RESOLUTION NO. 2008-01
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
ADOPTING A MITIGATED NEGATIVE DECLARATION
FOR THE HILLTOP MASTER PLAN
WHEREAS, the Town of Truckee has prepared a master plan for the Hilltop Master Plan
area and proposes amendments to the Downtown Specific Plan, rezonings of properties, and a
planned development as part of the master plan process; and
WHEREAS, said actions require legislative action by the Town Council, and the
Planning Commission is charged with the responsibility of reviewing the application and
forwarding to the Town Council a recommendation for the approval or denial of the application;
and
WHEREAS, the Community Development Department prepared an Initial Study to
analyze the potential environmental impacts of the plan and proposes a Mitigated Negative
Declaration finding the master plan and other actions will not result in significant environmental
impacts with the incorporation of mitigation measures; and
WHEREAS, the Community Development Department made substantive revisions to the
Initial Study and proposed Mitigated Negative Declaration and released the revised Initial Study
Proposed Mitigated Negative Declaration on May 9, 2008; and
WHEREAS, on or about May 9, 2008, a public notice was published in the Sierra Sun
and mailed to property owners within 300 feet of the project site and all other interested persons
informing the public of the Town Council's intent to adopt a Mitigated Negative Declaration and
the date, time, and location of the availability of the Initial Study I Proposed Mitigated Negative
Declaration for public review and comment during a public review period of not less than 30
days; and
WHEREAS, the Town of Truckee Planning Commission, at a duly noticed public
hearing, adopted Resolution No. 2008-09 on June 11, 2008, thereby recommending adoption of
the proposed Mitigated Negative Declaration and approval of the master plan, specific plan
amendments, rezonings, and planned development, and adopting findings in support of such
actions; and
WHEREAS, on or about May 30, 2008, a public notice was published in the Sierra Sun
and mailed to property owners within 300 feet of the project site and all other interested persons
informing the public of the date, time, and location of the public hearing for the Council's
consideration of the Mitigated Negative Declaration and the project; and
WHEREAS, the Council held a public hearing on the matter at meetings on July 16,
2008 and August 7, 2008 and considered all information and public comment related thereto
received during the public review period.

NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee I
hereby adopts the Mitigated Negative Declaration and incorporated mitigation monitoring
program as set forth in the revised version of the Initial Study / Proposed Mitigated Negative
Declaration dated May 7, 2008 and prepared by and located in the Truckee Community
Development Department, 10183 Truckee Airport Road, Truckee, California. The following
reference is added to the "References" section of the document:
Truckee Donner Public Utility District, Urban Water Management Plan, November 2005.
BE IT FURTHER RESOLVED, the Council hereby adopts the following findings in
support of adoption of the Mitigated Negative Declaration:
1. Based on the findings contained in the Initial Study and Mitigated Negative
Declaration and the discussion contained in the Planning Commission staff report dated June
11, 2008, the Council finds there is no substantial evidence in the record that the project will
have a significant effect on the environment. Although the Initial Study identified several
potentially significant environmental effects, the Council has revised the master plan and other
actions to incorporate the mitigation measures noted in the Mitigated Negative Declaration to
avoid the potentially significant effects or to mitigate the potentially significant effects to a point
where clearly no significant effects would occur.
2. The Initial Study and Mitigated Negative Declaration reflect the Council's
independent judgment and analysis.
3. The project site is located within the boundaries of the Truckee-Tahoe Airport
Land Use Compatibility Plan, and the Council considered and finds the project will not result in a I
safety hazard or noise problem for persons using the airport or for persons residing or working
in the project site.
The foregoing Resolution was introduced by Council Member Susman,
seconded by Vice Mayor Brown, at a Regular Meeting of the Truckee Town
Council, held on the 7th day of August, 2008 and adopted by the following vote:

Brown, and Mayor Green.
