1. William T. Lamson, 3813 N. Ocean Blvd. Request
to reduce front yard setback requirement from
91.59 feet to twenty -five percent of the build-
able lot depth, or 57.0 feet.
To reduce the required side yard setback from
15% to 10% which was allowed at the platting of
said lot.
2. Gulf Stream Bath and Tennis Club, 925 N. Ocean
Blvd. Request to reduce the required number of
parking spaces from 120 based on Fire Occupancy
Load of 360 persons to 111 parking spaces.
b. CONSIDERATION OF AND RECOMMENDATION TO THE TOWN
COMMISSION OF A PROPOSED ORDINANCE

were approved.
4. Financial Report
Mr. Gwynn gave the November report. On request of the Commission Mr. Gwynn
will provide a separate line for legal fees in future reports. On motion
duly made and seconded the Financial report was accepted.
5. Police Report
Captain Buchan gave the November report. On request of the Commission he
reported on firearm instruction frequency and depth.
6. Planning & Zoning Board Report
a. Request for Variance. William L. O'Hey, 2525 N. Ocean Boulevard.
Mr. Eaton read the specifics of this request noting the Planning
and Zoning Board recommended approval.
On motion duly made and seconded the Commission accepted said
recommendation to approve this request, Commissioner Cross
abstaining.

Final Plan Review
1. William Woolley Residence, 3111 N. Ocean Boulevard
Mayor Koch relinquished the Chair. Mr. Armour Chaired.
Mr. Woolley's architect appeared describing the problem
of the Australian Pines noting Town interest in preservation.
An assessment and recommendation of two trees will be made
to the Commission. On motion duly made and seconded the
Commission accepted the recommendation of the Planning &
Zoning Board to approve the plan subject to landscape plan
re— submittal in the immediate future.
2. Thomas Crocker Residence, 3265 N. Ocean Boulevard
Mr. Armour Chaired, Mayor Koch abstaining. On motion duly
made and seconded the Commission accepted the recommendation
of the Planning & Zoning Board to approve the plan.
a. Request for Construction Trailer Permit
On motion duly made and seconded the Commission accepted the
recommendation of the Planning & Zoning Baord to permit a
construction trailer on site for six months.
Mayor Koch resumed the Chair noting a Civic Association letter on Ordinances.
�) Discussion ensued on grandfathering in lots of less than twenty— thousand sq. ft.
as most of them require variances. Suggestions were made to: Follow Palm Beach
practice, to use Digby_ Bridges information, to focus on buildable lot
coverage, to have a special meeting on the subject and to consider the
interests of the Civic Association. Mayor -Koch suggested the Planning & Zoning
Board report to the Town Commission on buildable lot coverage at its next
meeting. Suggestion was also made for the Planning & Zoning Board to meet with
Sohn Randolph on this matter.
7. Ernst & Young, Auditors
Mr. Bremer reported the Financial Statement as fairly stated; that internal
controls are in place and there are no areas of non — compliance. The Commission
requested. the Dredging Account be listed separately. Mr. Bremer recommended
that proper budget approval be done prior to over — spending. Mr. Gwynn will
return to the Commission with specific recommendations on transfer of funds on
departments over budget. Mr. Gwynn read his letter of rebuttal to the Auditor
General of the State of Florida and his letter to the Mayor and Town Commission
datded December 11, 1989, in reply to the Auditor's Management Letter. On motion
duly made and seconded the Commission approved the Auditor's Report and Mr.
Gwynn's rebuttal letter.
8. EMS Report by Bethesda Ambulance Personnel
As Mayor Koch is Chairman of the Bethesda Hospital Board, he disqualified
himself from participating in this matter. Mr. Armour Chaired. Mr. Clair
answered questions on information previously distributed to the Commission.

contingent on Briny Breezes and Ocean Ridge acceptance of a similar
agreement and that Gulf Stream will provide staff quarters. Mr. Clair
noted that they have the capabilities and meetings with Briny Breezes
and Ocean Ridge will take place shortly. On motion duly made and
seconded the Commission approved the concept as proposed. The Town Manager
was requested to draft a contract to expedite the issue. V
9. Town Attorney /`
a. South Florida Water Management Model Ordinance.
The Commission affirmed the need for Town independence of water control
while acknowledging the need for resident information. Mr. Hawkins
concurred noting the Town Water Ordinance is entirely adequate to
enforce restrictions. No action was taken ou the proposed Model
Ordinance.
Notice of Water Restrictions should be placed on the Bulletin Board.
Mr. Flannery was requested to furnish the Commission with a short -term
water plan by January 12, 1990. It was requested that water bills ,
show the amount of water used the same month one year ago. Mr. Armour
made a statement that the Commission is all for water shortage controls
but we are not ready to accept or pass the Ordinance recommended by
the South Florida Water Management District.
�l b. Gulf Stream Homeowner's Improvement Association Sewer Project.
No action was taken by the Commission on this matter except to
clarify the Town's fiscal responsibility, which is: Any fees
connected with the sewer project are paid by the Gulf Stream
Homeowner's Association including attorney fees.
C. Second Reading of Proposed Town Ordinances 89/6 -89/7 -89/8. Said -
Ordinances were read by Title by Mr. Hawkins.

AMENDING CHAPTER 4 OF THE CODE OF ORDINANCES OF
THE TOWN OF GULF STREAM SO AS TO PROVIDE AN
INCREASE IN BUILDING PERMIT FEES; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE.

AMENDING THE OFFICIAL ZONING ORDINANCE OF THE
TOWN, ORDINANCE NO. 83 -1, SO AS TO PROVIDE FOR
AN INCREASE IN THE APPLICABLE FEES FOR SPECIAL
EXCEPTIONS AND VARIANCES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE.

PALM BEACH COUNTY, FLORIDA, AMENDING
CHAPTER 7 OF THE CODE OF ORDINANCES OF
THE TOWN OF GULF STREAM SO AS TO PROVIDE
AN INCREASE IN OCCUPATIONAL LICENSE TAXES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
On motion duly made and seconded said Ordinances were unanimously approved
by the Town Commission immediately following the reading of each
Ordinance Title.
10. Town Manager's Report
Mr. Flannery informed the Commission that Mrs. Taylor will begin her
employment with the Town of Gulf Stream on January 15, 1990. Her
status will be on the agenda for the Town Commission meeting of
January 12, 1990.
11. Mr. Flannery read the Title of Resolution No. 369 of the Town of Palm
Beach Shores as follows:
A RESOLUTION OF THE TOWN OF PALM BEACH SHORES,
PALM BEACH COUNTY, FLORIDA, URGING FLORIDA
CITIZENS TO SUPPORT THE CONSTITUTIONAL
AMENDMENT #3 ON THE NOVEMBER, 1990 BALLOT
LIMITING UNFUNDED STATE MANDATES ON CITIES
AND COUNTIES.
On motion duly made and seconded the Commission supported and approved
the above noted Resolution and resolved to draw the same Resolution for
the Town of Gulf Stream.
Notice was taken of the Growth Management Plan meeting set down for
Tuesday, December 19, 1989 at 8:00 a.m.

First Item: The Town Commission recommends the Town Manager obtain the services
of a qualified Hearing Officer who will make recommendations to the Commission
on the Peterson matter. On motion duly made and seconded the Commission voted
unanimously to implement the noted recommendation.
Meeting Subject:
Terry Clark spoke on a follow -up to two letters, dated December 11, 1989 from
Scott Harrington Ancluded herewith and made a part of this record. Letters
number one (Compliance Letter) and letter number two (Land Development)
were sent to the Mayor and the Commission.
Emphasis at this meeting is on letter number one with notice of time limitations
an letter number two.

Scott Harrington spoke on the Compliance letter noting the progression of
filing requirements to date. Mr. Harrington then spoke on alternatives
available to the Town. The Town is expected to sign a Compliance Agreement
stating what the Town will do and how the Comprehensive Plan will be
amended to be in compliance with State Statutes and Rules. The second step
will then be to go ahead and amend the Plan stating what water conservation
methods the Town will undertake. Mr. Harrington stated there are two areas
in which the Town is not in compliance:. One is there are no policies for
water conservation and the other is lack of a water level usage policy based
upon future lower level water usage.
The Commission will be asked to sign a Contract with DCA after agreement has
been reached on requirements and compliance. After adoption of an Agreement the
Town will adopt legal instruments, Resolutions or Ordinances, to implement the
Agreement.
Discussion ensued on gallon usage by the community noting heaviest usage is for
irrigation, noting also Town usage is approximately ten times higher than
state averages. The goal is to significantly reduce consumption, perhaps 10
to 20 per cent over a five year period.
Mr. Harrington and the Commission proceeded through the items listed in the
Compliance letter discussing each problem and possible solutions.
Under New Development the Commission noted the stated items usage could be
encouraged in existing development - shower heads, timers, etc.
`— Mr. Harrington expects that by the end of January Resource Engineering will get
a contract with DCA and then proceed to file the amendments to the text of the
Plan in the first quarter.
Mr. Flannery noted receipt of a letter with a contract allowing the Town to
obtain the $10,500. Contract was forward to the Town Attorney for review.
Mr. Harrington noted there is Compliance Funding available. It is part of the whole
compliance contract and must be worked out with the State. The Mayor stated that
the Town agreement with Resource Engineering is whatever the State gives the Town
will be enough.
Land Development
Mr. Harrington noted there will not be any further funding for land development
regulations for Gulf Stream. The Land Development Regulation Needs are supposed
to be in place by February, 1990. The Town must specify what it will do for the
current funding which was applied for in October, 1989.
Mr. Harrington discussed the Land Development Regulation Needs noting each
item under specific State Statutes noting also many items are in the Comprehensive
Plan.

Discussion ensued on what exactly is required of the Town. Mayor Koch noted
only thirty lots are available for development. Mr. Harrington responded that
the Town need only develops a system documenting Town information and that he
will supply said information to the State by the January deadline.
Mr. Stahl made a motion subject to review by the Town Attorney that the Mayor
sign and return this Document to the State as soon as possible. This motion
was seconded and unanimously approved by the Commission.
The last category "LDR'S Required by the Comprehensive Plan" was discussed
line by line noting application of County Ordinances.
Mr. Harrington gave a date and subject timetable for submission of information
requirements to the State suggesting the Commission consider items 1 and 2
and 1 through 11 in the near future to determine how it wants to address said
items (adopt County Ordinances or draw Town Ordinances) and to control issuance
of Building Permits for compliance with the Comprehensive Plan by February 1,
1990.
Notice was taken of two additional sources of funding -money from the State. Motion
was made to authorize Resource Engineering to proceed with this program and to
expend funds up to the limit the State will reimburse to the Town. Motion seconded
and unanimously approved.

provided a seating layout on the drawings number 7 and 8 which
indicate the maximum occupancy of the building. Seating for
members, guests and working staff are taken. Prom the maximum
fire occupancy load which is 360 persons.
From these figures of fire occupancy and according to code,
Section IX -OR Paragraph F. Parking Regulation. With a maximum
occupancy of 360, a 120 parking spaces are required. From the
space available on the Club property a 111 parking spaces are
provided.' We request a variance for the 9 spaces delinquent.
However, we would like to point out that most of the time there
is valet parking and a further 24 cars can be accommodated, due
to the fact that with valet parking, cars can be double parked.
We feel this makes the parking quite adequate. One further point
we would like to raise is that very seldom if at all would the
Club be used to the full occupancy of 360 persons.
We feel that this project will enhance the area, and will be in
general harmony with the area.

Pursuant to your suggestion I have incorporated the changes which
you have noted in your letter to me of January 8, 1990, into a
proposed Landmark Ordinance for the Town of Gulf Stream.
It is my understanding that you are going to discuss this ordinance
with the Town Commission at its upcoming meeting on Friday, January
12th. This ordinance is a good ordinance and one which has worked
very well for the Town of Palm Beach. I would like to point out,
however, that because this ordinance is drafted after the Palm
Beach Ordinance there are certain provisions of it which may not
necessarily be applicable in the Town of Gulf Stream. I
specifically refer to the reference in the ordinance to the Code
Enforcement Board. Currently the Town of Gulf Stream does not have
a Code Enforcement Board and therefore that language would not be
applicable at this time. The Commission may therefore wish to
consider modification to the ordinance in this regard.

Pursuant to your suggestion I have incorporated the changes which
you have noted in your letter to me of January 8, 1990, into a
proposed Landmark Ordinance for the Town of Gulf Stream.
It is my understanding that you are going to discuss this ordinance
with the Town Commission at its upcoming meeting on Friday, January
12th. This ordinance is a good ordinance and one which has worked
very well for the Town of Palm Beach. I would like to point out,
however, that because this ordinance is drafted after the Palm
Beach Ordinance there are certain provisions of it which may not
necessarily be applicable in the Town of Gulf Stream. I
specifically refer to the reference in the ordinance to the Code
Enforcement Board. Currently the Town of Gulf Stream does not have
a Code Enforcement Board and therefore that language would not be
applicable at this time. The Commission may therefore wish to
consider modification to the ordinance in this regard.

MR. CROSS: If I have the right page, there
is quite a jump in net revenue, budget and actual
down at the bottom, almost twenty thousand
dollars. I am delighted to see it but how did
we suddenly get that jump?
MR. GWYNN: In projecting the budget
expenditures we are at a three month period, it's
starting to keep up.
MR. CROSS: It will even out?
MR. GWYNN: Yes, you are on the Finance
Report Expenditures and that does project out
that we are fairly on target. I footnoted at
the bottom at your request that included in that,
in the budget expenditures for administration in
general, and where we stand on the legal expense.
It's a small part of the total budget.
MR. STAHL: The total expenditures are two
hundred sixty thousand versus two hundred and
sixty -eight budgeted?
MR. GWYNN: That would be a projected budget
figure for those three months, which shows in
terms of total expenditures; even though legal
expenses are over that, we are running well
within budget.

part, since we started watching it so closely,
since I have to allow for one shot items that
are expended, say, in October and November, so it
just takes me a little longer to refine what
the three month budget project should be compared
to the actual --
MR. STAHL: Is a lot of the twenty -five
thousand legal expenses incurred before October?
MR. FLANNERY: Over eleven thousand of it,
yes, sir.
MR. STAHL: Yes.
MR. ARMOUR: I have a question concerning --
it says we approve the budget prior to over
spending, how are we going to implement that, is
that your job?
MR. GWYNN: It's my job and I feel like the
point where we really start looking at it is at
the halfway point. If it gets out of line before
then, I'll bring it to your attention. I watch
the expenses every day.
MAYOR KOCH: Have you considered the new
employees and the employees on sick time, have
you projected that?
MR. GWYNN: For the tima being.

MR. GWYNN: Through this period, but what I'
saying, you are going to have to look at the
projection as it goes on, and that's where we
are going to catch ourselves in the hole.
MR. ARMOUR: That's my concern.
MR. GWYNN: Basically you are going to be
in the hole departmentally and what is probably
going to happen, your police budget is going to
be underspent and the administration overspent,
as always, so what we will probably do somewhere
along the line, probably at the end of March,
is make a budget amendment to shift allocations
from the police to the administration. That's
the proper way to do it.
MAYOR KOCH: There is other things that you
are going to have to consider. This mandate of
all this Statewide planning and zoning, we know
we are supposed to get money to cover this first
phase, but when he was here, he talked about there
is another phase and there isn't any -- I think
we are going to have to do some in depth crystal
ball gazing and start seeing where is this going
to go, because we might find that we are just
going to have to make some drastic cuts.
MR. GWYNN: It's very possible.

MAYOR KOCH: And how we are going to do it
and where we are going to do it, and we want to
work up some kind of retirement and we haven't
addressed the cost of that, and we need an
outside consultant to help us with that too.
MR. GWYNN: We have budgeted part of that.
MR. FLANNERY: I don't think we need any
outside consultant. We have people here in town
that we can look to, and I don't see any reason
for outside people to come in on the pension
plan.
MAYOR KOCH: I don't want to commit this
Town myself to a noose around its neck without
knowing and having some real expertise on
something like that, because some of the other
communities and people I talked to say it's hard
to make a correction, and I think Mr. Randolph
knows that on these pension things, and we might
have to have some, that's my feeling.
MR. GWYNN: All I can tell you, Mr. Mayor,
we are watching it very closely, more than we
ever have before.
MAYOR KOCH: I believe you and I believe we
will work it out.

December of 1989, there were no crimes reported.
We have thirty -seven directed patrols and
sixty -two false alarms. We had twenty -five other
complaints which totalled one hundred and thirty -
three calls. We had twenty -five citations
issued, thirty written warnings for a total of
fifty -five traffic contacts, and the total
activity was one hundred and eighty -eight for
December, and there is really nothing else to
report.

MR. FLANNERY: We are talking about
revenues. They probably are one hundred percent
above what we thought they would be, and that is
mostly traffic; although we we're Ticket Town,
USA, we haven't had one single complaint on a
traffic ticket because after thirty -five years
it's a miracle, if someone is going seventy -five
and you give them a ticket for fifty -five, they
are still going to complain, and revenues are up
one hundred percent.
MAYOR KOCH: The big thing, we haven't
had any fatalities on the highway.
MR. FLANNERY: None.
MAYOR KOCH: At this time in our agenda, I
think we should maybe take a moment of silence

and remember Bob Dion who served us well as

William T. Lamson came in and asked for variances
and he didn't have his plans, so we did not
allow him to go ahead with it. We wanted plans
to come in and the Gulfstream Bath & Tennis
Club, they requested to reduce the required numbe
of parking spaces from one hundred and twenty,
based on fire occupancy of three hundred and sixt
persons, to one hundred and eleven parking spaces
We passed it with a recommendation that they have
parking attendants to park the cars whenever it
gets to that point where they are a little over.
MAYOR KOCH: Lamson. You should say it's
withdrawn so it's clear in the Minutes. If you
don't accept something and it shows that it's on
our Minutes to act on it, if you change it, just
say it's been withdrawn from this meeting.

discussion of the proposed ordinance) we are not
going to pass anything that we are going to have
a special meeting but we would like to get
comments from the Planning Board.
MR. MAYER: I think Joan Orthwein could
discuss that because she is the one.
MS. ORTHWEIN: We had a meeting on Wednesday
and we decided since there are two hundred and
forty lots and ninety -one of them are ten to
twenty thousand square feet, there needs to be an
Ordinance recognizing the lots existing from
ten to twenty thousand square feet, and our
proposal is in addition to the twenty -five and
thirty percent lot coverages, that one hundred
percent of the buildings should be considered air
conditioned and space, twenty -five percent of the
garage and twenty -five percent of the covered
patio areas in the twenty -five and thirty percent
for one story and two story, the proposal that
you draw up. In addition, for a one story house,
the front setback should be twenty -five feet. The
two story front setback should be thirty feet and

the size for one story, one and a half and two
story, fifteen feet. For the rear setback for
one and two story, it's fifteen feet.
Also, we need a clear definition in the
Ordinance as to what is going to constitute a
two story house. A two story house should be
anything with two floors. Just because it's a
partial, they cannot consider it one story. Am
I clear on that? Just becuase it comes in in
the middle, they have to constitute that is a
two story. We don't want to get in any battles
of a clear definition of one and two stor?.es.
Also, I know we spoke about the Intercoastal
properties submerged, probably it should be
buildable land. There was a legal question on
that and that's what we need John Randolph for.
Also, we want Ordinances on continuity of the
sea walls and I do not have what the high tide
plus a foot is. That's what we decided to go
with.

But they have been putting them in. I'm just
wondering, are they just a foot above high tide

Put the sea walls in and they were all uniform,
but I don't think they took into account the
fact that we have those high tides in the fall
and the wintertime, and I think some people now
realize that their land is getting flooded with
the high tides and they would like to build a
little higher sea wall. I think we ought to
have something in the ordinance. I'm sorry if
it's legal.
MAYOR KOCH: Is Marsh still here. Do you
have any idea what the sea walls there must be,
some criteria as they use --
MR. MARCH: The Army Corps of Engineers.
MAYOR KOCH: Before we say one foot above
the high tide, we have to know what the accepted
standard is now.
MS. ORTHWEIN: There is --
MR. BRANDT: I did some research when we
had some request to raise sea walls by calling
the D 8'R and the other water body controllers,
and asking how high over sea level do you place
the sea walls, how high over high tide. They
say the standard rule is one foot over high tide
and our old sea walls were sufficient at one
foot over high tide, which they are no longer

sufficient at today.
MR. STAHL: Actually if you are going to
have continuity of sea walls, we really don't
have a problem. If you look at Polo Cove and
take your yard and my yard, our sea walls happen
to be probably two to three to four feet above
high water. That's my lot and Joan's lot. If
we look across the Cove, and I'm not sure whose
house that is, first of all, if you look around
the Cove I think you have continuity of sea
walls, and if you look over there with high tide
you will see a house whose sea wall is literally
below, which means when you walk around the sea
wall you are actually going down hill slightly.
So if you set a number today, those people could
raise their sea wall and you would have a
discontinuity in the sea wall, if they brought
it up to the same level with mine, so I don't
really see how we ever begin to come to grips wi-
this problem.

concerned about, that it's not the one or two
foot, but it may be the three or four feet that
a person may request to justify his raising his

to address what area is going to be used to
compute that percentage. Now I think a fair
and reasonable figure would be to use an
existing, that's a definite line, and show up on
the survey the reference of existing, and I think

the existing coastal construction and main high
water, people are going to argue that they are
paying hundreds and millions of dollars for it
and they should be given some credit. What that
credit is, is up for discussion.

lot, even east of the coastal construction line,
when we look at setbacks and coverage and so on.
MR. MARSH: But in your Ordinance also, you
see once you start talking about lot coverage as
a percentage, you have to clearly define because

name. This is regarding the Landmark
Preservation and you have a sample ordinance
in your packet which is pink.
MRS. KROLIK: I don't know if you got a
chance to read through it, I wanted to give you
a brief overview of what the ordinance entails.
Basically what this ordinance does is set
up an historical preservation Council for the
Town of Gulfstream, whose duties are to designate
historic landmark features. They would do that
on an historic site survey which I discussed,
that would cost about twenty -five hundred dollars
and arrangements could be under way to have a
fund raiser for this amount. It would take a
month to complete.
The second duty would be to grant certificat
of appropriateness for exterior changes requested
for designated sites and the historic
preservation Council would work with the Planning
and Zoning Board, the way it's set up now. This
ordinance essentially, the one you have for

Gulfstream, is similar to the Palm Beach
ordinances, and with a few changes having been
made to tailor it to Gulfstream. The most
significant change is the attention to
landscape features through the ordinance. The
trees along AlA should be able to be designated
an historical district and it seems that this
would be the most that Gulfstream could do to
protect those trees.
There are some other minor changes to the
Palm Beach ordinance. Palm Beach has an
immediate, it's hereby created the commitment to
establish the historical preservation council.
Delray Beach has a thirty day commitment to
nominate the commission. Gulfstream has ninety
days to create the council the way it stands now.
There is another change to the Palm Beach
ordinance taken from the Delray Beach, which
gives historical preservation power not only to
stop work if someone is working without being
granted a certificate of appropriateness. This
is Mark's changes, by the way, that the certifica
is needed, but to require the owner to return
the property to its original condition or
conform to the certificate of appropriateness yZE

Then there are a few questions that I
wanted to ask you all, or that you could talk

The Palm Beach ordinance and the Gulfstream
ordinance now has designations here, it goes only
from November through April, and I would assume
Palm Beach's, it's a seasonal community. Delray
Beach's are all year round and where Gulfstream
wants to stick with seasonal, or allow yourselves
to have hearings all year round, is something
you may want to discuss.
And there is another thing that Mr. Randolph
brought up. The ordinance as it stands refers
to a code enforcement board, which Palm Beach has
which Gulfstream does not have as far as
enforcing this ordinance.
MR. STAHL: No, we do not.
MRS. KROLIK: So what that would be
replaced with is the --
MR. RANDOLPH: You just wouldn't have an
enforcement board. If you don't have one and
just the provision of the ordinance which states
that it has to be returned to its condition,
if action is taken without action, et cetera --

that would take effect and that would be imposed
by the Landmark Council, and if there were any
appeal from that, it would come to this Commissio

certain circumstances the Council as a board of
adjustment, and that's really the way the appeal
-- when we consider special acceptances and that
sort of thing.
MR. RANDOLPH: I don't think this would be
a m atter for the Board of Adjustments.

have a meeting, not only on the zoning, but on
this too, and do them both jointly because there
is a lot of provisions in here that we should --
I'm in favor of, but I want to know what we are
getting into when we are talking about going into
forcing somebody to restore it back to what it
was, that gets kind of expensive. This ordinance
would not cause somebody to put something back
the way it was. It would allow a landmark to
be designated and it wouldn't force anyone to do
anything other than keep it in that condition.
If they wanted to make any changes to it, they
would have to come before this Council

brought to our attention that there are people
in town that are taking their garbage cans out
and leaving them at the curb.

understand why the people did it, but it's also
come to my attention that at least one person in
town has told someone that if they do not bring
the cans to the curb that the garbage men, when
they come to pick them up, won't take them to the
back of the property. They leave them. I have
been in contact with County Sanitation and they
assure me that it's going to stop, and it's
something that I am going to have to drive
around and see if they have been left there.
MR. ARMOUR: Personal experience, it was
around New Years, I had five or six or seven --
it was right after Christmas, I had like five
garbage cans, they emptied two and they didn't
empty three. By the next pickup I had five again
and I took them out to make sure that they were
taken out because they were only taking only one
or two and not all, i1nd this becomes a problem.
And they might take part of it but not all of it.

no. I said, wouldn't this require some sort of
a special taxing district, and he said, it
probably could. I said, this also takes care of
transportation in addition to the EMS, and he
said that may be able to be worked out.

I'm hearing at this point, yes, I give you my
word, I just brought it up to you. If it's my
recommendation, I'm saying that for now that we
go with Bethesda Ambulance who will be quartered
right now on our property. They are going to

different requirements. They like to have a fire
truck go along with them and it gets quite
expensive to do it the way they want to do it.
MR. STAHL: Isn't there a very important
point, if you deal with the municipalities and
you get the fire truck and paramedics, you still
have to have Bethesda if you have to transport?
MAYOR KOCH: That's true and the most
important thing with this contract with Bethesda
is that they are the ones responsible collecting
the money from the users. The municipalities
made us responsible and a lot of times we didn't
collect it. We had to pick it up. It's
altogether different.
You remember there was an article in the

the citizens of Gulfstream by going into the

apologized and said that he would write a

4 call from a citizen that advised that the
5 Maintenance Department just wasn't as good as it
6 used to be, and I'm going to take issue with
7 that totally. We have two of the hardest
8 working young men on that Maintenance Department,
9 that show the most personalized kind of service
10 to people in this Town. No one dreamed that our
11 temperatures were going to drop to twenty -nine
12 degrees and have loads of leaves like Chicago in
13 October. No one thought that would ever happen.
14 In the midst of this one of the two maintenance
15 people was in the State of Michigan because of
18 family problems, leaving one man all alone and me,
17 and we did the very best that we could, but I
18 promise you that in speaking to Clarence, who
19 has been here for thirteen years, he said that
20 daily there was a stack of messages about a
21 quarter of an inch thick with either requests or
22 additional pickups or things that had to be
23 done. In nine months there have been nine
24 complaints that we have with the new crew, and the
25 last one I think was absolutely uncalled for.

up tremendously, and I think that if the
Populous gets into an area of where they revolt,
just like they do in California, the petition
that is going on now is going to provide for the
increasing of Homestead property three percent
in the taxes, and there can't be tremendous
jumps in property taxes, and I think we have to
be aware, not only now but in the future, our
Town has to work with a very strong limit and I
know at my company everybody is becoming more,
we are becoming more productive. They are
cutting back tremendous amounts of personnel and
the people that are there like their jobs and
they are more productive, and I think Gulfstream
has to do the same thing, not only Town, but the
United States Government.
But I think the Government spending is too
much and let's start with us and try to cut our
tails and also if you would like to sign a
petition, there are some in the lobby.

facts need to come out. If I had not instituted
the cuts that I did when I came here, the Police
Department budget in salaries would be one
hundred and twenty -two thousand dollars a year,)
than it is now. When you are looking at a budget
that has nine hundred and seventy thousand
dollars and a tad over a million, when you cut
one hundred and twenty -two thousand dollars in
one felt swoop, I think that is a pretty good cut.
We come into Town Hall, I wash the windows.
Some of this might bring out a little bit of
laughter, a little joke, I'm not saying -- the
coffee that you bring out here costs fifty
cents because my wife clips coupons, and that's
what we buy the coffee with. There should have
been one new police car eighteen months ago.
Those cars are running with toothpicks and rubber
bands. We have not ordered a new car. The
truck was dangerously bad and that is still on the
road and we repaired it by ourselves.
All of the new decals end the work that you
see on the police cars have been done by Officer
Ed Allen and the policemen, themselves and not
one dime of cost to the Village. The air
conditioners used to run twenty -four hours a day.

being a one -way street. In my opinion it serves
absolutely no useful purpose. It's also my
understanding in discussing it with Frank and a
few persons who were here long before I came out,
that it was done without the benefit of any kind
of engineering studies. It was done without
being made legal by ordinance in the Town and
quite honestly? I cannot find any good reason for
its existence.

There was no objection, et cetera, to it, and at
the time it was a very sound reason because they
would shoot out of there and people would shoot
down that alleyway, and in one felt swoop, and
consequently they would accelerate and the vision

do was, I think that the thought was to use the
median strip. I know where you live and it's
probably a hardship on you to a great degree,
