City of McCall, Idaho Community Development Department Memo To: City Council  From: Lindley Kirkpatrick, AICP  Date: May 2, 2002  Re: Impact Area negotiations   After carefully reviewing the options for review of development proposals in the impact area, I still believe that the proposal originally presented by the City is preferred, with some modifications. In addition, I have learned that the membership of the existing City P&Z must be expanded. City P&Z membership Idaho Code requires that Impact Area residents be members of the City P&Z. City Code conflicts with this, by requiring City P&Z members to be city residents. IC 67-6526(g) reads: “If the area of impact has been delimited pursuant to the provisions of subsection (a) (1) of this section, persons living within the delimited area of impact shall be entitled to representation on the planning, zoning, or the planning and zoning commission of the city of impact.” (emphasis added) The City must amend Title 3, Chapter 1 to comply with State Code. Susan Buxton and I will prepare an amendment for your consideration at a future Council meeting. Impact Area Proposal Nearly a year ago, the Council developed a proposal and presented it to the County Commissioners. City Council and/or City staff have met with the County Commissioners three times to discuss the proposal. One of those meetings was a public meeting designed to receive input from the general public. The basic positions of both the City Council and County Commissioners have not changed. I do not anticipate that either side will compromise on the core unresolved issue: the existence of an Impact Area P&Z, separate from the City P&Z or the County P&Z. Staff recommends that the City Council begin the ‘committee of nine’ process, as allowed by Idaho Code 67-6526(b). Three City Council members must be designated to represent the City.
