Stewart Iglehart, Cecil Smith, and Mike Phipps. The United States 40 goal team of 1939 featured Iglehart, Phipps, Smith, and Thomas Hitchcock,Jr. When the Miami Beach fields were closed in the late 1930s, Gulf Stream became the only field South of Aiken, South Carolina. 1956 Henry Pope purchases polo fields from the Phipps Family. Bert and A.D. Beveridge announce the move to Arthur Vining Davis' new fields on Camino Real near the Boca Raton Hotel and Club. Demolition Procedure While the Town of Gulf Stream is assessing the adoption of preservation elements and architectural guidelines for new construction and renovation the following moratorium on demolition shall be in place by the Planning and Zoning Board: Upon the request for demolition of a property owner for any building or structure constructed before 1945, the following shall be guidelines in evaluating applications for demolition: Whether the structure is of such interest or quality that it would reasonable fulfill criteria for designation on the National Register. Whether the structure is of such design, craftsmanship, or material that it could be reproduced only with great difficulty or economically nonviable expense. Whether the structure is one of the last remaining examples of its kind within the community. Whether retaining the structure would promote the general welfare of the the Town by providing an opportunity to study local history, architecture, design, or by developing an understanding of the importance and value of a particular culture and heritage. Whether there are definite plans for immediate reuse of the property if the proposed demolition is carried out, and what effect those plans will have on the character of the surrounding area.
