CALL TO ORDER — Mayor Polivy called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Abrams, Commendatore, Vice Mayor Klovstad, and Mayor Polivy. Absent: Council Member Tirman. Staff Present: Jessica Thompson, Senior Civil Engineer; Jenna Gatto, Planning Manager; Dan Wilkins, Public Works Director/Town Engineer; Dan West, Chief Building Official; Andy Morris, Town Attorney; Denyelle Nishimori, Community Development Director; Jeff Loux, Town Manager; Kim Szczurek, Administrative Services Director; and Judy Price, Communications Director, Town Clerk. 3. PLEDGE OF ALLEGIANCE — recited in unison. 4. PUBLIC COMMENT — none. 5. PRESENTATIONS — none. 6. CONSENT CALENDAR Vice Mayor Klovstad pulled Item 6.7 for further discussion. It was moved by Council Member Abrams, and seconded by Vice Mayor Klovstad, to approve the Consent Calendar Items 6.1 through 6.6 as follows: 6.1 Approve the Minutes of December 10, 2019 Regular and Closed Session. 6.2 Approve an amendment to the Fiscal Year 2019-2020 Energy Efficiency Initiatives Capital Improvement Project C1910 — Depot Projects in the amount of $84,000. 6.3 Increase the Fleet Replacement budget for Fiscal Year 2019 — 2020 from $1,117,500 to $1,612,500. 6.4 Authorize the Town Manager to execute a Reimbursement Agreement for Preliminary Engineering Services with the Union Pacific Railroad for up to $75,000 for review and design services for the Reimagine Bridge Street Project. 6.5 Authorize the Town Manager to amend the existing Kappe Architects design contract for the Public Service Center Garages (C1609) project in the amount of $21,000 for a total not to exceed contract amount of $403,422. 6.6 Authorize the Town Manager to enter into three-year agreements with Roy Harthorn and CSG Consultants Inc. for plan review services up to $100,000 per fiscal year per vendor, and authorize spending with these vendors up to $150,000 for fiscal year 19120 and $100,000 for fiscal years 20121 and 21122. Noes: none. Absent: Council Member Tirman. Abstained: none. The motion passed 4-0. 6.7 Appointments to the Town of Truckee Building and Safety Board of Appeals. Recommended Action: Re -appointment of Craig Krauss, Mechanical Contractor, Mike de Lafontaine, Electrical Contractor, and the appointment of Kurt Reinkens, Architect, to the Town's Building Board of Appeals to fill the vacant seat for four (4) year terms. Vice Mayor Klovstad stated she would prefer Town extend the application period in order to get a Truckee resident to serve on the board in the Architect position. Mayor Polivy opened the item for public comment. Seeing none, Mayor Polivy closed public comment. Council Direction: • Reappoint Craig Krauss, and Mike de Lafontaine. • Postpone the appointment of Kurt Reinkens as an Architect representative on the Building Appeals Board. • Reach out to Truckee resident Architects to see if there is interest in serving on the Building Appeals Board. • Use the language "Truckee resident preferred". • Open the application period for an additional 30 days. The direction above was moved by Council Member Commendatore, seconded by Vice Mayor Klovstad, and adopted with the following vote: Ayes: Council Member Commendatore, Vice Mayor Klovstad, Council Member Abrams, and Mayor Polivy. Noes: none. Absent: Council Member Tirman. Abstained: none. The motion passed 4-0. 7. DISCUSSION ITEMS 7.1 STAFF REPORT - Revisions to Amenity Sponsorship Program Agreement with Truckee Trails Foundation. Recommended Action: Council direct staff whether to remove indemnification language from the Trails Amenities Adoption Program Agreement with Truckee Trails Foundation prior to execution by Town Manager. Town of Truckee January 14, 2020, Town Council Regular Page 2 Council Discussion: • Insurance questions for both the Truckee Trails Foundation and the Town of Truckee. Mayor Polivy opened the item for public comment. Alison Pedley, Truckee Trails Foundation, stated that the larger fear is the Truckee Trails Foundation Volunteers can be held personally liable. Mayor Polivy closed public comment. Council Discussion: • Indemnification language. Town contractual relationships may be different, can be handled differently. • The Trails Foundation is doing the Town a favor and it is our property so Town should hold the indemnity. • Andy Morris, Town Attorney: o Every agreement has different facts and circumstances. o The Town Attorney is not worried about this setting a precedent. The staff recommendation was moved by Council Member Abrams, seconded by Council Member Commendatore, and adopted with the following vote: Ayes: Council Member Abrams, Council Member Commendatore, Vice Mayor Klovstad and Mayor Polivy. Noes: none. Absent: Council Member Tirman. Abstained: none. The motion passed 4-0. 7.2 STAFF REPORT - Potential sale of Town -owned property located on Rue Ivy. Recommended Action: Direct staff to make the Town -owned property on Rue Ivy for sale via a competitive bidding process, for the purpose of developing affordable housing. Andy Morris, Town Attorney, presented from the staff report. Council Discussion: • The plan reviewed by the Town to date is for approximately 68 units. • A lease may make the project unable to secure funding. • Pacific West Communities has a good history, and has completed Town projects. • The 30 -day recommendation should be adequate and not delay potential project construction. Mayor Polivy opened the item for public comment. Seeing none, Mayor Polivy closed public comment. Noes: none. Absent: Council Member Tirman. Abstained: none. The motion passed 4-0. 7.3 STAFF REPORT - Request for Additional Planning Division Staff. Recommended Action: Approve the addition of a Development Services Technician to the Planning Division and approve a budget increase of $35,000 to accommodate this change for the balance of the fiscal year. Jenna Gatto, Planning Manager, presented from the staff report (presentation on file with the Town Clerk). Council Discussion: • Historically it has been challenging to recruit planning professionals. • The current recruitment garnered multiple qualified applicants. Noes: none. Absent: Council Member Tirman. Abstained: none. The motion passed 4-0. Member Commendatore, Vice 7.4 STAFF REPORT — Council Committee and Liaison Designations for 2020. Recommended Action: Review the committee and liaison designations, and provide direction regarding the Council committee appointments. Council Discussion: • Council Member Commendatore expressed interest in serving on the Truckee Chamber of Commerce committees. Mayor Polivy opened the item for public comment. Potentially check back in four months to see if Council Member Abrams can take on additional assignments. Request that Council representatives Carolyn Wallace Dee and Suzie Tarnay provide a brief email report on their respective committee work. 7.5 STAFF REPORT — Town Attorney Performance -Based Pay. Recommended Action: Approve Resolution 2020-01 awarding a $10,650 one-time performance-based pay amount to Town Attorney Andy Morris. Kim Szczurek, Administrative Services Director, presented from the staff report (presentation on file with the Town Clerk). Council Discussion: • The one time pay will be taxed as regular pay. • This payment is not subject CaIPERS. Mayor Polivy opened the item for public comment. Vice Member Klovstad • Attended Good Morning Truckee. • Attended the General Plan Advisory Committee. • Attended the Climate Vulnerability Subcommittee meeting. • Attended the General Plan Climate Subcommittee meeting. Met with Kathleen Eagan regarding the Library. Attended the Wildfire Preparation meeting. Was Inducted into Soropmist of Truckee. Town of Truckee January 14, 2020, Town Council Regular Page 5 Mayor Polivy • Attended two committee meetings for the Revenue for Housing Committee. • Attended TTBID meetings internal and TTBID meetings • Has participated with the Donner Lake Property Owners and the back country alliance in solving parking issues at the West end of Donner Lake. 9.
