The meeting was called to order at 9:05 a.m. by the Hon. William F. Koch, Jr., Mayor.
Mayor Koch announced this meeting is called to take action on the Comprehensive Plan
as required by the State of Florida and noting Commissioner Stahl's continuing
efforts to clear all points of the proposed document.

Mayor Koch introduced Mr. Healey who spoke in general terms of the response at the
State level to Comprehensive Plans submitted by all communities acknowledging
differences and concentrating on only what is relevant to a community.
Mr. Clark said the purpose today was to review the revised draft of the Plan
noting the date of submission to the State is scheduled for July 14, 1989 and
noting Ordinance No. 89 -4 would have to be voted on at this meeting and will
accompany the Comprehensive Plan to the State. Mr. Clark read the title of Town of
Gulf Stream Ordinance No. 89 -4 as follows:

ADOPTING A COMPREHENSIVE PLAN FOR THE TOWN OF GULF STREAM IN ACCORDANCE
WITH THE "LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT
REGULATION ACT ", AS AMENDED, BEING SECTIONS 163.3161 ET. SEQ., FLORIDA
STATUTES; ADOPTING A COMPREHENSIVE PLAN TO CONSIST OF A FUTURE LAND USE
ELEMENT, TRAFFIC CIRCULATION ELEMENT, HOUSING ELEMENT, SANITARY SEWER,
SOLID WASTE, DRAINAGE, POTABLE WATER, AND NATURAL GROUNDWATER AQUIFER
RECHARGE ELEMENT, COASTAL MANAGEMENT ELEMENT, CONSERVATION ELEMENT,
RECREATION AND OPEN SPACE ELEMENT, INTERGOVERNMENTAL COORDINATION ELEMENT,
AND A CAPITAL IMPROVEMENTS ELEMENT: PROVIDING A SEVERABILITY CLAUSE AND
A CONFLICTS CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
A page -by -page discussion of the Plan led by Commissioner Stahl ensued.
Commissioner Armour stressed the nature of the community, unique in size and
in number of winter residents, should be noted in the introduction to the Plan.
Mr. Clark accepted and noted the changes proposed by the Commissioners.
On motion duly made and seconded the Commission adopted Ordinance 89 -4
on the Comprehensive Plan.
Mr. Flannery read Mr. Skelly's letter of resignation as a Town Commissioner.
Mayor Koch reported that two persons have been recommended for the vacated
Commission seat and asked the Commission's pleasure on procedure noting an
election in March. Commissioner Stahl suggested an opportunity be given the
residents to propose possible candidates. Persons may submit their own
application for the seat. Notice of the vacancy will be placed-on the Bulletin Board.
Mr. Armour made a motion to accept Mr. Skelly's resignation with great regret.
Seconded and so moved by the Commission. A letter and Resolution will be sent
to Mr. Skelly.
Notice was made of Item 3 having been pulled from the Agenda. Mr. Mayer
explained the circumstances of this action. Mr. Randolph said a new Notice
would have to be sent to the neighbors and the Town noting the request as
stated in Item 3.
Future meetings set down are: Town Commission meeting at 4:15 on July 19, 1989,
with a Budget Workshop to follow immediately. Town Commission meeting at 9 a.m.
on August 4, 1989 and at 9 a.m. on September 8, 1989. All Budget requests to be
submitted prior to July 19, 1989.
The Commission thanked Mr. Healey for attending and participating in the meeting.
There being no further business the meeting was adjourned on motion at 10:25 a.m.

WHEREAS, the Local Planning Agency has held a public hearing
with due public notice on the proposed Comprehensive Plan and has
forwarded its recommendation to the Town Commission; and
WHEREAS; the Town Commission has held two public hearings in
accordance with Section 163.3184(15), Florida Statutes; and
WHEREAS; the Town Commission has reviewed the written
comments submitted to it by the state land planning agency in
accordance with Section 163.3184(7), Florida Statutes;
NOW, THEREFORE, THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA HEREBY ORDAINS that:
Section 1. Pursuant to the provisions of the "Local
Government Comprehensive Planning and Land Development
Regulation Act ", Sec. 163.3161 et. seq., Florida Statutes,
the Town Commission of the Town of Gulf Stream, Florida
hereby adopts the Comprehensive Plan of the Town of Gulf
Stream, Florida, consisting of a Future Land Use Element,
Traffic Circulation Element, Housing Element, Sanitary
Sewer, Solid Waste, Drainage, Potable Water, and Natural
Groundwater Aquifer Recharge Element, Coastal Management
Element, Conservation Element, Recreation and Open Space
Element, Intergovernmental Coordination Element, and a
Capital Improvements Element. A copy of each of the
aforesaid elements is attached hereto and made a part hereof

as Exhibit "A."

Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 3. Should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder
hereof.
Section 4. This ordinance phall take effect immediately upon
second reading.

A RESOLUTION OF APPRECIATION
TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA
WHEREAS, James T. Skelly, Jr. has served as Town Commissioner
and Finance Commissioner of the Town of Gulf Stream, Palm Beach
County, Florida from April 1987 until July 1989 and
WHEREAS, in recognition of the dedicated and devoted time,
service and energies given in the interest of the Town as a member
of the Town Commission and Finance Commissioner, the entire Commission
on behalf of itself and the Town wishes to extend its appreciation;

Dear Bill:
During our telephone conversation on Monday, June 19, 1989,
you told me that James T. Skelly, Jr. had stated he felt he should
resign from the Board of Gulf Stream Commissioners. I replied that
the Civic Association would like to recommend a person to replace
Jim Skelly. I have just learned that Jim Skelly has submitted his
resignation.
Since my conversation with Bill Koch, the Executive Committee
of the Civic Association and Fritz Souder, our Past President, have
given careful and thoughtful consideration to this matter. We
unanimously and most enthusiastically recommend Kathleen S. Wallace
be appointed at this time to succeed James T. Skelly, Jr. as a
Commissioner of Gulf Stream.
Kathy Wallace is a wonderful young woman, mother, and long time
resident who loves and cares about Gulf Stream, and is deeply in-
volved in our community activities.
Kathy has been a resident of Gulf Stream since 1975. She has
served on the Board of Trustees of St. Andrews School, and is chair-
man of the Annual Campaign this year. From 1980 to 1983 she served
on the Board of St. Paul's Episcopal Day School. She is presently
chairman of the Delray Beach Historical Society. She has been a
Board member and chairman of the Bethesda Hospital Ball Committee.
She was a founder of the Gulf Stream School Auxiliary. Kathy is a
member of the Board of the Gulf Stream Civic Association and is
chairman of the Town Appearance and Beautification Committee.
The Civic Association recommends that the mayor and commis-
sioners of Gulf Stream appoint Kathy now to replace Jim Skelly.
Her appointment at this time would enable her to receive valuable
experience as a commissioner prior to next March's election.
We hope you and the other commissioners will enthusiastically
endorse our recommendation.

I am respectfully submitting my application for
commissioner of the Town of Gulf Stream.
I have been a resident for eight years in the town
and have owned two homes. I have four children, two of whom
attend the Gulf Stream School. I am a conservative Repub-
lican and believe strongly in governmental ethics especially
in the case of zoning and future development.
My concerns are what is happening to Gulf Stream's
future. I feel that the integrity of the town should be
honored on a consistent basis.
My qualifications are a thorough understanding of
the zoning process and its impact on the town. I have
served under Jab Bush, the former Secretary of Commerce of
the State of Florida, on the Florida Task Voice, a group of
business leaders that help promote Florida commerce inter-
nationally, on a voluntary basis. I am President of Allmon
& Tiernan, Inc. and have dealt with and encouraged some out-
standing individuals to move into Gulf Stream. I am a
director of the Palm Beach County Drug Abuse Foundation. I
have served as a director of the Delray Beach Rotary Club.
I have civically served my community in many ways including
co- chairing the Bethesda Ball of 1989 which has broken all
records for fund raising.
I plan on living in our community for many years.
With this thought I would like to become active in Gulf
Stream politics either by election or by appointment. I
hope the commission will act favorably on my qualifications.

Subject: Sewer Services Status
Objective: Provide sewer services to the 40+ homes in the town of
Gulf Stream with the ability to add 80+ homes at a
later date.
The following are the current activities and status of the sewer
project we are working on:
City of Boynton Beach: Boynton Beach has approved the connection
for ourselves and the Little Club to their sewer services through
their lift station located at the edge of the Little Club.
Letters were sent to the City of Boynton Beach requesting the
service by both our lawyer (Mike Schroeder) and the Little Club
lawyer (Bob Federspiel). The request did include a waiver of any
requirement to use Boynton Beach's water services or any rights of
annexation. The engineer for the City of Boynton Beach is getting
their lawyer to draw up an agreement for us.
Town of Gulf Stream: We were unable to coordinate the activities
and attendance for the July 7th town meeting. We are now scheduled
on the agenda for the July 19th town meeting which will start at
4:15 PM. Attached you will find the memo containing our requests
for the town's approval. I will be attending the meeting and the
Little Club will also have someone attending. The next town
meeting will be on August 4th and I hope we can get a response at
that time. The delay in getting to the town will not drastically
impact the schedule I sent you. Hopefully we can make the time up
in one of the other activities. I will be giving the documentation
referred to in the memo to the commissioners prior to the meeting.
I will be available for telephone calls at home over the weekend
following the meeting if anyone needs an update immediately.
Document of Understanding between the Little Club and the Gulf
Stream Homeowners Improvement Association: Mrs. S. Winston and I
met with the Little Club(Bob Cundif and others) and discussed our
common goals of getting sewer services. In attendance also were
their lawyer and Doug O'Laughlin, the engineer from Adair and
Brady, Inc. While there were many concerns expressed about having
us connect through their facilities there was agreement that we
would pursue reaching an understanding including easements. Our
lawyer and the lawyer for the Little Club have talked about how tc
structure the agreement. Both lawyers are currently on vacation so
% this effort will begin again when they have both returned (July
l 20th). The Little Club is going to have an easement appraisal done
to determine what they should ask from us. They are also doing a
survey of the Little Club property. It is my belief that this
agreement is the focal point that our project depends on.
Adair and Brady, Inc.:I have talked to Mr. O'Laughlin about the
changes in casts if we locate the lift station at the town hall.
The net is that we would need to put the lift station at a greater
depth ancj add about 900 feet of gravity main. This would add
approximately 40,000 dollars but would be at least partially
offset due to the fact we no longer would be negotiating for a
easement from the Little Club to put the lift station on their
property. Mr. O'Laughlin and I discussed the fact that it is not
feasible to put one lift station at the town hall that'could
service all the way to the north end of the Gulf Stream Club. The
distance is just to far. This is the reason for the request for
two lift stations in our memo to the town of Gulf Stream.
Mike Schroeder (our lawyer) :I have met with Mr. Schroeder and
brought him up to date on this project. He is aware of what we
need and will be working with the Little Club lawyer when they
return from vacation. I am providing him with the documentation
and keeping him aware of the progress in all areas.
Funds to be collected:Immediately after the meeting with the town
commisionerT we will send a letter out to the members requesting
an initial amount of $1500 to be put into the association's
account for the purpose of paying expenses as the project
progresses. Jim Stenson has opened'an account for the Association
and he will be handling the finances. We have already had expenses
which have been paid and more are coming in for the legal and
engineering services. We will make another request-to the members
for the escrow required to begin construction when it is
appropriate.

of Boynton Beachand Jamaica Bay, Inc. for sewer services and
Letters sent to the City of Boynton Beach by-the two.lawyecs.

OBJECTIVE
Provide Sewer Services to 40+ homes in the town of Gulf Stream
with the ability to add 80+ homes at a later date.
The following are the current activities and status of the Sewer
Project we are all working on:
CITY OF BOYNTON BEACH
The current implementation of the Boynton Beach system to the
point where we and the Little Club would connect has adequate
capacity to handle our requirements. A letter has gone from the
/1 City Engineer to the City Manager stating this. We are in the
process of getting a copy of the letter.
ADAIR & BRADY, INC. - ENGINEERS
Attached you will find an estimated financial projection for the
project that was put together by Doug O'Laughlin.of Adair & Brady
and myself. I have also attached the engineering proposal they
have given to us for the engineering services. The proposal
states it is valid for 30 days but I have gotten them to extend
it for at least an additional 30 days (thru August 7th) to allow
us to get approval from the town of Gulf Stream. I have asked
Mr. O'Laughlin to keep July 7th free on his calendar in case we
need his assistance at the Gulf Stream Town Council Meeting.
Attached you will also find a projected schedule for getting the
project started. Mr. O'Laughlin helped me put this together and
we have used his experience to estimate the time frames.
TOWN OF GULF STREAM COUNCIL MEETING
we are scheduling to be on the agenda of the July 7th Town
Council Meeting. Mayor Koch has agreed to work on assisting us
to get the town to budget for any increased expense required to
have our implementation upgraded to allow more users that would
be added at a later date. We are planning to propose a 'Sewer
0
OSystem for our immediate area (40+ homes) attaching to the Little
Club System. We would have several choices of implementation,
but it will depend on how much the town wants to budget. The
system required for just our own area is a known quantity (see
the project estimated costs attached). We will need to reach an
agreement with the Little Club prior to this July 7th meeting.
NOTE: There has been increased interest in our efforts from
other homeowners. In the interest of time I am pursuing
this as if the original 40+ homes plan is our primary
objective.
INTERLOCAL AGREEMENT WITH BOYNTON BEACH
The agreement would be for the services Boynton Beach would
provide to the Little Club and ourselves which would include
billing, services and other commitments. I have asked
Barbara Gwynn at the town hall to get us a copy of the existing
interlocal agreement between the E1 Cortillo Condominiums and
Delray Beach for the sewer services. She has agreed and when we
receive it we will use it as a guide for our own agreement. This
agreement will be between Boynton Beach and the Little Club and
ourselves which means we need to reach a understanding with the
Little Club prior to going to Boynton Beach.
/ DOCUMENT OF UNDERSTANDING BETWEEN LITTLE CLUB AND THE GULF STREAM
HOMEOWNERt IMPROVEMENT ASSOCIATION
Little Club has voted to pursue connecting to Boynton Beach for
its sewer services. We would share the cost of this
implementation if we were included. The financial projection
that is attached reflects this. I have a meeting-scheduled with
Bob Cundiff and others in the Little Club this weekend. I will
give him a copy of this letter. He is receiving a copy of the
proposals and letters that Adair & Brady are sending me. Their
system will have to be upgraded (i.e. 3" to 8" pipe) -to
accommodate us. This cost is reflected in the financial
statement. They have not started on a separate interlocal
agreement with Boynton Beach so we should be able to work
together.
LETTER REQUESTING INITIAL MONIES FOR PROJECT
i have not requested any monies from the association members as
Yet because I did not know what it will take to get started. It
appears as though we will need $50,000+ for the first part which
will last up until construction starts. We will need to put the
rest in escrow before the construction starts. See the projected
schedule for these dates. I will try to get this firm in the
next week so we can send a letter out.
ASSOCIATION MEMBERSHIP APPROVAL
I will be able to get all of the above started but I believe we
should set up at least a board meeting to be held the day before
the town meeting to agree on the specific action plans.

Adair & Brady is pleased to present our professional services fee for
engineering plans and specifications for sanitary sewer mains, laterals,
lift station, force main and restoration items for the proposed
Homeowners Improvement Sewer District (see attached aerial). Permits
will be submitted to Boynton Beach Utilities and Palm Beach County
Health Department.
SURVEY
ObtaAn eight 1 " =2o' and one 1 " =50' photographs of the proposed
service area and proposed forcemain route. These aerials to be
utilized as the plan sheets.

2. Provide all topographical information and horizontal control
necessary to design the proposed sewer facility.

ENGINEERING
1. Prepare construction plans, specifications, contract documents,
obtain permits, and solicit bids for construction for the lift
station, forcemain, gravity sewer lines, laterals and restoration
for the District.

2. Attend meetings with owners, Attorney, Town of Gulfstream and
Boynton Beach.
(Hourly) Budget $1,500
3. Seven soil borings provided by Testing Lab of The Palm Beaches.
(Each) Budget $1,000
CONTRACT ADMINISTRATION & INSPECTION
1. Review bids, make recommendations, prepare contract, approve shop
drawings, review pay requests, prepare "As Builts ", submit
certifications for release of system by the Utility and Health
Department.
(Hourly) Budget $6,000
2. Provide field inspection sufficient to insure quality control and
provide certification.
(Hourly) Budget $4,000
3. Provide testing service to insure property compaction and material
testing.
(Per Test) Budget $2,500
The estimated total for surveying, engineering, contract administration
and inspection is $40,500.00 which includes the Little Club.

Therefore, the estimated cost to the Gulfstream special assessment
district is $35,600.00.
Adair & Brady's policy is a 10% retainage fee for projects of this
nature which require an upfront cost for outside aerial service.
We can complete the plans and submit to the utility company for permits
60 days following the receipt of an executed agreement and retainer.
ADDITIONAL SERVICES
Any work requested outside the scope established herein shall be con-
sidered additional services and compensated to the Engineer in accor-
dance with the attached rate schedule. Any work, attendance at meet-
ings, or other services requested of Engineer prior to receipt of writ-
ten authorization to proceed shall be considered additional services.
GENERAL CONDITIONS
This proposal is valid for a period of thirty (30) days following the
above date. The attached Schedule "A" - General Conditions shall apply
and is made a part of this proposal.

SCHEDULE "A"
GENERAL CONDITIONS
1. Payment: If the owner fails to make any payment due the Engineer/
Surveyor for services within thirty days after receipt of the
Engineer /Surveyor's bill therefor, the amounts due the Engineer/
Surveyor shall include a charge at the rate of 18% per annum from
said thirtieth day.
2. Termination: This agreement may be terminated by either party
upon seven days' written notice in the event or substantial
failure by the other party to perform in accordance with the
terms thereat through no fault of the terminating party.
3. Legal Cost: In connection with any litigation arising out of this
contract, the prevailing party shall be entitled to recover
all costs incurred, including reasonable attorney's fees.
4. Renegotiation: The unit prices given in this contract are
applicable through December 31, 1989, and are subject to renegot-
iation on January 1, 1990.
5. Engineer /Surveyor may, after giving seven days' written notice to
Owner, suspend services under this Agreement until he has been
paid in full all amounts due him for services and expenses.
6. Fees for permits, filing, recording, inspection, etc. shall be the
responsibility of the Owners.
7. Overtime: Overtime shall apply to any work in excess of 40 man -
hours per week, Saturdays, Sundays, and statutory holidays at a
rate of 1.5 times the current billing rates.

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA ADOPTING A COMPREHENSIVE PLAN FOR THE TOWN OF GULF STREAM
IN ACCORDANCE WITH THE "LOCAL GOVERNMENT COMPREHENSIVE PLANNING
AND LAND DEVELOPMENT REGULATION ACT", AS AMENDED, BEING SECTIONS
163.3161 ET. SEQ., FLORIDA STATUTES; ADOPTING A COMPREHENSIVE
PLAN TO CONSIST OF A FUTURE LAND USE ELEMENT, TRAFFIC
CIRCULATION ELEMENT, HOUSING ELEMENT, SANITARY SEWER, SOLID
WASTE, DRAINAGE, POTABLE WATER, AND NATURAL GROUNDWATER AQUIFER
RECHARGE ELEMENT, COASTAL MANAGEMENT ELEMENT, CONSERVATION
ELEMENT, RECREATION AND OPEN SPACE ELEMENT, INTERGOVERNMENTAL
COORDINATION ELEMENT, AND A CAPITAL IMPROVEMENTS ELEMENT;
PROVIDING A SEVERABILITY CLAUSE AND A CONFLICTS CLAUSE; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Local Planning Agency has held a public hearing
with due public notice on the proposed Comprehensive Plan and has
forwarded its recommendation to the Town Commission; and
WHEREAS; the Town Commission has held two public hearings in
accordance with Section 163.3184(15), Florida Statutes; and
WHEREAS; the Town Commission has reviewed the written
comments submitted to it by the state land planning agency in
accordance with Section 163.3184(7), Florida Statutes;
NOW, THEREFORE, THE TOWN COMMISSION OF THE TOWN OF GULF STREAM,
FLORIDA HEREBY ORDAINS that:
Section 1. Pursuant to the provisions of the "Local
Government Comprehensive Planning and Land Development
Regulation Act ", Sec. 163.3161 et. seq., Florida Statutes,
the Town Commission of the Town of Gulf Stream, Florida
hereby adopts the Comprehensive Plan of the Town of Gulf
Stream, Florida, consisting of a Future Land Use Element,
Traffic Circulation Element, Housing Element, Sanitary
Sewer, Solid Waste, Drainage, Potable Water, and Natural
Groundwater Aquifer Recharge Element, Coastal Management
Element, Conservation Element, Recreation and Open Space
Element, Intergovernmental Coordination Element, and a
Capital Improvements Element. A copy of each of the
aforesaid elements is attached hereto and made a part hereof
as Exhibit "A."
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 3. Should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence or word be
declared by a court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder
hereof.
Section 4. This ordinance shall take effect immediately upon
second reading.
