On motion duly made and seconded the Minutes of the November 17, 1989 meeting were approved. Financial Report Mr. Gwynn gave the November report. On request of the Commission Mr. Gwynn will provide a separate line for legal fees in future reports. On motion duly made and seconded the Financial report was accepted. 5. Police Report Captain Buchan gave the November report. On request of the Commission he reported on firearm instruction frequency and depth. 6.. Planning & Zoning Board Report a. Request for Variance. William L. O'Hey, 2525 N. Ocean Boulevard. Mr. Eaton read the specifics of this request noting the Planning and Zoning Board recommended approval. On motion duly made and seconded the Commission accepted said recommendation to approve this request, Commissioner Cross abstaining. Town Commission Meeting December 15, 1989 Page Two - Minutes C6. Planning & Zoning Board Report (continued) b. Final Plan Review 1. William Woolley Residence, 3111 N. Ocean Boulevard Mayor Koch relinquished the Chair. Mr.. Armour Chaired. Mr. Woolley's architect appeared describing the problem of the Australian Pines noting Town interest in preservation. An assessment and recommendation of two trees will be made to the Commission. On motion duly made and seconded the Commission accepted the recommendation of the Planning & Zoning Board to approve the plan subject to landscape plan re- submittal in the immediate future. 2. Thomas Crocker Residence, 3265 N. Ocean Boulevard Mr. Armour Chaired, Mayor Koch abstaining. On motion duly made and seconded the Commission accepted the recommendation of the Planning & Zoning Board to approve the plan. a. Request for Construction Trailer Permit On motion duly made and seconded the Commission accepted the recommendation of the Planning & Zoning Baord to permit a construction trailer on site for six months. Mayor Koch resumed the Chair noting a Civic Association letter on Ordinances. Discussion ensued on grandfathering in lots of less than twenty- thousand sq. ft. as most of them require variances. Suggestions were made to: Follow Palm Beach practice, to use Digby_ Bridges information, to focus on buildable lot coverage, to have a special meeting on the subject and to consider the interests of the Civic Association. Mayon Koch suggested the Planning & Zoning Board report to the Town Commission on buildable lot coverage at its next meeting. Suggestion was also made for the Planning & Zoning Board to meet with John Randolph on this matter. 7. Ernst & Young, Auditors Mr. Bremer reported the Financial Statement as fairly stated; that internal controls are in place and there are no areas of non - compliance. The Commission requested the Dredging Account be listed separately. Mr. Bremer recommended that proper budget approval be done prior to over - spending. Mr. Gwynn will return to the Commission with specific recommendations on transfer of funds on departments over budget. Mr. Gwynn read his letter of rebuttal to the Auditor General of the State of Florida and his letter to the Mayor and Town Commission datded December 11, 1989, in reply to the Auditor's Management Letter. On motion duly made and seconded the Commission approved the Auditor's Report and Mr. Gwynn's rebuttal letter. B. EMS Report by Bethesda Ambulance Personnel As Mayor Koch is Chairman of the Bethesda Hospital Board, he disqualified himself from participating in this matter. Mr. Armour Chaired. Mr. Clair answered questions on information previously distributed to the Commission. Discussion ensued on response time, cost to user and that this offer is Town Commission Meeting December 15, 1989 Page Three - Minutes 01 8. EMS Report (continued) contingent on Briny Breezes and Ocean Ridge acceptance of a similar agreement and that Gulf Stream will provide staff quarters. Mr. Clair noted that they have the capabilities and meetings with Briny Breezes and Ocean Ridge will take place shortly. On motion duly made and seconded the Commission approved the concept as proposed. The Town Manager was requested to draft a contract to expedite the issue. 9. Town Attorney a. South Florida Water Management Model Ordinance. The Commission affirmed the need for Town independence of water control while acknowledging the need for resident information. Mr. Hawkins concurred noting the Town Water Ordinance is entirely adequate to enforce restrictions. No action was taken oii the proposed Model Ordinance. Notice of Water Restrictions should be placed on the Bulletin Board. Mr. Flannery was requested to furnish the Commission with a short -term water plan by January 12, 1990. It was requested that water bills show the amount of water used the same month one year ago. Mr. Armour made a statement that the Commission is all for water shortage controls but we are not ready to accept or pass the Ordinance recommended by the South Florida Water Management District. b. Gulf Stream Homeowner's Improvement Association Sewer Project. No action was taken by the Commission on this matter except to clarify the Town's fiscal responsibility, which is: Any fees connected with the sewer project are paid by the Gulf Stream Homeowner's Association including attorney fees. C. Second Reading of Proposed Town Ordinances 89/6- 89/7 -8918. Said Ordinances were read by Title by Mr. Hawkins. Ordinance 89/6: AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA AMENDING CHAPTER 4 OF THE CODE OF ORDINANCES OF THE TOWN OF GULF STREAM SO AS TO PROVIDE AN INCREASE IN BUILDING PERMIT FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. Ordinance 89/7: AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE TOWN, ORDINANCE NO. 83 -1, SO AS TO PROVIDE FOR AN INCREASE IN THE APPLICABLE FEES FOR SPECIAL EXCEPTIONS AND VARIANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. Town Commission Meeting December 15, 1989 Page Four - Minutes Ordinance 89/8: AN ORDINANCE OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 7 OF THE CODE OF ORDINANCES OF THE TOWN OF GULF STREAM SO AS TO PROVIDE AN INCREASE IN OCCUPATIONAL LICENSE TAXES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. On motion duly made and seconded said Ordinances were unanimously approved by the Town Commission immediately following the reading of each Ordinance Title. 10. Town Manager's Report Mr. Flannery informed the Commission that Mrs. Taylor will begin her employment with the Town of Gulf Stream on January 15, 1990. Her status will be on the agenda for the Town Commission meeting of January 12, 1990. 11. Mr. Flannery read the Title of Resolution No. 369 of the Town of Palm Beach Shores as follows: A RESOLUTION OF THE TOWN OF PALM BEACH SHORES, PALM BEACH COUNTY, FLORIDA, URGING FLORIDA CITIZENS TO SUPPORT THE CONSTITUTIONAL AMENDMENT #3 ON THE NOVEMBER, 1990 BALLOT LIMITING UNFUNDED STATE MANDATES ON CITIES AND COUNTIES. On motion duly made and seconded the Commission supported and approved the above noted Resolution and resolved to draw the same Resolution for the Town of Gulf Stream. FLANNERY This is in reply to the Auditor's management letter from Ernst and Young, Certified Public Accountants, received December 8, 1989. Cash Disbursements: The police department checking account has been closed. I have implemented a policy that someone other than the payee will sign all checks other than regular payroll checks. Occupational Licenses: I have instituted a log to be used to account for all licenses issued or unissued. Contract Labor: I am now reviewing various contract agreements to use for all independent contractors working for the Town. I also will issue Internal Revenue Service Forms 1099 to all independent contractors working for the Town in 1989 and future years. Fixed Assets: An annual physical inventory will be taken during the current fiscal year and all future years. Granting such a variance will not therefore create a new encroachment into the set back requirement and will not in any way adversely effect public safety or the property rights of neighbors. Sectiom2. DEFINITIONS - 2.01 For the purpose of this Ordinance the following terms, phrases, words and their derivatives shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular, and words in the singular include. the plural. The word "shall" is always mandatory and not merely directory. (a) "District" is the South Florida Water Management District. 2 (b) "Person" is any person, firm, partnership, association, corporation, company, or organization of any kind. ie) "Water resource" means any and all water on or beneath the surface of the ground, including natural or artificial water courses, lakes, ponds, or diffused surface water, and water percolating, standing, or flowing beneath the surface of the ground. (d) "Water shortage condition" is when sufficient water is not available to meet present or anticipated needs of persons using the water resource, or when conditions are such as to require temporary reduction in total water usage within a particular area to protect the water resource from serious harm. A water shortage usually occurs due to drought. (e) "Water shortage emergency" means that situation when the powers which can be exercised under part 11 of chapter 4013-21, Florida Administrative Code, are not sufficient to protect the public health, safety, or welfare, or the health of animals, fish or aquatic life, or a public water supply, or commercial, industrial, agricultural, recreational or other reasonable uses. Section 3. APPLICATION OF ORDINANCE 3.01 The provisions of this ordinance shall apply to all persons using the water resource within the geographical areas subject to the "water shortage" or "water shortage emergency," as determined by the District, whether from public or privately owned water utility systems, private wells, or private connections with surface water bodies. This ordinance shall not apply to persons using treated effluent or saltwater. — Section 4. AMENDMENTS TO WATER SHORTAGE PLAN -4.0-1 Chapter 4013-21, Florida Administrative Code, as same may be amended from time to time, is incorporated herein by reference as a part of the County /City Code. Section 5. 5.01 The declaration of a water shortage or water shortage emergency within all 3 i or any part of County /City by the Governing Board or the Executive Director of the District shall invoke the provisions of this Ordinance. Upon such declaration all water use restrictions or other measures adopted by the District applicable to Count /Cit Y y, or any portion thereof, shall be subject to enforcement action pursuant to this Ordinance. Any violation of the provisions of Chapter 40E -21, Florida Administrative Code, or any order issued pursuant thereto, shall be a violation of this Ordinance. Section 6. ENFORCEMENT 6.01 Every police officer or sheriff having jurisdiction in the area governed by this Ordinance shall, in connection with all other duties imposed by law, diligently enforce the provisions of this Ordinance. In addition, the County /City Administrator may also delegate enforcement responsibility for this Ordinance to agencies and departments of County /City government, or cities in the service areas governed by this Ordinance, in accordance with state and local law. Section 7. PENALTIES 7.01 — Violation of any provision of this Ordinance shall be subject to the following penalties: First violation Second and subsequent violations $25.00 Fine not to exceed $500 and /or - imprisonment in the County jail not to exceed 60 days Each day in violation of this Ordinance shall constitute a separate offense. In the initial stages of a water shortage or water shortage emergency, law enforcement officials may provide violators with no more than one written warning. The County /City, in addition to the criminal sanctions contained herein, may take any other appropriate legal 4 ,t -�ce4 yti.: action, including but not limited to emergency injunctive action, to enforce the provisions of this Ordinance. Section 8. WATER USERS TO ACCEPT PROVISIONS OF ORDINANCE 8.01 No water- service shall be furnished to any person by a public or private utility unless such person agrees to accept all the provisions of this Ordinance. The acceptance of water service shall be in itself the acceptance of the provisions thereof. Section 9. ORDINANCES REPEALED 9.01 All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 10. SEVERABILITY 10.01 If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any Court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this Ordinance. Section 11. DECLARATION OF EMERGENCY 11,01 This Board does hereby declare that an emergency exists and that }mmediate enactment of this Ordinance is necessary, and by no less than four- fifths (4 /5ths) vote of the membership of the Board does hereby waive notice of intent to consider this Ordinance. Section 12. INCLUSION IN CODE 12.01 It is the intention of the Board of County /City Commissioners that the provisions of this Ordinance shall become and be made a part of the x �7 County /City Code; and that the sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section," "article," or such other appropriate word or phrase in order to accomplish such intentions. Section 13. EFFECTIVE DATE. 13.01 This Ordinance shall be immediately certified by the Clerk of the Board to the Department of State and shall take effect upon receipt of official acknowledgment to this office that it has been filed. No. 78 -3, DA, 5- 12 -78) SECTION 10 -17. SCOPE. The provisions of this ARTICLE shall apply to all persons to whom water is supplied through the Town of Gulf Stream's water system. (Or. No. 78 -3, §1B, 5- 12 -78) SECTION 10 -18. RESTRICTIONS OF CERTAIN USES. When an emergency situation is declared by the Town Clerk, the Town Clerk shall have authority to order restriction on the use of water for any or all nonessential purposes as determined by the Town Clerk, including, but not limited to: (1) Watering Vegetation. The sprinkling, watering or irrigation of shrubbery, trees, lawns, grass, ground cover, plants, vines, gardens, vegetables, flowers or any other vegetation. (2) Washing Mobile Equipment. The washing of automibiles, trucks, trailers, campers, boats, railroad cars, or any other type of mobile equipment. (3) Cleaning Equipment and Machinery. The washing and cleaning of any business or industrial equipment or machinery. (4) Ornamental Fountains and Swimming Pools. The operation of any ornamental fountain, swimming pool, wading pool or other structures making similar uses of water unless same employs a recirculating system. (5) Escape Through Defective Plumbing. The escape of water through defective plumbing which is known to the user or owner. (Ord. No. 78 -3, §1C, 5- 12 -78) XTION 10 -19. Capabilities. Bethesda Ambulance Service initiated operation in August 1985, and has been licensed and permitted to provide ALS service since January 1986. It remains the only ambulance service providing ALS service within EMS Zone 5 (the area in which the Town of Gulf Stream is located). Bethesda Ambulance Service meets or exceeds all state, county, and federal guidelines for staffing, equipment, and vehicles. All responding staff are state - certified Emergency Medical Technicians (30 staff members) or paramedics who are ACLS- certified (17). Medical direction is provided using standing physician orders and /or direct radio communication with full -time emergency physicians at Bethesda Memorial Hospital. Bethesda Ambulance Service currently operates seven vehicles from two locations. Bethesda Ambulance Service is committed to its employees; this commitment translates into a very low rate of employee turnover and a high level of enthusiasm. A manifestation of the of training and employee dedication is our employee's high level of performance at the international ALS competition held each year in Orlando. For the last two years, Bethesda Ambulance Service teams have finished within the top 10% of all competitors in this event. An additional measure of the quality of care that we provide is the performance of Bethesda Ambulance Service's response times. The September, 1989 report from the Palm Beach County Division of EMS illustrates that Bethesda Ambulance Service has better "enroute" and "arrival" times than any other comparably sized zone in the county. Medical Center, Delray Community Hospital, Boca Raton Community Hospital, West Boca Medical Center. If transportation is provided outside of this service area, the patient will be billed a mileage charge. Bethesda Ambulance Service will transport patients to the facility of their choice, or pending patient condition, to the nearest appropriate facility. Bethesda Ambulance Service will assume responsibility for billing and collection of all patient fees.
