CALL TO ORDER — Mayor Polivy called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Tirman, Commendatore, Vice Mayor Klovstad, and Mayor Polivy. Absent: Council Member Abrams. PRESENTATIONS 5.1 Jeff Loux, Town Manager, Employee Incentive Awards announcement, Officer of the Year Jake Donahue, Police Employee of the Year Valerie Pelc and Caitlin Brennan. 5.2 Nicole Casey, Senior Accountant, presented the Quarterly Financial Status Update. CONSENT CALENDAR Council Member Commendatore pulled Item 6.8 for further discussion. Vice Mayor Klovstad pulled Item 6.7 for further discussion. Staff pulled Item 6.6 for further discussion. Suzie Tarnay pulled Item 6.2 for further discussion. It was moved by Council Member Tirman, and seconded by Council Member Commendatore, to approve the Consent Calendar Items 6.1, 6.3, 6.4, 6.5, 6.9 and 6.10 as follows: 6.1 Approve the Minutes of January 28, 2020, Regular and Closed Session meetings. 6.3 Approve the earlier than planned hiring of a full-time Human Resources Technician to the Administrative Services Department. 6.4 Accept and File Treasurer's Report for the Quarter Ended December 31, 2019. 6.5 Waive the second reading and adopt Ordinance 2020-01, amending the Truckee Municipal Code, Title 18 – Development Code for transitional, supportive and employee housing, and manufactured homes (Chapter 18.08—Tables 2-2, 2-3, 2-7, 2-8, and 2-10, Section 18.58.170, and Section 18.58.245), Microenterprise Home Kitchens (Section 18.58.120), Density Bonuses (Chapter 18.212), Solid Waste/Recyclable Materials Storage (Section 18.30.150), Amendments to Recorded Maps (Section 18.98.140), Minimum and Maximum Density (Section 18.08.050), Special Purpose District Land Uses and Permit Requirements (Section 18.16.030— Table 2-10), Residential Accessory Structures (Section 18.58.220), Bars and Drinking Establishments (Chapter 18.220), Coffee Shops (Chapter 18.220) and Clean-Up Amendments. 6.9 Direct staff to shorten the deadline for submissions for bids for the Rue Ivy Property by five days in order to accelerate the production of affordable housing in Truckee. 6.10 Authorize the Purchasing Agent (Administrative Services Director) to make purchases which, in the aggregate, exceed $50,000 during the fiscal year. Specifically, expenditures in an amount not to exceed $70,000 for the fiscal year for Information Technology purchases including hardware, software and licenses from vendor CDW-G. Abstained: none. The motion passed 4-0. 6.2 Transit Center Relocation Feasibility Study Project – Green Dot Transportation Solutions Contract Amendment. Recommended Action: Authorize a contract amendment of $11,500 for Green Dot Transportation Solutions. Town of Truckee February 11, 2020, Town Council Regular Page 2 Suzie Tarnay: • Expressed disappointment that this workshop is at the same time as the next Planning Commission meeting. • Stated she believes that moving the Transit Center away from the train depot will create additional challenges for transit users. Mayor Polivy opened the item for public comment. Seeing none, Mayor Polivy closed public comment. The staff recommendation was moved by Vice Mayor Klovstad, seconded by Council Member Tirman, and adopted with the following vote: Ayes: Vice Mayor Klovstad, Council Member Tirman, Council Member Commendatore, and Mayor Polivy. Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. 6.6 Affordable Housing and Sustainable Communities Grant Agreements; Interstate 80/Donner Pass Road/Coldstream Road Roundabout Construction Reimbursement Agreement; and Restated Coldstream Road Culvert Reimbursement Agreement. Recommended Action: Adopt Resolution 2020-06 to Approve Coldstream Affordable Housing Sustainable Communities (AHSC) Grant and Loan Agreements and authorize the Town Manager to execute the following: 1) Coldstream Affordable Housing and Sustainable Communities Joint Applicant's Agreement; 2) Coldstream Affordable Housing and Sustainable Communities Grant Standard Agreement; 3) Coldstream Affordable Housing and Sustainable Communities Loan Standard Agreement; 4) Reimbursement Agreement for Coldstream Road Roundabout Construction Costs; 5) Restated Reimbursement Agreement for the Donner Creek Bridge/Arch Culvert Improvement and Offsite Improvements; and 6) Any additional agreements that might be necessary to administer the Affordable Housing and Sustainable Communities Agreement. Dan Wilkins, Public Works Director/Town Engineer, presented proposed agreement language modifications proposed by Teichert and agreed upon by Town staff. Mayor Polivy opened the item for public comment. Written comment received from Michael Isle, Teichert (on file with the Town Clerk). Seeing none, Mayor Polivy closed public comment. Council Direction: • Include the language changes to the agreement as outlined in additional information from Town Staff(on file with the Town Clerk). Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. 6.7 Purchase of(1) Parking District Truck. Recommended Action: Authorize the Public Works Director/Town Engineer to purchase one (1) 2020 Chevrolet Colorado 4X4 truck from National Auto Fleet Group for the amount of $39,528.76. Vice Mayor Klovstad questioned the opportunity to explore an electric or hybrid vehicle for this use. Rob Leftwich, Chief of Police, responded: • The purchase is immediate but not urgent. • This is a marked vehicle that will have emergency lights, police computers and equipment. Electric or Hybrid vehicles pose significant complexities in installing the necessary electronic equipment. • There is a need for a four-wheel drive pickup truck. • The Parking District does have an electric UTV that it uses in summer months. • Diesel is an option at an additional cost of$3,000 to $5,000. • The truck is expected to have a seven-year life span. Council Discussion: • This is a public vehicle and we should consider alternatives to reduce emissions. • Dissenting opinion: public safety vehicles should not be included in the electrical vehicle testing process. Council Direction: • Modify the action to increase the not to exceed amount of $45,000 in order to explore purchase of a diesel vehicle. Mayor Polivy opened the item for public comment. DISCUSSION ITEMS 7.1 STAFF REPORT — Discussion of Solid Waste Food-ware Report and Draft Policy Recommendations. Recommended Action: Direct staff to: 1) draft a single-use food-ware reduction ordinance following the framework as outlined in this staff report and 2) convene a working group of stakeholders and community members to help develop an implementation plan of a single- use food-ware reduction ordinance. Melanie Conti, Administrative Technician, and Erica Mertens, Administrative Analyst II, presented from the staff report (presentation on file with the Town Clerk). Council Discussion: • Styrofoam use for takeout containers in Truckee is split between local businesses or national chains. • Costs associated with moving from single-use products to reusable food-ware: o Cost of dishwasher. o Cost of chemicals. o Savings related to purchasing fewer single-use products. • The working group should consider: o Fee for single-use product. o Incentives for customers that do not request single-use products. o Incentives to business that do not use single use products. • Staff is not recommending any type of substitute product. • The Towns enforcement of the fee collection would be the same as it is now for single use bag fees. o If the money comes to the Town, it's a tax and has to be approved by voters. Mayor Polivy opened the item for public comment. Written comment(on file with the Town Clerk) received from: • Kathy Echols • Susi Lippuner (2) David Smith stated: • He has been in the food and beverage industry for about 35 years. • Dishwashers are typically leased through Cisco $100 to $200 per month depending on the model. • He is unsure regarding the cost of dishwasher installation. • There aren't adequate resources for alternative items. • Doing something is important. • Eliminating single use items will expand new business. Ben Anderson, one Envirolutions Club Presidents, stated: • Appreciation for staff. • From the Envirolutions Club's perspective, this is a great opportunity to show the value and importance we have for our environment. Town of Truckee February 11, 2020, Town Council Regular Page 5 Evan Anderson: • Thanked Council. • Questioned the $0.25 fee process for single use items (coffee cups); will the charge be $0.25 if you receive a cup, or will the recipient receive a $0.25 credit for bringing their own? • It is important to reduce the plastic use, manufacture and the greenhouse gas emissions from that process are substantial. • Commended the effort of Truckee and compared it to Berkeley and the European Union. Rylan Cordova, Alibi Ale Works, stated: • You rent dishwashers but you have to purchase expensive chemicals. o The dishwashers have to be installed based on ADA law and that requires a large amount of space. o In addition, you will have the cost of labor to run it. • Alibi Ale Works puts effort into eliminating the use of disposable items. • Quoted from a Silicon Mountain presentation. • We are heading in the direction of consuming less. • Support for the single use fee and an incentive to customers that bring their own items to change behavior in the community. Alex Tolger, Kitchen Colab, MOGROG Rotisserie, and Platterfare, stated: • They are here to bring more food trucks and options to the area. • As food truck operators, single use items are on their minds. • For Truckee Thursdays they are required to use compostable ware at a higher cost. • Most local food trucks are excited to be part of the effort, and strive to be as environmentally sound as possible. • To purchase a dishwasher is $2,000 to $5,000 plus labor, expensive chemicals and the space in the kitchen required for the installation. • Reducing price for individuals that bring their own is already happening at MOGROG. • Many food makers take issue with people bringing their own food-ware. If there is contamination you don't know if it was the food or the container. • Often put food products into customer containers and embrace the use of consumer provided beverage containers. • This is a large ask and a big project. • Thanked Council. Jenny Smart, owner Cornerstone Bakery: • Stated they deal with a lot of disposable coffee cups. • Thankful to live in Truckee and to have the dialog. o Would like to ensure the changes have a positive impact on the environment; and on the local individuals. • Stated she thinks a fee on disposables may disproportionally effect locals with limited financial resources. • Expressed concerns regarding customer expectations of receiving a cake provided in the security of a box. Town of Truckee February 11, 2020, Town Council Regular Page 6 • Expressed concerns regarding dishwashers that will have to comply with Nevada County requirements that are strict. We need to work closely with the County while implementing policy. Siobhan Smart, owner Wagon Train, stated: • Aligns with others with the exception of charging a fee to change behavior. o Expressed disapproval of the fee. • We can do better by being good examples with the products in the store. • Regarding the dishwasher, they paid $7,500 for the unit and likely $1,000 to the plumber. Then you have to have expensive chemicals, testing and staff to run it. • Questioned the outreach to our tourist community to bring their food-ware items with them when they travel. • Questioned the process and cost for a permit from the Town to install a dishwasher. Missy Muller, Sierra Watershed Education Partnerships (SWEP), a non-profit to promote stewardship, with Envirolutions and Eco Action clubs: • Stated Action fosters hope. This action is hopeful. • Understand there is always a cost whether it is on us or on the environment. • Commend the effort, and committed to support the community and the Town. Chloe Schaecher stated: • She represents the community's youth and the Envirolutions Club. • She brings her reusable item with her in Town. • This effort will help build the confidence to bring these items into a restaurant to use. • Has no experience with the travel or the business side, but believes a discount may work better than a fee. • Thanked the Town. Kyla McCarthy Smith stated: • She was part of the outlaw the straw project two years ago. • This year they are studying climate change. • If people can help more with single use items, it would make a big impact on our environment. Tracy Darue, Executive Chef at the Hospital, stated: • There are high temperature versus low temperature dishwashers. High temperature units kill the germs with heat, and low temperature units use chemicals. o They are expensive to maintain and require labor to run. • The Hospital is against: o It would be hard to do things on request based on the volume and the self- serve nature of their operation. o The items upon request, they are mostly self-serve and would have to hire additional staff just to hand out these items. o Charging a $.25 fee for single use items. They are very affordable and have clientele that may not be able to afford the fee. • They have made a lot of headway but they are mostly disposable. Town of Truckee February 11, 2020, Town Council Regular Page 7 John Henry Beyer stated: • The fee for grocery bags has change behavior and is an example of success. • He does not care if it's a fee or a discount, it does not take much to get people thinking and make them change their behavior. Clayelle Wolf, speaking from a tourist and full time resident, stated: • She cannot speak to the business perspective. • She is researching and making choices based establishments that support this effort. o This isn't going away. o It will catch on quickly. • Thanked Alibi for their business choices. • This is a big deal for her peers that spend money in this community. Cory Sacks, speaking from the tourism aspect, stated: • Qualified his perspective: He has spent five years as revenue management pricing strategy for 90% of the resorts on the west coast. • Working group pay attention to where the businesses are making money. • In his experience, "It" businesses will not lose business; rather, they will likely increase business. • The tourism market is primarily from the bay area, and these people will likely not object if businesses stop using single-use plastics. • Businesses should have a say in how this will be implemented. • Elevate concerns image create ways to elevate the valid concerns from the businesses. o There should be ways to deal with the one-off situations mentioned regarding those that cannot afford a $2.00 coffee. • Spoke in opposition to business that use Styrofoam containers. • Bring in the information for the businesses to feel more comfortable that they will not lose business from this effort, and can support the efforts. Riley Madigan, as part of the Envirolutions Club stated: • The $0.25 cost may be a stretch. • The power is within us as individuals. • Inspiring that people are already carrying their reusable items. • As a town we are making progress. • The way the world globally is dealing with this crisis is inspiring. • There are fires and disasters everywhere and a garbage patch in the ocean that is twice the size of Texas. • Although $0.25 may seem like a lot, the damage to the environment is greater. Sophia Martin, Eco Action Club member: • Questioned how the three or four things proposed will be implemented and if they will be implemented by local or chain business in the same manner. • Quoted from her school teacher, and spoke on behalf of her peers that they are concerned about the environment for their future. • Restated from Missy Muller, is the cost on us or on the environment. Town of Truckee February 11, 2020, Town Council Regular Page 8 Kim Harris, local business owner, stated: • She visited Innsbruck Austria. At a special event she attended, they had you put down a deposit for a cup. You could get a refunded if you return it or take it as a souvenir. • As owners of Truckee laundry her husband ordered re-usable laundry bags for large bedding items to replace the single use bags they previously used. Mayor Polivy closed public comment. Council Discussion: Provide Single use straws and single use items upon request only: • Directed staff to move forward. Provide only reusable food ware items for in-house items • The working group will be important to inform the necessary level of detail. • Expressed concerns, not to be solved tonight, chemicals could be as bad for the environment. We need to be careful while fixing one thing that we don't create another. • Cost passed on could be a burden on the business and customers. • Space and constraint for dishwashers is an issue. o Look at some way to support business in the process of upgrading. Continue to expand the reusable container • Directed staff to move forward. Requiring business to charge a fee on cups, utensils, or accessory items. • The bag program changed behavior and an incredible consumer bags. • Consumer expectations, we can influence consumer expectations. • Fees: o Fees are passed onto the consumer if it is a discount, the business has to increase their pricing in order to provide the discount. o Prefer a single fee for single-use items rather than by the item. o Keep it simple like the bag fee: • Self-assessed and user enforced. • Allow business owner discretion. o Fees do change behavior. o Fee is more effective than a discount. • Incentivize a change in behavior like the Austria example, try incentives first. • The working group should dive into the details and return to Council. • Concerned about business being effected. • Town could look for ways to recognize business that do the right thing rather than provide incentives to customers. o 17% business that offer incentives. • There is a cost-savings to the business when not purchasing single use items. • The working group can discuss the fee. • It needs to be consistently implemented. • Flexible policy—drives change over time. • Do have great partnerships in the community to help. Town of Truckee February 11, 2020, Town Council Regular Page 9 • The fee didn't change behavior with the grocery bags, the plastic bag ban was the start. • We don't know what the unintended consequences may be. • Recognize business that are doing the right thing. • There is a cost to the business, consumer and the environment. • Push the working group to work harder to solve the issue. • The Keep Truckee Green team will create a diverse working group. • Is there value in having our Chamber partner run the working group? o The Chamber is a business convener. • Not debating if this is an issue but involve the business to get this accomplished. Council Direction: • Begin with education and outreach. o Then assess if we achieved enough. • Empower the working group to move forward. • Vice Mayor Klovstad expressed disappointment regarding the Council's lack of support for the fee. • Create a formal Brown Act working group. o With no Council Member involvement. The staff recommendation was moved by Council Member Tirman, seconded by Council Member Commendatore, and adopted with the following vote: Ayes: Council Member Tirman, Council Member Commendatore, Vice Mayor Klovstad and Mayor Polivy. Noes: none. Absent: Council Member Abrams. Abstained: none. The motion passed 4-0. 7.2 STAFF REPORT — Council 2020 Team Building Summary. Recommended Action: Provide any additional direction to Town Staff on Council's 2020 goals and top priorities that were not provided at the Team Building. Judy Price, Communications Director, Town Clerk and Jeff Loux, Town Manager; presented from the staff report (presentation on file with the Town Clerk). Council Discussion: • Potentially schedule a midyear teambuilding in order to further discuss the items. • The 2020 priority diagram may be misleading. • While we create priorities: o With too many priorities, resources stretched and nothing gets accomplished. o The daily stuff still has to be done. o Our priorities should not make others wait for services. • The Teambuilding felt rushed in the end. • The three goals are really being the overarching focus of this year and exactly what is needed. • Budget process will refine how the goals are implemented. • The Climate Action Element of the General Plan may accomplish many goals. Town of Truckee February 11, 2020, Town Council Regular Page 10 • Underlying this doesn't mean everything else gets set aside, we have a vibrant economy, and an amazing list of projects in the pipeline; we have to figure out how to service those projects while we focus on the top three priorities. • General Plan Advisory Committee(GPAC) is almost two years in with one to two years left. o Council did not say there was a moratorium on projects, so they should continue to move forward. • Housing support. • Create raving fans— is an all-encompassing priority attentive to everything we do. • No moratorium and further prioritization of community engagement will require juggling, prioritization, and things will slow. • Council needs to be told we can't do everything, here's what we can do and here are the resources we will need. • Creating raving fans — we have to do things well, Council will keep asking for more, staff will have to provide Council with the tradeoffs for adding things. o Revenue are slowing tradeoffs will have to occur. Mayor Polivy opened the item for public comment. Written comment received (on file with the Town Clerk) from Kathleen Eagan. Lousie Zabriskie, Friends of the Truckee Library, stated: • Appreciate your support and priority to the Library item. • It is making encouraging progress. • A new library could help Council achieve their goal of Creating Raving Fans: o It can provide space and expand communication with community members. o Modern spacious library is an important civic institutive that creates a forum for town providing communication where community gathers. o Libraries are increasingly becoming social fabric of communities. Andrew Cross, Truckee Tahoe Lumber (TTL), stated: • Do not forget about the revitalization of the downtown. • TTL has an application to redevelop two sheds that will be followed by other reuse applications. Mayor Polivy closed public comment. 6. Consent Calendar Continued 6.8 Truckee Donner Public Utility District Electric System Master Plan. Recommended Action: Authorize the Mayor to submit a letter providing comments on the proposed Truckee Donner Public Utility District Electric System Master Plan. Council Member Commendatore letter to Truckee Donner Public Utility District (TDPUD). One thing philosophical that add costs to the community. Dan Wilkins, Public Works Director/Town Engineer, making comments to a sister agency Town of Truckee February 11, 2020, Town Council Regular Page 11 where our missions overlap. In conversation with the TDPUD where undergrounding was requested, there is no funding for undergrounding. Every project is a struggle. TDPUD doesn't have funding for undergrounding in their financial model. It was included here to raise the issue to the TDPUD at the Board level. Tying it back to funding. Council Discussion: • Donner Pass Road undergrounding was a collaborative effort. • It is beneficial to the community for the TDPUD to set aside money for undergrounding. • We keep adding costs to consumers. • The cost is not always on someone else's back.
