HomeMy Public PortalAbout01 Amending of Zoning Map Hilltop Master Plan I I I 'TOWN OF TRUCKEE California ORDINANCE NO. 2008-01 AN ORDINANCE OF THE TOWN OF TRUCKEE AMENDING THE TOWN OF TRUCKEE ZONING MAP The Town Council of the Town of Truckee Does Ordain as Follows: Section 1. Enactment. The Town of Truckee Zoning Map is hereby amended, thereby modifying the zoning district on APN 19-140-14 (portion) from DMP (Downtown Master Plan) to DRS-4 (Downtown Single Family Residential, 14 dwelling units per acre); on 19-450-42 (portion) from DMP (Downtown Master Plan) to CG (General Commercial); and on APN 19-300-38 from RR- 0.2 (Rural Residential, 1 dwelling unit per 5 acres) to RS-1 (Single Family Residential, 1 dwelling unit per acre). The properties are shown in Exhibit "A", attached hereto and incorporated herein. Section 2. FindinQs. The Council hereby adopts the following findings in support of the adoption of this ordinance: A. The proposed amendments to the Zoning Map ensure and maintain internal consistency with all of the goals, policies, and actions of all elements of the General Plan and the Downtown Specific Plan. This finding is supported by the discussion contained in the section titled "General Plan / Downtown Specific Plan Consistency" and Attachment 3 of the Planning Commission staff report dated June 11, 2008. B. The proposed amendments to the Zoning Map will not be detrimental to the public interest, health, safety, convenience, or welfare of the Town. This finding is supported by the revised Initial Study / Proposed Mitigated Negative Declaration dated May 7, 2008 and the discussion contained in the Planning Commission staff report dated June 11, 2008. C. The approval of the amendments is in compliance with the requirements of the California Environmental Quality Act (CEQA) and there would be no potential significant adverse effects upon environmental quality and natural resources that would not be properly mitigated and monitored, unless a Statement of Overriding Considerations is adopted. The Town Council adopted Resolution No. 2008-01 thereby adopting a Mitigated Negative Declaration in accordance with the CEQA statutes and guidelines. The Mitigated Negative Declaration finds that the approval of the amendments and the Master Plan may have potentially significant environmental impacts but mitigation measures have been incorporated into the Master Plan and will be applied to future development to eliminate or reduce each of these potentially significant impacts to a less than significant level. D. The proposed amendments to the Zoning Map ensure and maintain internal consistency with other applicable provisions of the Development Code. Except as identified in the sections titled "Transfer of Density" and "Other Planned Development Provisions" of the Planning Commission staff reports dated December 18, 2007 and June 11, 2008, the proposed amendments and Master Plan are consistent with the Development Code. The findings to approve a planned development and modifications to Development Code standards are set forth in Council Resolution No, 2008-03. E. There is adequate capacity in the community sewer and water systems to serve the potential development, and the site is physically suitable forthe requested zoning designation(s) and anticipated land use development(s). There is sufficient capacity in the TTSA wastewater treatment facility to treat effluent generated by future development, and the Martis Valley aquifer has sufficient water supply to serve future development. These findings are supported by the master plans of the TTSA and the TDPUD. As discussed in the revised Initial Study / Proposed Mitigated Negative Ordinance 2008-0 I Page 2 Declaration dated May 7,2008, the site is physically suitable to accommodate the maximum allowed development planned by the Hilltop Master Plan without resulting in significant environmental I impacts. Section 3. Summarv Publication and PostinQ. Within fifteen (15) days after final adoption of this Ordinance, the Town Clerk shall have the ordinance published as required. ****** The foregoing Ordinance was introduced at a regular meeting of the Truckee Town Council held on the 7'" day of August, 2008, and adopted at a regular meeting of the Truckee Town Council, on the 21st day of August, 2008; Council Member Susman, moved for the adoption, the motion was seconded by Council Member Dee and was carried by the following vote: AYES: Council Members; Susman, Dee, Anderson, Vice Mayor Brown and Mayor Green.
