HomeMy Public PortalAbout56 Calling for the November 3, 2020 Election including a Transient Occupancy Tax Ballot Measure TOWN OF TRUCKEE CALIFORNIA RESOLUTION 2020-56 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, CALIFORNIA, CALLING THE ELECTION AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF NEVADA TO CONSOLIDATE GENERAL MUNICIPAL ELECTIONS TO BE HELD WITH THE STATEWIDE GENERAL ELECTION ON THE DATE PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE WHEREAS, at its meeting on June 23, 2020, the Town Council adopted Resolution 2020- 53 calling the election and requesting Nevada County to consolidate the Town elections with the statewide election to be held on November 3, 2020; and WHEREAS, County staff requested that the language of the ballot measure to be submitted to Truckee voters in the election be revised, and the Town Council wishes to submit the revised ballot measure to the County for inclusion on the November 31 ballot; and WHEREAS, the Town Council of the Town of Truckee called a Municipal Election to be held on November 3, 2020 for the purpose of the electing two members of the Town Council for a term of office of four years; and one member of the Town Council for a term of two years, as requested by the Town Clerk; and WHEREAS, it is desirable that the General Municipal Elections be consolidated with the Statewide General Elections to be held on the same date; and that within the Town, the vote centers, ballot drop locations; and election officers of the two elections be the same; and that the County Elections Department of the County of Nevada canvass the returns of the General Municipal Elections and that the elections be held in all respects as if there were only one election; and WHEREAS, pursuant to authority of Article XIIIC of the California Constitution the Town Council of the Town of Truckee desires submit to voters a measure related to an increase in the Transient Occupancy Tax rate; NOW THEREFORE, BE IT RESOLVED THAT THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That the Truckee Town Council hereby rescinds Resolution 2020-53. SECTION 2. That pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Nevada is hereby requested to consent and agree to the consolidation of General Municipal Elections with the Statewide General Elections on Tuesday, November 3 2020, and in the future, for the purpose of the election of two members of the Town Council to four-year terms and one member of the Town Council to a two-year term. Resolution 2020-56 Page 2 SECTION 3. That a measure is to appear on the ballot as follows: General Tax Shall the measure which, without increasing taxes on Truckee residents, Yes No increases by 2% the Town of Truckee's transient occupancy tax paid by hotel/short-term rental guests, generating approximately $700,000 annually for 20 years for general services such as providing housing that is affordable for workers needed to sustain Truckee's economy, preserving natural open space, and preparing Truckee for wildfires and other natural disasters, with independent audits and all funds spent in Truckee, be adopted? SECTION 4. That the County Election Department is authorized to canvass the returns of the General Municipal Elections. The elections shall be held in all respects as if there were only one election, and only one form of ballot shall be used_ SECTION 5. That the Board of Supervisors is requested to issue instructions to the County Election Department to take any and all steps necessary for the holding of the consolidated elections, and that the Town of Truckee recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any costs. SECTION 6. That the Town Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the County Election Department of the County of Nevada. SECTION 7. That the Town Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. The foregoing resolution was introduced by Vice Mayor Klovstad, seconded by Council Member Abrams, at a regular meeting of the Truckee Town Council, held on the 14 day of July, 2020 and adopted by the following vote: AYES: Vice Mayor Klovstad, Council Member Abrams, Council Member Tirman, and Mayor Polivy.
