Commissioner Town Manager Town Accountant Supervisor, Public Works Code Enforcement Officer Chairman, Planning & Zoning Board Town Attorney's Office Mr. Cross called attention to the bottom line of page two of the August 4, 1989 Minutes wherein Mr. Stahl in a quotation is referred to as "Larry ". Mr. Cross said the Commissioner should be referred to as Mr. Stahl. Also, on page three, item 9 "trash fall" should be "trash flow" Mr. Stahl referred to page four, item 11, Resolution R 89 -13, stating the Commission took no action and the Commission will not take it up at a future date. Also on page four, item 11, the Fire Rescue contract has three instead of two years to run. Mr. Armour noted the summary of item 6 on page three was sufficient information in the Minutes and that the preceding information in item 6 was repetitive; also, the word "Commission" should be substituted for the word "Board" and the word "requests" should be singular. On motion duly made and seconded the Minutes of the August 4, 1989 meeting were approved as amended above. Town Commission Meeting September 8, 1989 Page Two - Minutes C) 4. Financial Report Mr. Gwynn gave the report for the month of August noting under "Receipts" the amount of $12,422 as not a monthly item but a yearly check from the electric franchise. Under "Comparison of the Budget" Mr. Gwynn noted a net revenue loss of $29,064. He projects a probable deficit of about $65,000 as of September 30, 1989. Mayor Koch commented it was the first time in 26 years the Town has ended the year with a deficit. On motion duly made and seconded the Commission accepted the Financial Report. 5. Police Report Captain Buchan reported for the month of August noting storm - caused alarm problems and explained billing under these circumstances. The Ocean Ridge Fire Department responded twice to assist. Mr. Flannery inquired if the Commission wished to discuss the Rustin Report. The consensus was to hold off a while. 6. Planning & Zoning Report a) Variance request. Mrs. Barbara Whittaker, 1120 N. Ocean Blvd. to reduce front yard setback on Shore Road from 25' to 15.8'. Mr. Mayer noted Mrs. Whittaker's property goes into the private road and probably would not need a variance. However, to avoid future problems, the Board approved the variance request on motion. Mr. Mayer noted Mrs. Whittaker has a septic tank where she wants to put the pool. Maor Koch said the matter is between the Building and Health Depts. and Mrs. Whittaker; the Town is only concerned with the setback. b) Mr. Brandt gave a breakdown of his Building Permit Fees Report noting the County effective date is October 1, 1989. The Commission proposed the following fees for the October 1, 1989 to September 30, 1990 year. Permit...... Town Commission Meeting September 8, 1989 Page Three — Minutes 7. Town Manager's Report Mr. Flannery reported the Comprehensive Report passed the Treasure Coast Council with little comment but the State Dept. of Community Affairs has charged the Town with using too much potable water. The questions asked are: How much reduction is required and by what date. Discussion ensued on means to determine usage, leakage or other problems. Mayor Koch informed the assembly of possible state funding for the consultant and survey. The Town has called the consultant, stated the Town will address the problem and asked how to apply to the State to receive the above mentioned funds. Mr. Armour proposed a motion the Town request the consultant send the Town a Proposal to consider keeping them* to finish this job. Motion seconded and passed unanimously. Mr. Armour suggested a notice about saving water be included in the water bills. Mayor Koch will endeavor 'te' obtain copies of studies done by Tequesta and Atlantis of a similar problem. 8. Mr. Armour welcomed Clarence back to the office with best wishes. Mr. Armour spoke of the Place Au Soleil gate —house congratulating Mr. Dittman and others who worked so successfully on this project. Mr. Armour spoke of the possible pending lawsuit which has been filed but not served on the parties mentioned in the suit and possible legal fees noting that if suit has been made against individuals, it would be beneficial to the individuals to know that the Town would back them and give them legal representation covering the legal fees and asked the question of who pays for the legal fees if suit is brought against the Town. Mr. Hawkins responded that such suits are usually for deprivation of Civil Rights brought under a Federal Statute in which instance your liability insurance would provide a defense to Commissioners who were acting within the scope of their official capacity but that there is a possible exception that may enable a carrier to get around having to provide for a defense and that is where it may be alleged that some bad faith was utilized, and to be honest, that is frequently alleged. The question is, what does the lawsuit say and what does the insurance policy provide? Mr. Randolph will study the insurance policy. The bottom line is quite possibly defense will be provided under the policy, the carrier will provide an attorney. Mr. Randolph has ordered the lawsuit in order to study it to see what they allege, etc. Mayor Koch noted the Town did "Hold Harmless" the Commissioners against any alleged act if they didn't do it with illegal intent, some years ago. The Minutes will reflect that decision. It also covered employees who acted under the scope of their employment; the Town would also hold them Harmless and defend them against any personal claim against them. * Resource Engineery & Planning Town Commission Meeting September 8, 1989 Page Four — Minutes 8. (continued) Mr. Armour requested clarification again in the near future. Mr. Flannery will notify the carrier on Monday. Mr. Dittman requested two signs "No Outlet" and "Town of Gulf Stream" be placed at the gate house. Mayor Koch advised him to present drawings to the Planning & Zoning Board. Mr. Cross spoke on the Civic Association's request to review certain Town Ordinances submitted to the Town in June of 1989 and on which the Town Commission took no action. Mr. Cross spoke of Mrs. Wallace's interest in this matter and asked if the Town Commission would approve Mrs. Wallace approaching persons mentioned in the request to determine if they would serve on a Review and Study Committee. Conflict of interest was noted and procedure outlined. The Civic Association should proceed through the Planning & Zoning Board who will make their recommendations to the Town Commission. Discussion ensued on taxation complaints. 45� Mr. Flannery noted the next two meeting dates as changed. The new dates are October 20, 1989 at 9:00 a.m. and November 17, 1989 at 9:00 a.m. Mr. Gwynn reminded the Commissioners of the final Budget Meeting on Tuesday, September 19, 1989 at 5:01 p.m. Mr. Stahl spoke on the Pension Plan giving a breakdown of information on present and proposed plans. Discussion ensued. Mr. Stahl made a motion that the Town Commission establish, effective the end of December, 1989, a Defined Benefit Plan for the Police Department under State Law 185 and that the Town continue under the Defined Contribution Plan making the same percentage contribution for the other Town employees with a 27 per year and a 10 year vesting requirement. Motion seconded and passed unanimously. This action will necessitate enabling Ordinances. Inasmuch as this action will be in place for only 9 months, the money figure will be adjusted accordingly. Mr. Stahl spoke on the matter of Trustees and the audience participated. Mayor Koch suggested the Trustee Committee meet on this matter and they agreed to meet at a now unspecified date. In particular, the Town's Elected Officials strongly believe that the County's municipalities with coastal access have common and unique interests compared to the interests of the solely inland municipalities, including the fact that 72% of the taxable property value in the County's municipalities is located in these coastal municipalities. Therefore, we believe that, to the maximum extent possible, the population of the coastal municipalities should be concentrated in one or two of the new Commission districts. At its meeting on August 8, 1989, the Palm Beach Town Council considered this matter at some length. At the conclusion of that discussion, it was agreed that I would write a letter to the County and to each of the coastal municipalities expressing the Town's grave concern about the possibility of the coastal municipalities' interests becoming diluted in the formation of mainly horizontal (i.e. east to west) districts. The Town of Palm Beach respectfully calls upon all coastal municipalities to advise the County Commission that redistricting proposals 1, 2, and 5 are undesirable, and to request the formation of one or two contiguous districts that are mainly vertical (i.e. north to south) and comprised of the coastal population of Palm Beach County. Most of the water usage of the Town is attributable to irrigation of private residences; however the Town states that by 1995, it will investigate and implement strategies for the reduction of the use of potable water for irrigation without any justification as to why the Town cannot implement conservation techniques in a more timely manner. 2. The Town adopted two level of service (LOS) standards for potable water (Policy 4.D.1.1.1 and 4.D.1.1.2, page 4D -11 of the Infrastructure Element). The Town has not designated which LOS will be utilized for the purposes of the issuance of development orders and permits, nor does adoption of such high level of service standards demonstrate regard for water conservation. B. Recommended remedial actions. These inconsistencies may be remedied by taking the following actions: 1. Revise Objective 4.D.1.3. to include an earlier date for the investigation and implementation of strategies to reduce the use of potable water for irrigation. Establish a specific and measurable objective addressing the conservation of potable water resources. 2. Revise Policy 4.D.1.3.3 to include an earlier date for the investigation of methods for the reduction of the use of potable water for irrigation. Include a specific policy that states how and when these methods will be implemented. 3. Revise the adopted LAS standard for potable water to one that will commit the Town to implementing water conservation methods. The Town should consider adopting a tiered LAS standard that will allow for "phasing" of water conservation over a period of time. A. Inconsistent provisions. The plan conflicts with and does not further Goal 8 (Water Resources), Policy 11 of the State Comprehensive Plan and Policy 8.1.1.6 of the Treasure Coast Regional Policy Plan. B. Recommended remedial actions. These inconsistencies may be remedied by taking the following actions: 1. The Town should revise the applicable objective and policies to address the development and implementation of water conservation programs.
