Call to Order: Mayor Henderson called the meeting to order at 5:05 pm. 2. Roll Call: Council Members; Zabriskie, Polivy, Klovstad, Vice Mayor Romack, and Mayor Henderson. Staff Present: Mike Ross, Chief Building Official; Denyelle Nishimori, Community Development Director; Nicole Casey, Administrative Services Director; Rosie Johnson, Short Term Rental Administrative Analysist II; Hilary Hobbs, Assistant to the Town Manager; Dan Wilkins, Public Works Director/Town Engineer; Danny Renfrow, Interim Chief of Police; Alfred Knotts, Transit Program Manager; Jessica Thompson, Senior Civil Engineer; Jen Callaway, Town Manager; Andy Morris, Town Attorney; and Judy Price, Communications Director Town Clerk. 3. Pledge of Allegiance – recited in unison. 4. Public Comment – none. Written comment received from Rylan Cordova. In response to written comment. Outdoor dining request to extend beyond the current COVID allowances that will expire this spring. The COVID emergency declaration ended March 2022. Staff is working on assisting the businesses with outdoor dining requests. 5. Presentations 5.1 Mayor Henderson presented the Building Safety Month Proclamation. Received by Mike Ross, Chief Building Official. 5.2 Denyelle Nishimori, Community Development Director, introduced Kayley Metroka, Administrative Technician for Planning. 5.3 Jen Callaway, Town Manager, presented Town Manager Report. Mayor Henderson opened the presentations for public comment. Seeing none, Mayor Henderson closed public comment. 6. Consent Calendar It was moved by Vice Mayor Romack, and seconded by Council Member Polivy, to approve the Consent Calendar Items as follows: DocuSign Envelope ID: 8608F7B0-5582-412E-AC66-DFCC0044940F Town Council Meeting April 26, 2022 Page 2 of 7 6.1 Approve the Minutes from April 12, 2022. 6.2 Authorize Town Manager to 1) execute a contract with Construction Materials Engineers, Inc. for construction support services for the Truckee River Legacy Trail Phase 4A (C0702) and the Church Street Extension and Trout Creek Restoration (C1804) projects in the amount of $658,580; authorize a 10% for a total authorized expenditure amount of $724,438; and amend the Fiscal Year 21/22 the Church Street Extension and Trout Creek Restoration (C1804) budget as outlined in this staff report. 6.3 Accept the Treasurer’s report for the quarter ending December 31, 2021. 6.4 Adopt Resolution 2022-17 authorizing the Town Manager to submit an application for operational assistance through the Federal Transit Administration (FTA) Section 5311 program to provide funding for the Town of Truckee transit operations. The Consent Calendar carried with the following vote: Ayes: Vice Mayor Romack, Council Member Polivy, Council Member Zabriskie, Council Member Klovstad, and Mayor Henderson. Noes: none. Absent: none. Abstained: none. The motion passed unanimously. 7. Discussion Items 7.1 Adoption of Resolution 2022-19 in Support of Measure U. Recommended Action: Adopt Resolution 2022-19 supporting the passage of Measure U, which will be on the June 7, 2022, ballot, to renew the ¼% sales tax dedicated to trails at a rate of ½% in support of the ongoing construction, operations, and maintenance of Truckee’s trail system. Alfred Knotts, Transit Program Manager, presented from the staff report (on file with the Town Clerk). Mayor Henderson opened the item for public comment. Verbal comment received from Paco Lindsay. Written comment received from Eric Sutton (late submission). Mayor Henderson closed public comment. The staff recommendation was moved by Council Member Klovstad, seconded by Vice Mayor Romack, and adopted with the following vote: Ayes: Council Member Klovstad, Vice Mayor Romack, Council Member Polivy, Council Member Zabriskie and Mayor Henderson. Noes: none. Absent: none. Abstained: none. The motion passed unanimously. 7.2 Truckee Police Department Policy 709 to Comply with Newly Established State Legislation under Assembly Bill 481. Danny Renfrow, Interim Chief of Police, presented from the staff report (on file with the Town Clerk). Chief Renfrow noted the correction to the recommended action of “Introduce and waive the first reading of Ordinance 2022-04 adopting Truckee Police Department Policy 709 - Military Equipment Funding, Acquisition and Use Policy.” Council Discussion:  There is no distinction between military drones and other drones including the one the Town has. o The drone cameras record when they are needed. o The videos have destruction deadlines based on the use of the videos. Mayor Henderson opened the item for public comment. Seeing none, Mayor Henderson closed public comment. The staff recommendation was moved by Council Member Zabriskie, seconded by Council Member Klovstad, and adopted with the following vote: Ayes: Council Member Zabriskie, Council Member Klovstad, Council Member Polivy, Vice Mayor Romack and Mayor Henderson. Noes: none. Absent: none. Abstained: none. The motion passed unanimously. 7.3 Short-Term Rental Fee Schedule Update. Recommended Action: Conduct a public hearing and adopt Resolution 2022-16 approving updates and additions to the Town-Wide Fee Schedule for fees associated with the short-term rental program as adopted in Chapter 5.02 of the Truckee Municipal Code. Rosie Johnson, Short Term Rental Administrative Analysist II, presented from the staff report (on file with the Town Clerk). Council Discussion:  The fire inspection is three years from application award.  The fire inspection will need to be renewed every three years.  The Consumer Price Index adjustment is not meant to increase the registration fee. o The registration fee may increase by request in the future.  Travel time is not billed separately. The travel time includes an estimated travel time.  The fees are in place to offset the cost to provide the service, so the general taxpayer does not subsidize short-term rental operations. Mayor Henderson opened the public hearing asking for anyone wishing to speak in support or opposition to the action stated above. Seeing none, Mayor Henderson closed public comment. Noes: none. Absent: none. Abstained: none. The motion passed unanimously. 7.4 Update Existing Housing Program: Lease to Locals program (Workforce Rental Grant program). Recommended Action: (1) Receive an update from Town Staff and Landing Locals on the Workforce Rental Grant Program: (2) Provide direction to staff on recommended program changes for Fiscal Year 2022/23, including a name change to the “Lease to Locals” program. Hilary Hobbs, Assistant to the Town Manager, presented from the staff report introducing co presenters Colin & Kai Frolich, Landing Locals (on file with the Town Clerk). Council Discussion:  Seasonal rentals will not receive additional grants.  This fiscal year end Town will have invested $300,000 on this program.  Council requested Landing Locals return with cost per bedroom investment. o Understanding that the cost per bedroom per year with retention could be a better metric over time.  With both Placer County, and Truckee being covered the Truckee Tahoe Workforce Housing Agency (TTWHA) employees are covered by the Landing Locals programs.  Concern over a flat rate fee for service. o Landing Locals appreciates the stable monthly income – it will help them recruit additional staff members to grow their business. o Still a very new business and unclear of the scaling opportunities. o One out of three contacts are ineligible.  The $3,500 is a rent cap requested for the program.  Landing Locals discussion: o The Lease to Locals marketing and promotion campaign. o The services provided by Landing Locals and the expectations for the property owner. o The method for counting children in families. o Pricing is being set to address the needs for the next several years with the intention to increase by the cost-of-living index in the future.  Council requested Landing Locals investigate family calculating opportunities.  Acknowledge the public-private partnership opportunity.  Town funded programs are a compliment to the workforce housing agency. Mayor Henderson reconvened at 7:26 pm. Council Direction:  The cost per bedroom is a valuable to compare to other programs the Town is funding.  Share information to help Council understand the increase in Measure K funding as well as how many bedrooms this is serving. DocuSign Envelope ID: 8608F7B0-5582-412E-AC66-DFCC0044940F Town Council Meeting April 26, 2022 Page 5 of 7 o Forecasting the Transit Occupancy Tax budget with the limited number of short- term rentals available.  Look at the different housing programs and budget to get the best benefit for the funding.  Unanimous support for the program. 7.5 Truckee River Legacy Trail Phase 4A C0702—Bid Update. Recommended Action: Town Council receive an update from staff regarding the Truckee River Legacy Trail Phase 4A construction contract bid. Jessica Thompson, Senior Civil Engineer, Dan Wilkins, Public Works Director/Town Engineer, John Svahn, Truckee Donner Land Trust, and Paco Lindsay, Truckee Trails Foundation presented from the staff report (on file with the Town Clerk). Council Discussion:  Council considered the pros and cons of project re-design, re-bid, removing the bridge and rebidding the project.  The impacts of re-bidding on the project timeline.  Council considered other funding sources that could be used to pay for the additional bridge costs. o Measure R or U o American Rescue and Recovery Plan Act funding. o General fund.  The Land Trust had a committee to help select this bridge design based on: o It was thought to be less expense to construct. o It is more environmentally sensitive in the construction method. o The esthetics were appreciated.  The trail bridges are constructed outside the river and the flood plain. o A truss bridge could accomplish the same goals. o This bridge will have a smaller visual footprint then a truss bridge. o A truss bridge would also not require a temporary bridge structure.  The Legacy Trail is also a Council priority. Council Direction:  Option three with the understanding that all the funding for the additional cost come from Measure R or U funding.  Explore bridge re-design opportunities with the contractor selected for economy. 7.6 Increase Stipend for Council and Planning Commission members. Council Member Klovstad  Attended the Southwest Gas discussions.  Announced an additional meeting with Southwest Gas to negotiate a franchise agreement.  Encouraged participation in Code Red.  Participated in a Tahoe basin biomass meeting  Participated in a Forest Futures tour.  Announced additional Forest Futures tours.  Attended the Budget workshop.  Attended Coffee Talk regarding Reach Codes.  Attended a Climate Transformation Alliance meeting. Council Member Zabriskie  Attended two meetings regarding Southwest Gas.  Attended Truckee River Legacy Foundation meeting. Mayor Henderson  Attended a policy forum on short-term rentals, housing, and California’s tourist-based economy.  Participated in a walking tour of the Hospital.  Attended the budget workshop.  Met with Chief Renfrow.  Participated in a Police Department ride along.
