President, Gulf Stream School Headmaster, Gulf Stream School On motion duly made and seconded the Minutes of the May 5, 1989 meeting were approved. 3. Financial Report Mr. Gwynn reporting for May noted the deficit is slowly being reduced; that budget projections through the end of the fiscal year will be no problem but until tax revenues are received in November the budget will be tight. On motion duly made and seconded the Financial Report was approved. Noting dropping interest rates Mr. Armour suggested possible restructering the Town's debt. Mr. Gwynn will make the necessary inquiries. Town Commission Meeting June 16, 1989 Minutes - Page Two 4. Police Report Captain Buchan gave the department's report for May noting increased traffic monitoring resulted in doubling citations issued. Mayor Koch said he has heard good comments about the department. 5. Planning & Zoning Board Report a. Mr. Mayer began his report with the request by the Gulf Stream School to move a cottage onto the sports field fronting on AIA for faculty use and historical preservation. Mr. Flannery read a letter addressed to the Town Commission from Mr. Brian Pfeifler in which Mr. Pfeifler listed his objections to placing the noted cottage on the school grounds. Mr. Pfeifler set forth certain landscaping conditions as well as certain restrictions on additional structures and requested the Commission consider his concerns in this matter. Mrs. Wallace, Chairman of the Town Beautification Committee, spoke in favor of having the cottage moved to the school. Mr. Dixson, representing the Civic Association, strongly supported the move and hoped the Commission would approve the'School's request. Mr. Woodward presented the plans for landscaping the cottage and surrounding areas. Mr. Brooks, who did the elevation, gave detailed information on the proposed landscaping noting that the cottage would not be visible from AIA. C' MayorlKoch said the Planning & Zoning Board will check to see that everything is in proper order prior to issuing a Certificate of Occupancy. Mr. Armour noted the three provisions made by Mr. Pfeifler are assets to the Town. Mr. Stahl proposed a motion to approve this request subject to 1) the Commission reiterating the prohibition as stated in our zoning Code on additional structures 2) that there will be no additional structures placed south along AIA on school property and 3) to insure the landscaping is carried out according to the plan as presented. Mr. Stahl's motion was seconded and carried by the Commission. b. On the Pulte matter tabled at the May 5, 1989 meeting and postponed to this date, the petitioner has withdrawn the request. c. Mr. Dudley Brown Morgan, Lots 3 and 4, Block B of Plat of Blocks A B & Z of Palm Beach Shore Acres, Ocean Boulevard Estates, Plat Book 7, Page 15. 1. Due to Coastal Setback restriction and the 25% front yard requirement, a request to reduce the required 68.75' front yard setbacks to 57'. This meets the 78' requirement along AlA. Total setback from the middle of AlA will be 90'. 2. Variance request to reduce the side yard requirement from 15% to 10' as allowed at the platting of said lots. No objections having been received and discussion concluded, the Board on motion duly made and seconded granted 'said requests. Mayor Koch stated for the record that he abstained from discussion and voting in this matter and submitted Form 8B to be filed with these Minutes and made a permanent _ part thereof. Town Commission Meeting June 16, 1989 Minutes - Page Three 5. Planning & Zoning Board Report C d. Mr. and Mrs. Stormet Norem, 539 Middle Road, Lot 11, Gulf Stream Cove. Variance needed to reduce the w/s yard setback from the required 15' to 10' 4" in order to place roof over existing rear patio. This would be a continuance to the present wall. Sec. VII - R.S., K -1, Page 24 -25. On motion duly made and seconded the Commission approved this request. Mayor Koch stated for the record that he abstained from discussion and voting in this matter and has submitted Form 8B to be filed with these Minutes and made a permanent part thereof. e. Mr. and Mrs. George L. Mueller, 1180 Polo Drive, Lots 5 & 6, Gulf Stream Cove No variance required. No action was required or taken. f. Mr. and Mrs. Breazeale, 3450 Gulf Stream Road, Lot 2, Block 1, Plat 1, Polo Fields. Request for addition of a second floor and deck enclosure to existing residence. For information only. No action required or taken. f. Mr. and Mrs. Mitchel Denberg, 1221 No. Ocean Blvd. Lot 9 Block D. Revised Plat of 13ioc &E, Palm Beach Shores Acres. 1. Request to place construction trailer on property during construction of new residence. 2. Request to cut down existing pine trees. C' On motion duly made and seconded the Commission approved request No.1 to place construction trailer on property for six months. Mr. Mayer related the background on cutting down the pine trees noting the petitioner agreed to fertilize and care for the trees. A decision will be made later if this is unsuccessful. g. Mr. and Mrs. Stiritz, 1421 No. Ocean Request to place construction trailer on property during construction of new residence. On motion duly made and seconded the Commission approved the request to place a construction trailer on said property for six months. h. Demolition Permit and Site Plan Review - Information only Thomas Crocker, 3265 No. Ocean Blvd. Sec. X- General Provisions M -1, Page 41 No action necessary or taken. 6. Ordinance 89 -4. Town of Gulf Stream Comprehensive Plan Mayor Koch gave a summary of the Town and State efforts to effect a compromise on the Plan. Terry Clark, Director of Planning, will return on July 7th with a substantially revised Comprehensive Plan and will request Commission to adopt said Plan. Discussion centered on beach access and public parking as specific information is required by the State. Town Commission Meeting June 16, 1989 Minutes - Page Four O6. Ordinance 89 -4, Town of Gulf Stream Comprehensive Plan (continued) Discussion of the use of F.I.N.D property ensued. It was noted the south section is residential. The northern portion will be a conservation area. The Town of Gulf Stream has received the Access Easement Deed. Beach preservation, conservation of the natural habitat and setback lines were discussed. On motion duly made and seconded the Commission approved the expenditure of $8500. for the Comprehensive Plan. The Plan will be in the Commissioner's hands prior to the July 7, 1989 meeting on the Comprehensive Plan. The first reading of the proposed Town of Gulf Stream Ordinance 89 -4 entitled: AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, ADOPTING A COMPREHENSIVE PLAN FOR THE TOWN OF GULF STREAM, FLORIDA, INCLUDING A FUTURE LAND USE ELEMENT, A TRAFFIC CIRCULATION ELEMENT, A HOUSING ELEMENT, A SANITARY SEWER, SOLID WASTE, DRAINAGE, POTABLE WATER AND NATURAL GROUND WATER AQUIFER RECHARGE ELEMENT, A COASTAL MANAGEMENT ELEMENT, CONSERVATION ELEMENT, RECREATION AND OPEN SPACE ELEMENT, INTERGOVERNMENTAL COORDINATION ELEMENT, CAPITAL IMPROVEMENTS ELEMENT. PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES. C' On motion duly made and seconded the Commission approved Town of Gulf Stream Ordinance 89 -4 on first reading. 7. Discussion of a Proposed Architectural Review Board by Mrs Wallace Mrs. Wallace proposed the Town Commission determine the need for an architectural review committee citing possible need to update code requirements and giving an historical perspective of the community. Mr. Dixson spoke on the Civic Association support of such a committee. Discussion ensued with general participation and interest in preserving the character of_the.community and the means by which this can be accomplished. Commissioner Stahl suggested Mrs. Wallace, Mr. Dixson and possibly others return in three weeks with a written document setting forth the goals of the proposed Architectural Review Board for Commission consideration. Mr. Dixson said the proposed committee has one single objective and that is to take whatever means are available that are reasonable, sensible and practical to preserve the profile and the community as it is now and has historically existed. 8. Resolution No. 89 -4 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, REQUESTING THE FLORIDA LEGISLATURE TO ENACT LEGISLATION TO PROVIDE FOR STATE FUNDING SOURCES FOR MUNICIPALLY / SUPPORTED PUBLIC LIBRARIES. The Commission referred this matter to the Town Attorney. Town Commission Meeting June 16, 1989 Minutes - Page Five 9. Discuss Employee Pension Fund �) Mr. Flannery summarized the present pension plan of Town policemen and the funding of an alternative plan. Mr. Flannery introduced Marvin B. Clayton of the State Insurance Office. Mr. Clayton answered Commissioner's questions, cited experiences of other municipalities and made a presentation of a pension plan available through the Municipal Police Officers and Firefighters Retirement Trust Funds including investment of funds and specific monies required. Mayor Koch requested Mr. Clayton send the Commission a list of municipalities participating in the Trust Funds Pension Plan. Mr. Flannery noted the Enabling Ordinance must be passed before any monies can be collected and the Ordinance has to be in place before the pension fund can be activated. Mr. Stahl expressed the Commissions appreciation to Mr. Clayton for his presentation. 10. Commission Comments Mr. Armour requested the record show the Commissioners thanked the City of Boynton Beach for passing an Ordinance that essentially prohibits "dirty book" stores and topless dancing. Commissioner Armour's motion to write a letter to the City of Delray Beaqh congratulating them for taking action to purchase the "dirty book" store was seconded and passed by the Commission. Mr. Flannery brought to the attention of the Commission a particular clause in the IDS pension plan that precludes union member participation in said plan. r- A letter will be sent to IDS by the Trustees to take care of the matter. The July Commission meeting date was changed to July 19, 1989 at 4:15 p.m. and a Budget Meeting will be held on the same date at 5:00 p.m. Mr. Gwynn will provide the budget information three or four days prior to July 19th. There being no further business the meeting was adjourned at 10:40 a.m. r o Cle k oo_o_ures) Engooanng_ and _Mann_hg� knco Hazardous Materials Management Environmental Engineering Planning DATE: June 5, 1989 TO: Gulf Stream Town Commissioners FROM: Terry A. Clark, AICP RE: Response and Recommended Plan of Action to the Florida Department of Community Affairs (DCA) Review of the Town's draft Comprehensive Plan. The Town of Gulf Stream transmitted 10 copies of the draft Comprehensive Plan to DCA on February 1, 1989. DCA reviewed the plan and prepared an Objections, Recommendations, and Comments (ORC) Report which was received by the Town on May 15, 1989. The Town must review the ORC Report, make any appropriate changes to the plan, and adopt the Comprehensive Plan by July 15, 1989. Resource Engineering and Planning, Inc. (REP /Inc.) prepared the draft plan, reviewed the plan with staff and Commissioners during several public workshops and meetings, and made revisions to the plan as a result of those meetings. All fees paid to REP /Inc. for preparation of the plan were the result of a grant program from DCA. No local funds were used in the preparation of the plan except for copying and advertising. REP /Ines. opinion of DCA's ORC Report is mixed. We feel the draft plan submitted to DCA meets the intent of the statewide planning legislation as it pertains to Gulf Stream. The town is almost builtout and is not subject to many of the growth pains experienced by other communities in Florida. Accordingly, we made this point very clear and repeatedly throughout the plan. DCA, however, has taken the approach of applying the statewide planning requirements (Rule 9J -5 and Chapter 163, FS) to Gulf Stream the same as they have been applied to Miami and Dade County. We feel this is not appropriate and unfortunate, but, that is DCA's posture. 111=1 REP /lnc. 3920 RCA Boulevard • Suite 2001 • Palm Beach Gardens, Florida 33410 • im 407.622.9030 As a result of DCA's approach, the ORC Report is a very tedious document but one that must be taken seriously. REP /Inc. has reviewed the ORC Report in detail and has classified the comments into 3 categories: Category 1. Items that were omitted or need elaboration according to DCA. Category 2. Items that the Town Commission must take action on or set policy more clearly. Category 3. New interpretations, inconsistencies, or oversights by DCA. Examples of Category 1 comments include inconsistent acreages given of existing land uses and the exclusion of historic sites in the data analysis. REP /Inc. takes full responsibility for Category 1 comments and will make these changes at no charge to the Town. Category 2 comments relate to issues such as the potential development of the FIND property and other issues where more specific direction is needed from the Town Commission on how certain policies are to be implemented. These issues must be considered by the Town, decisions made, and appropriate revisions made to the plan. These issues can be discussed during the June 16, 1989, Town Commission meeting. Category 3 comments are clear oversights by DCA or are new interpretations of the regulations by DCA that were not known until receipt of the ORC Report. Examples of these comments include 10 A and C on page 7 of the ORC Report which state that the Town's plan must include objectives addressing blighted areas and urban sprawl. However, the draft plan clearly states on pages 22 -23 that these are not issues in Gulf Steam. Response to these and other similar comments will require further clarification in the plan or the preparation of a separate document specifically indentifying sections of the requirements that do not apply to Gulf Stream with supporting justification. Attached is a schedule listing critical dates for revising, adopting, and transmitting the adopted plan to DCA. In addition to revising the plan, other tasks must be performed including: • Preparation of the ordinance for adoption of the plan. • Advertising of the adoption public hearing for the plan. • Public hearings for plan adoption. • Copying, binding, and transmittal of all documents to DCA. In addition, REP /Inc. recommends that representives from the Town of Gulf Stream travel to Tallahassee to meet with DCA officials after transmittal of the adopted plan and before DCA makes a final determination of consistency or non - consistency. The purpose of such a trip is to discuss any potential problems and to alleviate any problems prior to DCA's final statement. This has proven beneficial for other communities and is recommended by DCA. As stated previously, REP /Inc. will respond to Category 1 comments at no charge to the Town. Category 2 and 3 comments and preparation and transmittal of the plan and other required documents can be done by the Town staff or by REP /Inc. We estimate our fee for such work would be $8,500.00 and would include: • Response to Category 2 and 3 comments; • Attendance at two Commission meetings; • Advertising for the plan adoption public hearing; • Copying, binding, and transmittal of the plan and related documents; • Preparation of the plan adoption ordinance. • one meeting with DCA officials after transmittal of the adopted plan prior to DCA's final determination. REP /Inc. wants to help the Town in meeting the requirements and timeframe plan imposed by the state for adoption of the Comprehensive Plan. BOX 1496, DELRAY BEACH, FLORIDA Memorandum to: The Commissioners of the Town of Gulf Stream From The Appearance and Beautification Committee and the Executive Comittee of the Gulf Stream Civic Association. Subject A Statement of Purposes and Objectives of a Committee formed to consider and recommend on various matters concerning the future profile of the Town of Gulf Stream. Date June 20, 1989 To comply with the request of the Commission made June 16, 1989, the Town Appearance and Beautification Committee of the Civic Association submits the following objectives of a Committee to be appointed by the Town Commission at the earliest possible date. The overall objective of this committee is to establish for the Town of Gulf Stream assurance that future construction and landscaping be in conformity with good taste and generally contribute to the image of Gulf Stream as a place of beauty, balance, charm and high quality and thus protect the historical profile of the community, 1. The Town Appearance and Beautification Committee of the Gulf Stream Association as well as the Association's Executive Committee requests the Town Commission appoint a Review and Study Committee of residents of the Town of Gulf Stream and others having necessary experience and abilities, to deal with all matters related to this Statement of Purposes and Objectives and to make recommendations to achieve same. This Review and Study Committee would be made up of the following: Representatives of the Town Commission, the Planning & Zoning Board, the Gulf Stream Civic Association and its Appearance and Beautification Committee, the Place au Soleil Home Owner's Association and the Town Attorney acting in an advisory capacity. 2. The said Committee shall review the Zoning Ordinance the Town adopted in 1983. In such review, questions involving the following should be carefully examined and recommendations made for such changes as may be adviseable. a) In considering all specific shortcomings of the existing Ordinances the Committee shall identify those which have arisen from the experience of the Planning 8 Zoning Board and by reason of unsatisfactory results in legal procedures. b) Construction setbacks of side, front and rear re- evaluated, determined and amended where adviseable to meet the present and future needs of the Town. C) Minima and maxima square footage restrictions determined both to meet the needs of the area configuration of the lot in question and to benefit the community as a whole. Relevant questions arising from the extended construction setback line, which is believed will be adopted by State authorities not later than mid -year 1990, must be faced and considered. d) While acknowledging that the Planning & Zoning Board has done an excellent job operating within the provisions of the present Code, however, the Planning Board decisions and policy during the six years following the adoption of the Zoning Ordinance should be examined with a view to applying more restrictive interpretation of need and hardship principles. e) Re- examine the entire Zoning Ordinance to determine adviseable and necessary revisions. 3. The'Committee shall study and make recommendations establishing an architectural function within the Planning and Zoning Board such as has existed in the Towns of Palm Beach and Manalapan for some years. a) The architectural review functions shall include recommendations for approval or disapproval of the issuance of a Building Permit by the Town Commission or other authority based upon specific criteria to be recommended by the Committee, including planting and landscaping. With this in mind we are providing this letter to encourage your assistance in protecting sea turtles, which are classified by Federal and State Laws as "threatened" and "endangered." From April 1 through October 31, the approximate length of the sea turtle nesting season, the Town requests.and:strongly encourages all oceanfront property owners to shield or redirect any artificial light that would otherwise be visible from the beach between 10:00 p.m. and 7 :00 a.m. Artificial light confuses turtle hatchlings and can prevent them from successfully entering the Ocean when they emerge from their nests. Please also note that State Laws and regulations require that beach cleaning be performed in a manner that does not damage, alter, or destroy sea turtle nests or hatchlings. While you are shielding or redirecting all artificial light on your property from the beach, the Town and Florida Power and Light will be doing the same by shielding the beach from street lights and other artificial lighting on public property. Moreover, the Town encourages all new oceanfront construction to include provisions for shielding or redirecting artificial light away from the beach. We know that many of you have already taken steps to protect nesting sea turtles, and your voluntary assistance is greatly appre- ciated. Via ordinances, several cities and Palm Beach County have instituted more restrictive and mandatory regulations to protect sea turtles (and the State is considering such a law). We are optimistic that residents' voluntary cooperation will preclude the need for the Town to consider a more,restrictive ordinance. The purpose of this ordinance is to protect the threatened and endangered sea turtles which nest along the beaches of the Town of Gulf Stream, Florida by safegarding .the sea turtles and hatchlings from the impact of artificial light. The "Beach" is defined for purposes of this ordinance as being that land along the Atlantic Ocean extending either to the dune or permanent vegetation within the Town Limits of the Town of Gulf Stream. All oceanfront property owners are strongly encouraged to insure that no artificial light shall illuminate any area of the beach which may be used for turtle nesting and hatchlings.
