Mayor Briggs called the regular meeting of the City Council to order at 7:35 p.m. in the Council Chambers of the City Hall. 2. The invocation was given by Elder Ernest E. Perry, Seventh -Day Adventist Church, 9664 E. Broadway, Temple City. 3. •Mayor Briggs •led the Pledge of Allegiance to the Flag. 4. . ROLLI CALL: PRESENT: Councilmen- Dennis, Gilbertson, Merritt, Tyrell, Briggs ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Parks & Recreation Director Kobett, Administrative Assistant Biel, Regional Engineer Kriegel 5. APPROVAL' OF MINUTES It was moved by Councilman Merritt, seconded by Councilman Gilbertson and unanimously carried to approve the minutes of the regular meeting of May 16, 1972, as written. At this point in the meeting, Mayor Briggs presented a plaque to the Council from the San Gabriel Valley Hospital which he had received on behalf of the City, in gratitude and recognition to City government. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. Adoption by Reference of County Building Code, Mechanical Code and Plumbing Code. A. Ordinance No. 72 -352 - Building Code ) 2nd. read. B. Ordinance No. 72 -353 - Mechanical Code ) C. Ordinance No. 72 -354 - Plumbing. Code City Manager Koski presented background information, advising that in adopting by reference the County Building, Mechanical and Plumbing Codes, that a public hearing was required, which hearing had been ,set by the City Council at a previous meeting and due notice given. Mayor Briggs declared the public hearing open and.invited.those present who wished to speak for or against the matter to come forward. No one came forward. Councilman Tyrell moved to close public hearing, seconded by Councilman Merritt and unanimously carried. City Attorney Martin presented Ordinance No. 72-352, entitled AN ORDINANCE AMENDING ORDINANCE No. 68 -267 OF THE CITY OF TEMPLE CITY BY ADOPTING BY REFERENCE THE LOS .'ANGELES COUNTY BUILDING CODE AND AMENDMENTS AS CONTAINED IN THE 1971 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC. INCLUDING CHAPTERS 68, 69, 98 and 99 OF THE SUPPLEMENT TO THE SAID LOS ANGELES COUNTY BUILDING CODE FOR AND INSTEAD OF THE PRESENT BUILDING CODE AND MAKING OTHER AMENDMENTS; Ordinance No. 72 -353, entitled AN ORDINANCE AMENDING ORDINANCE No. 68 -268 OF THE CITY OF TEMPLE CITY BY ADOPTING BY REFERENCE THE LOS ANGELES COUNTY MECHANICAL CODE AS CONTAINED IN THE 1971 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC. AND INCLUDING THE APPENDIX THERETO AND MAKING OTHER AMENDMENTS; Council Minutes, June 6, 1972 - Page 2 and Ordinance No. 72 -354,. entitled AN ORDINANCE AMENDING ORDINANCE No. 68 -269 OF THE CITY OF TEMPLE CITY BY ADOPTING BY REFERENCE THE LOS ANGELES COUNTY PLUMBING CODE AND AMEND- MENTS AS CONTAINED IN THE 1971 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC., AND INCLUDING APPENDICES A, B, C, F AND G, AND MAKING OTHER AMENDMENTS, for second reading. Councilman Tyrell moved to waive further reading of Ordinances 72 -352, 72 -353 and 72 -354 and adopt, seconded by Councilman Gilbertson and unanimously carried. 7. ORDINANCE No. 72 -355: 2nd read. Re. Sewer Connection. City Manager Koski presented background information on the need for reconstruction of the sewers because of development and density changes in the City. City Attorney Martin presented Ordinance No. 72 -355 entitled, AN ORDINANCE OF THE CITY OF TEMPLE CITY TO PROVIDE FOR THE RECONSTRUCTION OF THE SYSTEM OF PUBLIC SEWERS IN SAID CITY AND TO ESTABLISH CHARGES FOR SEWERAGE SERVICES AND FACILITIES PROVIDED THEREFOR, for second reading. Councilman Merritt moved to waive further reading and adopt, seconded by Councilman Tyrell and unanimously carried. 8. ORDINANCE No. 72 -356: 1st read. Re. Amendment to Municipal Code Re. Requirement for Conditional Use Permit for Certain Discontinued Uses. City Attorney Martin advised that an ordinance had been prepared as instructed at the previous meeting, relating to conditional use permits for certain discontinued uses, and introduced Ordinance No. 72 -356 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9277 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO NON- CONFORMING USES. Councilman Tyrell moved to waive further reading, seconded by Councilman Gilbertson and carried unanimously. The ordinance was referred to the Planning Commission for review and recommendation. 9. AMENDMENT TO MUNICIPAL CODE RE. R -2 DENSITY STANDARDS: Councilman Gilbertson .moved . to remove this item on R-2 Density Standards from the table for further discussion. The motion was seconded by Councilman Dennis and carried unanimously. City Manager Koski advised that this item had been held over from the previous meeting of the Council for further discussion on Planning Commission Resolution No. 72 -453PC regarding the R -2 Density Standards. Due to the extent of the discussion, Councilman Gilbertson moved to defer this matter to a study session with the Planning Commission, seconded by Councilman Merritt and unanimously carried. NEW BUSINESS: 10. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of May 17, 1972: City Manager Koski presented a recommendation from the Parks and Recreation Commission to re- cosponsor the Temple City Youth Football Organization for the 1972 season. Councilman Tyrell moved to approve the request, seconded by Councilman Merritt and carried unanimously. RECOMMENDATION FROM PLANNING COMMISSION - Meeting of May 23, 1972 Council received the recommendation from the Planning Commission relative to amending the Municipal Code to include a new C -3 zone. Councilman Tyrell moved to set the matter for Public Hearing on Thursday, July 6, 1972, at 7 :30 p.m., seconded by Councilman Gilbertson and unanimously carried. 11B. CHANGE OF COUNC'I'L MEETING DATE DUE TO JULY 4 HOLIDAY: Because the July 4 holiday will fall on a regular meeting date of the Council, Councilman Tyrell moved to change the regular meeting date from the first Tuesday in July to Thursday, July 6, 1972, at 7:30 p.m., seconded by Councilman Gilbertson and unanimously carried. 12. RENEWAL OF AGREEMENT - COMMUNITY RECREATION PROGRAM WITH TEMPLE CITY UNIFIED SCHOOL DISTRICT - 1 year period: City Manager Koski advised that the agreement for community recreation program between the City of Temple City and the Temple City Unified School District expires June 30, 1972, and that it was recommended for renewal without change. Councilman Tyrell moved to approve, subject to adoption of the budget, and to authorize the Mayor and City Clerk, to sign. Councilman Gilbertson seconded "the -motion :which unanimously carried. 13. RENEWAL OF AGREEMENT - L & L GARDENING SERVICE - 1 year period: City Manager Koski advised that the agreement for median strip maintenance on Baldwin and Santa Anita Avenues with L & L Gardening Service expires on June 30, 1972, and that it was recommended for renewal without change. Councilman Gilbertson moved to approve, subject to adoption of the budget, and to authorize the Mayor and City Clerk to sign, seconded by Councilman Tyrell and unanimously carried. 14. RENEWAL OF AGREEMENT - SAN GABRIEL VALLEY HUMANE SOCIETY: City Manager Koski advised that the agreement with the San Gabriel Valley Humane Society for related services expires on June 30, 1972. A report and recommendation was presented for discussion. It was moved by Councilman Tyrell, seconded by Councilman Merritt and unanimously carried that the City Attorney be instructed to prepare an agreement between the San Gabriel Valley Humane Society and the City of Temple City, which would reflect all of the content of the present agreement, plus any necessary revision which would provide the City a stronger means by which to enforce compliance by the contractor to the provisions contained therein, the renewal to be for a period of one year, to be presented at the June 20, 1972, Council meeting. 15. APPROVAL OF FIREWORKS PERMITS: City Manager Koski advised that 15 applications were received for sale of fireworks, that the locations had been checked by the Planning Department, and that one location, L.D.S. Church, did not meet zoning requirements. Also, the Temple City Republican Women's Club had applied for three locations. In all instances necessary deposits and /or insurance certificates had been received. Gordon Cutler from the L.D.S. Church stated that they had been notified of the zoning requirement when they had applied, however they were requesting Council approval on the basis of a variance. APPROVAL OF FIREWORKS PERMITS (continued): Councilman Tyrell moved to approve locations No. 1 thru 11 and No. 13, as submitted by memorandum dated June 2, 1972, denying Nos. 14 and 15 allowing only one location per organization. Temple City Republican Women's Club Federated Gateway Market, Broadway and Rosemead one of three locations Councilman Tyrell moved to approve a permit for location: 12. L.D.S. Church - Las Flores Ward subject to finding a location in proper zone, and insurance and permission from property owner The motion was seconded by Councilman Gilbertson and carried unanimously. 16. PROPOSED BUDGET - 1972 -73 City Manager Koski advised that the proposed budget for 1972 -73 had been submitted to the Council for consideration and that a Public Hearing may now be set. Councilman Tyrell moved to receive the proposed budget for 1972 -73 as submitted by the City Manager, and to set Public Hearing for June 20, 1972, and any supplemental meetings that may be required. The motion was seconded by Councilman Gilbertson and unanimously carried. Council Minutes, June 6, 1972 - Page 5 17. RESOLUTION No. 72 -1209: WARRANTS & DEMANDS, Demand Nos. 5968 thru 6061, in the amount of $50,547.46. Councilman Tyrell moved to adopt Resolution No. 72 -1209 entitled A RESOLUTION OF THE CITY COUNCIL OF THE .CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $50,547.46, DEMAND NOS. 5968 THRU 6061, seconded by Councilman Gilbertson and unanimously carried. City Manager Koski presented a request from die City Treasurer for approval of a warrant in the amount of $50,000 for interest bearing deposit. Councilman Tyre]] moved to approve, seconded by Council- man Gilbertson and unanimously carried. RECESS: Councilman Tyrell moved to recess to meet as the Community Redevelopment Agency, seconded by Councilman Dennis and unanimously carried. 18. COMMUNITY REDEVELOPMENT AGENCY ACTION: Council convened as the Community Redevelopment Agency at 8 :25 p.m., approved minutes of regular meetings held on March 21 and May 16, 1972, adopted Resolution No. CRA 10 - Adopting a Rule of Parliamentary Procedure, and adjourned at 8:30 p.m. The minutes of the CRA are set forth in full in the records of the Agency. 19. COMMUNICATIONS: A. DAMAGE CLAIM - Mrs. Helen Castle. City Manager Koski presented a claim for damage to the automobile of Mrs. Helen Castle. Councilman Gilbertson moved to deny and to refer the claim to the City's insuring agency, seconded by Councilman Tyrell and unanimously carried.. B. .STATE DIVISION OF HIGHWAYS - Re. Lower Azusa Road City Manager Koski presented a letter from the State Division of Highways stating that the Lower Azusa Road project submitted for State Highway Funds for 1973 -74, had been denied. This project may again be submitted prior to February 1, 1973, for consideration in the 1974 -75 fiscal year. C. City Manager Koski presented a letter of notification re. adoption of the Redevelopment Plan and advised that it had been sent to all agencies affected by the project. 20. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Mayor Briggs paid recognition to the Cadette Troop of Girl Scouts who were present in the audience. No one came forward to speak. 21. MATTERS FROM CITY OFFICIALS: A. CALIFORNIA CONTRACT CITIES - COST FOR SHERIFF'S SERVICES City Manager Koski presented a communication from California Contract Cities Association dated June 5, 1972. Councilman Tyrell, as City representative to the Association, recommended and moved that the City agree to a voluntary assessment in the amount equal to 1/5 of 1% of the 1971 -72 appropriation for law enforcement as the fair share of the anticipated costs related to a proposed lawsuit by the California Contract Cities Association against the County of Los Angeles pertaining to costs for Sheriff's Services. INTERIM ORDINANCE No. 72 -344 m BUILDING AND OCCUPANCY PERMITS City Manager-Koski advised that l:nterJmArdinance No. 72 -344 imposing a moratorium on building.and occupancy permits in .a certain sector of the City expires July 5, 1972. .Councilman Gilbertson moved to set the matter for Public Hearing on June 20, 1972, at 7:30 p.m. in the Council Chambers of the City Hall, seconded by Councilman Tyrell and unanimously carried. C. SURPLUS PROPERTY - 1949 FORD TRUCK City Manager Koski advised that a recommendation had been received from the Parks and Recreation Director regarding a 1949 Ford Truck being declared surplus property and disposed of. Councilman Tyrell moved to approve the recommendation for sale of 1949 Ford Truck as surplus property, seconded by Councilman Gilbertson and unanimously carried, D. Councilman Gilbertson stated that classes would begin in September at Temple City High School, from Pasadena City College. There would be 30 credit classes and 7 non - credit classes presented. E. Councilman Gilbertson stated that enabling legislation toward establishment of a new county, SB 262, would be before the .Commi.ttee on:Local Gover'nrmenti i.n Sacramento on Thursday, June 8, 1972, He read.a. letter from Gerald Crump, Legislative Representative from -the County, suggesting some proposed -amendments. The motion was seconded by Councilman Merritt and unanimously carried. F. Councilman Gilbertson advi -sed that the attempt by SCAG toward regionalism in the form of AB 776 had been lost in, the Senate Committee, G. Councilman Tyrell advised that he had received a reply from. ;, Howard Earle, Assistant Sheriff, in answer to a letter of congratulations he had sent to Chief Earle on his appointment to this position. 22. ADJOURNMENT: On motion of Councilman Tyrell, seconded by Councilman Gilbertson, the Council adjourned to the North Meeting Room at 845 p.m. to review the 1972 -73 proposed budget, following which they adjourned to Monday, June 12, 1972, at 7 :30 p.m., for the purpose of review of proposed budget with Parks and Recreation, Parking and Traffic Commissions.
