RESOLUTION APPOINTING THE CARTERET REDEVELOPMENT AGENCY
AS THE REDEVELOPMENT ENTITY TO IMPLEMENT A REDEVELOPMENT
PLAN AND CARRY OUT A REDEVELOPMENT AGREEMENT BETWEEN
THE BOROUGH AND KAPLAN AT CARTERET, LLC
WHEREAS, on February 25, 2004, the Borough and Kaplan at Carteret, LLC entered
into a Redevelopment Agreement for the redevelopment of the Lower Roosevelt Avenue
Redevelopment Area ("Redevelopment Agreement"); and
WHEREAS, the Carteret Redevelopment Agency ("CARA") was created and exists for
the purpose of furthering the redevelopment goals and policies of the Borough; and
WHEREAS, pursuant to Resolution #04-75 adopted by the Borough on March 4, 2004,
the Borough appointed CARA to administer the Redevelopment Agreement on behalf 0
the Borough, but the Borough did not designate CARA as the redevelopment entity to
implement such Redevelopment Agreement; and
WHEREAS, pursuant to their respective powers under the Local Redevelopment and
Housing Law, the Borough now wishes to designate CARA as the redevelopment entit
to implement the Lower Roosevelt Avenue Redevelopment Plan-which was adopted b
the Borough by Ordinance #03-02 on February 6, 20Q3-and to administer and carry ou
the Redevelopment Agreement pursuant to the full statutory authority available to CAR
set forth in the Local Redevelopment and Housing Law.
NOW, THEREFORE, BE IT RESOLVED, subject to acceptance by CARA pursuan
to resolution of such agency, that the Borough Council hereby designates CARA as th
redevelopment entity to implement the Lower Roosevelt Avenue Redevelopment PIa
and to administer and carry out the Redevelopment Agreement pursuant to statutor
authority set forth in the Local Redevelopment and Housing Law.
BE IT FURTHER RESOLVED, that a du1y executed copy of this resolution shall b
filed in the office of the Borough Clerk.
