APPROVING THE DESIGNATION OF REDEVELOPMENT AREA
BOUNDRIES - MIDDLESEX A VENEUE RESIDENTIAL REDEVELOPMENT
AREA- AND DIRECTING BEACON PLANNING AND CONSULTING
SERVICES, LLC, TO PREPARE A REDEVELOPMENT PLAN THEREFORE AS
PROVIDED FOR HEREIN
WHEREAS, by Resolutions #04-336, adopted on October 28,2004, and Resolution #05-
46, adopted on January 27, 2005, the Mayor and Council of the Borough of Carteret
("Borough Council") authorized and directed the Planning Board of the Borough of
Carteret (the "Planning Board") to undertake a preliminary investigation to determine
whether those properties listed on Exhibit A hereto ("Delineated Area") meet the criteria
set forth in the New Jersey Redevelopment and Housing Law, NJ.S.A. 40A: l2A-l et
seq. ("Redevelopment Law"), a for being determined to be an "area in need of
redevelopment" as therein defined; and
WHEREAS, after providing requisite notice, the Planning Board held a hearing on July
27, 2005 to review the results of the preliminary investigation and to solicit public
comment on whether the Plarming Board should recommend to the Borough Council that
the Delineated Area be determined to be an "area in need ofredevelopment"; and
WHEREAS, at the public hearing, the Planning Board considered the testimony of and
exhibits furnished by a license professional planner from Beacon Plarming and
Consulting Services, LLC, the author of the Redevelopment Area Assessment Report for
the Delineated Area, dated June 2005, and afforded all interested members of the public
an opportunity to make inquire into and give testimony concerning the boundaries of the
proposed Delineated Area and whether said area should be determined to be a
redevelopment area; and
WHEREAS, the Plarming Board, by a Resolution of Findings and Conclusions,
memorialized on July 27, 2005, has recommended to the Borough Council, pursuant to
Section 6 of the Redevelopment Law, that the Delineated Area, namely Block 242, Lots
1,2,3,and 5, be determined to be an "area in need of redevelopment", finding that said
properties meet at least three (3) of the statutory criteria to be an area considered in need
ofredevelopment all as set forth in the Assessment Report prepared by Andrew W. Janiw
P.P., AICP, and Victor Furmanec, P.P., of Beacon Planning; and
WHEREAS, the Borough Conncil has given due consideration to the recommendation of
the Planning Board and further finds that said recommendation is supported by
substantial evidence; and
WHEREAS, the Borough Council further concludes that there exits within the delineated
area sufficient criteria for the designation of a redevelopment area as set forth in N.J.S.A.
40A:12A-5, as more fully described and delineated in the Redevelopment Area
Assessment Report, and as found by the Carteret Planning Board.

NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey that the Middlesex Avenue
Residential Redevelopment Area as depicted on Figure 10, Proposed Redevelopment
Area, containing those properties listed on Table I, Study Area Properties, namely Block
242, Lots I, 2, 3 and 5, as set forth in the above-referenced Beacon Plarming Assessment
Report, dated June 2005, a copy of which is attached hereto and made a part hereof, is a
redevelopment area as so defined by NJ.S.A. 40A: l2A-3.
BE IT FUTHER RESOLVED, that a duly executed copy of this Resolution shall be
transmitted to the Commissioner of the New Jersey Department of Community Affairs.
BE IT FUTHER RESOLVED, that a copy of the Redevelopment Area Assessment
Report shall be kept on file in the Office of the Borough Clerk for public inspection.
BE IT FURTHER RESOLVED, that, upon approval of the within redevelopment area
designation by the Commissioner of Community Affairs pursuant to N.J.S.A. 40:l2A-
6(5), should the same be required thereby, Beacon Planning and Consulting Service,
LLC, is hereby authorized and directed to prepare a Redevelopment Plan for the hereby
designated Middlesex Avenue Residential Redevelopment Area.
BE IT FURTHER RESOLVED, that duly executed copies of this Resolution shall be
transmitted to the Planning Board, filed in the office of the Borough Clerk, and Beacon
Plarming and Consulting Services, LLC.
